6. CONSENT AGENDA
The following items are distributed to Councilmembers in advance for study and review, and the
recommended actions will be accepted in a single motion. Any item may be removed for further
discussion if requested by a Councilmember.
a. Approval of Council meeting minutes of July 12, 2004. Council concur.
b. City Clerk reports the official population of the City of Renton as of April 1, 2004, to be 55,360
as calculated by the State of Washington Office of Financial Management. Information.
c. Community Services Department recommends approval to allow Mithun Architects to extend its
repayment schedule to June, 2006, from the currently agreed to date of December 31, 2004, for
the design irregularities on the Pavilion Building project. Refer to Finance Committee.
d. Development Services Division recommends acceptance of dedication of additional right-of-way
at the corner of Index Ave. NE and NE 5th Pl. to fulfill a requirement of the Skywire ShortPlat
(SHP-04-023). Council concur.
e. Economic Development, Neighborhoods and Strategic Planning Department submits 10% Notice
of Intent to annex petition for the proposed Anthone' Annexation, 4.84 acres located east of
Talbot Rd. S. and south of SE 192nd St., and recommends a public meeting be set on August 2,
2004, to consider the petition. Council concur.
f. Fire Department recommends approval of a lease with King County in the amount of $751.29 per
month plus escalation clause, to continue allowing the stationing of a King County paramedic
unit in Renton's Fire Station #14. Council concur. (See 9. for resolution.)
g. Hearing Examiner recommends approval, with conditions, of the Stonehaven Preliminary Plat;
36 single-family lots on 5.95 acres located at 4801 and 4815 Main Ave. S. (PP-04-003). Council
concur.
h. Human Resources and Risk Management Department recommends approval of the 2004 Group
Health Cooperative medical coverage agreements for LEOFF I Employees; LEOFF I Retirees;
and all other City of Renton covered employees. Refer to Finance Committee.
i. Utility Systems Division requests approval to transfer $165,000 from the NE loth St. and
Anacortes Ave. NE Storm System Improvement Project to the SW 7th St. Storm System
Improvement Project and the Small Drainage Projects Program. Refer to Utilities Committee.

Mayor Keolker-Wheeler welcomed everyone to the first Council meeting "on

SPECIAL PRESENTATION
Kathy Blore, with the Women in Stitches Quilt group, explained that the group

had donated a 9-11 commemorative quilt to the Renton Fire Department that
Donation, Station #12
was made in tribute to those who lost their lives during the 9/11/2001 terrorist
attacks. Ms. Blore stated that the quilt, which will now hang at Fire Station
#12, serves as a reminder to the firefighters of the appreciation citizens feel for
the service they provide to the community.

ADMINISTRATIVE
Chief Administrative Officer Jay Covington reviewed a written administrative
REPORT
report summarizing the City's recent progress towards goals and work
programs adopted as part of its business plan for 2004 and beyond. Items noted
included:
• The 2005-2006 funding cycle for non-profit agencies is underway, and this
is a record year with 58 applications received. The Human Services
Advisory Committee is reviewing the gaps and needs in the City of Renton
and will recommend to Council and the Mayor the agencies and amount of
funds to be allocated.
• The annual Transportation Advisory Committee meeting to discuss the
draft Transportation Improvement Program (TIP) will be held on June 24th,
7:00 p.m. to 9:00 p.m., at the Community Center.

Kellogg/Maxwell - Renton
Community Foundation. Mr. Kellogg explained that the foundation's mission is

to create a legacy of philanthropic giving to shape the future of the community

by cultivating an atmosphere of growth and strength, making Renton a good

place to live, work and play. He expressed his appreciation for the City's
support of the foundation.
Ms. Maxwell announced that in honor of the Mayor's 50th birthday, members
of the public made donations to the foundation which amounted to over $5,000.
Ms. Maxwell and Mr. Kellogg presented a plaque to the Mayor to
commemorate the occasion.

Community Services Department submitted CAG-03-005, Pavilion Building
Building Renovation, Edifice
Renovation, and requested approval of the project, commencement of 60-day

Construction Company, Inc., contractor, if all required releases are obtained.

Development Services: KKS Development Services Division recommended acceptance of the dedication of
Short Plat, ROW Dedication at additional right-of-way of approximately 952 square feet for NE 21st St. to
NE 21st St, SBP-03-051 fulfill a requirement of the KKS Short Plat (SHP-03-051). Council concur.
Legal: Fireworks Ban Legal Division recommended adoption of an ordinance that changes the
Ordinance Change from UFC ordinance banning fireworks (Ordinance 5078) to reference the 2003
Reference to IFC International Fire Code instead of the Uniform Fire Code. Council concur.

Separate Consideration Economic Development, Neighborhoods and Strategic Planning Department
Item 6.d. recommended adoption of an ordinance creating parking standards for
Planning: Downtown Core development in the downtown core. (The public hearing was held on 1/27/2003
Off -Street Parking and the Planning and Development Committee report was approved that same
Requirements date).
Council President Persson inquired about the revisions made to the ordinance
since its presentation to Council in 2003. Economic Development
Administrator Alex Pietsch explained that the matter has now undergone SEPA
(State Environmental Protection Act) review, and as part of that process there
were some structural changes made to the ordinance language. Mr. Pietsch
confirmed that the changes only affected the formatting.

UNFINISHED BUSINESS
Transportation (Aviation) Committee Chair Palmer presented a report regarding

Public Safety Committee Public Safety Committee Chair Law presented a report regarding legislation
Police: Motorized Scooters controlling motorized scooters. It was determined that the location of operation
Regulations should be controlled, that the scooters should be muffled, that the riders be
required to wear helmets, that 13 years of age be the minimum age of operators,
and that there be a ban on operation from one half hour after sunset to one half
hour before sunrise. Other areas of concern were addressed, including speed
limits, and the requirement of a driver's license or other identifying information.
It was determined to defer this last set of topics for future review if there was a
continuing problem with motor scooters after the regulatory ordinance has been
adopted and in place for some time.
The Committee concurred in the staff recommendation that Council adopt an
ordinance regulating motor scooters relating to their place of operation, that the
motor scooters be muffled, that riders wear helmets, that 13 years of age be the
minimum age of operation, and that there be a ban on operation from one half
hour after sunset to one half hour before sunrise. The Committee further
recommended that the ordinance regarding this matter be presented for first
reading. MOVED BY LAW, SECONDED BY NELSON, COUNCIL

Utilities Committee
Utilities Committee Chair Clawson presented a report regarding the request by
Utility: Water Main
First Savings Bank of Renton that the City contribute $85,235 towards the

bank's installation of a new water main in Williams Ave. S. from S. 2nd St. to

The Water Utility Division has reviewed the bank's submitted total cost of
$165,230 for the waterline and determined that this cost is higher than the
City's average cost for similar projects. The Water Utility has limited
remaining budget for infrastructure improvements for economic development
projects since there is already a commitment to pay for a portion of the
infrastructure improvements in the Highlands area in conjunction with the
development of the Harrington Square project. In addition, the City will be
paying for full -width asphalt overlay of the street after the completion of the
bank's waterline and other City utilities instead of requiring the bank to overlay
half of the street.
The Committee recommended concurrence with the recommendation of the
Planning/Building/Public Works Department that Council approve the City's
contribution of $50,000 towards the installation of the waterline by First
Savings Bank instead of the requested $85,235. This proposal is consistent

with the City's priorities in supporting infrastructure improvements for
economic development projects in the Downtown and Highlands areas.
First Savings Bank may request additional funding through City Council if 50%
of the bank's final cost for the waterline exceeds the City's contribution of
$50,000 plus the City's cost for the asphalt overlay of one-half the street.
The Committee also recommended that Council authorize the funding of
$50,000 to come from the Water Utility's 2004 Capital Improvement Project
budget contingency fund for the Downtown Core Rehabilitation, account no.
421.500.18.5960.34.65.055290. MOVED BY CLAWSON, SECONDED BY
PALMER, COUNCIL CONCUR IN THE COMMITTEE REPORT.

Utility: Oversizing Request for
Utilities Committee Chair Clawson presented a report regarding the request by

Lakeridge Development for approval of required oversizing and extra depth

compensation for the installation of sanitary sewer mains associated with its
Earlington Ridge development, located near Stevens Ave. SW and S. 134th St.
The Committee concurred in the recommendation of the
Planning/Building/Public Works Department that Council approve the request
by Lakeridge Development for oversizing and extra depth, in accordance with
City Code 4-6-010.C, in an amount not to exceed $143,616. MOVED BY
CLAWSON, SECONDED BY NELSON, COUNCIL CONCUR IN THE
COMMITTEE REPORT. CARRIED.
Utility: Sewer Service
Utilities Committee Chair Clawson presented a report concurring with the

recommendation of the Planning/Building/Public Works Department that

service of one existing single-family home on an existing platted single-family

The Committee further recommended that the applicants execute a covenant to
annex document and an agreement that all development on the parcel is in
compliance with Renton zoning and development standards. MOVED BY

Regulations) of City Code by adopting the amendments to the International Fire
Code that outlaw all fireworks and that establish penalties for violation of the

Police: Motorized Scooters An ordinance was read adding Section 10-12-28 of Chapter 12, Traffic Code, of
Regulations
Title X (Traffic) of City Code to regulate the use of motorized foot scooters by
eliminating or prohibiting their use on sidewalks, streets, and in parks;
prohibiting their operation by those under 13 years of age; prohibiting their
operation from a half hour after sunset until a half hour before sunrise;
requiring operators to wear helmets; requiring the devices to be muffled;
requiring the safe operation of such vehicles; and providing a penalty for
violation. MOVED BY LAW, SECONDED BY NELSON, COUNCIL REFER
THE ORDINANCE FOR SECOND AND FINAL READING ON 6/28/2004.

Responding to Councilman Corman's inquiry as to how this information will be
publicized, Chief Administrative Officer Covington stated that information will
be placed in the City's newsletter which is published in the Renton Reporter, on
the City's cable channel 21, and on the City's website. The information will
also be provided to the City's neighborhood groups.

An ordinance was read amending Section 4-1-140 of Chapter 1, Administration
Development Services:

Council President Persson reported that the State Building Code Council
deferred action on the controversial regulations pertaining to the proposed ban
on the use of barbecues on combustible apartment or condominium decks that
lack sprinklers, and the proposed ban on Christmas trees in apartments and
churches that lack sprinklers.

NEW BUSINESS
Council President Persson relayed a citizen concern regarding off -leash dogs at

Councilwoman Briere expressed her pleasure with the opening of the new fire
station in her neighborhood.
Community Event: Cavalia
Councilman Corman said he had the pleasure of attending the opening
performance of "Cavalia" and encouraged citizens to attend the show.
Fire: House Fire, SW 3rd PI
Councilman Corman stated that a house fire occurred yesterday in Renton. He
reported that the ten people who lived in the house were tenants without
insurance, and he indicated that a fund has been established to assist them at the
Washington Mutual Bank branch at Fred Meyer.

PARK TERRACE ANNEXATION PUBLIC MEETING
COUNCIL CONSIDERATION OF THE
10 % NOTICE OF INTENT TO COMMENCE ANNEXATION
July 19, 2004
The City is now in receipt of a 10% Notice of Intent to Commence Annexation request for the
7.65-acre Park Terrace Annexation site. The City received the petition on May 21, 2004 and
under state law the City is required to hold tonight's public hearing within 60 days.
The annexation site abuts the City on its western and southern boundaries (see map on reverse
side). 1381h Avenue SE (Duvall Avenue NE), if extended, would define its western boundary and
SE 120`h Street, if extended, would define its northern boundary. It currently consists of an
existing plat of 23 lots with an estimated 14 lots developed with single-family detached
dwellings.
Council is holding tonight's public meeting pursuant to RCW 35.A.120 to consider whether it
wishes to accept this proposed annexation, geographically modify it, or reject it. If it accepts the
Notice of Intent Council will authorize circulation of the 60% Direct Petition to Annex. If it
rejects it there is no appeal under state law. If Council authorizes circulation of the petition it
will typically ask signers whether they wish to be annexed into the City of Renton, whether
property owners within the annexation site should be required to assume their fair share of the
City's outstanding bonded indebtedness, and whether properties within the annexation site
should be zoned consistent with Renton's Comprehensive Plan and more specifically whether
they should be zoned R-8.
The Administration recommends that Council accept the 10% Notice of Intent. If Council
concurs with this recommendation, the Administration recommends that Council take the
following actions (pursuant to RCW 35A.14.120):
• Authorize the circulation of 60% Petition to Annex for the proposed area;
• Require the adoption of City zoning on the property consistent with the Comprehensive
Plan; and,
• Require that property owners assume a proportional share of the City's outstanding
indebtedness.

Mr. Wenzl came to our home and indicated that he was a neighbor. We found out later he is not a
neighbor, he is a developer. He wanted our support for the proposed annexation that would line his
pockets with gold and destroy our way of life. We could not and do not support such a thing. We enjoy our
county life and can't see where it would benefit the city to annex us.
We are a old neighborhood with a mix of traditional housing and trailers, the tax revenue simply won't
support the services the City of Renton would have to provide that the county provides now.
am also concerned about the parking issue. If a mulit family complex comes to the small cul-de-sack on
138 pl it will become a huge expense due to the increase in police calls to have cars removed from
blocking the driveways; unless the builder is willing to provide 2 spaced per unit and as you know most
don't. They figure it as 1.2 auto per unit, those people will need to park someplace.
Please do not support this, I honestly don't think this is a good idea for Renton. I think it will end up being a
cash cow for the city and for us old folk, it won't be any fun in our golden years either.
We understand that Mr. Wenzl contributes large sums of money for election campaigns, but he needs to
understand that people can not be bought and deceit has no rewards.

In addition to our day-to-day activities, the following items are worthy of note for this week:
GENERAL
• IKEA Renton River Days begins this week at Liberty Park and other locations. This annual festival
celebrates all the amenities and activities that make Renton a great community in which to live, work,
and play. Events include the Kick Off Banquet on Tuesday, Kids' Day on Wednesday, the Parade on
Saturday, and the Rubber Ducky Races on Sunday, as well as an art show, a book sale, sporting
events, and free entertainment throughout the weekend. For a complete line up of activities, events,
schedules, and locations, visit www.rentonriverdays.org.
Do you know someone who promotes and supports Renton? Someone who is dedicated to making
the Renton community a great place to live, work, play, and learn? You can recognize that special
person for their commitment to Renton by nominating them as Renton's 2004 Citizen of the Year.
Applications are available at City facilities, the Greater Renton Chamber of Commerce, or on the
City's website at www.ci.renton.wa.us. Nominations for Renton Citizen of the Year are being

ADMINISTRATIVE, JUDICIAL, AND LEGAL SERVICES DEPARTMENT
• Election Day is coming; don't forget to register to vote. To be eligible to vote you must be a citizen
of the United States, at least 18 years old by election day, and a legal resident of Washington. Voter
registration forms and absentee ballot applications are available at the City Clerk's Office on the 7"'
floor of Renton City Hall, at Renton Public Libraries, or on the City's website. For more information

COMMUNITY SERVICES DEPARTMENT
• The 2004 Recreation Youth Track and Field Program hosted the annual All City Track Meet at
Renton Stadium on Thursday, July 15". Over 600 people attended to watch teams from Issaquah,
Snoqualmie, Auburn, and Renton compete in running and field events.
PLANNINGBUILDING/PUBLIC WORKS DEPARTMENT
• As of July 13, 2004, 34 states plus Puerto Rico reported the presence of the West Nile virus. Ten
states reported a total of 108 human cases, the majority of which are in Arizona (66), with three
deaths reported in Arizona. The only western states with no detection are Washington, Oregon,
Montana, Nevada, and Utah. Peak activity for the West Nile Virus is from late July through early
September.

Neighborhoods in Renton and across the nation are fighting back to get rid of crime and drugs
through National Night Out, a program designed to heighten crime and drug prevention awareness;
generate support for, and participation in, local anti -crime efforts; and strengthen neighborhood spirit
and police -community partnerships. The Renton Police Department would like to invite you and
your neighborhood to join forces on Tuesday, August 3`d, to give crime and drugs a going away
party. Talk with your neighbors and plan to host a block party, potluck, barbecue, dessert social, or
just a casual get-together. Register your event with the Crime Prevention Unit by calling 425-430-

Beginning Tuesday, June 20, nine members of the Police Department's
Patrol Services Division will be assigned to "Quality of Life" issues in the
Highlands.
The areas between NE 7`h Street to NE 27t' Street and Edmonds Avenue NE
to Monroe Avenue NE have been targeted and will be saturated with police
patrols, animal control and parking enforcement.
Parking violations, abandoned vehicles, nuisance properties, and other
illegal behavior observed or reported will be addressed with a "no tolerance"
philosophy. This effort is a beginning to the strong nuisance abatement and
code enforcement initiatives discussed by Mayor Kathy Keolker-Wheeler
earlier this year.
Anyone observing illegal behavior on or around NE Sunset Boulevard,
adjacent parking lots, in the Metro bus shelters, in City parks, or residential
neighborhoods, should phone 911. If you request contact with a police
officer, one will be dispatched to meet with you. If you do not request
contact, an officer will still be dispatched to the location regarding the
behavior you have reported.
Please remember that 911 is the phone number to call, regardless of whether
the situation is an emergency or not.

SUMMARY OF ACTION:
Mithun Architects agreed on March 30, 2004 to pay the City $108,135.84 (excluding interest) by December
31, 2004 for design irregularities on the Pavilion Project. The City accepted Mithun's offer at the Renton City
Council Meeting on April 5, 2004. Since then, Mithun has requested a time extension to June, 2006 in order to
make the repayment schedule consistent with their expected cash flow. The repayment schedule includes an
interest rate they must pay that covers the cost of money to the City.
STAFF RECOMMENDATION:

SUBJECT: Mithun Repayment Plan Extension
ISSUE:
Should the City Council concur in allowing Mithun Architects to extend its repayment
schedule to June 2006 from the currently agreed to date of December 31, 2004?
RECOMMENDATION:
That the Council concur with the time extension requested by Mithun.
BACKGROUND:
• By letter dated March 30, 2004 (copy attached) Mithun agreed to pay the City
$108,135.84 by December 31, 2004.
• The City Council accepted Mithun's proposal on April 5, 2004.
• Subsequently, Mithun asked for a time extension to June 2006, citing cash flow
difficulties with trying to make the entire payment by the end of 2004.
• The interest rate being charged Mithun covers the cost of money to the City.
The City neither makes any money from Mithun's misfortune nor subsidizes
their repayment.
• The City could push Mithun to take out a 3`d party loan if they could not
complete their repayment by the original schedule. This approach has the
advantage of minimizing our exposure should bankruptcy occur. Mithun, when
faced with our determination to hold them to their original agreement, could
choose to continue with an extended payment plan. The City would be hard
pressed to force collections.
• Mithun has made two payments on the extended payment schedule and is
current as of July 2004. The extended payment schedule is attached.
• If the City Council agrees to the time extension, City Staff would write Mithun
indicating that no City work would be available to them until the debt has been
paid.
CONCLUSION:
The chance of Mithun going bankrupt is real, but small. They are a respected firm that has
been in business for decades. The City is not losing any money with the extended
repayment schedule.

Dear Mr. Culp:
As a follow on to our recent discussions, the design team has agreed to assist the City with its
efforts to close out the change orders and resultant costs for the Pavilion project. To that end, the
team is willing to pay $io8, r35.84•
This payment to the City is contingent upon receipt of a full release of all claims between all
parties to the project which were known, or should have been known, as of the date of this letter in
any way related to the project, with the only exception being claims for unknown latent deficits.
Mithun further accepts the City's offer to establish a payment plan for the amount due which will
be paid in monthly installments with the balance paid in full, no later than December 3r, 2004.
Please have your finance department contact our Ms. Cathy Goldberg, Mithun CFO, to finalize
arrangements. Please draft an appropriate agreement to reflect this understanding.

SUMMARY OF ACTION:
The area to be dedicated for additional right-of-way is a 15-foot corner radius (approx. 28.0 sq.ft.)
at the corner of Index Ave NE and NE 5`h Place. The requirement of this dedication is to dnsure
proper turning radius at street corners for emergency .vehicles. The dedication is a City of Renton
code requirement of the Skywire Short Plat, LUA04-023, and Council acceptance of said right-of-
way should be completed prior to recording deed with the short plat.
STAFF RECOMMENDATION:

1. Project Description/Background
The subject property is located at 2906 NE 5th Place. The applicant has proposed to subdivide an
approximately 13,394 square foot parcel (0.31 acres) into two lots. The property currently contains an
approximately 1,090 square foot single-family residence that is proposed to remain on Lot B. Lot A is intended
for the future construction of a detached single-family residence.
The lots are proposed at the following lot sizes: 4,880 square feet (Lot A) and 8,514 square feet (Lot B). Lot A
would be considered a corner lot, since it has frontage on both Index Avenue NE and NE 5th Place. Lot B
would be considered an interior lot, with frontage on NE 5th Place.
The subject site slopes down from east to west at an average grade of approximately 8-percent over the entire
site, and an average grade of approximately 11-percent over Lot A. The subject site has a grade difference of
approximately 10 feet between the east and west property lines. The subject site is predominately vegetated
with grass lawn and shrubs. The applicant has not proposed to remove any trees.
2. Environmental Review
Except when located on lands covered by water or critical areas, short plats are exempt from SEPA
Environmental Review pursuant to WAC 197-11-800(6)(a).
3. Compliance with ERC Conditions
Not applicable.
4. Staff Review Comments
Representatives from various City departments have reviewed the application materials to identify and address
issues raised by the proposed development. Comments from the various departments are contained in the
official file, and the essence of those comments has been incorporated into the appropriate sections of this
report.
5. Consistency Short Plat Criteria
Approval of a short plat is based upon several factors. The following criteria have been established to assist
decision -makers in the review of a short plat:
a) Compliance with the Comprehensive Plan Designation
The site is designated Residential Single Family (RSF) on the Comprehensive Plan Land Use
Map. The RSF designation is intended to promote and enhance single-family neighborhoods. The
proposal is consistent with the RSF designation because it allows for the future construction of a
new single-family home and promotes infill development. The proposal is consistent with the
following Comprehensive Plan Land Use and Housing Element policies:
Policy LU-34. Net development densities should fall within a range of 5 to 8 dwelling units per
acre in Residential Single Family neighborhoods.
The net density of the proposed subdivision is 6.51 dwelling units per acre, which is within the
density range prescribed.
Policy LU-35. A minimum lot size of 4,500 square feet should be allowed in single-family
residential neighborhoods except when flexible development standards are used for project review.
The applicant has proposed a two -lot subdivision. Lot A is 4,880 square feet; Lot B is 8,514
square feet. Both of the proposed lots met the minimum lot size requirements.
Policy H-4. Encourage infill development as a means to increase capacity.

The proposal will create one additional residential lot, thereby increasing density within a
developed residential area.
b) Compliance with the Underlying Zoning Designation
The subject site is designated Residential — 8 Dwelling Units per Acre (R-8) on the City of Renton
Zoning Map. The proposed development would divide an existing lot into two lots and allow for the
future construction of one new single-family dwelling.
The R-8 zone allows densities ranging from a minimum of 5.0 to a maximum of 9.7 dwelling units
per net acre for lots one-half gross acre or less in size. Net density is calculated by deducting
sensitive areas, areas intended for public right-of-way, and private easements serving three or
more lots from the gross acreage of the site. The subject property does not contain any areas to
be deducted for the purpose of density calculations. Therefore, the net site area of the property is
the same as the gross area (13,394 square feet/0.31 acres). The division of the existing lot into
two lots results in a net density of 6.5 dwelling units per acre (2 lots/ 0.31 acre = 6.5 du/ac), which
is within the allowed density range of the R-8 zone.
The allowed building lot coverage in the R-8 zone is 35 percent or 2,500 square feet, whichever is
greater, for lots over 5,000 square feet in size. The existing dwelling and garage would result in a
building coverage of approximately 17 percent for Lot B, which complies with the lot coverage
restrictions of the zone. Staff will verify that future development on Lot A meets lot coverage
restrictions at the time of building permit submittal.
Setbacks in the R-8 zone are as follows: 20-foot front yard, 5-foot side yard, and 20-foot rear yard.
Based on the short plat drawing submitted by the applicant, the existing home on the underlying lot
(proposed Lot B) would have a non -conforming front setback and side yard setback if the
proposed short plat was approved. An Administrative Variance (LUA04-042) was approved May
5, 2004 allowing a14.86 foot front yard setback for the existing home. The covered porch
projection into the side yard must be removed. Staff recommends as a condition of short plat
approval that the applicant be required to obtain final inspection approval of a demolition permit for
the roof of the attached porch prior to short plat recording.
While no building construction is proposed at this time, Lot A has adequate area to facilitate a new
single-family residence that meets the required setbacks. Lot A will be considered a corner lot
therefore, staff recommends as a condition of short plat approval that the south property line will be
considered the front and the north property line will be considered the rear; side yard along a street
will be the west property line and the other property lines will be considered side yard.
Both lots appear to have adequate area to provide two off-street parking spaces as required by the
parking regulations. Staff will verify compliance with setbacks and parking requirements for Lot A
at the time of building permit submittal.
c) Compliance with Subdivision Regulations
Streets: No new public streets will be created as part of the proposed short plat.
The Subdivision Regulations require the installation of full street improvements, including curb,
gutter, and sidewalk along the site's street frontage (RMC section 4-6-060), unless previously
installed or waived or deferred through the City of Renton Board of Public Works. The required
street improvements have been previously installed.
The proposed subdivision is anticipated to generate additional traffic on the City's street system. In
order to mitigate transportation impacts, staff recommends as a condition of short plat approval
that the applicant pay a Transportation Mitigation Fee based on $75.00 per net new average daily
trip attributed to the project prior to recording of the short plat. The additional lot is expected to
generate approximately 9.57 new average weekday trips. The fee for the proposed short plat is
estimated at $717.75 ($75.00 x 9.57 trips x 1 lot = $717.75).
Blocks: No new blocks will be created as part of the proposed short plat.
Lots: The minimum lot size permitted in the R-8 zone is 4,500 square feet. The short plat will
result in a total of two lots, both of which meet the minimum lot size requirements. Lot A is
proposed to be 4,880 square feet; Lot B is proposed to be 8,514 square feet.

The proposed lots also comply with the R-8 requirements for minimum lot width (50 feet for interior
lots, 60 feet for corner lots) and minimum lot depth (65 feet). Lot A would be considered a corner
lot and Lot B would be considered an interior lot. Lot A is proposed to be 64 feet wide along the
north property line; 58.41 feet wide along the south property line. The property lines average a lot
width of 61.21 feet (64+58.41 =1 22.41/2=61.21). Lot A is proposed to have a depth of 75 feet along
the west property line; 94.55 feet depth along the east property line. The property lines average a
lot depth of 84.78 feet (75+ 94.55=169.55/2=84.78), therefore meeting the minimum lot width and
depth requirements. The north property line of Lot B is 79.51 feet wide; the south property line is
59.82 feet wide. The property lines average a lot width of 69.67 feet (79.51 + 59.82 = 139.33 / 2 =
69.67). The west property line of Lot B is 94.55 feet deep; the east property line is 128.58 feet
deep. The property lines average a lot depth of 111.57 feet (94.55 + 128.58 = 223.13 / 2 =
111.57). Based on an average of property line lengths, Lot B meets the minimum lot width and
depth requirements.
d) Reasonableness of Proposed Boundaries
Access: Lot A has frontage on both Index Avenue NE and NE 5th Place. Lot B has frontage on
NE 5th Place. The applicant is proposing Lot A and B have access via existing driveways off Index
Avenue NE and NE 5th Place.
Topography. The subject site slopes down from the east side to the west side. The vertical
change from the east to west side of the property is approximately 10 feet, resulting in an
approximately 5.5 percent grade. The site is predominately vegetated with grass lawn and a mix of
mature trees. The applicant is proposing to remove three birch trees located within the driveway
as part of the short plat.
Relationship to Existing Uses: The properties to the east and south of the subject parcel are
zoned Residential — 8 Dwelling Units Per Acre (R-8). To the north and west of the subject parcel is
Residential —10 Dwelling Units Per Acre (R-10). The proposal is consistent with the
Comprehensive Plan and Zoning Development Standards, which encourage residential infill
development. Moreover, as future redevelopment occurs in this area of the city, many of the
nearby lots are likely to be platted into smaller infill lots.
e) Availability and Impact on Public Services (Timeliness)
Police and Fire: Police and Fire Prevention staff indicate that sufficient resources exist to furnish
services to the proposed development, subject to the condition that the applicant provide Code
required improvements and mitigation fees. In order to provide for public safety and timely
emergency response, staff recommends as a condition of approval that street addresses shall be
made visible from a public street prior to short plat recording. To mitigate the potential impacts of
the proposal on demand for City emergency services, staff recommends as a condition of approval
that a Fire Mitigation Fee, based on $488.00 per new single-family lot, be paid prior to recording of
the short plat. The fee is estimated at $488.00 ($488 x 1 new lot = $488.00).
Schools: According to the Draft Environmental Impact Statement for the City of Renton Land Use
Element (January 16, 1992), the City of Renton has a student generation factor of 0.44 students
per single-family residential dwelling. It is anticipated that the proposed short plat would result in
0.44 new children (0.44 X 1 new lot = 0.44) to the local schools (High Elementary School, Dimmitt
Middle School, and Renton High School). The Renton School District has indicated they can
accommodate the additional demand generated by this proposal.
Streets: The subject site is located adjacent to Index Avenue NE and NE 5th Place. Lot A has
street frontage on both Index Avenue NE and NE 5th Place and Lot B has street frontage on NE 5th
Place. All addresses must be visible from a public street. The maximum driveway slope allowed
per RMC 4-4-080.1.6a is 15-percent, provided that a slotted drain is required at the low side of the
slope for driveways exceeding 8-percent. Driveways exceeding 15-percent require a variance from
the Board of Adjustment.
Storm Water. The site drains to the North Renton basin by existing storm water facilities located
in Index Avenue NE and NE 51h Place. Due to the limited amount of new impervious surface
associated with the proposal, no additional drainage improvements are required. A Surface Water
System Development Charge of $715.00 for the new single-family lot will be collected as part of
the construction permit prior to the recording of the short plat.

Water and Sanitary Sewer Utilities: There are an existing 6 and 10-inch water mains in Index
Avenue NE and NE 5th Place. An 8-inch sanitary sewer main is located along the frontage of the
site. The applicant is responsible for securing all necessary private utility easements prior to the
recording of the short plat. A Water System Development Charge of $1,525.00, and a Sewer
System Development Charge of $900.00 will be collected for the new single-family lot as part of
the construction permit, prior to the recording of the short plat. In addition, the applicant will be
required to install stortz fittings on all fire hydrants serving the site.
H. Findings:
Request: The applicants have requested Administrative Short Plat Approval for the Skywire Short
Plat, File No. LUA-04-023, SHPL-A.
2. Application: The applicants' short plat application complies with the requirements for information for
short plat review. The applicants' short plat plan and other project drawings are contained within the
official land use file.
3. Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan Residential
Single Family (RSF) land use designation.
4. Zoning: The proposal complies with the zoning requirements and development of the Residential - 8
(R-8) zoning designation, provided all advisory notes and conditions of approval are complied with.
5. Subdivision Regulations: The proposal complies with the requirements established by the City's
Subdivision Regulations for the short platting of two lots, provided all advisory notes and conditions of
approval are complied with.
6. Existing Land Uses: Land uses surrounding the subject site include: North: Multi -Family Residential
(zoned R-10); East: Single -Family Residential (zoned R-8) and Multi -Family Residential (zoned R-10);
South: NE 5th Place Right -of -Way and Single -Family Residential (zoned R-8); and West: Index
Avenue NE Right -of -Way and Multi -Family Residential (zoned R-10).
7. Setbacks: The south property lines of the two lots will be considered the front property lines. The
north property lines of each of the two lots will be considered the rear property lines. Lot A will be
considered a corner lot therefore the west property line will be a side along a street. All other property
lines will be considered side property lines.
8. System Development Charges: A Water System Development Charge of $1,525.00, a Sewer
System Development Charge of $900.00, and a Surface Water System Development Charge of
$715.00 will be assessed for the additional lot, and will be payable prior to issuance of the utility
construction permit.
L .,Conclusions:
1. The subject site is located in the Residential Single Family (RSF) Comprehensive Plan land use
designation and complies with the goals and policies of this designation.
2. The subject site is located in the Residential — 8 Dwelling Units per Acre (R-8) zone and complies with
the zoning and development standards of this zone, provided all advisory notes and conditions of
approval are complied with.
3. The proposed two lot short plat complies with the subdivision regulations as established by City Code
and state law, provided all advisory notes and conditions of approval are complied with.
4. The applicant has obtained approval of the Skywire Setback Variance, File No. LUA-04-042, V-A, May
5, 2004 allowing a 14.86-foot front yard setback where a 20-foot front yard setback is required.

J. DECISION:
The Skywire Short Plat, File No. LUA-04-023, SHPL-A, is approved subject to the following conditions:
1. The applicant shall pay a Transportation Mitigation Fee of $75.00 per not new average daily trip

1. Work hours for new single-family developments are limited to the hours between seven o'clock (7:00) a.m. and
eight o'clock (8:00) p.m. Monday through Friday. Work on Saturdays is restricted to the hours between nine
o'clock (9:00) a.m. and eight o'clock (8:00) p.m. Nor work is permitted on Sundays.

1. Per City code any new construction must have a fire hydrant capable of delivering a minimum of 1,000 GPM and
shall be located within 300 feet of the new structure. If the building square footage exceeds 3,600 square feet in

300 feet of the structures. This distance is measured along a travel route.

The administrative land use decision will become final if the decision is not appealed within 14 days of the effective date of
decision. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680).
RECONSIDERATION. Within 14 days of the effective date of the decision, any party may request that the Administrator
reopen a decision on a short plat. The Administrator may modify the decision if material evidence not readily
discoverable prior to the original decision is found or if it is found that there was misrepresentation of fact. After review
of the reconsideration request, if the Administrator finds insufficient evidence to amend the original decision, there will be
no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the
following appeal timeframe.
APPEAL. This administrative land use decision will become final if not appealed in writing to the Hearing Examiner on or
before 5:00 PM on June 9, 2004. City of Renton Municipal Code Section 4-8-110 governs appeals. Additional information

SUMMARY OF ACTION:
The Council received a 10% Notice of Intent petition on June 8, 2004 to annex 4.84 acres east of
Talbot Road South and south of SE 192nd Street. The proponents have submitted an addendum to
their June 8, 2004 petition with additional signatures to show that they have the support of 100%
of the property owners in the annexation area.
Under state law the City is required to hold a public meeting with the proponents within 60 days
of receipt of such petition to consider whether it wants to accept the area as proposed,
geographically modify it, or not accept it all. If Council accepts the 10% petition it will typically
authorize the circulation of a 60% Direct Petition to Annex. The site is currently designated RLD
(Residential Low Density) on the Comprehensive Plan Land Use Map and would likely be
prezoned R-4 consistent with this designation.

SUBJECT: Proposed Anthone'Annexation 10% Notice of Intent
ISSUE:
The City is in receipt of a Notice of Intent to annex about 4.84 acres to the City of Renton by direct
petition (Figure 1, Vicinity Map). State law requires that the Council hold a Public Meeting with
annexation proponents to decide whether to accept, reject or geographically modify the proposal,
whether to require the assumption of bonded indebtedness and whether to require the simultaneous
adoption of zoning.
RECOMMENDATION:
On the basis of the following analysis, the Administration recommends that Council accept the 10%
Notice of Intent. If Council concurs with this recommendation, the Administration recommends that
Council take the following actions (pursuant to RCW 35A.14.120):
• Authorize the circulation of the 60% Direct Petition to Annex for the proposed area;
• Require the adoption of City zoning on the property consistent with the Comprehensive Plan; and,
• Require that property owners assume a proportional share of the City's outstanding indebtedness.
BACKGROUND SUMMARY:
The rectangular shaped Anthone' Annexation site has not previously been considered for annexation to
Renton. It is located at the corner of South 55`h Street (SE 192,d Street) and Talbot Road South. It also
is at the edge of Renton's sewer and water service areas.
Location: The proposed 4.84-acre rectangular shaped Anthone'Annexation is located between
SE 192°d Street on the north and Talbot Road South on the west.. It borders Talbot Estates

subdivision on its south and Springbrook Terrace subdivision on its east. It is just north of the
City's Springbrook Springs Reservoir area in the south part of the City.
Assessed value: The assessed value at current development is $$746,000.
Natural features: The site slopes upward from its southwest corner to its northeast corner with
an average 12% slope. (Figure 4, Topography) There are no mapped wetlands on the site.
4. Existing land uses: Existing development includes two single-family dwellings on two lots and
two vacant parcels. (Figure 3, Existing Structures)
Existing zoning_ King County zoning is R-4. R-4 allows up to a base density of four units per
gross acre, and up to six units per acre with incentives and transfer of density credits.
Comprehensive Plan: Renton's Comprehensive Plan designates the subject parcel Residential
Low Density (RLD). Potential zoning under the RLD designation includes R-5, 5 units per net
acre, R-1, 1 unit per net acre, and Resource Conservation (RC) 1 unit per 10 acres.
7. Public services: All responding departments and divisions noted that the annexation represents
a logical extension of their respective services and systems.
Water Utility. The subject area is within Renton's water service area by agreement under the
East King County Coordinated Water System Plan. A developer extension of approximately
550 feet along South 55"' Street will be required to serve the site when it develops.
Sewers. The area is not currently served by sewer. Sewer exists to the north of South 55"'
Street in the City. Metro sewer mains serve the Talbot Estates subdivision on its south and
Springbrook Terrace subdivision on its east. Sewers would most likely be extended by a
developer extension.
Surface Water. The Surface Water Utility reports that this annexation is upstream of a sensitive
area in the Springbrook Creek Basin. Depending on future storm water conveyance design they
report that the annexation could drain into the Upper Springbrook Creek possibly affecting the
Springbrook Trout Farm. As a result they are suggesting more stringent storm water flow
control requirements at the time of future development of the site.
Parks. The City currently lacks developed parks in this area. The City has acquired land for a
future park on the former Cleveland property west of Talbot Road South. The projected cost of
developing and maintaining parkland to a level consistent with the service levels in the City's
Comprehensive Park, Recreation and Open Space Plan will be included in the fiscal impact
analysis, should the Council accept the 10% Notice of Intent petition.
Fire. The area is currently served by Fire District #37.
Public Works Maintenance. Maintenance staff noted that the only organized drainage is
roadside ditches along South 55"' Street, which are already in the City. As a result no additional
maintenance costs would result from this annexation. However there could be future costs
associated with development of the 4.84-acre site but the City will not assume ownership or
maintenance responsibility for existing systems.
ANALYSIS OF THE PROPOSED ANNEXATION:

The annexation policies generally support the proposed annexation. The subject properties are
within Renton's Potential Annexation Area and are subject to development pressure. (Policies
LU-378 and LU-380) The area is available for urbanization under the King County
Comprehensive Plan, zoning and subdivision regulations. (Policy LU-380) Renton is the
logical provider of urban infrastructure and services to the area. (Policy LU-383) Policy LU-
388 states that, in general, the greater the contiguity with the city limits, the more favorable the
annexation. The area proposed for annexation is adjacent to the city limits along approximately
50% of its boundary. Proposed boundaries also are generally identifiable in the field. (Policy
LU-388).
2. Consistency with the Boundary Review Board Objectives:
(from RCW 36.93.180)
a. Preservation of natural neighborhoods and communities;
The proposed annexation would cause no disruption to the larger community.
b. Use of physical boundaries, including but not limited to bodies of water, highways, and
land contours;
Boundaries generally follow existing physical features such as roads and/or adjacent
subdivisions.
Creation and preservation of logical service areas;
Not applicable.
d. Prevention of abnormally irregular boundaries;
The boundaries are quite regular.
e. Discouragement of multiple incorporations of small cities and encouragement of
incorporations of cities in excess of ten thousand population in heavily populated urban
areas;
Not applicable.
f. Dissolution of inactive special purpose districts;
Not applicable.
g. Adjustment of impractical boundaries;
Neither the existing nor the proposed boundaries are impractical.
h. Incorporation as cities or towns or annexation to cities or towns of unincorporated areas
which are urban in character; and,
King County has designated this area for urban development.
Protection of agricultural and rural lands which are designated for long term productive
agricultural and resource use by a comprehensive plan adopted by the county legislative
authority.
Not applicable. No portions of the proposed Annexation area are rural or designated for
long-term productive agricultural use in the King County Comprehensive Plan.

CONCLUSION:
The proposal is essentially consistent with City policies and Boundary Review Board objectives for
annexation. No impediments to the provision of City services to the area have been identified.
A full fiscal analysis will be conducted following receipt of a certified 60% Direct Petition to annex, if it
is the Council's intent that the annexation proceed.

The undersigned are the owners of not less than ten percent (10%) of the assessed value of
property within the proposed annexation area which they desire to annex to the City of Renton.
We hereby advise the City Council of the City of Renton that it is our desire .to commence
annexation proceedings under the provisions of RCW 35A.14.120 of all or any part of the area
described below.
The territory proposed to be annexed is within King County, Washington, and is contiguous to
the City of Renton. A legal description (Exhibit A) and map (Exhibit B) are included as part of
this petition.
The City Council is requested to set a date not later than sixty days after the Piling of this request
for a public meeting with the undersigned.
1. At such meeting, the City Council will decide whether the City will accept, reject or
geographically modify the proposed annexation;
2. The City Council will decide whether to require simultaneous adoption of a
proposed zoning regulation, such a proposal having been prepared and filed for the
area to be annexed as provided for in RCW 35A.14.330 and 35A.14.340; and,
3. The City Council will decide whether to require the assumption of existing city
indebtedness by the area to be annexed.

SUMMARY OF ACTION:
The Hearing Examiner's Report and Recommendation on the Stonehaven Preliminary Plat was
published on April 22, 2004. The appeal period ended on May 6, 2004. The Examiner
recommends approval of the proposed preliminary plat, subject to the conditions outlined on
page 6 of the Examiner's Report and Recommendation. Staff submitted a Request for Delay of
Final Decision concerning a "stream course" on the site on May 6, 2004. After further review
and correspondence, The Examiner's response was issued on June 28, 2004 approving the
development of the plat as now proposed. The appeal period ended on July 12, 2004. This
office notes that the conditions placed on this project are to be met a later states of the platting
process.

The hearing opened on Tuesday, April 6, 2004, at 9:36 a.m. in the Council Chambers on the seventh floor of the
Renton City Hall. Parties wishing to testify were affirmed by the Examiner.

The hearing opened with a presentation of the staff report by Susan Fiala, Senior Planner, Development
Services, City of Renton, 1055 S Grady Way, Renton, Washington 98055. There are two separate parcels
comprising the 5.95-acre site. There are two separate property owners. This property was annexed into the City
in December 2003 and is located in the Residential — 8 (R-8) zoning designation. The proposal would create 36
lots intended for the eventual development of detached single-family homes. There is an existing single family
home that is proposed to remain on what would become new lot 24, on the larger parcel to the north. On the
narrow southern parcel are a mobile home and several outbuildings. Those are proposed to be removed as part
of the development of the plat.
There are two tracts, Tract A is located in the southwest corner of the site, which contains a Category 2 wetland,
approximately 3,000 square feet is located on this parcel, the remaining is on other parcels. A 50-foot buffer is
required and will be maintained. Track B would contain the storm detention facility located in the northeast
portion of the site.
The Examiner noted that in the staff report the storm detention facility is listed as being in the northwest portion
of the site and it is actually in the northeast portion.
Ms. Fiala continued stating that access to the plat is from Main Avenue South within the City of Renton or 102nd
Avenue SE as well as South 471h Street. Internal to the plat would be two new roads designated as Road A and
Road B.
The plat is divided into three areas, Lots ]-16 following the western and southern property lines. A central
block, containing nine lots, and the northeast block which will contain the storm detention, the existing home,
and several new lots.
The project was reviewed by the Environmental Review Committee (ERC) who issued a Determination of Non -
Significance Mitigated (DNS-M). The DNS-M included seven mitigation measures. There were no appeals
filed. The seven mitigation measures included those related to erosion control, temporary and permanent
fencing for the wetland area, the storm drainage facilities would be designed to the 1990 King County Surface
Water Design Manual for 100 year storms, and standard mitigation fees for Fire, Traffic and Parks.
The Comprehensive Plan is Residential Single Family, it complies with the land use element, housing, and
environmental element as related to residential single family. It meets all density requirements as well as
completing housing infill by adding 35 new lots to an undeveloped lot.
With respect to the underlying zoning designation, the density after deduction of the critical area wetland, streets
and roads is 7.42 dwelling units per acre.
All lots meet width, depth and area requirements. The proposal meets all front, rear and side yard setback
requirements, but will be verified at the time of individual building permits.
There are several corner lots, Lots 1, 16, 17, 21, 27, 28, 32, 33 and 36. It is necessary to insure that they are at
the appropriate front yard setbacks, it is not appropriate for the front of a yard to be facing South 47`h Street

versus Road A, this will be a condition of approval that Lots 1, 16, 17, 21 and 36 face Road A and Lots 28, and
32 face Road B.
The internal road system has been requested to reduce the right-of-way from 50' to 42' with 32' of pavement,
including curb, gutter, sidewalk and street lighting on both sides of the street and as appropriate.
Staff has several recommendations, due to the distance from secondary access all buildings within the plat, with
the exception of the existing home, will have to be sprinklered, provide a 20'access easement between proposed
lots 10 and 11, and to place "No Parking" signs along Main Avenue South.
Staff also recommends as a condition of plat approval the establishment of a homeowner's association or
maintenance agreement including but not limited to common improvements.
Fire, Transportation and Parks mitigation fees are required.
The plat is within the Renton School District, the proposed plat will generate approximately 16 additional
students and the school district is able to handle these new students.
The plat is within the Soos Creek Water and Sewer District, as a condition of approval the applicant be required
to obtain a certificate of water and sewer availability from the Water District prior to obtaining a construction
permit.
In conclusion, staff recommends approval of the project subject to conditions
Lafe Hermansen, Core Design, 14711 NE 29'h Place, Suite 101, Bellevue, WA 98007 stated the he represents
the applicant and property owners, and are in agreement with most everything that staff has reported. The only
contention is with the access easement, there is room to provide it with the adjustment of Lots 1, 2, and 3,
sliding all of them up around the corner. However, the houses being built are required to be sprinklered and the
additional access easement with the property owner to the southwest has indicated that he has no interest in
developing or granting an easement. It this is a requirement, then that easement will have to be relocated.
The water/sewer certificate of availability has been obtained from Soos Creek and copies will be provided to the
City.
The Examiner further inquired as to the easement requirement by the Fire Department.
Kayren Kittrick, Development Services, 1055 South Grady Way, Renton, WA 98055 stated that in regard to the
Required easement stated that it was recognized from the beginning that the owner may not wish to grant such
an easement and therefore, it was a preferred alternative but not a required one. It is not a requirement that there
be a 20'easement.
The Examiner asked about a reference to a storm drainage system that would be routed around the detention
facility. What is that reference all about?
David Cayton, Core Design, 14711 NE 291h Place, Suite, 101, Bellevue, WA 98007 stated there is an existing
pipe coming out of the main street that runs through the tract to a culvert. A proposed by-pass system that will
go around the pond, it is a direct off -site runoff through the site and around the pond. It is not draining this site,
but collecting drainage from the southeasterly area. Most of the recharge of the aquifer occurs from off -site
runoff.

Carl Falk, 1902 Bigelow Avenue North, Seattle 98109 stated that he is one of the owners of the property and has
read the report and agrees with the recommendations. If any adjustments are necessary, they are willing to work
with the Fire Department to make this work.
Fred Gustafson, 18439 102" d Avenue SE, Renton 98055 stated that he is one of the owners of the property and
he supports the project and thinks that it will be an improvement to the neighborhood. There currently are farm
animals and they are not a good mix with residential areas.
Steve Beck, 19129 SE 145"' Street, Renton 98059 stated that he is the applicant for Stonehaven Plat and that in
order to clarify some of the Fire Department requirements, it was that if an easement could be obtained and shift
the lots over and run a 20' access through the adjoining property then no sprinkler systems would be required
for the individual homes. The attempt was made with the property owner, he has no interest in ever developing.
Therefore with individual sprinklers required in each individual home it will be a very safe neighborhood, there
are roads coming in and out of that 5-acre tract.
Ms. Kittrick stated that she had just spoken with Mr. Rudy, the Fire Marshall and had a discussion on the 20'
easement. They do want the 20' easement to the south, but it doesn't have to go through the property but they
do wish it left open in this plat so that eventually sorneday perhaps when this property is developed, they wish
there to be a secondary access available to all the properties involved.
The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and
no further comments from staff. The hearing closed at 10:17 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATION
Having reviewed the record in this matter, the Examiner now makes and enters the following:
FINDINGS:
The applicant, Steve Beck, filed a request for approval of a 36-lot Preliminary Plat.
2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation
and other pertinent materials was entered into the record as Exhibit 41.
3. The Environmental Review Committee (ERC), the City's responsible official, issued a Declaration of
Non -Significance - Mitigated (DNS-M) for the subject proposal.
4. The subject proposal was reviewed by all departments with an interest in the matter.
The subject site is located at 4801 and 4815 Main Avenue South. The subject site is located on the west
side of Main (102nd Avenue SE in King County) immediately south of South 47th Street. The subject
site consists of two underlying lots. A single family home and separate mobile home are currently
located on the site. The single family home would be retained on what would be Proposed Lot 24. All
other structures would be removed.
A Category 2 wetland is located in the southwest corner of the subject site. There are approximately
3,129 square feet of the wetland on the subject site. Its buffer would be east of the wetland. The
Category 2 wetland requires a 50-foot buffer.
7. The subject site is approximately 5.95 acres or 259,251 square feet in area. The parcel is rectangular. It

is approximately 636 feet wide (east to west) and 406 feet deep.
The subject site generally slopes upward to the west approximately 2% to 3% but reaches approximately
22% at the southwest corner of the site near the wetland.
9. The subject site contains evergreen and deciduous forest and brush. Ornamental vegetation is located
near the existing home. Vegetation around the home and wetland will be maintained while most of the
remaining vegetation will be removed to accommodate roads and building pads.
10. The subject site was annexed to the City with the adoption of Ordinance 5041 enacted in December
2003.
11. The subject site is currently zoned R-8 (Single Family - 8 dwelling units/acre).
12. The map element of the Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of single-family uses.
13. The applicant proposes dividing the subject site into 36 lots for the development of detached single-
family uses. The lots would more or less be arranged as two blocks divided by a new, north south road
and a separate tier of lots along the south and west margins of the site that follows the curve of a new
east -west road.
14. Access to the plat will be provided from both Main, east of the site and S. 47th Street north of the site.
both of these access roads originate from the same roadway system and are considered a "dead end"
roadway. The length of the system exceeds 700 feet. The applicant has requested and been granted a
modification allowing a longer than permitted dead end road system. Homes beyond 500 feet will have
to have sprinklers installed. In addition, the city has required an easement in the vicinity of Proposed
Lots 10 and I 1 to provide potential access to the south eventually. The property owner of the property
to the south will not at this time provide access across that property. The applicant has indicated that lot
lines on nearby lots can be shifted to accommodate this easement.
15. The division of the subject site into 36 lots yields a density of 7.42 units per acre after subtracting
roadways (44,716 sq ft) and the small part of the wetland found on the subject site (3,129 sq ft). The
wetland buffer is not subtracted when calculating density.
16. The stormwater detention system will be located in the northeast corner of the site. It will be an open
pond system approximately 16,347 square feet in size on Proposed Tract B. The topography of the site
will necessitate routing storm water to both the wetland (clean water sources) and the detention pond
area. The ERC imposed a 100-year storm plus 30% additional capacity on the project due to its terrain
and location.
17. The wetland on the subject site is a portion of a larger 20,000 square foot wetland located on adjacent
property. As noted above, the wetland is a Category 2 wetland and a 50-foot buffer will be maintained
on the subject site. The wetland and buffer will be contained on Proposed Tact A and will be
approximately 10,456 square feet.
18. Staff has noted that Proposed Lots 1, 16, 17, 21, 27, 32, 33 and 36 are corner lots. In order to create
consistent building setback lines and somewhat uniform front yards staff has recommended that
Proposed Lots 1, 16, 17, 21 and 36 front on proposed Road A (a city street name has not yet been
assigned). Similarly, staff recommended that Proposed Lots 28 and 32 front proposed Road B.

19. The subject proposal would generate approximately fifteen school age children. These students would
attend the Renton School District and would be spread across the grades and be assigned on a space
available basis.
20. The subject site is located in the Soos Creek Water District. Sanitary sewer and domestic water will be
provided by that district. The applicant has been provided availability certificates.
CONCLUSIONS:
I . The proposed 36-lot plat appears to serve the public use and interest. The applicant will be preserving
the small on -site portion of a Category 2 wetland and providing the required 50-foot setback buffer.
The subdivision will create nearly rectangular lots in fairly standard block and tier arrangements.
2. The area has or can be provided with appropriate utilities. It appears that the site has made provision for
storm water detention while also assuring the wetland's character is maintained.
3. There will be increased traffic but the street system can apparently handle it. The applicant will be
paying a traffic mitigation fee to help with overall circulation flow. The applicant has agreed to create
an easement near the southwest corner of the subject site that may ultimately serve to shorten what is
now considered an excessive dead end street pattern. That easement though will not provide any quick
relief, as the adjacent property owner has not agreed to allow passage at this time.
4. The subdivision will increase the tax base of the City. The additional taxes plus the mitigation fees will
offset some of the impacts particularly on parks and fire.
5. The plat meets the density required by the Zoning Code and Comprehensive Plan.
6. Staffs recommendations on the issue of which direction corner lots should face appear appropriate and
will be made a condition of approval.
In conclusion, the proposed preliminary plat should be approved by the City Council subject to the
conditions enumerated below.
RECOMMENDATION:
The Preliminary Plat is approved subject to the following conditions:
The applicant shall indicate on the face of the final plat the orientation of the front yard of Lots 1, 16,
17, 21, 27 and 36 to face Road A and Lots 28 and 32 to face Road B. The satisfaction of this
requirement is subject to the review and approval of Development Services Division prior to the
recording of the final plat.
2. The applicant shall obtain a demolition permit and complete all inspections and approvals for all

Dear Mr. Kaufman:
In reference to the Request for Reconsideration, letter of May 6, 2004, staff respectfully submits
the following information for the subject plat forward in reference to the potential presence of a
streani/watercourse tributary to Panther Creek that meets the City's code definition of "stream".
May 5, 2004: Staff (Susan Fiala), applicant (Steve Beck) and contact (Lafe Hermansen) met on
site with the City's On -Call wetland consultant to assess the potential presence of a stream. Greg
Johnston, a Certified Fisheries Professional of The. Watershed Company assessed the site and
surroundings as well as reviewed information provided by staff from the project file.
May 6, 2004: The consultant provided a written summarization of the site visit, documentation
review and findings. (See Attachment 1). As stated in the correspondence, no flow was present
along the drainage path on the day of the site visit. It appeared that a small, unclassified,
intermittent stream that has a poorly defined channel and not used directly by fish is present.
Furthermore, the consultant questioned the City of Renton if gaps along the course of a stream
area accepted and at what width. Staff has determined that that portion of a potential
stream/watercourse within the subject plat does not fully meet the City's definition due to the
non-contiguous nature of the watercourse, the surrounding detention, culverts, etc. that currently
exist.
May 10, 2004: Staff met with applicant and contact whereupon it was determined that the
applicant needed to revise the plat and storm drainage plan,. if needed.
May 20, 2004: Received revised plat.
Analysis of Revised Preliminary Plat:
• The number of lots remains the same as originally proposed, 36 lots.
■ The access has been revised including. shifting the internal public road to the south at Lot 16.
Removing the north -south internal road and replacing lot access with. private access
easements. Removing the single driveway to Lot 19.
■ Creating Tract D as open space.

hearing be re -opened. Based on the information pertaining to the potential stream

including the number of lots (density) and storm drainage design. However, all of the potential
impacts are not fully known at this time.

This office has reviewed your letter regarding Stonehaven and I`m not clear on some of the issues.
The documents still leave issues unclear. A tributary to Panther Creek, no matter how small must
play a part in the hydrology of the Panther Creek and its associated wetlands. The absence of
water during one visit does not appear to be determinative of a stream's status. There is a
"stream" upstream of the subject site and it appears to enter the subject site. It would seem
problematical that is disappear on its course through the subject site.
Also some parts of the letter are unclear and this office would appreciate additional clarifying
information and maybe additional details.
Also, should this new information and proposed changes to the plat be made available to the
neighboring property owners and parties of record?
If this office can provide additional assistance please feel free to write.

In response to your letter of June 7, 2004, staff submits this letter as a clarification
concerning the potential presence of a stream/watercourse tributary to Panther Creek
that meets the City's code definition of "stream" for the above -referenced plat.
Determination of the Presence of a "Stream":
Staff has determined that the potential stream/watercourse within the subject plat does
not meet the City's definition for a "stream" (RMC 4-11-190).
Culverts channeling the unclassified watercourse upstream exist under Main Ave. S. (SE
102nd St. in King County) adjacent to the subject site and under SE 1851h and SE 186th
Streets, south of the subject site, in King County. The proposal is to continue the existing
culvert from Main Ave. S. under the subject plat's access road and then daylight the
watercourse within Open Space Tract D. Although the watercourse within Tract D has a
defined channel, it does not support fish or salmonoids which is part of the criteria to
meet the City of Renton's stream definition. The stream channel ends at the north
boundary line of Tract D. There is no channel within proposed Tract B. — Storm
Detention.
Discussion:
Based on the site visit conducted with Greg Johnston a Certified Fisheries Professional
of the Watershed Company, it was stated in his letter of May 6, 2004 (see attached), that
the stream or stream channel does not exist on the northern portion .of the subject site
where Tract B is proposed. From Tract B, heading north, there exists another culvert of
same stream channel. As apparent, the stream is .not a continuously defined channel
through the subject site. Culverts exist under both Main Ave. S. and S. 471h St.. which
leads to the conclusion as stated above, that there is no "stream" present on site that
meets the City's definition.
The applicant has revised the plat (see Attachment "B") such that the defined channel is
proposed to be located within Tract D as described below.

This office has received correspondence from staff that asked that the final decision on this plat
be delayed while it explored a "stream course" that runs through the subject site.
Apparently, subsequent to the public hearing, staff learned that a possibly regulated or defined
stream ran across a portion of the subject site. The City used its consultant to review the
situation. That review appears to have determined that the stream that runs through the subject
site does not meet the City's definition of a stream. At the same time, the applicant revised the
plat in some ways to protect a portion of the course as it runs through open space at the east
edge of the plat.
It appears reasonable to allow the plat to be developed as now proposed. Although, this office
does have to express some misgivings about the way this information was made available. It
would have helped the entire process if this information had been made available prior to the
public hearing and could have beenexplored in that setting where questions could have been
asked and answered. The submission of information after the close of the hearing led to some
delays as issues were sorted out for review.
As stated in the last correspondence of this office, the fact that a more defined stream -course (I
will not at this juncture debate whether it is defined as a stream by code) is found upstream and
downstream of the subject site does create some hesitancy to just write if off where is crosses the
subject site. If all, many or even some such drainage, water or moist courses were ignored.
upstream of Panther Creek, ultimately, no water or less water would reach and recharge Panther
Creek. That could affect waters that are defined and which do contain fish. Also, swales, runnels
or courses that do not contain fish might contribute nutrients and or insect life that again,
ultimately affects fish. So while the course passing through the subject site might not be much in
the way of a stream or water channel, it has and is part of an interdependency that affects larger
bodies of water, some of them having special significance or protected. status.
It appears that the course will be incorporated into and subsumed -by the detention pond area
(Tract B) and it will be preserved in open .space that will be protected as Tract D..Again, this
might not be the best situation but one, which at this time, is reasonable. .
This office has to believe that it would help. the process if there were a bit more time and thorough
review of projects prior to the public hearing. This would avoid post -hearing delays as occurred in
this instance when information is discovered as when questions arise at the hearing or in

subsequent processes: A similar situation recently occurred with a plat with a proposed road
system that did not meet code. There was no reason for that project to have come to a public
hearing when it was clear that it could not be approved and would have to be substantially
reworked to meet code requirements.
Clearly, the applicant in this case did not happily accept the delays but at the same time,
potentially sensitive environmental features were not addressed in the initial review: This office
Wants to be clear that staff requested a delay in the decision due to the discovery of this potential
stream. Once that discovery was made, some delay became necessary to fully answer all
questions.
If this office can provide further assistance please submit those requests in writing.

LANGUAGE/BENEFIT CHANGE EXPLANATION
General Information The agreement has been totally rewritten and
reformatted. Numerous changes have also
been made to reflect the fact that the
agreement is an insurance document, rather
than a care delivery document.
Allowances Schedule The ambulance benefit has been clarified to
state that GHC-initiated hospital -to -hospital
ground transfers are covered in full, and that
non -emergent ground/air inter -facility
transfers are covered at 80%.
The benefit period allowance under
chemical dependency services has been
increased in accordance with Washington
state law. The dollar amount will be
reflected in the Agreement.
The new standard devices, equipment and
supplies benefit will separate the prosthetic
devices benefit from the other devices and
equipment, and will also eliminate the
reference to formularies. Durable medical
equipment, orthopedic appliances, ostomy
supplies and post -mastectomy bras will be
covered at 50% up to a $2,500 maximum
benefit per calendar year. Prosthetic devices
will be covered at 50% up to a $20,000
maximum benefit per calendar year.
In accordance with Washington State
requirements, the emergency deductible for
emergency care services received at non-
GHC facilities will now be waived if the
member is admitted as an inpatient directly
from the emergency department.
A clarification has been made regarding the
medication monitoring visits. Medication
monitoring visits in a primary care setting
are not counted as a mental health visit;

SUMMARY OF ACTION:
The Surface Water Utility requests Council approval to transfer $165,000 from the NE loth St /
Anacortes Ave NE Storm System Improvement Project account to the SW 7th St Storm System
Improvement Project account ($120,000) and the Small Drainage Projects account ($45,000).
Construction on the NE loth St project has been completed and there is $165,000 in construction
funds remaining that will not be used for the project. The additional $120,000 for the SW 7th St
Project and $45,000 for the Small Drainage Projects will be used for construction costs,
contingency for potential changes, investigations, and repairs performed for those projects.
The approved 2004 project budget for the NE 10th St / Anacortes Ave NE Storm System
Improvement Project is $239,000. Only $74,000 of the approved project budget is needed for the
project. The remaining $165,000 is surplus budget, which could be used to provide contingency
funding for other Surface Water Utility Capital Improvement Projects.
STAFF RECOMMENDATION:
The Planning/Building/Public Works Department recommends that Council approve transferring

$165,000 of construction funds remain in the project account and will not be needed for the
project. The SWU requests Council approval to transfer the unused surplus funds to other
Surface Water CIP accounts where it may be needed this year.
RECOMMENDATION:
The Planning/Building/Public Works Department recommends that Council approve
transferring $165,000 from the NE loth St / Anacortes Ave NE Storm System Improvement
Project (account # 421.600.018.5960.0038.65.065145) to the SW 7th St Storm System
Improvement Project ($120,000) (account # 421.600.018.5960.0038.65.065430), and the

BACKGROUND
The construction of the NE 10' St / Anacortes Ave NE Detention Pond and Storm System
Improvement Project has been completed. Council approved the Final Pay Estimate of
$865,227 on June 14, 2004. The SWU estimates that $165,000 of construction funds remain
in the project account and will not be needed for the project. The SWU requests Council

approval to transfer the unused surplus funds to other Surface Water CIP accounts where it
may be needed this year.
The total 2004 budget for the NE 10' St / Anacortes Ave NE Detention Pond and Storm
System Improvement Project is $239,000. Based upon year to date actual expenditures and
remaining cost associated with project close out, it is estimated that $74,000 is all that will be
expended from the project budget this year. The remaining $165,000 is surplus budget not
needed for the project and could be used to provide contingency funding for other Surface
Water Utility Capital Improvement Projects.
The SW 7`h St Storm System Improvement Project bid was awarded by the Council on April
5, 2004, and is currently under construction. The engineer's estimate for the project was
$2,931,000 and the low bid award was for $3,045,312, which was higher than the estimate.
The approved 2004 budget for the project is $3,287,500. In order to have funds available for
potential increases in material quantities, design changes, change orders, and other
unforeseen circumstances, the SWU would like $120,000 transferred to the SW 7' St Storm
System Improvement Project account, increasing its approved 2004 budget to $3,407,500.
The Small Drainage Projects Program is used to address small problems, investigations, and
maintenance work that may occur during the year. The approved 2004 budget for the
Program is $180,000. The SWU plans on replacing the storm systems in Wells Ave S and
Williams Ave S in coordination with a Wastewater and Water Utility Capital Improvement
Project to replace the sanitary sewer system and water systems. The estimated construction
cost for the storm system portion of the work is $170,000. The SWU would like $45,000
transferred to the Small Drainage Projects Program to ensure adequate funding for
construction and other project costs related to design and project management. The fund
transfer would increase the Small Drainage Projects Program approved 2004 budget to
$225,000.
CONCLUSION
The Planning/Building/Public Works Department recommends that Council approve
transferring $165,000 from the NE loth St / Anacortes Ave NE Storm System Improvement
Project (account # 421.600.018.5960.0038.65.065145) to the SW 7th St Storm System
Improvement Project ($120,000) (account # 421.600.018.5960.0038.65.065430), and the
Small Drainage Projects Program ($45,000) (account # 421.600.018.5960.0038.65.065015).

The attached Inter Agency Lease Agreement with King County Emergency Medical Services is a
renewal of a 2001 lease (LAG-01-001). The County agrees to continue to lease space, for
$751.29 per month. In addition, the County continues to provide one paramedic unit staffed with
two (2) paramedics located within the leased space, at Fire Station 14, 1900 Lind Ave SW,
Renton, WA 98055.
The lease agreement includes an escalation factor based on the Consumer Price Index for Seattle
to adjust the rent annually. The term of the agreement is for three (3) years beginning January 1,
2004 and expires December 31, 2006. All other conditions remain the same.
STAFF RECOMMENDATION:
Adopt resolution authorizing Mayor and City Clerk to execute lease.

SUBJECT: Inter -Agency Lease Agreement for Medic Space at Fire
Station #14
ISSUE:
King County has housed a paramedic unit since 1998, at Fire Station #14, 1900 Lind
Ave. SW, Renton 98055. King County Emergency Medical Services Division operates
the unit. This Inter -Agency Lease Agreement will renew the lease.
BACKGROUND:
The space leased by King County is 1834 square feet consisting of garage space, sleeping
quarters, office space and storage. The paramedic unit shares the following space with
Renton Fire personnel: bathroom/shower, office space, kitchen, dining and day room,
and exercise room.
The rent has been adjusted each year, correlating with the Consumer Price Index for
Seattle. The term of this agreement is for three (3) years beginning January 1, 2004 and
expires December 31, 2006. All other conditions remain the same.
The agreement underwent extensive revision to correct the format, clarify the least
description, correct spelling errors and update the mayor's signatures to list Mayor Kathy
Keolker-Wheeler. The legal team for King County then reviewed it and returned it to us
for review and execution.
RECOMMENDATION:
Staff recommends that the City of Renton Council authorize the Mayor and City Clerk to
sign and execute the Inter -Agency Lease Agreement with King County.
INTER -AGENCY LEASE AGREEMENT
This LEASE AGREEMENT is entered into this day of , 2004 between THE
CITY OF RENTON as LESSOR, hereinafter referred to as "CITY"., and KING COUNTY,
a political subdivision of the State of Washington, as LESSEE, hereinafter referred to as
"COUNTY".
WITNESSETH
WHEREAS, the CITY and the COUNTY both desire to enter into a certain Lease Agreement
for the use of appropriate square footage of space at the fire station located at 1900 Lind
Avenue S.W., Renton, WA, hereinafter referred to as the "FACILITY", for the stationing of a
paramedic unit operated by the King County Emergency Medical Services Division.
WHEREAS, the King County Emergency Medical Services Master Plan and its associated
location analysis have demonstrated that the fire station at the above address provides quality
paramedic response into the greater Renton and Maple Valley area.
WHEREAS, the CITY desires to utilize King County's Emergency Medical Services
Programs.
NOW THEREFORE, the parties mutually agree as follows:
1. DESCRIPTION OF LEASED PREMISES:
I. Leased Space - 1900 Lind Avenue S.W., Renton, WA
a. 1834 total square feet - See Exhibit "B" attached hereto and made a part
hereof. Comprises:
1200 square feet - Garage space inside the apparatus bay for one
(1) primary paramedic vehicle and one (1) spare medic vehicle.
ii. 456 square feet - Sleeping quarters consisting of two (2) 11' x
20' sleeping rooms with three (3) beds. The sleeping quarters
include 18 built-in lockers available for use by the COUNTY.
Each bed includes mattress, mattress pad, bedspread and two (2)
blankets.
iii. 178 square feet - Office space and EMS storage.
H. Space Shared By The CITY And The COUNTY
a. Bathroom/shower facilities for both sexes shared with Renton Fire
Department personnel;
b. Office space including a desk and chair;
C. Kitchen facilities, dining and day rooms shared with Renton Fire
Department personnel;
d. Exercise room and equipment shared with Renton Fire Department
personnel;
2. GENERAL SERVICES OR CONDITIONS PROVIDED BY THE CITY
I. Basic Services
a. . Heating and Lighting - Heating, lighting and cooling will be provided by
the CITY for the FACILITY and those services will be available on a 24
hour basis.
b. Standby Power - The FACILITY will have an emergency generator
available to provide backup power to the building.
C. Waste - The CITY will provide a waste receptacle and collection service
for all waste; EXCEPT, that the COUNTY shall be responsible for
disposal of all contaminated medical waste.
d. Storage Space - The CITY will provide storage space for limited storage
of "non -controlled" operational supplies. The COUNTY shall provide
shelving for storage of "non -controlled" operational supplies.
3. GENERAL SERVICES OR CONDITIONS PROVIDED BY KING COUNTY
I. General Services
a. Paramedic Unit - The COUNTY will station a paramedic unit staffed
with two (2) paramedics in the FACILITY.
b. Security - The COUNTY agrees to maintain all pharmaceutical supplies,
including controlled substances, under mutually agreed upon methods of
security and accessible only by COUNTY personnel.
C. Maintenance - The COUNTY agrees to require all COUNTY personnel
assigned to the FACILITY to participate in the daily, weekly
housekeeping duties and other periodic cleaning of the FACILITY
(building and grounds) in cooperation with Renton Fire Department
personnel.
d. Special Conditions - The COUNTY further agrees that any problems or
issues that arise involving personnel or operations of the respective
agencies will be handled as set forth in Exhibit A of this agreement,
attached hereto and made a part hereof.
4. RENT
I. The COUNTY agrees to pay the CITY $751.29 per month, effective January 1,
2004, for space and other systems and services described in Item 1 above. The
monthly rate will be adjusted annually based upon the increase in the Consumer
Price Index for Seattle and shall become effective the first day of January for
2
each subsequent year of this lease.
TENANT IMPROVEMENTS
I. The COUNTY agrees to pay all costs incurred in modifying the FACILITY to
meet the COUNTY'S needs, including but not limited to alarm notification and
lighting equipment, telephone and computer systems, security (locks) systems.
a. All such modifications shall be made by the CITY with the prior written
approval of the King County Emergency Medical Services Division
Manager and shall be consistent with the FACILITY'S standards as
determined by the CITY. Signatures of both parties are required upon
completion of the improvements to show that all improvements have
been completed to the satisfaction of both parties.
b. Payment for the identified modifications shall be in addition to monthly
payments provided for herein. Any additional costs for changes to the
original plan will require prior approval by the COUNTY. The
COUNTY shall make all payments within 30 days of receipt of an
invoice.
C. Any tenant improvements made subsequent to this agreement shall be
made by or with the approval of the CITY with the prior written
approval of the King County Emergency Medical Services Division
Manager and shall be entered as an Exhibit to this agreement.
d. The COUNTY agrees to reimburse the CITY for all direct and indirect
costs incurred by the. CITY for repair and replacement of CITY property
which is lost, destroyed or damaged (normal wear and tear excepted) to
the extent such loss, destruction, or damage is caused by equipment or
employees of the COUNTY.
e. The COUNTY agrees, at the termination of this agreement, to restore
the FACILITY to the high quality condition it was in originally. This
will include removing tenant improvements, refinishing walls, ceilings,
replacing carpet, restoring the alarm system, etc.
6. TERM
I. This Lease Agreement is for three (3) years beginning January 1, 2004 and
expires December 31, 2006. This agreement may be terminated annually for
lack of funding.

II. Termination for Other Causes:
a. This Agreement is subject to termination upon ninety (90) days written
notice by the COUNTY should:
i. The CITY fail to comply with the terms and conditions expressed
herein.
ii. The CITY fail to provide work or services expressed herein.
b. This Agreement is subject to termination upon ninety (90) days written
notice by the CITY should:
i. The COUNTY fail to comply with the terms and conditions
expressed herein.
ii. If, in the judgement of the Administrator of the CITY OF
RENTON FIRE DEPARTMENT, or his/her designee, the
relationship is no longer compatible with the organizational
philosophy or values of the Fire Department.
III. Changes:
a. Either party may request changes in the services to be performed or
provided hereunder. Proposed changes, which are mutually agreed
upon, shall be incorporated by written amendment to this agreement
signed by both parties.
7. HOLD HARMLESS AND INDEMNIFICATION
I. The COUNTY agrees to assume responsibility for all liabilities that occur or
arise in any way out of occupancy of the rented space at the FACILITY, and to
save and hold harmless the CITY, its employees and officials, from all claims,
causes of action, costs, expenses, losses and damages, including the cost of
defense, incurred as a result of any negligent acts or omissions of the
COUNTY, its agents, officers, or employees only arising out of or relating to
the performance of this agreement.
II. The CITY agrees to assume responsibility for all liabilities that occur or arise in
any way out of the performance of this agreement by its agents, officers, or
employees, and to save and hold harmless the COUNTY, its employees and
officials, from all claims, causes of action, costs, expenses, losses and damages,
including the cost -of defense, incurred as a result of any negligent acts or
omissions of the CITY, its agents, officers, or employees only arising out of or
relating to the performance of this agreement.

8. INSURANCE
I. The CITY understands that the COUNTY is self -insured and is willing to
provide the CITY with proof of said insurance upon request.

Interagency Cooperation
a. The COUNTY agrees to designate one (1) paramedic on each duty shift who will
coordinate the station activities and issues with the Station Officer, including but not
limited to regular maintenance of the FACILITY by on -duty personnel
b. The COUNTY agrees that when issues, conflicts or problems arise, the Station Officer
and the designated COUNTY employee shall attempt to resolve the matter at their
level. If the matter is unable to be resolved at that level it shall be taken to the next
level of the respective chains of command, up to and including the Fire Chief, or
his/her designee, for the CITY and the Manager of the King County Emergency
Medical Services Division for the COUNTY.
c. The COUNTY recognizes the importance of the organizational philosophy and values
of the CITY and agrees to cooperate with the CITY to support those values. The
COUNTY further agrees to abide by Renton Fire Department Policies and Procedures
as discussed and agreed to by the Fire Chief and Manager of the King County
Emergency Medical Services Division.

The purpose of this letter is to request permission to connect a future single-family residence to
the sewer lift station located at the intersection of NE 26th St. and 148th Ave SE (Nile Ave NE).
The City of Renton owns this lift station.
Per conversation with the King County Health Department, I am required to hook up to this
sewer lift station because it is within 200 feet of my lot. I have obtained a sewer availability
letter from the City of Renton. One of the conditions of the sewer availability letter (attached) is
approval from the Renton City Council. We plan to apply for a building permit as soon as this
condition has been met.

Access Roads for Barbee Mill Preliminary Plat

The property owner for the proposed plat has requested approval from City Council, designating the
two proposed railroad crossings providing access to the. site as public crossings. These two at -grade
crossings of the Burlington Northern railroad:.will provide access to a proposed residential subdivision
between the railroad tracks and Lake Washington. At the suggestion of City staff, the applicant has..
requested that ;Council decide if these crossings should be publicly owned •and maintained, or be
developed` as private crossings under the ownership and maintenance of .the property `owner or future
homeowners'. association.. Following.thisdecision and submittal of appropriate revised plans" for the

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
AMENDING SECTION 1-5-1.0 OF CHAPTER 5, COUNCIL, OF TITLE I
(ADMINISTRATIVE) OF ORDINANCE NO. 4260 ENTITLED "CODE OF
GENERAL ORDINANCES OF THE CITY OF RENTON, WASHINGTON"
BY INCLUDING THE DEFERRED COMPENSATION BENEFIT IN THE
CITY COUNCILMEMBERS' SALARY DESCRIPTION.
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN
SECTION I. Section 1-5-1.0 of Chapter 5, Council, of Title I (Administrative)
of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton,
Washington" is hereby amended to read as follows:
C. The salaries of the Councilmembers are hereby fixed at nine hundred fifty dollars
($950.00) per month plus 2% of salary for deferred compensation, plus for those
Councilmembers not participating in PERS, an extra 1.4 % of salary for deferred compensation.
However, the compensation of such elected officials who fix their own compensation shall not
be increased during their terms of office, and as limited by the Constitution and statutes of the
State of Washington.
SECTION II. This ordinance shall be effective upon its passage, approval, and
30 days after publication.

Subject: Regarding pets in the park —
Dear Don,1 have been meaning to address this issue for some time because I
miss the opportunity to walk my dog Andy in the park on the lake, (coulon) When
I lived in Kirkland, Andy and I walked often in Houghton Beach park. It never
seemed to be a problem for anyone. We still drive over there on these very
hot nights here in my condo.
I have driven through the park on several evening,s(coulon) and it is such a
huge area there and I do wonder why there is no designated area for pet
strolling, and even using the lake, (labs would love it). If dogs were leashed and
controlled by their owners I simply do not see a problem. Of course every owner
picks up after their pet, or that would surely be the rule. I love my little
Andy and he is my family. I do think he should be able to enjoy the park with

I moved to my condo here in Renton in Dec. of 2003. In the early 60's I
taught in the Renton Schools. From 62 to 65 at Hazelwood, and from65 to 69 at Honey
Dew schools. My family and I lived in Newport Hills in Bellevue and I took
the Coal Creek Parkway road to go to Honey Dew. When at Hazelwood I rode my
bike. Those were great years. Not a sign of a car on CC Road back then! ! ! ! ! ! ! ! ! ! !
I really love being back here in Renton and on Friday the 23rd I will be
singing in Jerry McManus's choir at Liberty Park at 6:30 p.m. Hope to see you
