There is a comment about the vault encroaching into the sewer easement. This has been the case the entire design and I believe it was discussed early on as well. The top of the vault
lid is at 75.60 and the bottom of the sewer through this area is between elevation 77-78.8. The sewer line itself is not over the vault.

I expect we will have all of our comments completed to you sometime early next week. I have completed my review but there may be additional comments that come in directly from the District.
I can send you my comments now so you may get a head start on them but with the understanding this is not our completed review so please do not submit another set of plans until Patrick
and Bill confirm they have no additional comments. See attached for my comments on the water plans, no additional comments for the sewer plans. Please let me know if you have questions.
Also please keep in mind next opportunity for plan approval by the District is at the board meeting on April 27th. We will do our best to complete our review to allow you time to turn
around comments by then (if there are additional).

Given the property owner is not being cooperative and you cannot obtain the easement, the District understands that looping the system may not be an option for this project. With that
being said, please proceed with installing the PRV at the property line within the 112th Ave ROW to the east. The design submitted shall include a plan, profile and PRV detail, which
we can provide a sample if requested.

The property owners engineer is not being responsive. We’ve reach out several times. We can’t be held back and wait for him; we need to move this project forward.
There has been preliminary discussion with Newcastle but we haven’t gotten as far as a full review. If it was infeasible for Quadrant I assume that is still the case for us. Given
that, it doesn’t really make sense for us to extend water within the unopened ROW to the north as it will never go anywhere. Do you agree?
We’re happy to provide the PRV on our site and a Tee/Stub to the property line to the east such that this work could be done in the future but at this point it is holding us hostage.
Can we resubmit the onsite sewer and water plans to get these into final review?

Understanding the construction season is set to begin soon, the District attorney has been preparing an amendment to your agreement which would allow your construction to begin without
the easement in hand yet. With that being said, the amendment would also require the easement acquisition and water main be constructed through the private property of parcel 3224059001.
So, if it is a factor of time of why you cannot obtain the easement, the District is open to working with you. If it is not a factor of time, can you provide some more background as
to why the easement is not obtainable? When we reached out to the property owner’s engineer, they were responsive. Did they provide a reason why they were not willing to work with
you? We need to be absolutely certain this option is not feasible before accepting alternatives.
As for the option of extending the water main to the North, this option is still not in the District’s best interest because of the 80th unimproved right of way and inability to access
the water main for maintenance. Our understanding this option was not feasible before due to the critical area in that region, is that not the case anymore? Has there been discussions
with the City of Newcastle?

Sam/Bill, we’re unable to obtain the offsite water easement through the private property of parcel 3224059001. Given that we have 2 options.
Option 1, we can extend water north through the unopened public ROW and connect to Hazelwood. This option is roughly sketched on the attached. I understand Hazelwood wasn’t required
to extend due to access but if we do it, access would still not be achievable. You would have access at SE 80th and within the Canopy plat, but between those 2 points you’d have to
flush the line out from either side.
Alternatively, we can extend the water across our project frontage of the unopened ROW and provide the PRV as outlined in our DEA. Additionally, we can provide a tee and stub to the
end of existing ROW such that when/if parcel 3224059001 develops, they could make an easy connection and close the loop at that time.
We’re getting very close to our construction season for this project, and I want to get the onsite sewer and water plans back in to you for final review. Final consensus on this would
be greatly appreciated. Please let us know which option above is preferred by CCUD.

The water main that services this development extends into the Hazelwood Gardens Development from SE 80th ST then loops back into CCUD’s system on 113th Ave SE. See below for quick sketch.
The watermain was not extended to the west because of the steep grade and vegetation in the SE 80th St unimproved ROW, CCUD would have no access to the water main unless access is provided.

Hi Holli,
The plan sheet provided was only intended as a reference to a general location of where the District would like to place a hydrant. Currently there is no plan for a water main extension
to service this property. The plans provided are dated back in 2020 and this is the first we have heard about them while doing investigative work on the existing easement. The District
has to review developments independently and cannot rely on the hope that someday adjacent properties will develop. The current property owner has no contractual obligation or signed
DE agreement with the District and therefor we have to assume they may never develop. If the water main improvements are not part of the Canopy project and the adjacent property owner
never develops, then the District is left with an inadequate water system for water quality and fire flow.

Hi Sam, pardon my bluntness here but if a water extension is already planned to service this project, why are we being required to do it? That project would have full control of the
easement and could easily connect to the extension we provide within the unopened ROW. There was never any mention of a proposed project on this site before so we’re a bit surprised
by this. It really makes more sense that they do it with all of their improvements that way they have control with utility spacings, locations, elevations, etc. Our design would
place the water line at the required depth below existing grade, but their project may need to alter those grades, requiring adjustment or replacement anyway. Wouldn’t it be in everyone’s
best interest for each project to do it’s own water main extension?

I wanted to touch base with you and provide some updates with regards to the off-site improvements so your team can keep action items moving. We have made contact with the Engineer for
the subject property owner who’s property holds the existing sewer easement. The Engineers name is George Sheng and can be reached by his e-mail hometechwa@gmail.com <mailto:hometechwa@gmail.com>
. From our initial conversations with George it sounds like the property owner is receptive to revising the easement to 25’ and include the addition of the watermain. We have notified
George that you would reach out to work with them on revising the easement and go over the proposed watermain improvements with them.
As for the status on the District reviewing bonding options, Bill and Patrick are currently assessing options and will reach out to you following their discussions.

There is one more thing I would like to mention before you and Bill set up your chat. The District is going to require exhibits for the two design alternatives for their review. Please
develop exhibits for the two alternatives we have discussed, one exhibit for construction of the water main to the North and one exhibit for construction of water main to the East.
On these exhibits please identify the challenges and advantages of each alternative. These exhibits do not need to be a developed set of plans but need to include key items for discussion
like the proposed water main alignment, proposed PRV’s, profile of existing grades, existing easements, wetlands, critical areas, property lines, vegetation, proposed connections to
existing mains, etc.
Please let me know if you would like us to assist you with the creation of these exhibits and we will do so.

Bill, can we set up a time to chat about our options with the board. As we’ve noted we’re extremely concerned with the timing of all of this. The option to have a bond in place in
the event we don’t have full approval from Newcastle will allow us to move forward with engineering approval and construction. Would love to hear any options the board would allow
in this circumstance, I imagine this isn’t the first time something like this has come up.

Sorry for the delayed response. From our initial discussion you will likely need a clearing and grading permit, a critical areas permit, and depending when you construct potentially
a wet seasons permit. Although you will ultimately need to be confirm this with City when you start the permitting process.

We will need basemap and topo to confirm the exact location of the PRV, but it can be placed int the ROW. The District has access through an existing access road/sewer easement.
Bonding this work as separate projects is not District standard and would not be our decision to make, bonding in such a way would require consideration and approval by the District

Considering timing and wet season work, in the event the easements and permits with Newcastle cause delays, could this connection be bonded for such that it won’t hold up approval of

We have made contact with the Owner’s Engineer for the related property. From our initial discussion they are receptive to revising the easement to include the water main and allowing
the construction along the proposed route to the east of your property but they still need to confirm this with the Owner. We are currently waiting to hear back for confirmation but
will follow up with them early next week if we don’t get a response today. If the Owner for the adjacent property to the east agrees to revise the easement to include the water main,
then the District is still going to require the water main be looped as part of the Canopy project.
As for coordination with Newcastle, please see attached e-mail for additional information as the site is in an erosion hazard area.
The District would prefer to have the PRV located on Canopy’s property adjacent to 112th Ave SE. This is so the watermain in Alley 2 and respective properties remain in the same pressure
zone as the rest of the site development.

Thanks Sam. Understood regarding the plan/profile acceptance (we appreciate the understanding here and allowance to keep the plans as is).
Has there been any update/movement on getting the easement from the neighbors and coordination with Newcastle?
Considering our need to get into construction as soon as the wet season ends, we’re quite leery of timing here. We understand the need for a PRV and are willing to install it. Can
it be installed on the Canopy property or the unopened ROW along the east of the Canopy site? (Keep in mind for access/maintenance it would be better installed within the canopy project,
possibly within Tract C near Road A. Snipped with possible location clouded below).
Our though is that if we can provide the water extension through our project, the PRV, and extend the water line to our property line, then the looping through offsite easements and
Newcastle could be done as a separate permit. We’re still willing to pay a proportionate share if CCUD is willing to make the connection themselves as a part of a CCUD improvement
project.
Does this approach work for everyone?

Hope you had a good holiday as well. I will defer to Patrick if the District will allow a variance for the plan/profile.
Our team went out and visited the site today and took pictures of the existing easement for the sewer main east of the canopy project (pictures attached). Given the easement is well
maintained with no significant vegetation in the way of installing a water main, the District would like to continue to pursue this option as it is the most feasible for construction
and looping the main. To help facilitate this option, we are going to contact the property owner to request permission to install a water main while also coordinating with the City
of Newcastle to see what the permitting requirements will be for the site as it is in an erosion hazard area. As for the PRV, we will require per the water availability certificate
that a PRV be constructed at the bottom of (west end) the easement.
This is the best update I have for now but will keep you posted.

Sam – we’ve been looking into this further and we still feel this ask of CCUD is well beyond the scope of our project. We understand the districts want for a looped main but per our
water availability cert as well as the districts standards, extension to the property line is required and that is what we are providing.
Understanding that the district would like this extension in the future we are willing to discuss the idea of the Canopy project paying a proportionate share into a fund held by CCUD
for a future capital improvement project completed by CCUD. Adjoining properties of this extension could pay their fair share, or latecomer, at the time they develop. Given the timing
of the offsite permits and easements that would be needed for this, we’re asking the district to consider our proposal. This will allow for the Canopy project to maintain its construction
schedule without delay.
Please let us know if this is an acceptable compromise.

Hi Holli,
I understand this is a difficult scenario but I have to disagree that this work would not be feasible. Work for public and private utilities can still be performed in Landslide Hazard
slopes per the City of Newcastle Municipal Code 18.24.270.B. Unfortunately in my experience this would require a critical areas permit. I believe the City would accept this work especially
given the circumstance that our proposed alignment for the water main would be constructed under an existing developed gravel access roadway. Furthermore per the code, our work would
not increase risk of landslide or erosion and vegetation removal would be limited. I do agree that we would need to obtain private easements or amend the existing easement to 25’ and
to include both the new water and existing sewer.

Hi Sam, hope all is well. Hope you were able to enjoy a little time off over the recent holiday.
As previously discussed, we reviewed the options of extending the water main to create a loop for canopy and unfortunately it doesn’t appear to be feasible. The attached shows the 2
options but both go through critical areas with Landslide hazard slopes (which are protected). As well, option 1 required offsite private easements which we don’t have.
I do wish there was a better solution here but at this time I feel the best case is to extend the water main to our project limits, as shown in the second attachment, and when further
development occurs in the future, looping would be done at that time.
