PRIVATE STORM DRAINAGE EASEMENT
Grantor(s), Sierra Homes, Inc., the owner of Lots 35 & 36, in consideration of mutual
benefits, hereby grants to Grantee, Sierra Homes, Inc., the owner of Lots 34, 35 & 36,a
Private Storm Drainage Easement,the right to use an easement area on the property listed
in Exhibit A, the easement described in Exhibit B, and shown in Exhibit C, attached hereto
and by this made a part herein, for the purposes of constructing and installing,
reconstructing, replacing, repairing, rnaintaining,operating,and using a private storm
drainage system serving Lots 34, 35 & 36 to be located along the south side of Lots 35 &
36, and all necessary connection and appurtenances. The cost of maintenance, repairs or
reconstruction of those portions of the jointly-used storm drainage system shall be borne in
equal shares between those Grantees, owners of Lots 34, 35 & 36 that jointly use said storm
drainage system: no lot owner will be responsible to maintain any portion of the jointly-used
storm drainage system upstream from their point of connection. When necessary to repair,
clean or reconstruct the storm drainage system,the owners of Lots 34, 35 & 36 shall have a
right of entry for that purpose.
Grantor shall retain the right to use said easement area as long as said use does not interfere
with the easement rights conveyed therein.

At such time as title and possession of Lots 34,35 or 36 has been sold,transferred or
otherwise conveyed to any third party,said easement shall become effective and
binding.
The covenants herein shall run with the land and shall forever be binding on the Grantors',
and Grantees' heirs, successors,and assigns.
