covenants (covenantj with t�e City of Renton {"City of Renton"ar"City"), a municipal carporatian
of the state of Washingtan,that he/she{they)will observe,cansent to,and abide by the conditions
and obligations set forth and described in Paragraphs 1 through 9 beiow with regard to the
Property, and hereby grants (grant) an easerY►ent as described in Para�raphs 2 and 3. Grantor(s)

1. The Grantor(sE or his/her(their)successc�rs in interest and assigns("Owners")shall at their own
cost,operate, maintain,and keep in good repair,the Praperty's drainage facilities constructed
as req�aired in the approved constructian plans and specifications (PraJert
P�on�) an file with the City of Renton and subrnitted to the City of Rentan far the review and
approval of pefmit{s} (Consirucclon/BuFlding/UtilityPermir#).The
Property's drainage facilities are shown and/ar listed on Exhibit A—Site Plan. The Rroperty's
drainage facilities shall be maintained in campliance with the operation anci maintenanee
schedule included and attached herein as Exhibit B—Operatians and Maintenance. Drainage
facilities include pipes, channels, fiaw contral faciiities, water quality facilities, an-site best
management practices (BMPsy and ather engineered structures deslgned to rnanage and/ar

treat stormwater on the Praperty. C}n-site BMPs include dispersion and infiltratian devices,
bioretention, permeable pavements, rainwater harvestirtg systems, tree retention credit,
reduced imperviaus surface footprint,vegetated roofs and other measures designed ta mimic
pre-develaped hydrology and minirnize starmwater runoff on the Properky.
2. City of Rentan shall have the right to ingress and egress over those portions of the Property
necessary to perfarm inspections of the stormwater facilities and BMPs and conduct
maintenance activities specified in this Dectaratian af Covenant and in accardance with the
Renton Municipal Code. City af Renton shall provide at least thirCy(30)days'written notice to
the Owners that entry an the Property is planned for the inspectian af drainage facilities.After
the thirty (30) days,tF�e Owners shall aflow the City of Renton to enter for the sale purpose of
inspecting drainage facilities, In lieu af inspection by tMe City,the Owners may elect to engage
a licensed civil engineer registered in the state of Washington who has expertise in drainage ta
inspect the drainage facilities and provide a written report describing their condition. If the
engineer aptian is chosen,the Owners shall provide written notice ta the City of Renton within
fiReen (�5)days af receiving the City's natice of inspectian.Within thirty�30�days of giving this
notice,the Owners,ar engineer on behalf of the Owners,shall provEde the engineer"s report to
the City csf Renton. If the report is not pravided in a timely manner as specified above,the City
of Renton may inspect the draina�e facilities without further natice.
3. If City af Rentan determines from its inspection, or fram an engineer's report provided in
accordance with Paragraph 2,that maintenance, repair, restoration, and/or mitigatian work is
required to be done to any af the drainage facilities, City at Rentor�shall natify the Owners af
the specific maintenance, repair, restoratian, and/ar miti�gation wcrrk ("Work"j required
pursuant ta the Renton Municipal Gade.The City �hall also set a reasonable deadlifle for the
Owners to campCete the Work, �r to provide an engineer's report that verifies campletian of
the Work. After the deadline has passed, the O�wners shalt allow the City access to re-inspeck
the drainage #acilities unless an engineer's re�nrt has been prnvided verifying completion af
the Work. lf the Wark is not completed within the tirne frame set by the City, the City may
initiate an enforcement action and/or perforrn the Work and hereby is given access to the
Praperty for such purposes. Written notice wifl be sent to the Owners stating the City's
intention to perform such Work.This Work will not commence until at least seven(7)days after
such natice is mailed. If, within the sole disc�etion of the City, there exists an imminent ar
present danger, the seven (7) day r�otice periad will be waived and Wark will begin
immediately.
4. The Owners shall assume all responsibility far the east af any Wark, or any measures taken by
the Gity to address conditions as described in Paragraph 3. Such responslbility shall include
reimbursement to the City within thirty(3Q)days of the receipt of the invoice far any such Work
performed. Oaerdue payrnents will require payrnent of interest at the maximurn legal rate
allawed by RCW 19.52.020(currently twelve perceni(12%)). If the City initiates legal action to
enfarce tF�is agreement, the prevailing party in such actian is errtitled to recover reasonable
litigation costs and attorney's fees.
5, The tJwners are required to obtain wrifiten appraval from City of Renton prior to filling, piping,
cutting, or removing vegetation (except in routine landscape rnaintenance) in open vegetated
storrnwater facilities (such as swales, channels, ditc9�es, ponds, etc.), or performing a�y
alterations or modifications to the drafnage facilities referenced in this Declaratian of Covenant.

6. Any notice ar consent required ta be given or ath�rwise provided for by the provisions of this
Agreement shall be effective upon personal delivery,or three(3) days after mailing by Certified
Mail, ret�rn receipt requested.
7. With regard to the matters addressed herein,this agreement constitutes the entire agreement
b�etween the parties, and supersedes alt prior discussians, negotiations, and all agre�ments
whatsaever whether oral or w�itten.
8. 7his [�eclaration of Covenant is intended to protect the value and desirability and pramate
efficient and effective management of surface water drainage af the real property describ�d
above, and shalf inure to the benefit af all the citizens of the Gity af Renton and its succ�ssors
and assigns. 7his Declaratican of Cavenant shall run with the land and be binding upon
Grantor(s), and Grantar's(s')successors in interest,and assigns.
9. This Declaratian of Covenant may be terminated by execution of a written agreement by the
Owners and the City that is recorded by King Caunty in its real property records.
