PROPOSAL DESCRIPTION: The applicant is requesting a Shoreline Substantial Development
Permit and Environmental (SEPA) Review for the installation of a new residential dock at 3101 Mountain View Ave N.
The project site is located within the Residential-8 (R-8) zone. The proposal is to install 20 new 8" steel piles and
construct a 613 sq ft dock covered by grated decking material. The proposal includes a 25-foot planted buffer along the
Lake Washington Shoreline. The project site abuts Lake Washington, a Shoreline of the State, and is within reach E and
the Shoreline Residential and Aquatic designations. The project site is mapped with a Moderate Landslide Hazard Area.
An Environmental (SEPA) Review Determination of Non-Significance-Mitigated (DNS-M) was issued for this project on
May 16, 2022. The appeal period of the determination ends on May 31, 2022.
FINDINGS OF FACT:
1.The applicant is requesting a Shoreline Substantial Development Permit for the construction of a residential
dock for the use of an upland residential property owner.
2.The landward portion of the site currently is developed with an existing single-family residence and detached
garage.
3.The proposed dock would have a width of 3’10” a length of 159’10”, would be supported by 20 new 8” steel
piles and covered by grated decking material.
4.The proposed dock would provide boat moorage, which would facilitate access to Lake Washington for use by
the property owner.
5.The dock would result in approximately 613 sq. ft. of new overwater coverage. ThruFlow grated decking has a
measured performance at 43 percent light penetration. Using grated decking results in an effective reduction
of overwater coverage of 264 sq. ft.
6.New residential docks are permitted when a shared/joint-use dock is not available.
7.The subject site has priority habitat and is located in areas regulated by the City of Renton Shoreline Master
Program for Lake Washington.
8.There is a moderate landslide hazard area mapped on the upland portion of the project site, however the
installation of the dock would largely occur below the Ordinary High Water Mark (OHWM) and would not
require additional geotechnical analysis.
9.The proposed dock installation would not require the removal of existing trees or other significant vegetation.
10.The proposed dock would be located on the least sensitive portion of the project site.
11.Representatives from various city departments have reviewed the application materials to identify and address
issues raised by the proposed development. These comments are contained in the official file, and the essence
of the comments have been incorporated into the appropriate sections of this report, the Environmental (SEPA)
Review Report, and the Departmental Recommendation at the end of this report.
12.An Environmental (SEPA) Review Determination of Non-Significance-Mitigated (DNS-M) was issued for this
project on May 16, 2022. The appeal period of the determination ends on May 31, 2022. No appeals have been
filed as of the date of this decision.

13.Based on an analysis of probable impacts from the proposal, the Environmental Review Committee (ERC) issued
the following mitigation measures with the Determination of Non-Significance – Mitigated:
1.Project construction shall comply with the recommendations outlined in the submitted Lake Study/No Net
Loss Determination including but not limited to planting trees and other vegetation along the shoreline and
implementing the Best Management Practices during construction.
2.The applicant shall also submit the planting plan as-builts and annual monitoring reports required by the
Army Corp of Engineers for five (5) to the City to ensure there is no net loss of ecological functions.
3.A surety device shall be required to ensure the mitigation performance standards are met. The surety device
shall be sufficient to guarantee that structures, improvements, and mitigation required by permit condition
perform satisfactorily for a minimum of five (5) years after they have been completed.
14.A Lake Study, prepared by Northwest Environmental Consulting, LLC, dated May 2022 (Exhibit 3) was submitted
with the project application. The Lake Study states that with the mitigation proposed for this project, there
would be no net loss of ecological functions and values.
15.The following table contains project elements intended to comply with the Shoreline Master Program standards
and policies, as outlined in RMC 4-3-090:
SHORELINE MASTER PROGRAM CRITERIA:
A.COMPREHENSIVE PLAN COMPLIANCE AND CONSISTENCY, SHORELINE ELEMENT:
The site is located in the Shoreline Residential and Aquatic Overlay Districts. The objective of the Residential
Shoreline Overlay District is to accommodate residential development and appurtenant structures that are
consistent with this chapter. The objective of the Aquatic designation is to protect, restore, and manage the
unique characteristics and resources of the areas waterward of the ordinary high water mark. The proposal is
compliant with the following Shoreline policies:
✓Objective SH-A. Provide for use of the limited water resource consistent with the goals of the
Shoreline Management Act by providing a preference for water-oriented uses.
✓
Objective SH-B. Provide that the policies, regulations, and administration of the Shoreline
Master Program ensure that new uses, development, and redevelopment within the shoreline
jurisdiction do not cause a net loss of shoreline ecological functions.
✓Policy SH-7. Existing and future activities on all Shorelines of the State regulated by the City of
Renton should be designed to ensure no net loss of ecological functions.
✓
Policy SH-14. Shoreline use and development should be carried out in a manner that prevents
or mitigates adverse impacts so that the resulting ecological condition does not become worse
than the current condition. This means ensuring no net loss of ecological functions and processes
in all development and use. Permitted uses should be designed and conducted to minimize, in so
far as practical, any resultant damage to the ecology and environment (RCW 90.58.020). Shoreline
ecological functions that should be protected include, but are not limited to, fish and wildlife
habitat, food chain support, and water temperature maintenance. Shoreline processes that shall
be protected include, but are not limited to, water flow; littoral drift; erosion and accretion;
infiltration; ground water recharge and discharge; sediment delivery, transport, and storage; large
woody debris recruitment; organic matter input; nutrient and pathogen removal; and stream
channel formation/maintenance.

B.DEVELOPMENT STANDARDS:
The subject site where the pier will be located is classified as Shoreline Residential and Aquatic on the City of
Renton Shoreline Overlay Map. The following development standards are applicable to the proposal:
1.No Net Loss of Ecological Functions Required
✓
Shoreline use and development shall be carried out in a manner that prevents or mitigates
adverse impacts to ensure no net loss of ecological functions and processes in all development
and use. Permitted uses are designed and conducted to minimize, in so far as practical, any
resultant damage to the ecology and environment (RCW 90.58.020). Shoreline ecological
functions that shall be protected include, but are not limited to, fish and wildlife habitat, food
chain support, and water temperature maintenance. Shoreline processes that shall be protected
include, but are not limited to, water flow; erosion and accretion; infiltration; groundwater
recharge and discharge; sediment delivery, transport, and storage; large woody debris
recruitment; organic matter input; nutrient and pathogen removal; and stream channel
formation/maintenance.
Impact Evaluation Required: In assessing the potential for net loss of ecological functions or
processes, project-specific and cumulative impacts shall be considered and mitigated on- or off-
site.
Evaluation of Mitigation Sequencing Required: An application for any permit or approval shall
demonstrate all reasonable efforts have been taken to provide sufficient mitigation such that the
activity does not result in net loss of ecological functions. Mitigation shall occur in the following
prioritized order:
(a)Avoiding the adverse impact altogether by not taking a certain action or parts of an
action, or moving the action.
(b)Minimizing adverse impacts by limiting the degree or magnitude of the action and its
implementation by using appropriate technology and engineering, or by taking
affirmative steps to avoid or reduce adverse impacts.
(c)Rectifying the adverse impact by repairing, rehabilitating, or restoring the affected
environment.
(d)Reducing or eliminating the adverse impact over time by preservation and
maintenance operations during the life of the action.
(e)Compensating for the adverse impact by replacing, enhancing, or providing similar
substitute resources or environments and monitoring the adverse impact and taking
appropriate corrective measures.
Staff comment: The applicant submitted a Lake Study (Exhibit 3), prepared by Northwest
Environmental Consulting, LLC, dated May 2022 with the project application materials. The report
includes an evaluation of mitigation sequencing. The proposed dock would be located on a portion
of the site that would result in no vegetation removal thereby avoiding impacts to existing
vegetation. Construction impacts, including noise disturbance of sediments during piling
installation would be minimized by using Best Management Practices (BMPs) during project
construction and by limiting the number of piles to 20 as well as limiting the diameter of the piles
to 8”. The proposed dock has been designed to rectify impacts to Lake Washington through the

use of grated decking, limiting the width (3’10”), and through the proposal to place moorage in
the deepest water possible at the site. To mitigate for long term impacts of the proposed dock,
the applicant is proposing to plant three (3) western red cedars, two (2) shore pine, four (4) nootka
rose, and three (3) mock orange along the shoreline. These proposed plantings would provide
overhanging cover, structural diversity for birds and wildlife, detritus for aquatic invertebrates and
long-term recruitment of woody material and other allochthonous food sources for aquatic
invertebrates and fish. It is anticipated that the benefits of these plantings would reduce the
impacts of the dock overtime. The study concludes that with the mitigation plantings proposed
the proposed dock would result in no net loss of ecological functions at the site.
2.Burden on Applicant

Applicants for permits have the burden of proving that the proposed development is consistent
with the criteria set forth in the Shoreline Master Program and the Shoreline Management Act,
including demonstrating all reasonable efforts have been taken to provide sufficient mitigation
such that the activity does not result in net loss of ecological functions.
Staff Comment: The applicant has submitted a Lake Study (Exhibit 3) that demonstrates that the
proposed dock, as mitigated, woud not result in a net loss of ecological functions and values on
the project site, which is consistent the the City of Renton’s Shoreline Master Program and the
Shoreline Management Act.
3.View Obstruction and Visual Quality
N/A
View Corridors Required: Where commercial, industrial, multiple use, multi-family and/or multi-
lot developments are proposed, primary structures shall provide for view corridors between
buildings where views of the shoreline are available from public right-of-way or trails.
Staff comment: Not applicable, the proposal does not include commercial, industrial, multiple use,
multi-family and/or multi-lot developments.

Maximum Building Height: Buildings shall be limited to a height of no more than 35 feet above
average finished grade level except at specific locations.
Staff comment: The lift is less than 35 feet in height above the waterline.

Minimum Setbacks for Commercial Development Adjacent to Residential or Park Uses: All new or
expanded commercial development adjacent to residential use and public parks shall provide
fifteen feet setbacks from adjacent properties to attenuate proximity impacts such as noise, light
and glare, and may address scale and aesthetic impacts. Fencing or landscape areas may be
required to provide a visual screen.
N/A
Lighting Requirements: Display and other exterior lighting shall be designed and operated so as
to prevent glare, to avoid illuminating nearby properties used for noncommercial purposes, and
to prevent hazards for public traffic. Methods of controlling spillover light include, but are not
limited to, limits on the height of light structure, limits on light levels of fixtures, light shields, and
screening.
Staff comment: Not applicable, no lighting is proposed as part of this project.
N/A Reflected Lights to Be Limited: Building surfaces on or adjacent to the water shall employ
materials that limit reflected light.

Integration and Screening of Mechanical Equipment: Building mechanical equipment shall be
incorporated into building architectural features, such as pitched roofs, to the maximum extent
feasible. Where mechanical equipment cannot be incorporated into architectural features, a
visual screen shall be provided consistent with building exterior materials that obstructs views of
such equipment.
Staff comment: Not applicable, no mechanical equipment is proposed as part of this project.

Visual Prominence of Freestanding Structures to Be Minimized: Facilities not incorporated into
buildings including fences, piers, poles, wires, lights, and other freestanding structures shall be
designed to minimize visual prominence.
Staff comment: The dock would primarily be located below the water surface. Therefore the
structure would not have a significant visual prominence when viewed from neighboring homes
or the shoreline in general.

Maximum Stair and Walkway Width: Stairs and walkways located within shoreline vegetated
buffers shall not exceed four feet in width; provided, that where ADA requirements apply, such
facilities may be increased to six feet in width. Stairways shall conform to the existing topography
to the extent feasible.
Staff comment: No stair or walkways are proposed within buffers. The width of the proposed dock
would be 3’10”, which is less than the four foot (4’)-maxmimum width permitted.
4.Community Disturbances:
✓
Noise, odors, night lighting, water and land traffic, and other structures and activities shall be
considered in the design plans and their impacts avoided or mitigated.
Staff comment: The project is not anticipated to generate noise, odors, lighting issues, or other
water and land traffic disturbances beyond those that are part of water and boating related
activities on the lake and that occur with a residential pier and moorage facility.
5.Public Access:
Physical or visual access to shorelines shall be incorporated in all new development when the development
would either generate a demand for one or more forms of such access, would impair existing legal access
opportunities or rights, or is required to meet the specific policies and regulations of the Shoreline Master
Program.
N/A
Lake Washington Reach E: Public access shall be provided when lots are subdivided or new
nonresidential development occurs consistent with standards of this Section.
Staff comment: The project proposal includes the addition of a residential dock to an existing single
family residence. No subdivision or nonresidential development is proposed; therefore the public
access requirement is not applicable.
6.Building and Development Location – Shoreline Orientation

Shoreline developments shall locate the water-dependent, water-related, and water-enjoyment portions of their
developments along the shoreline. Development and use shall be designed in a manner that directs land
alteration to the least sensitive portions of the site to maximize vegetation conservation; minimize impervious
surfaces and runoff; protect riparian, nearshore and wetland habitats; protect wildlife and habitats; protect
archaeological, historic and cultural resources; and preserve aesthetic values

Minimization of Site Alteration: Development shall minimize site alteration in sites with
substantial unaltered natural features by applying the following criteria:
(a) Vehicle and pedestrian circulation systems shall be designed to limit clearing, grading, and
alteration of topography and natural features.
(b) Impervious surfacing for parking lot/space areas shall be limited through the use of under-
building parking or permeable surfaces where feasible.
(c) Utilities shall share roadway and driveway corridors and rights-of-way wherever feasible.
(d) Development shall be located and designed to avoid the need for structural shoreline
stabilization over the life of the development. Exceptions may be made for the limited instances
where stabilization is necessary to protect allowed uses, particularly water-dependent uses,
where no alternative locations are available and no net loss of ecological functions will result.
Staff comment: The construction of the proposed dock would required minimual site alteration.
No trees or significant vegetation removal is proposed as part of the dock construction. The
decking proposed on the dock would consist of grated decking to allow light and rainwater to pass
through the dock. No new utilities are proposed, however there is an existing City of Renton sewer
main that has been mapped that would be located underneath the proposed dock. The proposed
pilings would be setback a minmum of five feet (5’) from the sewer line as required by the City’s
sewer utlity section. The proposed dock is not anticipated to result in additional shoreline
stabilization on the project site.
Applicable BMPs are proposed to be implemented during project construction, including but not
limited to: construction activities ocurring during the in-water work window, the installation of a
floating boom around the in-water work area to contain any floating debris that may escape
during construction, a perimeter containment sock around the barge to absorb oil and grease that
may wash from the barge during construction, and hazardous material containment materials
such as spill absorbent pads and trained personnel would be onsite during any phase of
construction where machinery is in operation near surface waters.

Location for Accessory Development: Accessory development or use that does not require a
shoreline location shall be located outside of shoreline jurisdiction unless such development is
required to serve approved water-oriented uses and/or developments or unless otherwise
allowed in a High Intensity designation. When sited within shoreline jurisdiction, uses and/or
developments such as parking, service buildings or areas, access roads, utilities, signs and storage
of materials shall be located inland away from the land/water interface and landward of water-
oriented developments and/or other approved uses unless a location closer to the water is
reasonably necessary.
✓Navigation and Recreation to Be Preserved: Shoreline uses shall not deprive other uses of
reasonable access to navigable waters. Existing water-related recreation shall be preserved.

Staff comment: The proposed dock would be located within the property boundaries of the project
site and would not encroach past the inner harbor line of Lake Washington or impede access to
navigable waters.
7.Archaeological, Historical, and Cultural Resources:

Detailed Cultural Assessments May Be Required: The City will work with tribal, State, Federal,
and other local governments as appropriate to identify significant local historical, cultural, and
archaeological sites in observance of applicable State and Federal laws protecting such
information from general public disclosure. Detailed cultural assessments may be required in
areas with undocumented resources based on the probability of the presence of cultural
resources.
Staff comment: The project proposal and notice of application were provided to reviewing
agencies including the State Department of Archaeology & Historic Preservation (DAHP), and the
Duwamish and Muckleshoot Tribes as part of the SEPA review process. No agency comments
were provided that require any additional assessments or mitigation measures related to
archaeological, historical, and cultural resources.

Coordination Encouraged: Owners of property containing identified or probable historical,
cultural, or archaeological sites are encouraged to coordinate well in advance of application for
development to assure that appropriate agencies such as the Washington State Department of
Archaeology and Historic Preservation, affected tribes, and historic preservation groups have
ample time to assess the site and identify the potential for cultural resources.

Detailed Cultural Assessments Required: Upon receipt of application for a development in an area
of known or probable cultural resources, the City shall require a site assessment by a qualified
professional archaeologist or historic preservation professional and ensure review by qualified
parties including the Washington State Department of Archaeology and Historic Preservation,
affected tribes, and historic preservation groups.

Work to Stop Upon Discovery: If historical, cultural, or archaeological sites or artifacts are
discovered in the process of development, work on that portion of the site shall be stopped
immediately, the site secured, and the find reported as soon as possible to the Administrator of
the Department of Community and Economic Development or designee. Upon notification of such
find, the property owner shall notify the Washington State Department of Archaeology and
Historic Preservation and affected tribes. The Administrator of the Department of Community and
Economic Development or designee shall provide for a site investigation by a qualified
professional and may provide for avoidance, or conservation of the resources, in coordination
with appropriate agencies.

Access for Educational Purposes Encouraged: Land owners are encouraged to provide access to
qualified professionals and the general public if appropriate for the purpose of public education
related to a cultural resource identified on a property.

8.Standards for Density, Setbacks, and Height – Activities Exempt from Buffers and Setbacks
The following development activities are not subject to buffers and setbacks; provided, that they are constructed
and maintained in a manner that minimizes adverse impacts on shoreline ecological functions; and provided
further, that they comply with all the applicable regulations in RMC Title IV.

Water-Dependent Development: Those portions of approved water-dependent development
that require a location waterward of the OHWM of streams, rivers, lakes, ponds, marine
shorelines, associated wetlands, and/or within their associated buffers.
Staff comment: The proposed dock would be considered water-dependent development and
would therefore not be subject to the vegetation conservation buffer or building setback
requirements.
9.Use Regulations: Boat Moorage, such as piers and docks, is permitted in the Aquatic Shoreline Overlay
District as it is water dependent pursuant to the Shoreline Use Table RMC 4-3-090E.1.
Piers and Docks:
✓
a.General criteria for use and approval of all new expanded piers and docks:
i. Piers and docks shall be designed to minimize interference with the public use and
enjoyment of the water surface and shoreline, nor create a hazard to navigation.
ii. The dock or pier shall not result in the unreasonable interference with the use of adjacent
docks and/or piers.
iii. The use of floating docks in lieu of other types of docks is to be encouraged in those areas
where scenic values are high and where substantial conflicts with recreational boaters and
fishermen will not be created.
iv. The expansion of existing piers and docks is preferred over the construction of new.
v. The responsibility rests on the applicant to affirmatively demonstrate the need for the
proposed pier or dock in his/her application for a permit, except for a dock accessory to a
single family residence on an existing lot.
vi. All piers and docks shall result in no net loss of ecological functions. Docks, piers, and
mooring buoys, including those accessory to single family residences, shall avoid, or if that is
not possible, minimize and mitigate adverse impacts to shoreline ecological functions such
that no net loss of ecological functions results.
vii. Over-water construction not required for moorage purposes is regulated as a recreation
use.
viii. New or expanded piers and docks allowed for water-dependent uses shall be consistent
with the following criteria:
(a) Water-dependent uses shall specify the specific need for over-water location and shall be
restricted to the minimum size necessary to meet the needs of the proposed water-dependent
use.
(b)Water-related, water-enjoyment and multiple uses may be allowed as part of a dock or pier
to serve as water-dependent use structures where they are clearly auxiliary to and in support

of water-dependent uses, provided the minimum size requirement needed to meet the water-
dependent use is not violated.
(c) Public access is required over all docks utilizing public aquatic lands that serve water-
dependent uses, water-enjoyment uses and multiple uses, provided it does not preclude the
water-dependent use.
(d) The dock or pier length shall not extend beyond a length necessary to provide reasonable
and safe moorage.
b. Additional criteria for new or expanded residential docks:
i. Single Family Docks:
(a)Single Family Joint Use Docks: A pier or dock which is constructed for private recreation
moorage associated with a single family residence, for private joint use by two or more single
family waterfront property owners, or a community pier or dock in new waterfront single
family subdivision, is considered a water-dependent use; provided, that it is designed and used
only as a facility to access watercraft owned by the occupants, and to incidental use by
temporary guests. No fees or other compensation may be charged for use by nonresidents of
piers or docks accessory to residences.
(b) Individual Single Family Docks: The approval of a new dock or pier or a modification or
extension of an existing dock or pier shall include a finding that the following criteria have been
met:
(1) A new dock providing for private recreational moorage for an individual lot may not be
permitted in subdivisions approved on or before January 28, 1993, unless shared moorage is
not available, and there is no homeowners association or other corporate entity capable of
developing shared moorage.
(2) A new dock shall not be allowed for an individual lot in cases where a joint use dock has
been constructed to serve the subject lot.
(3) Prior to approval of a new dock for private recreational moorage for an individual lot, the
owner should demonstrate that adjacent owners have been contacted and they have declined
to develop or utilize a shared dock. Such information should be provided in the project
narrative at the time of permit submittal.
(4)A new dock should be approved only in cases where use of a mooring buoy is demonstrated
to be impractical for reducing over-water coverage.
c. Design criteria:
i. Pier Type: All piers and docks shall be built of open pile construction except that floating
docks may be permitted where there is no danger of significant damage to an ecosystem,
where scenic values are high and where one or more of the following conditions exist:
(a) Extreme water depth, beyond the range of normal length piling.
(b) A soft bottom condition, providing little support for piling.
(c) Bottom conditions that render it not feasible to install piling.
ii. Construction and Maintenance: All piers and docks shall be constructed and maintained in
a safe and sound condition.

iii. Approach: Approaches to piers and docks shall consist of ramps or other structures that
span the entire foreshore to the point of intersection with stable upland soils. Limited fill or
excavation may be allowed landward of the OHWM to match the upland with the elevation of
the pier or dock.
iv. Materials: Applicants for the new construction or extension of piers and docks or the repair
and maintenance of existing docks shall use materials that will not adversely affect water
quality or aquatic plants and animals over the long term. Materials used for submerged
portions of a pier or dock, decking, and other components that may come in contact with water
shall be approved by applicable State agencies for use in water to avoid discharge of pollutants
from wave splash, rain or runoff. Wood treated with creosote, pentachlorophenol or other
similarly toxic materials is prohibited. Pilings shall be constructed of untreated materials, such
as untreated wood, approved plastic composites, concrete or steel.
v. Pilings: Pile spacing shall be the maximum feasible to minimize shading and avoid a “wall”
effect that would block or baffle wave patterns, currents, littoral drift, or movement of aquatic
life forms, or result in structure damage from driftwood impact or entrapment. The first piling
set shall be spaced at the maximum distance feasible to minimize shading and shall be no less
than eighteen feet (18'). Pilings beyond the first set of piles shall minimize the size of the piles
and maximize the spacing between pilings to the extent allowed by site-specific engineering
or design considerations.
vi. Minimization of Nearshore Impacts: In order to minimize impacts on nearshore areas and
avoid reduction in ambient light level:
(a)The width of piers, docks, and floats shall be the minimum necessary to serve the proposed
use.
(b) Ramps shall span as much of the nearshore as feasible.
(c) Dock surfaces shall be designed to allow light penetration.
(d) Lights shall avoid illuminating the water surface. Lighting facilities shall be limited to the
minimum extent necessary to locate the pier or dock at night for docks serving residential uses.
Lighting to serve water-dependent uses shall be the minimum required to accommodate the
use and may not be used when the water-dependent aspects of the use are not in operation.
vii. Covered Moorage: Covered moorage is not allowed on any moorage facility unless
translucent materials are used that allow light penetration through the canopy, or through the
roof of legal, pre-existing boat houses. Temporary vessel covers must be attached to the
vessel. New boat houses are not allowed.
viii. Seaplane Moorage: Seaplane moorage may be accommodated at any dock that meets the
standards of the Shoreline Master Program.
ix. Other Agency Requirements: If deviation from the design standards specified in subsection
E7 of this Section, Piers and Docks, is approved by another agency with permitting authority,
such as the Washington Department of Fish and Wildlife or the U.S. Army Corps of Engineers,
it shall be approved with a variance, subject to all conditions and requirements of those
permitting agencies.
d. Design standards
Single Family dwellings are permitted a maximum of one pier or dock per developed waterfront
lot or ownership. Maximum length is eighty feet (80') unless a depth of ten feet (10') cannot be
obtained. In such circumstances the dock may be extended until the water depth reaches a point

This Permit is granted pursuant to the Shoreline Management Action of 1971 and pursuant to the following:
1.The issuance of a license under the Shoreline Management Act of 1971 shall not release the applicant from
compliance with federal, state, and other permit requirements.
2.This permit may be rescinded pursuant to Section 14(7) of the Shoreline Management Act of 1971 in the event
the permittee fails to comply with any condition(s) hereof.
3.Construction permits shall not be issued until t21 days after approval by the Washington State Department of
Ecology or until any review proceedings initiated within this twenty-one (21)-day review period have been
completed.
4.The proposed dock may require additional permits from other state and federal agencies. It is the applicant’s
repsonsiblity to obtain all necessary permits.
5.Project construction shall be required to comply with the Mitigation Measure adopted as part of the DNS-M issued
on May 16, 2022:
a.Project construction shall comply with the recommendations outlined in the submitted Lake Study/No
Net Loss Determination including but not limited to planting trees and other vegetation along the
shoreline and implementing the Best Management Practices during construction.
b.The applicant shall also submit the planting plan as-builts and annual monitoring reports required by the
Army Corp of Engineers for five (5) to the City to ensure there is no net loss of ecological functions.

No portion of a pier or dock may lie closer than 5 ft. to an adjacent property line and may not
interfere with navigation.
Staff comment: The proposed dock would not interfere with the public use of Lake Washington,
nor create a navigation hazard as there are existing docks in the vicinity of the proposed dock that
are of similar length. The proposed dock would not impede access to neighboring docks as it would
be located approximately 41 feet from the existing dock to the south and 126 feet from the dock
to the north.
There is not existing dock located on the project site and there is not joint-use or community dock
accessible to the property owner. The abutting properties each have their own developed docks
for their own private use, so there does not appear to be an opportunity to develop a joint-use
dock along the shared property line.
The proposed dock would have a total length of one hundred fifty nine feet (159’-10”), which would
exceed the maximum length permitted of eighty feet (80’), however the additional length is
required due to the shallow lake depth at this location. The lake depth at the maximum dock extent
is only six feet (6’), which is less than the ten foot (10’) depth required to exceed the eighty foot
(80’) maximum length required.
The proposed dock with have a width of three feet, ten inches (3’10”), which is less than the four
foot (4’)-maximum width permitted. The proposed dock would be setback approximately ten feet
(10’) from the south property line and ninety seven feet (97’) from the north property line, which
exceeds the five foot (5’) minimum setback.
The proposed project would result in the driving of 20 eight inch (8”)-diameter steel piles, which
would be spaced no closer than eleven feet, nine inches (11’9”) apart. In addition, as previously
mentioned, the dock surface would be a grated surface (Thruflow) to allow for light penetration.
No lights were identified on the proposed plans.

c.A surety device shall be required to ensure the mitigation performance standards are met. The surety
device shall be sufficient to guarantee that structures, improvements, and mitigation required by permit

APPEALS: Appeals of Shoreline Substantial Development Permit issuance must be made directly to the Shorelines Hearings
Board. Appeals are made by filing a request in writing within the 21 days of receipt of the final order and concurrently
filing copies of such request with the Washington State Department of Ecology and the Attorney General’s office as
provided in section 18(1) of the Shorelines Management Act of 1971. All copies of appeal notices shall also be filed with
the City of Renton Planning Division and the City Clerk’s office.
EXPIRATION: Unless a different time period is specified in the shoreline permit as authorized by RCW 90.58.143 and
subsection J1 of RMC 4-9-190, construction activities, or a use or activity, for which a permit has been granted pursuant
to this Master Program must be commenced within two (2) years of the effective date of a shoreline permit, or the
shoreline permit shall terminate, and a new permit shall be necessary. However, the Planning Division may authorize a
single extension for a period not to exceed one year based on reasonable factors, if a request for extension has been filed
with the Planning Division before the expiration date, and notice of the proposed extension is given to parties of record
and the Washington State Department of Ecology. DEFINITION OF COMMENCEMENT OF CONSTRUCTION ACTIVITIES: the
construction applications must be submitted, permits must be issued, and foundation inspections must be completed
before the end of the two (2) year period.

A. Constant vigilance shall be kept for the presence of protected fish species during all aspects of the
proposed action, particularly during in-water activities such as vessel movement, deployment of anchors &
spuds, pile driving, dredging, and placement of gravels and other fill.
1. The project manager shall designate an appropriate number of competent observers to survey the project
site and adjacent areas for protected species, including the presence of fish as conditions allow.
2. Visual surveys shall be made prior to the start of work each day, and prior to resumption of work following
any break of more than an hour. Periodic additional visual surveys throughout the work day are strongly
recommended.
3. All in-water work shall be done during the in-water work window for the waterbody. Where there is a
difference between the USCOE and WDFW work windows, the overlap of the two shall apply.
4. All pile driving and extraction shall be postponed or halted when obvious aggregations or schooling of fish
are observed within 50 yards of that work, and shall only begin/resume after the animals have voluntarily
departed the area.
5. When piloting vessels, vessel operators shall operate at speeds and power settings to avoid grounding
vessels, and minimize substrate scour and mobilization of bottom sediments.
B. No contamination of the marine environment shall result from project-related activities.
1. Appropriate materials to contain and clean potential spills shall be stored and readily available at the work
site and/or aboard project-related vessels.
2. The project manager and heavy equipment operators shall perform daily pre-work equipment inspections
for cleanliness and leaks. All heavy equipment operations shall be postponed or halted should a leak be
detected, and shall not proceed until the leak is repaired and the equipment is cleaned.
3. To the greatest extent practicable, utilize biodegradable oils for equipment that would be operated in or
near water.
4. Fueling of land-based vehicles and equipment shall take place at least 50 feet away from the water,
preferably over an impervious surface. Fueling of vessels shall be done at approved fueling facilities.
5. Turbidity and siltation from project-related work shall be minimized and contained through the appropriate
use of erosion control practices, effective silt containment devices, and the curtailment of work during
adverse weather and tidal/flow conditions.
6. All wastes shall be collected and contained for proper disposal at approved upland disposal sites
appropriate for the material(s).
7. When removing piles and other similarly treated wood, containment booms must fully enclose the work
area. Wood debris, oils, and any other materials released into lake waters must be collected, removed,
and properly disposed of at approved disposal sites.
8. All in- and over-water wood cutting would be limited to the minimum required to remove the subject wood
component, and all cutting work should be enclosed within floating containment booms.
9. When removing piles, no actions shall be taken that would cause adhering sediments to return to lake
waters.
10.Above-water containment shall be installed around removed piles to prevent sediment laden waters from
returning to lake waters.
11.Construction staging (including stocking of materials, etc.) will occur on the supply barge.
12.All Exposed wood to be used on the project will be treated with a cheminite treatment.

2.The property owner will implement and abide by the shoreline planting plan. The plants shall be installed before or
concurrent with the work authorized by this permit. A report, as-built drawing and photographs demonstrating the plants
have been installed or a report on the status of project construction will be submitted to the U.S. Army Corps of Engineers,
Seattle District, Regulatory Branch, within 12 months from the date of permit issuance. This reporting requirement may be
met by completing and submitting a U.S. Army Corps of Engineers approved Report for Mitigation Work Completion form.
3.The property owner will maintain and monitor the survival of installed shoreline plantings for five years after the U.S. Army
Corps of Engineers accepts the as-built report. Installed plants shall achieve 100% survival during monitoring Years 1 and 2.
Installed plants shall achieve at least 80% survival during monitoring Years 3, 4 and 5. Percent survival is based on the total
number of plants installed in accordance with the approved riparian planting plan. Individual plants that die will be replaced
with native riparian species in order to meet the survival performance standards.
4.The property owner will provide annual monitoring reports for five years (Monitoring Years 1-5). Each annual monitoring
report will include written and photographic documentation on plant mortality and replanting efforts and will document
whether the performance standards are being met. Photos will be taken from established points and used repeatedly for each
monitoring year. In addition to photos at designated points, photo documentation will include a panoramic view of the entire
planting area. Submitted photos will be formatted on standard 8 1/2 x 11" paper, dated with the date the photo was taken,
and clearly labeled with the direction from which the photo was taken. The photo location points will be identified on an
appropriate drawing. Annual shoreline planting monitoring reports will be submitted to the U.S. Army Corps of Engineers,
Seattle District, Regulatory Branch, by November 31 of each monitoring year. This reporting requirement may be met by
completing and submitting a U.S. Army Corps of Engineers approved Mitigation Planting Monitoring Report form.

Lake Study 1
Project Purpose
The project purpose is to construct a new residential dock and moorage structure in Lake
Washington.
Location
The subject property is located at 3101 Mountain View Ave N (King County parcel number
3342103895) in the City of Renton, Washington (see Sheet A1.0 – in Project Drawings). The
parcel is on the waterfront of Lake Washington.
Project Description
The proposed work is to construct an approximately 160-feet long by 4-feet wide residential
dock. The new dock is being constructed to access the deepest water possible at the site for
good moorage. The dock will be supported by 20 8-inch epoxy coated steel piles and the new
decking will be grated to minimize long term impacts from the new structure.
During construction, a floating boom will surround the work barge, pier, and work area.
Project drawings are included in Appendix A – Project Drawings.
Approach
Northwest Environmental Consulting LLC (NWEC) biologist Brad Thiele conducted a site visit
on January 20, 2022 to evaluate conditions on site and adjacent to the site. NWEC also
consulted the following sources for information on potential critical fish and wildlife habitat along
this shoreline:

Site Description
The subject property is a shoreline tract in a residential neighborhood. It has shoreline on its
west boundary with single-family homes to the north and south.

Lake Study 2
The only existing structure on the property is the house. The property has a shoreline consisting
of a bulkhead, with lawn and some garden beds landward of the bulkhead. Vegetation includes
a hedge of laurel and a dwarf deodar tree. (Photos 1 through 3).
The substrate of the lake is sand, gravel, and cobble. No submerged aquatic vegetation was
present at the time of the site visit, but observations were only possible from the shore.
Adjacent properties to the north and south contain similar shorelines and residential docks.
Lake and Stream Classifications
As a Shoreline of Statewide Significance (RMC 4-3-090B1) Lake Washington is defined as a
Shoreline of the State (RMC 4-11-190S). The Shoreline is designated as “Shoreline Residential”
and as a reach of Lake Washington (Figure 1 – Renton COR Map). No streams are present
within 500 feet of the site.
Ordinary High Water Mark
The Ordinary High Water Mark (OHWM) for Lake Washington is the line of mean high water
(RMC 4-11-150 Definitions O). The Lake Washington water depth is controlled by the Army
Corps of Engineers at the Hiram M. Chittenden Locks and is at 21.8 feet above sea level (Corps
of Engineers Datum). The OHWM at the project site is shown in Appendix A – Project Drawings.
Vegetative Cover of the Site
There are no wetlands or floodplains mapped as occurring in the study area. There are no DNR
Natural Heritage Features listed in the study area (Figure 2 – Natural Heritage Features). The
site is maintained as a residential property with lawns and various ornamental beds and trees.
Ecological Functions of Lake Washington at Site.
The site lacks native plantings that would provide habitat functions along the shoreline. Planting
additional native plantings will further increase habitat conditions at the project site. These
plants will provide overhanging cover for fish, structural diversity for birds and wildlife, detritus
for aquatic invertebrates and long-term recruitment of woody material and other allochthonous
food sources.
Species Use
Birds
Birds observed near the site include raptors, herons, eagles, waterfowl, and songbirds. Bald
eagles, protected by the Bald and Golden Eagles Protection Act and the Migratory Bird Treaty
Act, are protected as a “sensitive species” within the state of Washington (WAC 232-12-011).
Eagles were not observed in the area during the site study and no nest or adequate nesting
trees were visible along the shoreline. Bald eagles and other raptors are common on along the
shoreline of Lake Washington.

Mammals
No wild mammals were observed during the site visit, but Lake Washington is known to have
river otters, beavers, nutrias, and muskrats. Deer and coyotes are known to be present in the
vicinity.
Fish
WDFW’s PHS mapping and SalmonScape mapping tools show the following salmonid species
using Lake Washington for migration and/or rearing: residential coastal cutthroat (Oncorhynchus
clarki), winter steelhead (O. mykiss), Dolly Varden/bull trout (Salvelinus malma), sockeye
salmon (O. nerka), fall Chinook (O. tshawytscha), coho salmon (O. kisutch), and kokanee (O.
nerka). The Salmonscape database maps the site as critical habitat to the Endangered Species
Units (ESU) of Threatened Chinook and steelhead (Figure 3 – SalmonScape Map). Sockeye
spawning is mapped as occurring along the shoreline at or adjacent south of the site and within
a few hundred feet to the north of the project.
The nearest salmon stream is May Creek, located approximately 3,000 feet north of the project
area. May Creek is modeled by Washington Department of Fish and Wildlife (WDFW) for
spawning of non-listed coho and sockeye and listed Fall Chinook and winter steelhead trout.
Juveniles may rear in the waters near the project when traveling from spawning sites on other
lake tributaries to the lake’s outlet at the Locks. The project site is accessible to any fish
migrating or rearing in the lake, and Lake Washington is designated as critical habitat for
Endangered Fall Chinook salmon.
There are no other aquatic or terrestrial priority habitats or species mapped as occurring within
1,500 feet of the site. (Figure 4 – PHS Map).
Measures to Protect Trees and Vegetation
No trees will be disturbed during construction as all work will occur in-water and from the work
barge. Some minimal shoreline work will be completed to connect the dock to the shoreline.
No significant vegetation will be removed to make this connection. A planting plan is proposed
to enhance the shoreline with native trees and shrubs and should improve habitat potential for
birds and mammals that use the shoreline of Lake Washington.
Project Impacts and Conservation Measures
Direct Impacts:
Sediments: Sediment disturbance will occur below the OHWM and along the shoreline of Lake
Washington. Additionally, the tug and barge propwash may disturb sediments temporarily when
making trips to/from the site. Juvenile salmonids could be temporarily displaced or stressed by
increased turbidity. Impacts to sediments should be minimal from pile work and the project
actions are not expected to exceed State Water Quality Standards.
Shoreline: Planting native vegetation, especially three native cedar trees and two shore pine,
will increase the habitat functions of the shoreline by creating shade along the shoreline that will
be an improvement from the existing baseline habitat conditions at the project site. These plants
will provide overhanging cover for fish and shade the water, structural diversity for birds and
wildlife, detritus for aquatic invertebrates and long-term recruitment of woody material and other

allochthonous food sources. The proposed planting plan is included (see Appendix A - Sheet
A7.0).
Lakebed: The proposed project will add 20, 8-inch diameter steel piles. This will result in
displacement of 7 square feet of lakebed.
Noise: Construction equipment will create noise audible to neighbors and in-water. Noise
disturbance from 8-inch piles will be short-term and should have negligible effects on fish and
wildlife in the area. Work will be completed during the in-water work window when juvenile fish
are not expected to be present.
Potential spills: Short-term risks include the potential for petroleum spills that can occur with
any equipment operation. The chance of impact to the aquatic environment is reduced because
a crew trained in using spill containment measures will be on site and employ these measures
should a spill occur.
Indirect Impacts:
Shading: The proposed dock will result in 599 square feet of new overwater coverage from the
construction of the new dock.
Grated decking allows more light to penetrate the water below a dock that can increase
productivity in the littoral zone below the dock and reduce the full shade favored by salmonid
predators. Salmonid predators are known to use hard shadowing under solid-decked docks to
ambush juvenile salmonids. Reducing these hard shadows limits predation opportunity caused
by hard shading under the dock.
ThruFlow grated decking has a measured performance at 43 percent light penetration
(ThruFlow, 2020). Thus, effective cover of the area is 57% of the area of a solid decked
structure. Using grated decking results in an effective reduction of overwater coverage of 258
square feet.
Recreational Boating: The project supports continued recreational boating, which has been
identified as a limiting factor for salmonid populations in Lake Washington. The lift installation
will not introduce additional boating to Lake Washington, as the owners could still access the
lake from a public boat launch or private moorage facility.
Other Conservation measures:
Work window: The work will be completed during the prescribed in-water work window for this
area of Lake Washington (July 16 to December 31). Operating within this time frame helps
protect Chinook salmon, steelhead, bull trout and other salmonid fish species.
Best Management Practices: Applicable BMPs will be used such as a floating boom around
the in-water work area to contain any floating debris that may escape during construction. The
barge will have a perimeter containment sock to absorb oil and grease that may wash from the
barge during construction.
Hazardous material containment materials such as spill absorbent pads and trained personnel
will be required onsite during any phase of construction where machinery is in operation near
surface waters.

Mitigation Strategy
Avoidance and Minimization
Impacts to Lake Washington cannot be avoided. The project has been designed to reduce
impacts by using grated decking, minimal piling quantity and diameter, and will use BMPs to
reduce potential impacts from construction. The dock has been designed with a minimal width
and will place moorage in the deepest water possible at the site.
Mitigation Approach
Mitigation will be provided by a shoreline planting plan along the shoreline. The existing dock
and new dock uses grated decking to reduce effective overwater coverage. In addition, the
owner has opted to pay the required in-lieu fee to King County to complete the mitigation
requirements as required by the National Marine Fisheries Service using the RAP process. The
City of Renton has not codified in lieu mitigation as an option for the project.
Shoreline Function and Values Improvements
The property owner is proposing to plant three western red cedars, 2 shore pine, 4 nootka rose,
and 3 mock orange at the site to offset the dock impacts. These plants will provide overhanging
cover, structural diversity for birds and wildlife, detritus for aquatic invertebrates and long-term
recruitment of woody material and other allochthonous food sources for aquatic invertebrates
and fish. The proposed planting plan is included (see Appendix A - Sheet A7.0).
The in-lieu fee will be used for conservation projects within King County improving watershed
conditions.
Conclusion
Juvenile Chinook salmon, and other salmonids, rear and migrate along the Lake Washington
shoreline.
There will be temporary impacts from noise and disturbed sediments during installation of the
pilings to construct the new docks.
The project will minimize construction effects on the environment by following the prescribed in
water work window and use applicable BMPs to prevent construction spills and debris from
escaping the area.
The long term effects of the dock will be minimized by using grated decking, minimizing the
width of the dock to less than 4 feet, placing moorage in the deepest water possible and using
the minimum number of piles and pile diameter to construct the dock.
The planting plan will enhance the nearshore environment and increase the shoreline functions
and values at the site offsetting the impacts from the new dock in the long term.
This project has been designed to meet current residential dock standards and will use Best
Management Practices to reduce project impacts. The conservation measures are designed to
improve ecological functions or prevent further degradation of habitat and will result in No Net
Loss of ecological functions at the site.

A. Constant vigilance shall be kept for the presence of protected fish species during all aspects of the
proposed action, particularly during in-water activities such as vessel movement, deployment of anchors &
spuds, pile driving, dredging, and placement of gravels and other fill.
1. The project manager shall designate an appropriate number of competent observers to survey the project
site and adjacent areas for protected species, including the presence of fish as conditions allow.
2. Visual surveys shall be made prior to the start of work each day, and prior to resumption of work following
any break of more than an hour. Periodic additional visual surveys throughout the work day are strongly
recommended.
3. All in-water work shall be done during the in-water work window for the waterbody. Where there is a
difference between the USCOE and WDFW work windows, the overlap of the two shall apply.
4. All pile driving and extraction shall be postponed or halted when obvious aggregations or schooling of fish
are observed within 50 yards of that work, and shall only begin/resume after the animals have voluntarily
departed the area.
5. When piloting vessels, vessel operators shall operate at speeds and power settings to avoid grounding
vessels, and minimize substrate scour and mobilization of bottom sediments.
B. No contamination of the marine environment shall result from project-related activities.
1. Appropriate materials to contain and clean potential spills shall be stored and readily available at the work
site and/or aboard project-related vessels.
2. The project manager and heavy equipment operators shall perform daily pre-work equipment inspections
for cleanliness and leaks. All heavy equipment operations shall be postponed or halted should a leak be
detected, and shall not proceed until the leak is repaired and the equipment is cleaned.
3. To the greatest extent practicable, utilize biodegradable oils for equipment that would be operated in or
near water.
4. Fueling of land-based vehicles and equipment shall take place at least 50 feet away from the water,
preferably over an impervious surface. Fueling of vessels shall be done at approved fueling facilities.
5. Turbidity and siltation from project-related work shall be minimized and contained through the appropriate
use of erosion control practices, effective silt containment devices, and the curtailment of work during
adverse weather and tidal/flow conditions.
6. All wastes shall be collected and contained for proper disposal at approved upland disposal sites
appropriate for the material(s).
7. When removing piles and other similarly treated wood, containment booms must fully enclose the work
area. Wood debris, oils, and any other materials released into lake waters must be collected, removed,
and properly disposed of at approved disposal sites.
8. All in- and over-water wood cutting would be limited to the minimum required to remove the subject wood
component, and all cutting work should be enclosed within floating containment booms.
9. When removing piles, no actions shall be taken that would cause adhering sediments to return to lake
waters.
10.Above-water containment shall be installed around removed piles to prevent sediment laden waters from
returning to lake waters.
11.Construction staging (including stocking of materials, etc.) will occur on the supply barge.
12.All Exposed wood to be used on the project will be treated with a cheminite treatment.

MITIGATION PLAN
Notes:
1.Shrubs are show, and shall be planted, at least five feet on center. Trees are show, and shall be planted, at least ten feet to

2.The property owner will implement and abide by the shoreline planting plan. The plants shall be installed before or
concurrent with the work authorized by this permit. A report, as-built drawing and photographs demonstrating the plants
have been installed or a report on the status of project construction will be submitted to the U.S. Army Corps of Engineers,
Seattle District, Regulatory Branch, within 12 months from the date of permit issuance. This reporting requirement may be
met by completing and submitting a U.S. Army Corps of Engineers approved Report for Mitigation Work Completion form.
3.The property owner will maintain and monitor the survival of installed shoreline plantings for five years after the U.S. Army
Corps of Engineers accepts the as-built report. Installed plants shall achieve 100% survival during monitoring Years 1 and 2.
Installed plants shall achieve at least 80% survival during monitoring Years 3, 4 and 5. Percent survival is based on the total
number of plants installed in accordance with the approved riparian planting plan. Individual plants that die will be replaced
with native riparian species in order to meet the survival performance standards.
4.The property owner will provide annual monitoring reports for five years (Monitoring Years 1-5). Each annual monitoring
report will include written and photographic documentation on plant mortality and replanting efforts and will document
whether the performance standards are being met. Photos will be taken from established points and used repeatedly for each
monitoring year. In addition to photos at designated points, photo documentation will include a panoramic view of the entire
planting area. Submitted photos will be formatted on standard 8 1/2 x 11" paper, dated with the date the photo was taken,
and clearly labeled with the direction from which the photo was taken. The photo location points will be identified on an
appropriate drawing. Annual shoreline planting monitoring reports will be submitted to the U.S. Army Corps of Engineers,
Seattle District, Regulatory Branch, by November 31 of each monitoring year. This reporting requirement may be met by
completing and submitting a U.S. Army Corps of Engineers approved Mitigation Planting Monitoring Report form.
