2. City�f Ren4arr shall have the right to in�ress and egress over those portions nf the Property
a�ecessary to perform 6nspe�tions of the stormwater fa�ilities a�d �MPs and condu�t
rnaintenance act6vities spec6fied in thos D��laration of Covenant and in accordanc� with the
itent�n Munici�sal Crade. City of Renton shall prov6de at le�st thirty(30)days'written notdce to
the Oenrners that entry erm the Property i�planrsed for the bnspection of drai�age faciliti�s.Aft�r
tF�e thirty(30)days,the Qwn�rs shall aliow the�ity of Renton to enter for th�s�le purpose of
inspeetin�dr�inage facilities. In lieu of inspectian by the�ity,the Q�ners may elect to enga�e
a licensed civil engineer r�gistered in the st�t�of V!/ashwn�ton v�ho has expe�tise in dr�Bnage to
inspect the drain�g� facilities and prnvide a written report des�ribing their conditior�. If the
�ngineer opti�n is chosen,the Own�rs sha91 provide written notice to the City gf Renton rvithin
fifte��r(15)days csf receiving the City's rsotice of inspection.V�/ithin thirty(30)days af giving this
notice,the Ovvners,�r engineer on behalf of the Av�rners,shall pravide the�ngin�er's report ta
the Ci�y cz�Ren�on. If the report is not pravided in a timely manner as specified above,the City
af Renton may inspeci th�draina�e f�c6lities without f�rther notBc�,
3. If City of Renton determin�s frorn its inspectian, or #rorrt an �ngineer's report provided �n
acct�rdance uNath Paragraph 2�that mair�teraance, repair, restorationa and/ar mitigation wark is
required to be done ta any c�f the drairta�e fiacilities, City of ftenton shal! nt�4ify th�(��ners of
the sp�cific masrotenanc�, repair, restoration, and/or miti�ation �vork ("Wark") required
pursuant to the Renton IV9unicipal �ode. The City shal0 also set a reasoraable d�adl6ro�for th�
Qwners to complete the Work, �r ta prmuide an engoneer's report that v�rifies �ornpletian of
the 1JVork.After the deadline has passed,th� Ovrrners shall allow the City access to re-insp�ct
the draina�� facilitB�s unless an engineer's r�p�rt has been provided verifying corcaple#ioro of
the Work. If the Work is r�at cornpleted within the tirn� frarn� s�t by th� �ity, the City may
initiat� an enf�rcement action andjor p�r��rrn ihe VVork and hereby is given access to the
Property for �uch purposes. °dVr6tten not�ce owill be sent to the Owners st�ting the City's
interstpon ta perforrn�uch Work.This�A7ork vvit!not corrimence until at least sev�n(7)days after
such n�tice is rnailed. If, within the sole discretion of �he City, there exists ar� imminent �r

4. Th�C?wners shall assume all responsibility for the cost af any Work,or any m�asures tak�n by
th� Cit�r to �ddress canditi�ns as described i� Paragraph 3. Such responsibility shall incl�d�
reienburs�mer�t to the City within#hirty(30j days af th�r�ceipt a�f the invoBce for any such Wark
perforrvied. Overdue paym�nts will require paym�nt �f inter�st at the maxemurn legal rate
allowed ay RCViB 19.52,020(currently twelve percerst(12%)). If the City inotBat�s I�gal actiora to
enforc� this agre�rnerrt, the prevailing party in such action is entitled to recover reas�nable
litigation cos4s and attorney's fees.
5. The Ovvners are reguired to obtain written�pproeral from City of Renton pri�r to fi{fprsg,pipin�,
cutting, or removin�vegetation (ex�ept in routine landscape maintenance) in apen vegetated
stormwater faciBBti�s (such as sv✓�les, channels, d9tches, ponds, etc.�, ar perforrning any
alteratians ar rnz�dific�ti0ns tn the drairoage faeilities ref�rer�ced in this�ec9aration of Cove�ant.
