C. PROJECT DESCRIPTION/BACKGROUND
Renton Avenue S is classified as a residential access street with an existing ROW width of 40 -feet per the King
County Assessor’s Map. The existing pavement width is approximately 26 feet wide.
Per RMC 4-6-060, a residential access street requires a minimum right of way width of 53-feet. A paved minimum
roadway width of 26-feet consisting of 2 – 10-foot travel lanes and 1 – 6-foot parking lane is required. A 0.5-foot
curb and gutter, 8-foot planter, and 5-foot sidewalk are required along each side of the pavement. To meet the
City’s complete street standards, dedication of 6.5 feet along the east property line would be required.
D. FINDINGS OF FACT (FOF):
1. The Planning Division of the City of Renton accepted the above master application for review on June 27,
2022 and determined the application complete on July 25, 2022. The project complies with the 120-day
review period.
2. The applicant’s submittal materials comply with the requirements necessary to process the waiver request
(exhibit 2).
3. The project site is located at parcel 7221400166.
4. The project site is located in the R-8 zone.
5. The project site currently contains a single-family residence and is vegetated with groundcover and trees.
A single-family addition is proposed to be constructed.
6. Access to the site would be provided via an existing driveway connection along the north property line on
Renton Avenue S.
7. Waiver Analysis: The applicant is requesting a waiver from RMC 4-0-060, Street Standards, to install
frontage improvements along Renton Avenue S. The Section 4-6-060.Q.1 allows the Administrator to grant
waivers of Street Improvements provided the waivers meet the criteria “a” and “b” below; additional
justification may include, but is not limited to, criteria “c” through “e” below (pursuant to RMC 4 -9-250C.5):

Staff Comment: The proposed project is a remodel with an addition, which means that
the existing house would remain in its current location. For existing homes in this
neighborhood, requiring frontage improvements outside of a complete redevelopment
would result in existing homes not meeting current setback requirements.

b. In no case shall a waiver be granted unless it is shown that there will be a de minimis
effect on the public health, safety or welfare if the improvements are not installed,
and that the improvements are not needed for current or anticipated
development.

Staff Comment: There is an existing 5-foot sidewalk along both sides of Renton Avenue
S. Staff has determined that the new improvements are not needed for this current
development. The lot is in the R-8 zone and can be subdivided into 2 lots. As part of a
future short plat or a new single-family home project, the new street standard which
includes a 26-foot paved width, 8-foot planter, and 5-foot sidewalk, would be applied.
The existing sidewalk does not meet ADA standards (i.e. cross slopes that exceed A DA
standards, trip hazards, etc.). City staff recommend a condition of approval to replace
the 5-foot sidewalk in its current location with a sidewalk that meets ADA standards.

c. Required street improvements will alter an existing wetlands or stream, or have a
negative impact on a shoreline’s area.
Staff Comment: No existing wetlands, streams, or shoreline areas are located within the
project area.

d. Required improvements will be installed as part of a City project, as identified in
the City’s Transportation Improvement Program or similar documentation as
determined by the Administrator.
Staff Comment: There are no current plans to install street improvements as part of a
City project, on Renton Avenue S.

e. Existing steep topography would make required street improvements infeasible.
Staff Comment: The project site slopes from east to west. The installation of an 8 -foot
planter and 5-foot sidewalk would require substantial re-grading and/or the installation
of retaining walls behind the new sidewalk which would conflict with existing home
which is a little over 15-feet from the existing right of way.
E. DECISION:
The proposal satisfies 2 of the 2 required criteria (“a” and “b”) listed in RMC 4-9-250C.5 for the requested waiver.
Therefore, the street waiver for the Miller SFR Addition Project located at 439 Renton Avenue S, Project Number
LUA22-000227, B22000642 is approved with the following condition:
1. The existing sidewalk along the property frontage shall be replaced in its current location and width with
an ADA compliant sidewalk.

K. LAND USE ACTION APPEALS, REQUEST FOR RECONSIDERATION, & EXPIRATION:
The administrative land use decision will become final if the decision is not appealed within 14 days of the decision
date.
APPEAL: This administrative land use decision will become final if not appealed in writing to the Hearing
Examiner via the City Clerk’s Office on or before 5:00 PM on August 9, 2022. Due to the ongoing state of
emergency enacted by Governor’s Proclamation 20-28.14 (and as amended), the City Clerk’s Office is working
remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov
or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The appeal fee, normally due at the time an
appeal is submitted, will be collected at a future date if your appeal is submitted electronically. Appeals to the
Hearing Examiner are governed by RMC 4 -8-110 and additional information regarding the appeal process may be
obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
EXPIRATION: The Waiver decision will expire two (2) years from the date of decision. A single one (1) year extension
may be requested pursuant to RMC 4-9-250.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by
the approval body. The approval body may modify his decision if material evidence not readily discoverable prior
to the original decision is found or if he finds there was misrepresentation of fact. After review of the
reconsideration request, if the approval body finds sufficient evidence to amend the original d ecision, there will be
no further extension of the appeal period. Any person wishing to take further action must file a formal appeal
within the 14-day appeal time frame.
THE APPEARANCE OF FAIRNESS DOCTRINE: provides that no ex parte (private one-on-one) communications may
occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals to the
Hearing Examiner as well. All communications after the decision/approval date must be made in writing through
the Hearing Examiner. All communications are public record and this permits all interested parties to know the
contents of the communication and would allow them to openly rebut the evidence in writing. Any violation of this
doctrine could result in the invalidation of the appeal by the Court.
