HomeMy WebLinkAboutAddendum - 4AMENDMENT NO. _4_ TO AGREEMENT FOR PHILIP ARNOLD PARK SITE IMPROVEMENTS THIS AMENDMENT, dated for reference purposes only as _____________, 2022, is by and between the City of Renton (the “City”), a Washington municipal corporation, and HBB Landscape Architecture, Inc. (“Consultant”), a Washington corporation. The City and the Consultant are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-19-360, dated December 12, 2019, to provide necessary services for the Philip Arnold Site Improvements (referred to herein as the “Agreement”); Whereas, the Parties wish to amend the Agreement to change the scope of work and change the compensation in order to provide additional professional design services for the Philip Arnold Park site improvements. NOW THEREFORE, It is mutually agreed upon that CAG-19-360 is amended as follows: 1.Scope of Work: Section 1, Scope of Work, is amended to add work as specified in Exhibit A-4, which is attached and incorporated herein. 2. Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $_43,958.62_ from $_471,863.58_ to $_515,822.20_, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit A-4, which is attached and incorporated herein. 3.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. Electrical:   a. Added light fixtures in the shelters.  b. Added light fixtures for the monument sign.  c. Added light fixtures inside handrail.   d. Added electrical pedestals/vaults/transformers.  e. Added new J‐boxes and electrical wiring runs.  f. Added PSE provision for their own designed connections and layout that will need  review.   2. Civil/Structural:  a. Added repackaging formats for BMPs covenant exhibit.  b. Added catch basins’ stormwater connection at the ballfield that are currently  unknown that would need to be addressed during construction.   c. Added custom designed pedestrian bridge which will need structural review.   d. Added potable water booster pump system for operable PSI per the manufacturer of  Portland Loo and Drinking Fountain.  3. Landscape Site Improvements:  a. Deleted playground equipment, play surfacing, and drainage base material.   b. Added custom‐designed bronze inlay markers.   c. Added custom designed pedestrian bridge: There’s 1 manufacturer for guardrail and  1 manufacturer for decking and the custom‐designed bars underneath.  d. Added 3 unit‐masonry walls.   e. Added light‐integrated handrail and staircase cheek‐walls.   f. Added removable bollards in parking lot.  g. Added custom‐designed wayfinding sign and monument sign.  4. Landscape Irrigation:  a. Providing a completely new system for the park with rotor‐based spray zones, corner  sprays zones, full radius sprays zones, 180 spray heads and increased quantity of pipe  and trench length to review.  Exhibit A-4 Philip Arnold Park   1 August 2022  Page 2  b. Added complexity to the irrigation Point‐of‐Connection:  i. Added the hot box for the DCVA.  ii. Added the removal and reinstallation of flow sensor to a new location to get  accurate readings. Currently, it’s not installed correctly.   iii. Added cutting out the existing DCVA and patching all the copper piping for  the new DCVA in hot box.  c. Added a new 2‐wire system, that will also control existing valves in the ballfield with  conventional wiring to each valve.   d. Added a new controller which is a new product by Toro, needing coordination with  Toro representative during commissioning.   e. Added phasing of irrigation and temporary connections to maintain ballfield  irrigation, and maintaining a 480 Volt irrigation pump for increased PSI required at  the ballfield rotors and for temporary mainline routing.      To address the construction administration needs of the current design, this amendment replaces the entirety  of the scope for Task 7: Construction Administration Assistance of the current agreement. That scope is  replaced with the following, more clearly defined scope sections with detailed, quantified metrics in each  subtask and assumptions.     Based on this more detailed scope, the team has developed a clearly defined level‐of‐effort to match (see  Exhibit 1‐ Spreadsheets enclosed). Since the current agreement already has existing fee for Task 7, this  amendment is a request for only the difference in the fee to cover the full level‐of‐effort for the following CA  support scope.     TASK 7: CONSTRUCTION ADMINISTRATION SUPPORT  Construction Administration Support scope assumes:   a. the city will have the lead CA management role.  b. the city will periodically review the contractor’s as‐built drawings to ensure compliance, typically at the site  following a contractor meeting.  c. the construction schedule duration is 10 months to final completion/park opening (end of May 2023). A  change in final completion by 2 months or more will necessitate a review of this task scope and fee as  additional services may be required to meet a prolonged construction schedule.    7.1 Conformed Set.  Integrate changes from issued Addenda into the Contract Document Drawing Set, update titleblocks,  repackage Drawings, and issue to City of Renton for distribution to Contractor.   7.2 Preconstruction Meeting.  Attend one (1) preconstruction meeting held at the project site. HBB & PND to attend.  7.3 Contractor Site Progress Meetings.   Attend contractor’s site progress meetings assumed to be held weekly at the project site. These are by  request only and consist of the following allowance:  o HBB: attend up to 10.  o PND: attend up to 8.  o HPe: attend up to 2.   Exhibit A-4 Philip Arnold Park   1 August 2022  Page 3  7.4 Pay Application Reviews  Review monthly contractor pay applications and provide written feedback on percentage completion to  the city. Review, team coordination, and feedback assumes an average of 15 min/month for HBB, PND, &  HPe; for 10‐month schedule is 2.5hrs for each discipline.  7.5 Submittals  Review and process submittals including product data samples, contractor provided shop drawings, and  technical submittals required by the construction documents. Time for review, processing, and mark‐up of  each submittal assumes an average of 2 hours each and that 20% will require resubmittal review.  o HBB: process up to 30.  o PND: process up to 25.  o HPe: process up to 3.   7.6 Requests for Information  Review and respond to requests‐for‐information (RFIs) generated by the contractor. Responses will be  provided in writing. Time for RFIs assumes an average of one (1) hr each, and that 25% of these will  require additional teleconference and/or coordination meetings to discuss resolution, clarifications,  and/or responses.   o HBB: process up to 20.  o PND: process up to 17.  o HPe: process up to 3.   7.7 Field Reviews w/ Reports.   Provide field reviews during the construction process to observe the progress and quality of construction  work. Provide written field reports with photographs documenting each field review that are reviewed for  quality assurance by a senior landscape architect. Assumes an average of 6 hours per field visit review and  written report.  o HBB: provide up to 20.  o PND: provide up to 10.  o HPe: provide up to 2.   7.8 Substantial Completion & Punch List.  Provide one (1) project site walk‐through for substantial completion. Provide one (1) consolidated,  written, punch‐list of open items, with photographs. Assumes 12 hours per walk through, written lists, and  compilation of lists into written report. HBB, PND, & HPe (1/2 time) to attend.  7.9 Physical Completion & Back Punch List.  Provide one (1) project site walk‐through for physical completion of punch‐list items (the back punch).  Provide back punch list of items marked as completed or not completed and documenting any additional  open items found. Assumes 10 hours per walk through, written lists, and compilation of lists into written  report.  HBB, PND, & HPe (1/2 time) to attend.  7.10 Change Orders  Prepare change orders regarding design during construction. Review Contractor provided cost proposals  and provide written comment. Time assumes an average of 8 hrs of drafting, redesign, and review time,  and that 25% of these will require additional teleconference and/or coordination meetings to discuss  resolution, clarifications, and/or responses.  o HBB: prepare and process up to 3.  o PND: prepare and process up to 3.  o HPe: prepare and process up to 1.   Exhibit A-4 Philip Arnold Park   1 August 2022  Page 4  7.11 As‐Built Review & Record Drawings  The Contractor’s maintained and complete as‐built field drawings will be sent to Design Team. Prepare  record drawings based solely on as‐built information provided by the Contractor. HBB, PND, & HPe to  provide.   7.12 BMP Exhibit Reformatting  Reformat and repackage drainage site plan and on‐site BMPs so that viewports fit 8.5” x 14” format for  the Declaration of Covenant submittal. PND effort only.     AMENDMENT #4 FEE   In consideration of the above services, we are proposing the following estimated fee (see Exhibit 1 enclosed for  spreadsheet breakdown). The fee request takes into account the fee already contracted for CA services and is  the additional fee needed to meet the level‐of‐effort. The fee spreadsheets are enclosed and includes a rate  adjustment for 2022.     Assumptions:  1. Review and evaluate Contractor’s claims and supporting documentation are not included.   2. Additional Substantial or Physical Completion walk‐throughs are not included.   3. Final Acceptance of the project at end of guarantee period is by the city. Services do not extend into  the warranty and/or guarantee period.  4. Preconstruction Meeting Notes and Contractor Site Progress Meeting Notes are by others.   5. Items not explicitly stated as part of the scope above are not included, and would be additional services.  6.
