PROJECT DESCRIPTION: The applicant, Sound Transit, is requesting a Tier II Temporary Use Permit to conduct
soil remediation work and place artwork at the South Renton Transit Center site located at 750 Rainier Ave S
(APNs 192305-9035, -9063, -9068, -9074). The soil remediation work would include excavating and removing
known contaminated material on-site and backfilling would be completed using non-contaminated soil,
through best management practices and controls. The soil remediation work requires a Building Grading Permit.
According to COR Maps, the site contains high seismic hazards and is in the Downtown Wellhead Protection
Area (Zone 2). Sound Transit, the lead agency for the new South Renton Transit Center and BRT station, issued
a Determination of Nonsignificance (DNS) under WAC 197-11-340 (2) and Sound Transit’s SEPA rules on
September 30, 2020. Placement of objects of art would be required to comply with the other provisions of the
City’s Zoning and Building Codes.
The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions::
*CONDITIONS OF APPROVAL:
1. The applicant shall provide to the Current Planning Project Manager photographs, scaled drawings,
and/or three (3) dimensional depictions of the proposed ‘objects of art’, a biographical sketch of the
artist, and appropriate plans depicting the location(s) of the objects of art.
2. The applicant shall share the temporary artwork with the City by the first quarter of 2023, unless
otherwise agreed upon by Sound Transit and the City.

3. The applicant’s temporary artwork shall undergo review and recommendation from the Renton
Municipal Arts Commission. The final objects of art shall be reviewed and approved by the Current
Planning Project Manager prior to installation of the temporary artwork.
4. The temporary artwork shall be removed and the site shall be restored to the original condition when
the South Renton Transit Center construction work commences, unless otherwise agreed upon by the
City and Sound Transit.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened
by the approval body. The approval body may modify his decision if material evidence not readily discoverable
prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the
Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there
will be no further extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14-day appeal time frame.
APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on September 6, 2022.
Due to the ongoing state of emergency enacted by Governor’s Proclamation 20-05, the City Clerk’s Office is
working remotely. For that reason, appeals must be submitted electronically to the City Clerk at
cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub only on Tuesdays and/or Wednesdays.
The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal
is submitted electronically. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional
information regarding the appeal process may be obtained from the City Clerk’s Office,
cityclerk@rentonwa.gov.
EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit, unless
the Community & Economic Development Administrator or designee establishes a shorter time frame or an
applicant can request that a permit be valid beyond the one-year expiration, for up to five (5) years at the time
of application or prior to permit expiration.
EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit
expiration to the Department of Community & Economic Development Administrator.
