• Dear Mr. Tripp:
Enclosed please find an easement for utility purposes over the southerly
15 feet of your property and an easement for roadway slopes and side-
walk areas over the southerly 45 feet of your property.
As was discussed the utility easement has been reduced so that only the
southerly 15 feet of your property will be encumbered. The slope
easement over the southerly 45 feet will allow the City to fill this
strip of land to presettle the "round prior to the installation of the
sewer. After the sewer is installed this strip will be used for access
to maintain and repair the line when needed.

It is hoped that these n,o documents will meet your needs and still allow
the City access to your property for the installation of the sewer line.
If this is agreeable, one copy of each document should be executed and
returned to this office.

of constructing, maintaining, repairing, altering or reconstructing said
utility, or making any connections therewith, without incurring any legal

The Grantor shall fully use and enjoy the aforedescribed premises,

line. However, the grantor shall not erect buildings or structures over, under
or across the right-of-way during the existence of such utility.
This easement, shall be a covenant running with the land and shall be bind-
ing on the Grantor, his successors , heirs and assigns. Grantors covenant that
they are the lawful owners of the above properties and that they have a good and
lawful right to execute this agreement.

The Grantor, GLACIER PARK COMPANY, a Minnesota corporation hereinafter called
Railway Company, for and in consideration of Three Hundred and No/100 Dollars •
($300,00) to it paid, and the agreements herein contained, does hereby grant to

2 A strip of• land 45 feet wide within the NW 1/4 of Section 30, Township
23 N., Range 5 E., W.N. lying parallel with, adjacent to and southerly
of the centerline of the new alignment of Strander Blvd., and more
particularly described as follows:
Beginning at the NW corner of said Section 30, thence S. 89052'02" E.
along the north line thereof a distance of 1003.37 feet to the 1/16 '
line which runs in a north-south direction through the NW 1/4 of said
Section 30, said 1/16 line also being the centerline of Lind Ave. SW;
thence S.-1°35'13" W. along said 1/16 line and the centerline of Lind
Ave. SW a distance of 1313.91 feet to the 1/16 line which 'runs in an
east-west direction through the NW 1/4 of said Section 30, said 1/16
line also being the centerline of SW Strander Blvd.;

Thence N. 89°40'25" W. along said 1/16 line and the centerline of SW
Strander Blvd. a distance of 40 feet to the true point of beginning;
thence. continuing N 89°40'25" W. a distance of 515 feet to a, point of
curvature; thence northwesterly along a curve to the right, having a
radius of 2000 feet, through a central angle of 11050'26" an arc distance
of 413.31 feet to a point which' lies 20 feet easterly of, as measured at
right angles to, the west line of said Section 30; •
Thence S. 0°49'10" W. along a line parallel with and 20 feet.easterly of •
said subdivision line a distance of 45.88 feet to a point.on a'curve;
thence northeasterly along a curve to the left, having,a radius of 2045 feet,
through a central angle of 11035']5" an arc distance of 413.58 feet to a
point which lies 45 feet southerly of, as measured' at right angles to, the
east-west 1/16 line within the NW 1/4 of said Section 30, said 1/16 line •
also being the centerline.of SW Strander Blvd.
Thence S. 89040'25" E. along a line parallel with and 45 feet southerly of .
said subdivision line a distance of 515 feet to 'a point which lies 40 feet
• westerly of as measured at right angles to the aforementioned centerline
of Lind Ave. SW;
Thence N. 1°35'13" N. along a line parallel with and 40 feet westerly of
chid centerline a uistance of 45 feet, to the true point of beginning.
This easement is made subject to and upon the following express conditions:

The Railway Company, for itself and its successors and assigns, reserves
all rights to use the property hereinbefore described for -any and all purposes
• Whatsoever not inconsistent with the easement hereby granted when deemed necessary
or expedient to the Railway Company. Rights reserved shall be so exercised as •
not to damage or interfere with the utility easement as above defined. This
casement is subject to all existing interests of third parties in said property
• of any kind or nature whatsoever and any and all extensions or renewals thereof.

This instrument does not grant or convey unto the City any rights or
title to the surface of the soil along the route of said permanent utility ease-
ment except for the purpose of laying down, inspecting, restoring and replacing
utilities; provided that any such work which shall disturb the surface of the
soil shall be subject to the granting of a temporary construction permit granted
by the Railway Company.
III
The City shall protect and save harmless the Railway Company from any
.ON and all claims, demands, loss, damage expense and liability of every kind and
CO description including personal injury and for any damage to or loss or destruction
of property whatsoever suffered by the Railway Company their heirs, successors and
assigns, or by any persons, firms or corporations, because of the construction
and/or maintenance of said facilities.
N IV
In the event that said property shall at any time cease to be used for
utility purposes, or shall by operation of law or• otherwise become vacated or
abandoned, the easement herein granted shall immediately cease and terminate
without notice. or other proceedings on the part of the Railway Company and the
City, its successors or assigns, shall immediately reconvey said property to the
Railway Company.
IN WITNESS WHEREOF, the Railway Company has caused this instrument to
be executed by its proper officers and its corporate seal to be hereunto affixed

TEMPORARY EASEMENT
Drainage District Number One of King County, Washington, a municipal corporation
existing under the laws of the State of Washington, hereinafter called Grantor, in consi-
deration of One dollar($1 . 00) and other good and valuable consideration, grants unto the
City of Renton, a municipal corporation existing under the laws of the State of Washington,
hereinafter called Grantee, a temporary easement as follows:
Grantor grants a temporary easement to Grantee, its agents and employees, with
necessary equipment, to enter upon and have access to the real property owned by Grantor.
Said temporary easement is for the purpose of construction work, and is specifically des-
cribed as follows:
A strip of land, having a width of twenty feet., lying within the real property of
Drainage District Number One of King County, and being adjacent to and parallel with the
northerly line of the real property described on Exhibit "A" attached hereto and made a
part hereof; situated in King County, Washington.
This grant of temporary easement shall terminate sixty days after the filing of the
notice of completion of construction or December 31 , 1978, whichever occurs first. Upon
termination Grantee will return the property as nearly as practicable to its original
condition.
Grantee shall be required to exercise this temporary easement so as not to hinder or
prevent the use of said property by Grantor as part of a continuous drainage "system, and so
as not to hinder or prevent the operation of the existing drainage ditch in that location.

may be necessary to enter upon said above described property for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
utility, or making any connections therewith, without incurring any legal

Enclosed please find an easement for utility purposes over the southerly
15 feet of your property and an easement for roadway slopes and side-
walk areas over the southerly 45 feet of your property.
As was discussed the utility easement has been reduced so that only the
southerly 15 feet of your property will be encumbered. The slope
easement over the southerly 45 feet will allow the City to fill this
strip of land to presettle the ground prior to the installation of the
sewer. After the sewer is installed this strip will be used for access
to maintain and repair the line when needed.
It is hoped that these two documents will meet your needs and still allow
the City access to your property for the installation of the sewer line.
If this is agreeable, one copy of each document should be executed and
returned to this office.

on the southerly side of your property,located in Renton, Washington.
Although the roadway is not proposed for construction at this time a sanitary
sewer line is scheduled for construction in conjunction with the Lind Ave.
Improvement Project.
In order to facilitate this construction and keep the sewer line within the
proposed Right-of-Way the City of Renton would like to obtain an easement
for utility purposes across the southerly 40 feet of your property as shown
in red on the attached print.
If you have no objections to this proposal, please sign the original copy
of the easement document in the presence of a Notary Public, returning the
original to this office and retaining the second copy for your records.
If you have any questions or would like additional information, please do not
