on September 20 approved by both. counsel in the form, a copy of
which was transmitted to you on September 11; and on September 21
the Judgment was signed and entered by Judge Edward E. Henry. On
the same date we deposited with th.e Clerk of Court City of Renton
Warrant C-50 in the sum of $22 , 599 . 80 (Summers) and Warrant C-51
in the sum of $13 , 294. 00 (Edwards) in full satisa&.tion of the

30 compensation payable for the slope easements sought to be acquired
31 herein as to both parcels "A" and "B" , (described in. the Petition
32 herein as temporary easements) , by reason of the mutual benefits

3 be extinguished at such time as the "remainders" of those respective
4 parcels are each filled to a buildable elevation based on the 100 year
5 flood plan as established by the United States Soil Conservation
6 Service, now therefore, it is hereby
7 ORDERED, ADJUDGED AND DECREED that Petitioner shall pay
8 the sum of Thirty Five Thousand Eight Hundred Ninety Three Dollars
9 and 50/100 ($35 , 893. 50) into the Registry of this Court for the
l0 benefit of Respondents herein, as their interest may appear, as
11 just compensation; and upon such payment the Petitioner shall
12 become the owner of the following property and property rights, to-wit.

Pursuant to our telephone conversation of this date,
you will find enclosed a copy of City of Renton Department
of Engineering map of February 2 , 1978 , designated "Lind
Avenue LID #302 Grading Plan" , upon which is shown the
Summers property (parcel "A" ) as well as the Edwards
property (parcel "B" ) , with the areas to be appropriated
(fee and easement) specifically indicated thereon. .
This is also to confirm that--the hearing as to public
use and necessity has been continued to Friday, August
18 , 1978 at 9 : 30 A.M. ; and that you will be contacted by
Mr. Don Monaghan . of the City' s Engineering Department
to set up a conference at which you can obtain engineering
details of the project, which will hopefully lead to a
stipulated order of public use -and necessity as well as
an agreement whereby the City would be given the right of
entry upon the properties in question, so the project may
be completed. .
The undersigned will be in touch with you upon return from
vacation on August 15, 1978 . .

This Is to confirm that a petition in condemnation was filed
July 11, 1978 , and assigned case No . 847917 . Also filed were
a Demand for Jury and Lis Pendens .
The hearing for public use and necessity is set for August 4,
1978 at 9 :30 A.M. A trial date will be on that occasion.
. Hopefully, we will be contacted by counsel shortly after service
of copies of the petition on the various parties in. interest,
and will then be able to work out an agreement for immediate
possession and use by the City, as that is the only way respondents
. can preserve their claim for an award of attorney' s fees and
appraisal fees if the verdict or judgment. exceeds the City' s

Dear Mr. Partin:
I am in receipt of your letter of May 11 , 1978 , in response
to my letters of March 24 and April 5, 1978 . Frankly, if
you had seen fit to respond earlier it would have made the
handling of this matter much easier.
As it now stands, the City cannot wait and attempt to
negotiate since the right of way is badly needed to insure
that LID 302 will not be held up. You mention wanting to
keep the cost of the LID down, but your actions to date have
had exactly the opposite affect.
The City will be proceeding with condemnation and if you
wish to keep the cost down I would suggest that you or
your attorney agree to an order of immediate use and possession
of the property upon tendering by the City into Court of the
appraisal amounts.
I find it rather hard to believe that you are accusing the
City of bad faith in this transaction when you have never
provided us with any documentation outside of that which .
we surrendered to you to support our appraisals . While you
may wish to attack the validity of the appraisals , those
appraisals are the only documented evidence I have, at this
time , to support any sort of an offer to acquire your land .
Your letter also states that the City has handled this case
in a ridiculous manner and frankly I resent that statement .
The City has attempted to resolve this matter and you have
done nothing but ignore our correspondence. Outside of meeting
with the City and indicating that you would not be satisfied
with our offers , we have had no communications from you.
My letters have been answered approximately a month after
having been forwarded to you .

As previously mentioned, the City will proceed to
condemnation on this property. We will be quickly moving
for a certificate of public use and necessity in order
to gain title to the property. In the meantime, I will
ask our appraiser to reassesshis figures and tell me if
they need to be changed in any manner. I would request
from you that you indicate to the City the price at which
you would be willing to surrender the property. Hopefully,
that will lead to a resolution of the issues and the
settlement of this dispute.

This letter is in response to your letters of March 24th
and April 5, 1978 concerning our property on Lind Avenue S.W.
My office records indicated that Mr. Wilcox, the appraiser
for the City, attempted to make contact with me twice in
the last week of March, 1978. I was at that time on a business
trip and have since made contact with him. In our conversation
of March 30th, when I returned his call, some interesting
points were brought up and discussed that may enlighten the
City' s position in this matter.
1. Mr. Wilcox indicated that there was no real need
for the information that I have concerning the
value of our property which includes appraisals , •
comparable sales, and prices on those properties
currently available for sale. Mr. Houghton,
representing the City, had indicated to him
previously that the matter was now "in the hands
of the attorneys. "
2. Mr. Wilcox indicated that the appraisal was made
approximately. one year ago, thus not reflecting
current market value and, although he hasn' t
actively worked in the Renton industrial area
since his appraisal, he was aware that there
have been a great deal of activity over that
one year period.
3. He further indicated that the only criteria used
to determine whether a property was filled or
unfilled, was the depth of the fill only.
4 . After discussing with Mr. Wilcox our appraisal
on the property at slightly over 50 per square .
foot unfilled, it was his opinion that the
appraisal should be submitted to the City to aide
in the re-evaluation of our property. (I indicated
that that was made available at our first meeting. )
With this information, I must once again indicate to you my
feelings that the City is not acting in good faith in this
matter. And, although we have responded to all correspondence
and attended a meeting set up through the City to resolve
this matter, the City is still unwilling to negotiate. We
have, as of this date, received no indication from the City
that they would alter their position of l5 per square foot
for the right of way, which represents and in our opinion, an
inaccurate, and certainly outdated appraisal.
Please be advised that at this time, we feel justified in not
granting the right of entry to the City of Renton because
of the ridiculous way that this matter has been handled.
I am interested in resolving this matter out of court if at
all possible, and realize that to do this concessions must
be made on both sides.
I believe it is the obligation of the City to keep costs to
a minimum in not only the acquisition of property in L. I:D. #302 ,
but also in the increased construction costs that may be passed
on to us as property owners through the unnecessary delays
caused by the unalterable position of the City. I strongly
suggest that the City re-evaluate our property and the Edwards
property to save court costs through litigation.

On May 4„ 1978 I spoke with Marcus Partin who is representing
BEMP and the Edwards . He indicated to me that they rejected
our proposal for a right of. entry and that they refused to
permit us on the property until we had a Certificate of
Public Use and Necessity. I mentioned to Mr.. Partin that this
meant that the property would have to go through condemnation
and he agreed that that was the case.
Mr. Partin asked me for a copy of our appraisal and I indicated
to him that we would not surrender a copy of the appraisal
until we had .a copy o.f their appraisal upon which they placed
their values . There is a tentative unspoken agreement thaterdiale
or an appraisal will be undertaken prior to sit .

Dear Earl:
This letter is in response to a request from the Council
for a legal opinion concerning the ability and the legality
of the City to pay sums over and above appraisals in order
to acquire property for public use .
Please be advised that although there is a constitutional
provision forbidding the City to lend its credit or to give
anything of value away, in order to acquire property the
City may go over the appraisal amount to avoid the expense
of litigation and to acquire property that could not
otherwise be timely acquired.

This letter is in response to your letter to me dated
March 27, 1978 and received by my office March 30, 1978.
In your letter you state that our appraisor has not got
in contact with you. Please be advised that I had a
call the previous day from our appraisor, Mr. Wilcox,
and he told me that he had tried to reach you several
times, and that you were not available and had not
returned his telephone calls . What is more , it was -
my impression from our meeting attended also by Mr.
Houghton and Mr. Monaghan of the City, that you were to
provide the City and our appraisor with your information
concerning the value of this property. I can see no
reason why the City should surrender any more information
then it has, having previously surrendered most of our
information. We have only one item that we can go on, and
•
that is our appraisal . If you wish us to consider other
information, you should surrender that information to the
City.
I note that your letter is in response to my letter of
February 23, 1978 and since that time, I have sent you
another letter containing a right of entry. Could you
please inform us immediately if you are going to sign that
letter so that we can determine our future action. If we
do not hear from you within the next several days the
condeuuiation proceedings will be filed and we will immediately
request the court to give us a Declaration of Public Use and
Necessity so that we can have access to your property.

LETTER AGREEMENT
COMES NOW the undersigned as a partner in BEMP and
hereby grants and gives to the City of Renton a right of entry
upon the property commonly known as the Edwards Property and the
Suicuuers Property more particularly described as :
See Exhibit "A" attached hereto
for the purposes of surveying, staking and doing any and all
other work preparatory to the installation of certain roadways as
part of LID #302 , including but not limited to Lind Avenue S.W.
and do any and all other tasks incident thereto . This right of
entry in no way prejudices the parties' rights with respect to
just compensation for any and all easements or rights of way
hereinafter acquired by the City of Renton with respect to this
project.

pared and .a copy of the sale agreement is enclosed.
At the time you were requested to proceed with the condemnation of the Edwards
parcel it was not known that a temporary construction easement would be
required. The legal description of this 20 ft. strip is enclosed and it would
be appreciated if you could secure this easement as part of your right-of-way
acquisition.

CITY OF RENTON
REPORT AND RECOMMENDATION .
APPLICANT: BEMP Associates FILE NO. SP-134-78
LOCATION: Southwest corner of the intersection of Lind Avenue S.W.
and S.W. 19th Street.
SUMMARY OF REQUEST: Applicant requests the approval to fill and grade the
proposed subject site in preparation for possible future
development.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on March 8, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on March 14, 1978 at 10:20 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were sworn.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1. .
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

The Examiner asked for testimony from a representative of the Engineering Division of
the Public Works Department. Responding was:

In response to the Examiner's inquiry regarding the necessity for installation of a dyke
surrounding the subject property, Mr. Monaghan indicated that because the entire parcel
will be sloped towards a proposed sedimentation pond, provision ofa dyke will be
unnecessary. Regarding the Examiner's inquiry relating to proposed access to the site,
Mr. Monaghan reported possible access alternatives could include obtaining access on
S.W. 16th Street from the. Austin Company, utilizing access from Raymond Avenue S.W.
although it is also scheduled for construction during 1978, or utilizing either
alternative access temporarily until Lind Avenue S.W. is completed. Mr. Monaghan
confirmed the Examiner's inquiry that the Public Works Department would review all
possible access alternatives and constraints with the applicant. In response to the
Examiner's question regarding dedication of property for the Lind Avenue S.W. project,
Mr. Monaghan advised that all property is currently being acquired at a fair market
value. Regarding the fill elevation, the Examiner asked if the proposed level met the
current requirements of the King County Hydraulics Division. Mr. Monaghan reported that
two separate permit processes were established for the project; the City of Renton permit
does not require conformance to an elevation level, but receipt of approval from the
King County Hydraulics Division requires an elevation level for flood control of 21.8
feet when structural development is proposed.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Partin indicated that he was not in complete agreement and he would discuss concerns
relating to recommendations enumerated in Exhibit #1. Referencing Section 0.11 of the
report, Mr. Partin emphasized that utilization of Lind Avenue S.W. was necessary to
prevent delay of the fill project and meet the projected schedule for completion. He
advised that access to Lind Avenue had been granted to the City of Renton, Austin Company
and Metro during previous fill operations and felt that access should be allowed to the
subject property provided interference did not occur with the construction of the roadway.
He stated that cooperation between the contractors would be assured, but objected to
authority of approval provided to the contractor for the Lind Avenue S.W. project for
utilization of that access in the event he and the contractor for the subject property
may be business competitors.
Referencing Section 0.18 of Exhibit #1, Mr. Partin advised the necessity of extending the
recommended time frame for completion from two to three years, and noted that if Lind
Avenue S.W. could not be utilized for access, an extension to four years may be necessary
to complete the fill operation. He also requested review of the phasing plan by city
staff rather than through a formal hearing process if extension of time were deemed
necessary to complete the project consisting of 150,000 cubic yards of fill material.
The Examiner asked for testimony in support of the application. Responding was:

Mr. McCann, the contractor for the proposed project, reported that he is also the contractor
for fill operations on the Austin property to the north and will be actively pursuing the
contract on Lind Avenue. S.W. He reiterated Mr. Partin's comments relating to prior
utilization of Lind Avenue S.W. for access for fill operations by other businesses in
the immediate area and indicated his intent to cooperate with other contractors in
negotiating access to the subject site. He also expressed concern regarding the time
limit recommended by the Planning Department for the project, noting delays caused by
roadway construction on Lind preventing completion of the fill operation in less than
three to four years.
The Examiner asked for further comments in support of the application. Responding was:

Mr. Lang stressed the importance of access to the site from Lind Avenue S.W. because the
direction of the drainage flow is anticipated from the east side of the site from Lind
Avenue to the proposed sedimentation pond at the northwest corner and the project would
proceed in that direction.
The Examiner asked for testimony in opposition to the request. There was no response.
He asked Mr. Smith for comments regarding previous testimony. Responding to questions
of time limit and access, Mr. Smith reported that a letter had been received by the
Planning Department from Allen L. Lang, President, Eastside Consultants, Inc. dated
February 3, 1978 requesting a four-year time limit for completion of the 150,000 cubic
yard fill project., and indicated that Exhibit #1 could be amended to impose a three-year
time limit on the proposal from the date of license approval with the stipulation that
the access situation had been settled in a satisfactory manner with the Public Works
Department. The letter from Mr. Lang was read and entered into the record by the
Examiner as Exhibit #5.
The Examiner asked for further comments from the applicant. Mr. McCann reported a
desire to commence utilization of the roadway as soon as possible because of current
availability of fill material from other projects in the area and because of possible
delay of six months before commencement of the Lind Avenue project.
In response to the Examiner's inquiry regarding landfill elevation, Mr. Smith noted that
as a result of a current study of the established King County 21.8-foot flood level,
certain revision may occur, but the majority of fills in the area have maintained a
level of 18 feet. He indicated to the applicant that a requirement may exist to increase
the proposed elevation from 17 feet to meet the average flood level of other properties
in the area, but that the Public Works Department would review the matter with the
applicant.

Regarding requirements of Resolution No. 1923 pertaining to 2% landscaping requirement
for wildlife mitigation to be met at the time of development, the Examiner asked Mr. Smith
if the proposal meets the resolution requirements. Mr. Smith advised that the requirement
is maintained through interim as well as permanent development through recommendations
which provide for retention of the drainage channel and setbacks in their natural state.
He noted that through eventual construction of the proposed P-1 and P-9 channels,
landscaping on the site development would apply.
The Examiner noted that Exhibit #4 does not designate tapering of slopes at boundaries
of the site. Mr. Smith advised that Exhibits #3 and #5 denote a two to one proposed
slope which would conform to ordinance requirements. In response to the Examiner's
inquiry regarding content of fill material, Mr. Smith indicated that the ordinance
specifies requirements enforced during the annual permit process which include content
of fill material as well as compaction rate and other details of the fill project, and
that the contractor, Mr. McCann, had conformed to ordinance requirements in previous
projects.
The Examiner asked for further comments. Since there were none, the hearing on
Item #SP-134-78 was closed by the Examiner at 10:20 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a special permit to fill approximately 14.4 acres
with 150,000 cubic yards of landfill over a three to four year period.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter
and is hereby attached as Exhibit #1 and incorporated in this report by reference
as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971., as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity, except that sanitary
sewer is located some distance from the site but will be included in the Lind Avenue S.W.
LID.
7. The proposal may not be compatible with the setback requirements of Section 4-2314
and 4-729 (G) of Title IV, Ordinance No. 1628, Code of General Ordinances. Precise
setback requirements for the property under G zoning (Section 4-729) were not
established in the hearing.
8. Per Section 4-2303.2.C, the final uses and the site plan must be approved by the
Examiner. A public hearing will be held, and the Examiner must conclude that the
uses and site plan conform to the Comprehensive Plan and are compatible with the
vicinity as well as the applicable zoning requirements.
9. Landfill does not exist contiguous to the property.
10. The proposed elevation of the landfill (17 feet) is 4.8 feet less than the elevation
of 21.8 feet recommended by the King County Division of Hydraulics and the Department
of Ecology. A Flood Zone Control Permit has not been issued.
11. The applicant testified that fill material will comply with the requirements of
Chapter 23, Mining, Excavating and Grading Ordinance.
12. Vehicular access to the property is proposed via what will be Lind Avenue S.W.
However, the Public Works Department expressed reservations about utilization of this
future street until the forthcoming LID is completed the first part of next year.
All parties stated that the location of the access could be mutually developed to
satisfy everyone's concerns.

13. Storm water retention is to be accomplished via a retention pond at the northwest
corner of the site. The landfill is to be sloped and ditched to this pond, and
siltation prevention measures have been included to the satisfaction of the Public
Works Department.
14. An existing 30-foot wide drainage ditch exists along the northerly property line,
which serves other properties in the area.
15. An annual permit is required per Sections 4-2303.3, 4-2307.1, 4-2309'and 4-2310 to
insure compliance with the Examiner's decision and other requirements of Chapter 23.
16. Wildlife habitat of 2% of the site is required per the U.S. Soil Conservation
Service and City of Renton Resolution No. 1923.
CONCLUSIONS:
1. The proposal conforms to the Comprehensive Plan for the Green River Valley, provided
that wildlife habitat is provided on the site in the amount of 2% according to
Resolution No. 1923. Existing vegetation will be covered by the landfill operation.
The drainage ditch along the northern boundary of and within the property (Exhibit
#3) will be retained. It is appropriate that the landfill be sufficiently set
back from this ditch and bank stabilization measures taken to preserve the ditch
and not endanger the flow of water (Sections 4-2313 and 4-2319) .
2. Access to the site remains somewhat unresolved, due mainly to the construction of
Lind Avenue S.W. From the testimony, it appears that a satisfactory access can be
resolved by the applicant and the Public Works staff.
3. Section 4-2303.2.B requires that the Examiner conclude that the fill activity
". . .not be unreasonably detrimental to the surrounding area. Based upon the
testimony submitted in the public hearing and the physical characteristics of the
site, the proposed landfill is compatible with and similar to existing landfill
operations in the vicinity and therefore of no unreasonable detriment to other
properties. Restrictions are necessary to control erosion and to mitigate loss
of wildlife habitat.
4. Dust and mud control measures were not discussed during the hearing. These impacts
of the landfill operation upon public streets or private property must meet the
requirements of Section 4-2312.8.
5. To control erosion of the landfill and provide minimal wildlife habitat pending
approval of a final development plan, it is appropriate that the landfill be
hydroseeded during the operation. During review of the annual permit per
Sections 4-2303.3, 4-2307.1, 4-2309 and 4-2310, other erosion control measures
may be required as the circumstances warrant.
6. The landfill operation was indicated to require close to four years if delayed
by the construction of Lind Avenue S.W. A three-year minimum time period was
indicated by the applicant. These time frames appear reasonable in view of the
other landfill operations in the vicinity. However, as filling progresses, the
need may arise for rehabilitation of the site in a manner other than hydroseeding
(Section 4-2306) . If during review of the annual permit such a need is identified
by city staff, the appropriate rehabilitation measures should be required by staff.
7. Section 4-2314 requires that the top of the slopes of the landfill be set back
10 feet in addition to the normal building setback. As no slope occurs on the
easterly boundary of the property, this section applies only to the other boundaries
of the property. These setbacks can be determined by the Planning Department.
Because "moats" could be eventually created around the property, it appears
appropriate for a variance to be sought from the requirements of Section 4-2314.
DECISION:
Based upon the record, testimony, findings and conclusions, it is the decision of the
Examiner to approve the requested special permit (Exhibit #3) for a landfill subject to:
1. The toe of the landfill be set back sufficiently from the drainage channel and
the bank of the landfill sufficiently stabilized to prevent sluffage into the
drainage channel as approved by the Planning and Public Works Departments.
2. Resolution of the access by the Public Works Department.

3. Approval of the State Flood Zone Control Permit by the King County Division of
• Hydraulics.
4. Hydroseeding of other erosion control measures that are deemed appropriate by the
Planning and Public Works Departments.
5. Rehabilitation of the site per Section 4-2306 as deemed necessary by the Planning
and Public Works Departments.
6. Appropriate dust and mud control measures as approved by the Public Works Department
per Section 4-2312.8.
7. Top of slopes set back 10 feet from building setback lines established in
Section 4-729.
8. Completion of the operation in three years after receipt of landfill permit. A
one-year extension may be granted by the Planning and Public Works Department upon
showing by the applicant of reasonable cause for delay in completing the operation.
9. Compliance with all other applicable sections of Chapter 23.

F. NEIGHBORHOOD CHARACTERISTICS :
The area surrounding the site is a mixture of undeveloped land and
industrial uses with some residential and commercial .
G. PUBLIC SERVICES :
1 . Water and Sewer : A sixteen (16) inch water main runs south along
Lind Avenue SW to SW 19th Street. At that intersection the
sixteen (16) inch main changes to a twenty-four (24) inch main .
Southeast of the subject site , an eight (8) inch sanitary sewer
runs along East Valley Highway while approximately one-third (1/3)
of a mile to the west , a Metros Gravity Line is available. Water ,
sewer , and storm drainage facilities are planned in conjunction with
the Lind Avenue SW project , the construction of which is to begin
in the summer of 1978.
2. Fire Protection : Provided by the Renton Fire Department , as per
ordinance requirements . Any future development of the site will
be subject to City of Renton Standards .

4. Schools : No schools are located in close proximity to the site .

0. PLANNING DEPARTMENT ANALYSIS :
1. The subject request is consistent with the Comprehensive. Plan and
other similar fill permits recently granted in the area.
2. The general area is experiencing significant changes which together
reflect a transition from undeveloped land to commercial /industrial
uses . Such changes include the approval of fill and grade permits
needed to prepare sites for development, recent new development in
the area ( i . e . Group Health facility ) , and the Lind Avenue S . W.
street project. The site is just south of the Austin Company
property, the northerly portion of which a fill and grade permit
• was granted for on September 13, 1977 .
3. The subject proposal will add approximately six (6 ) feet of
elevation (approximately 150,000 cubic yards of fill material )
to the 15 . 4 acre site. This is considered an engineered grading
project per ordinance definition .
4 . Plans for proposal have been reviewed by all the applicgble
City departments . Comments are attached to this report and
should be included as conditions for any permit granted.
5 . All utilities are in close proximity or planned as part of the
Lind Avenue S . W. street project.
6 . The proposed elevation of the site will be 17 feet . Future
development will be required to attain a 21 . 8 foot flood
proofing elevation as required by the King County Division of
Hydraulics and Department of Ecology. A state flood zone con-
trol permit will be required for the project. Any special ,
permit approval should be subject to such approval .
7. Interim storm drainage facilities have been indicated on the
plans and reviewed by the Public Works Department. No signifi -
cant problems were noted. (See memo from office engineer
dated February 24, 1978. )
8. An existing 30 foot wide drainage ditch is located along the
north property line of the subject site. A setback should be
maintained along so as not to impact this existing ditch .

scaping and Open Space, page 6)
9 . No specific site development has been proposed. However, Sec-
tion 4-2303. 2. C. requires Hearing Examiner approval of any
proposed future site development.
10 . The site is presently zoned G (General Classification District)
and will be required to be rezoned to M-P (Manufacturing Park
District) prior to development of the site . It also appears
that a short plat is needed as it appears that the site is
actually a portion of a larger tract of land. Additional
dedication for street right-of-way, especially along Raymone
Avenue S . W. and possibly S. W. 19th Street , will be required as
part of future rezoning and site development.

11. Access to the landfill will eventually be from the Lind Avenue SW
right-of-way. However, this facility will not be open for public
use for nine (9) to twelve ( 12 ) months . (See memo from office
engineer dated February 24, 1978) Any special permit should be
granted subject to the condition that the annual license not be
granted until sufficient access is provided per Public Works
Department approval .
12. Sufficient methods to control mud and dust off-site will be required
per ordinance requirements . This includes methods such as water
sprinkling and street sweeping. (Section 4-2312 )
13. It may be necessary during the cause of the fill operation for the
Public Works Department to require for safety purposes additional
traffic control measures on public streets near the site , especially
at the intersection of SW 16th Street and Lind Avenue SW. ; (Section
4-2312)
14 . The two (2) percent site landscaping suitable for wildlife food
and habitat required by the Soil Conservation Service and City
Resolution No. 1923 will be added per Planning Department approval
at the time of specific site daevelopment.
15 . • Proper site rehabilitation and erosion control methods including ,
but not limited to hydroseeding should be provided progressively
as the site is filled.
16. A performance bond or similar vehicle per Section 4-2309 may be
required during the annual permit process to insure proper compliance
with ordinance requirements .
17. Soil engineering and engineering geology reports shall be submitted
with the annual license application per Section 4-2310 . 2 . B .
18. A time frame should be established for the Special Permit with
possible review and extension at the termination of such period.
This would expedite the fill process and shorten the time that the
surrounding area will be disrupted . A two ( 2) year period appears
reasonable. The applicant has not proposed a phase plan .
P. PLANNING DEPARTMENT RECOMMENDATION :
Recommend approval of the Special Permit for fill and grade for a two-
year period with possible additional review at such time subject to
the following conditions :
1. Conditions as noted in February 24, 1978, memo from Donald Monahan ,
Office Engineer, Pubilc Works Department.
2. Access shall not be permitted from Lind Avenue SW until Lind Avenue
SW is completed. Proposed access shall be subject to approval of
the Public Works Department (See abovenoted February 24, 1978 memo ) .
3. Soils engineering and geology reports shall be required as part of
annual license approval process per Section 4-2310. 2 . B.
4. Final interim drainage plans shall be approved by the Public Works
Department.
5. Approval of a State Flood Zone Control permit by King County Division
of Hydraulics .

6. Final approval by the Public Works and Planning Departments of
erosion control methods in order to minimize erosion of the land-
fill onto adjacent properties and drainage ways . These methods
are to be compatible with the storm water drainage, retention , and
sedimentation system, and will include appropriate safeguards to
insure stabilization of the landfill during periods of inactivity
and upon completion of the landfill operation .
7 . Final Planning Department approval of the two ( 2) percent landscaping
for wildlife habitat mitigation requirement as part of future site
development plan approval .
8. Final approval of the uses and site plan for the property by the
Hearing Examiner after conducting a public hearing.
9. Final approval by the Planning and Public Works Departments of the
annual permit which shall include the discretion to require a
performance bond or similar device per Section 4-2309.
10. Final approval by the PUblic Works Department of the measures taken
to satisfy the requirements of Section 4-2312, Work in Progress .
This shall include resolutiondof the access situation and provision
of proper site watering and street clearing procedures to be
• utilized.
11 . A minimum twenty (20) foot setback from the drainage channel right-
of-way line along the northerly boundary of the subject site to
insure protection of the drainage channel and provide certain area
for wildlife mitigation during the fill process and prior to' develop-
ment of the property.
12. Further dedication of street right-of-way to be considered at the
time of rezone and site development.

price for acquisition of the right of way. I would also
request that you reply to me in writing whether or not
you wish to agree to the City' s prior offer of $ .15 per

Dear Mr. Gonnason:
As you acknowledged in your letter of November 30 , 1977,
our property along the proposed route of Lind Avenue S.W.
has been filled. I assure you that the fill material .
does meet specifications for fill material under Renton' s
filling and grading ordinance. It is also our opinion
that the material is comparable to the material utilized
by other property owners in this area. If the city feels,
however, that the material must be removed we offer the
following alternatives :
1. Realign the roadway taking all of the right
of way off the city owned property to the east.
2. Remove all of the material from the right of
way you desire to purchase and place it back
on our property at a location mutually agreed
upon.
3. Trade a city owned parcel for our property.
4. Offer a more realistic price.
It would seem to me that if the city is serious about
negotiating in good faith for the purchase of our property
it would at least request a meeting. I would then be in
a better position to indicate what we may or may not
accept as fair compensation.
We are most interested in resolving this matter as soon
as possible, however, if the city does not demonstrate
an interest in negotiating in good faith we are prepared
for the condemnation process. I shall await your response.

located on Lind Avenue SW has recently been purchased
by BEMP Associates, 3016 Benson Road South, Renton,
Washington, 98055. All future correspondence should
be directed to me personally at the address of BEMP Associates.
The City of Renton' s official offer of $4 , 000 , based upon
$0. 15 per square foot, for the strip of land forty feet
wide on the east side of our property is unacceptable. You
should be aware that the property required by the city for
street purposes has been filled and therefore has a value
much greater than is being offered by the city. As a matter
of fact, the cost of filling the property far exceeds the
amount offered by the city.
It is our recommendation that you review your offer and
resubmit an offer to us that would reflect a much more
accurate estimate of the true market value. At that time,
we would be pleased to meet with you to finalize our
negotiations with you.

RE : PROPOSED LID ON LIND AVENUE SW
This letter is to inform you that I have a financial
interest in a parcel of property located on Lind
Avenue SW between SW 19th Street and SW 21st Street
known as Tax Lot 13 . Even though I see no potential
conflicts , I would prefer not to be included in any
meetings or decisions regarding this LID.
I would also point out that I do not intend to
protest the LID as proposed although I think the
proposal for the abutting property owners to pay
100 percent of the costs of this LID is highly
unusual. The roadway as designated by the Arterial
Street Plan is classified as a secondary arterial ,
and many of the design provisions are for the
general public and not the benefit of the abutting
property owners . I feel that the City should
participate to some extent in a roadway of this
classification.

Reference is made to my letter of August 24, 1977 offering to purchase
a portion of your property for the purpose of providing the necessary
Right-of-Way for the improvement of Lind. Ave. SW.

As you are aware the City of Renton at the request of adjacent property
owners has formed LID 302 for the purpose of improving Lind Ave. SW
between SW 16th St. and SW 43rd Street. This improvement will require
that a strip of land forty feet wide on the east side of your property
be acquired by the City.
The strip of land that will be required was appraised by Wilcox and
Asso. , Inc. A copy of that portion of the appraisal that pertains to
your property is enclosed for your review. The appraisal in its
entirety is available for review at City Hall in the Public Works
Department.
The City would be willing to pay $4,000 for the property that is
required from you based upon $0. 15 per sq. ft . The City will absorb
all costs in conjunction with this transaction including preparation
of deeds, title report and filing fees.
Would you please advise if this proposal is satisfactory and if you
would be willing to deed the forty foot strip to the City for the mar-
ket value as indicated by the appraisal .
If you have any questions or would like additional information, please
