PROJECT DESCRIPTION: Evergreen City Ballet requests a Tier 1 Temporary Use Permit pursuant to Renton
Municipal Code (RMC) Code Section 4-9-240 to install two (2) murals using detachable plywood panels installed
over existing exterior building windows for the purpose of covering the windows while the building is under
construction and Evergreen City Ballet is occupying the rear studio space. The first mural will face Bronson Way
N; the second will face the alley abutting the east side of the building (Attachment 1). The mural facing Bronson
Way N will be 42 feet long by 7.5 feet tall (42’x7.5’); the mural facing the alley will be 15 feet long by 7.5 feet
tall (15’x7.5’) (Attachment 2). The murals will depict artwork by Renee Hazen and feature silhouettes of
ballerinas in a variety of poses with the slogan “Dance is for all”. The silhouettes will feature male and female
dancers, children, a variety of hair styles and body types to represent the diversity of the Renton dance
community (Attachment 3). The work has received an award of $5,300.00 from the Renton Municipal Arts
Commission (Attachment 4). Both murals would be located within a High Seismic Hazard area and Wellhead
Protection Area Zone 1; no other critical areas are located on the site. No ground disturbance activity or
alteration to the structure of the building is proposed. An Abatement Agreement, dated August 2, 2022, was
included with the application (Attachment 5).

The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions::
*CONDITIONS OF APPROVAL:
1.The murals shall be removed from the building exterior windows prior to scheduling the final inspection
of the Tenant Improvement permit or upon expiration of the TUP on September 12, 2023, whichever
comes first.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened
by the approval body. The approval body may modify their decision if material evidence not readily discoverable
prior to the original decision is found or if they find there was misrepresentation of fact. After review of the
Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there
will be no further extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14-day appeal time frame.
APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on September 26,
2022. Due to the ongoing state of emergency enacted by Governor’s Proclamation 20-28.14 (and as
amended), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted
electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub
Monday through Friday. The appeal fee, normally due at the time an appeal is submitted, will be collected at
a future date if your appeal is submitted electronically. Appeals to the Hearing Examiner are governed by
RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s
Office, cityclerk@rentonwa.gov.
EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit,
unless the Community & Economic Development Administrator or designee establishes a shorter time
frame or an applicant can request that a permit be valid beyond the one (1) year expiration, for up to five (5)
years at the time of application or prior to permit expiration.
EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to
permit expiration to the Department of Community & Economic Development Administrator.
