PROJECT DESCRIPTION: The applicant is requesting a Temporary Use Permit for a lumber store to be occupied
by Compton Lumber at 2940 East Valley Road. The project site totals 69,696 sq. ft. and is located within the
Commercial Arterial (CA) zone and Urban Design District D. A wetland is mapped on the east side of the project
site. The applicant has paved the existing surface parking lot, drive aisles, and lumber storage area, some of the
paving extended beyond the boundaries of the existing impervious surface areas (i.e. along the north, south
and east portions of the project site). In addition, a portion of the new pavement was installed without approval
within the onsite wetland buffer located on the east side of the project site. An outstanding code compliance
case (CODE21-000302) regarding the fill places within the wetland buffer is currently open on the project site.
A total of 12 surface parking spaces were striped within the surface parking lot. Compton Lumber obtained Site
Plan approval, under LUA19-000050, for the construction of a permanent building on the four (4) abutting
properties to the south. The Site Plan approval expired on October 11, 2021. The applicant is requesting a
temporary use permit to occupy the existing building while the necessary permits are obtained and a
permanent building for Compton Lumber is constructed on the four (4) abutting parcels to the south. The
applicant is requesting that the temporary use permit be valid for a period of one year or until the permanent
building for Compton Lumber is completed. A wetland and high seismic hazard area are mapped on the project
site.
DECISION CRITERIA: The Administrator may approve, deny, modify, or condition an application for a temporary
use permit, based on consideration of the following factors:
1. The temporary use will not be materially detrimental to the public health, safety, or welfare, nor injurious

to property or improvements in the vicinity of the temporary use; and
The applicant contends that the proposed temporary use would not be detrimental to the public health, safety,
or welfare or injurious to property or improvements in the vicinity as the existing building that would house the
temporary use was previously occupied by a lumber sales use.
Staff has reviewed the request and concurs that the proposed temporary use would not have a detrimental
impact on surrounding uses and properties, provided that the applicant submits a new complete land use permit
application for their permanent building within 90 days of the issuance of this temporary use permit and
removes the pavement placed within the wetland buffer and restores the wetland buffer in accordance with the
City’s adopted Critical Areas Regulations. A Critical Areas Exemption and buffer restoration plan shall be
submitted for the removal of the pavement to the Current Planning Project Manager for review and approval
within 90 days of the issuance of this temporary use permit, unless otherwise approved by the Current Planning
Project Manager.
2. Adequate parking facilities and vehicle ingress and egress are provided to serve the temporary use and any
existing uses on the site; and
The applicant is proposing to utilize the existing driveway access and 12 surface parking spaces have been
striped on the project site for customer use. Staff concurs that adequate access and parking are provided for the
proposed temporary use.
3. Hours of operation of the temporary use are specified, and would not adversely impact surrounding uses;
and
The proposed hours of operation are 7:00 am to 3:30 pm, which are not anticipated to adversely impact
surrounding uses.
4. The temporary use will not cause nuisance factors such as noise, light, or glare which adversely impact
surrounding uses; and
Ther proposed temporary use would occupy an existing building and is therefor e not anticipated to generate
excess noise, light, or glare that would adversely impact surroun ding uses.
5. If applicable, the applicant has obtained the required right-of-way use permit.
Not applicable. The proposed use would not occur within the public right-of-way.
The Temporary Use Permit is hereby Approved with Conditions* and subject to the following conditions::
*CONDITIONS OF APPROVAL:
1. The applicant shall submit a new complete land use permit application for their permanent building
within 90 days of the issuance of this temporary use permit or this temporary use permit shall be
considered null and void, unless otherwise approved by the Current Planning Project Manager.
2. The applicant shall remove the pavement placed within the wetland buffer and restore the wetland

buffer in accordance with the City’s adopted Critical Areas Regulations. A Critical Areas Exemption and

Project Manager for review and approval within 90 days of the issuance of this temporary use permit,
unless otherwise approved by the Current Planning Project Manager.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened
by the approval body. The approval body may modify his decision if material evidence not readily discoverable
prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the
Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there
will be no further extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14-day appeal time frame.
APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on October 10, 2022..
Due to the ongoing state of emergency enacted by Governor’s Proclamation 20-28.14 (and as amended), the
City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City
Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub Monday through Friday. The
appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is
submitted electronically. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional
information regarding the appeal process may be obtained from the City Clerk’s Office,
cityclerk@rentonwa.gov.
EXPIRATION: A Temporary Use Permit is valid for up to one (1)-year from the effective date of the permit, unless
the Community & Economic Development Administrator or designee establishes a shorter time frame or an
applicant can request that a permit be valid beyond the one-year expiration, for up to five (5) years at the time
of application or prior to permit expiration.
EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit
expiration to the Department of Community & Economic Development Administrator.
