Introduction The State Environmental Policy Act of 1971, Chapter -43.21C, RCW, requires •
all state and local governmental agencies to consider environmental values both for their
own actions-and when licensing private proposals . The Act also requires that an EIS be
prepared for -all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely -as you can with the information
presently available to you. Where explanations of your answers are required, or where
' you believe an explanation would be helpful to government decision makers , include your
explanation in the space provided, or use additional pages if necessary. You should
.include references to any reports or -studies of which you are aware and which are rele-
vant to the• answers you provide. Complete answers to these questions now will help all
agencies involved with your p-roposal to undertake the required environmental review with-
out unnecessary delay.
The following questions apply to yourtotal proposal , . not just to the -license for which
you are currently applying or the proposal for which approval is sought. Your answers
should include the impacts which will be caused by your proposal when it is completed,
even though completion may not occur until sometime in the future. This will allow all
of the agencies which will be involved to complete their environmental review now, with-
out duplicating paperwork in, the future.
NOTE: This is a standard form being used by all state and local agencies in the State.
of Washington for various types of proposals . Many of the questions may not apply to
your proposal . If a question -does not apply, just answer it "no" and continue 'on to the

5. Water : No surface water was observed on the subject site.
6. Land Use: An existing auto repair shop is located on the subject
site along with..three older single family residences . To the west
and south is the ePuget Power complex while an auto parts store
and other retail businesses are located to the north of the
subject site.
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are of a mixed land use with the trend
being a transition from older single family and light commercial
to more intensified commercial, light industrial and some multiple
family.
F. PUBLIC SERVICES :
1. Water and Sewer : 10" and 14" water mains extend north-south on
Main Avenue South adjacent to the subject site and an 18" main
is located on South Grady Way. 8" sanitary sewers are found on
Main Avenue and near the southwest portion of the property.
2 . Fire Protection: Provided by the Renton Fire Department as per
ordinance requirements.
3. Transit : Metro Transit Route #155 operates along South Grady
Way adjacent to the subject site.
4. Schools : Talbot Hill Elementary School is within 14 miles to
the southwest of the subject site and Fred Nelsen Junior High
School is approximately 1* miles to the southeast , while Renton
Senior High School is within 3/4 of a mile to the northwest .
5. Recreation: Jones, Liberty and Cedar River Parks are all within
3/4 of a mile to the north of the site.

D. PHYSICAL BACKGROUND :
1. Topography : The site is generally level except for the extreme
south portion which rises from west to east at approximately a
2% slope.
2 . Soils : Urban Land (Ur) . The erosion hazard is slight to moderate.
No capacbility or woodland classification .
3. Vegetation : Most of the natural vegetation has been replaced
with asphalt although a few small shrubs and medium growth
deciduous trees remain on site.
4. Wildlife : Some vegetation may be suitable for birds and small
mammals.

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton' s Environmental Ordinance a d the
State Environmental Policy Act of 1971 , as amended, RCN -43 21C,
a declaration of non-significance has been issued' 'for the roposed
rezone. However, subsequent development will require furt er
environmental review.

L. PLANNING DEPARTMENT ANALYSIS :
1. The proposed rezone of the subject site is consistent ith the
Comprehensive Plan designation of Light Industrial for the subject
site and surrounding area.
2. The Fire Department indicates that a turn-around for e ergency
equipment willbe required at the east end of the pipes em road.
3. Even through the Comprehensive Land Use Plan clearly states
that this area should be light industrial, the present zon-
ing and land uses around the site suggest that the curent
request to rezone to L-1 from B-1 and R-3 is untimely. The
proposed use of a retail shopping center would be more
appropriate in a B-1 zone. The site is relatively close
to the central business district and single family residen-
tial uses to the northwest .

setback would be 20 feet from the edge of the existing roadway.
The Examiner inquired if the applicant was withdrawing the, zoning request of B-1 and R-3 •
to L-1 and replacing it with a request for L-1 and R-3 to B-1 designation. Mr. Brown
.responded affirmatively. The Examiner advised that the burden of proof for justification
for rezone is the responsibility of the applicant and requested testimony from either the
applicant or the Planning Department staff. Mr. Clemens advised that the current zoning
classification predates the Comprehensive Plan adoption in 1965, and since subsequent
revisions in 1967 and 1968, no significant Comprehensive Plan or zoning review of the site
has occurred.

•Mr. Schourp advised that structures on the subject site have existed since the late 1930's
and, the intent of the applicant to remove deteriorating buildings would enhance the area
and be an asset to the neighborhood. He requested, further clarification regarding
required setbacks from Grady Way and Benson Road South. The Examiner requested response
from Warren C. Gonnason, Public Works Director. Mr. Gonnason reviewed the process of
city designation of state 'highways and noted that the matter of reclassification had
recently been presented to the City Council for consideration. He advised that the
department would research the matter further to determine if Benson Road South will retain
its designation .as a state highway in view of plans for construction of SR-515 in the area.
Mr. Gonnason indicated that although highway designations would not be a factor in the •
rezone of the property, it may affect the site planning at a future date. He also noted
that although off-site improvements exist on Grady Way South, they would be required on
Benson Road South as a condition of development.
Mr. Schourp reported that existing structures on the site are currently located within
the recommended setback area off of Benson Road South and it is the applicant's desire
to construct the new buildings as near an existing 18-foot bank adjacent to the roadway
as possible to develop the property to its best use. The Examiner advised that variance
from the 20-foot setback requirement would be within the jurisdiction of the Board of
Adjustment, not the' Hearing Examiner. Mr. Clemens clarified that the ordinance requirement
does not relate to the requirement of setback from state highways., but relates to setback
from a major city street'and the ordinance specifies Benson Road South and N.E. 4th Street.
The Examiner indicated that because the city requirement would not be affected by a
future revision in state highway designation, a variance may be requested from the Board
of Adjustment for setback revision.
Mr. Brown reported that Ordinance No. 2272, adopted September 19, 1966, approved a rezone
of a portion of the subject site from R-3 to B-1 which further supports the subject
request for rezone of multiple family designation to business category. He also requested
clarification of earlier discussion regarding requirement of off-site improvements on
Benson Road South from the apex of the property to the southeast corner. Mr. .Gonnason
confirmed that curbs, gutters, sidewalks, storm sewers would be required.
•
The Examiner requested further comments. Since there were none, the hearing on File No.
R-363-79 was closed by the Examiner at 10:20 a.m.

REPORT: the Examiner on July 16, 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examinin•
available information on file with the application, and Meld
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on July 17, 1979 at 9:00 a.m. in the Council Chambers of th- Renton
Municipal Building.. .
It was determined by the Examiner that the hearing should be continued because rec-ipt
of Public 'Works Department staff comments had not occurred prior to the scheduled earing.
The Examiner requested an estimated date of receipt of comments from Paul Lumbert,
representative of the Public Works Department. Mr. Lumbert indicated that comment- could
be transmitted in a timely manner to allow continuance for one week. The Examiner
subsequently continued the hearing to July 24, 1979 at 9:00 a.m. to be held in the Council
Chambers of the Renton Municipal Building.
CONTINUANCE:
The hearing was opened on July 24, 1979 at 9:55 a.m. in the Council Chambers of t e Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record' as Exh bit #1.
Roger Blaylock, Associate Planner, assisted by David Clemens, Senior Planner, rev ewed
Exhibit #1, and entered the following additional exhibit into the record:
Exhibit #2: Site Plan. with staff comments
Mr. Blaylock corrected Section B.7 to add L-1 designation to existing zoning on t e property;
and deleted Section L.2 pertaining to Fire Department requirements for a turnarou d for
emergency equipment at the end of the pipestem .road from the recommendation. He Toted that
revision of the plan eliminated the pipestem road from the proposal. The Examiner
clarified the designation of Main Avenue S. on Exhibit #2 which should be correc ed to
reflect Benson Road S. just south of the intersection of Grady Way and Main Aven e S.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

The' Examiner,•inquired if a required 50-foot setback from the centerline of Benso Road South

as the L-1 category. Mr. Clemens referenced Section 4-716. (b) (1) , Primary State Highway

4: Further, the Comprehensive Plan appears to merge various uses in the area in which
the subject property is located which probably accounts for the multiple zoning
category applied to the subject property. The proposed classification, B-1, would
seem an appropriate zone for the subject property and the proposed use, one which
would blend well with the surrounding uses and not introduce development or zoning
which would be out of character for the area.
5. The subject property's location next to and just south of the Central Business District .
and relatively close to a single family residential district to the northwest indicates
that the site would be appropriate for the proposed shopping center. The proposed
zoning to B-1 would therefore better serve the existing and surrounding development
than L-1. The public interest would be met by the proposed rezone to B-1.
RECOMMENDATION:
•
The requested reclassification for L-1 and R-3 to B-1 should be approved by the City
Council subject to approval by the Planning Department of the site and landscaping plans.

Pursuant to Title IV, Section 3015 .of the City's Code, request for reconsideration must
be filed .in writing on or before August 15, 1979. Any aggrieved person feeling that the
decision of the Examiner is based on' erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available at
the prior hearing may make a written request for review by the Examiner ,within fourteen
(14) days from the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, .after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires

at cost in said department.

5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal will have to meet the required setbacks, lot coverage and height
requirements of Sections 4-711 (business zone) and 4-716(b) (1) (Highway Restrictions)
of Title IV, Ordinance No. 1628, Code of General Ordinances. The applicant may
apply for variances from mandated requirements by applying to the Board of Adjustment.
8. The subject proposal is located at the junction of South Grady Way and Benson Highway.
9. The site is generally level except for the extreme south portion where the slope
rises from west to east at about a 2% slope. While most of the site is developed
with a variety of structures in various states of repair, there is still some natural
vegetation consisting of some small shrubs and deciduous trees.
10. The area around the subject site is in transition from older single family residential
and commercial to intensified commercial and some multifamily residential. Puget
Power's complex is located to the south of the subject property.
11. The subject property is presently comprised of three zone classifications - L-w, B-1
and R-3. The applicant had originally requested a reclassification of the subject
property to L-1 but changed the request to B-1 which better suited the intended use,
a retail shopping center.
12. The subject property is surrounded by various zoning categories including S-1
(single family residential) , R-3 (multifamily residential) , and H-1 (heavy industry) .
The east margin of the subject property is street (Benson Highway) and interstate
(I-405) right-of-way.
13. The area had already been zoned its present classifications prior to the enactment
of the Comprehensive Plan in 1965. The Comprehensive Plan indicates that the area
in which the subject property is located may be or would eventually be suitable for
light industry.
14. The Planning Department indicated that the use of this area for light industry would
probably be premature and out of character with the area, and that the proposed use
would be better suited to a B-1 zone. Part of the property is already zoned B-1.
15. The present development on the subject property consists of vacated and abandoned
dwellings and a car repair shop and car parts shop.
16. The applicant proposes constructing a retail shopping center on the site with access
via Grady Way South. The Public Works Department had indicated that Grady Way South
could accommodate both the increased traffic and the turning movements.
17. It does not appear that this site was considered in any previous land use or zoning
analysis since the adoption of the Comprehensive Plan.
18. The Central Business District is located to the north of the subject site and single
family residential uses lie to the northwest of the subject site.
CONCLUSIONS:
The proposed reclassification of the subject site would reclassify the three existing
zoning categories of the site into one. The proposal would change the mixed B-1, R-3
and L-1 classifications to a uniform B-1. The site does not appear to present a
viable location for residential development as it is located at the intersection of
two heavily traveled roads, Grady Way and Benson Highway, and is very near to I-405.
2. There is a large L-1 area to the west and south of the subject property, part of
which zone includes the subject property. The loss of that portion of the L zone
which is proposed for reclassification by the applicant will not harm the rem.ining
L-1 property and is not necessary to the development of light industry in the City
of Renton.
3. The area has not been the subject of any similar request since the enactment 'f the
Comprehensive Plan and therefore the requirements of Section 4-3014(A)1 have ►een
met. While the Comprehensive Plan may indicate that the area in which the s ,ject
property is located is suitable for some form of industrial zoning, the Comprehensive
Plan would not preclude construction in the L-1 zone of the proposed retail c,nter
(a permitted use in the L-1 zone) . The retail use would be better suited to he B-1
zone the applicant has requested.

The applicant has requested a waiver of off-site improvements
along Benson Highway. The east side of Benson Highway is
presently improved, and along the west side of Benson Highway
in this area there are only two property owners, Atlantic
Services and Puget Power. It is very unlikely that an LID
situation will ever develop on the site, and the result will
be that the City will have to improve the right-of-way itself.
RECOMMENDATION:
It is recommended that the Board of Public Works deny the
waiver request , and the improvements are to be constructed
at the time of the development of the property.

recommendation for King County to directly operate paramedic .ervices

program would be to handle administration and funding. Also, explaining
proposed county wide six year levy issue to fund basic and pa amedic
services at approximately $.21/$1,000 from Renton would total
$195,775.00. King County Councilwoman Pat Thorpe noted desire for
City to be aware of the program coming before the County Council
probably next week requesting the County administrate such a program.
Councilman Stredicke requested that a countywide 911 program be
included.

Kennydale Trunk and Kennedy, Inc. have prepared cost estimates for installation
Sewer Lines of the Honeydew and Kennydale trunk sewer lines at total con-
and struction cost of $1 ,650,000 including 10% inflation factor from
Revenue Bonds present until proposed commencement of construction in one year.
Proposed The letter proposed the city install ' sewer lines connecting with
Metro installed trunk lines explaining that the city will realize
' savings through elimination of Sunset and Honeydew pump stations
into the Highlands trunk line . The letter proposed that the
city's initial installation financing will be recollected by means
of a latecomer agreement as properties 'in the drainage basin that
develop and connect to the system at estimated $0.030 per sq. ft.
Also, properties now developingTin Kennydale and Honeydew basins
can be assessed, at present six developments would amount to
assessment of $49,000. The letter requested authorization to -
establish a project fund for the two trunk lines to be financed
by revenue bonds and to proceed with the design and construction
of the Kennydale and Honeydew trunk lines to connect to May Creek

Cedar Tree large cedar tree from the south side of the museum. The r:port
at Historical noted Mr. Tonda changed his request to trimming 'of tree af 'ecting
Society Museum down. spouts and asked that drain tile be repaired, that bu lding
work accomplished since the fire department vacated the bu lding
has been primarily financed by the Historical Society thro gh
state and county grants, some work done by the Renton Buil .ing
Department. The report .recommended that the original request
to remove the tree be denied and that the matter of trimmi g,
drain work and landscaping maintenance be referred to the .dminis-

J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended, RCW 43-21C,
a declaration of non-significance has been issued for the proposed
rezone. However, subsequent development will require further
environmental review.

L. PLANNING DEPARTMENT ANALYSIS :
1 . The proposed rezone of the subject site is consistent with the
Comprehensive Plan designation of Light Industrial for the subject
site and surrounding area.
2. The Fire Department indicates that a turn-around for emergency
equipment willbe required at the east end ofthe ,pipestem road.
3e Even through the Comprehensive Land Use Plan clearly states
that this area should be light industrial, the present zon-
ing and land uses around the site suggest that the current
request to rezone to L-1 from B-1 and R-3 is untimely. The
proposed use of a retail shopping center would be more
appropriate in a B-1 zone. The site is relatively close
to the central business district and single family residen-
tial uses to the northwest .
M. DEPARTMENTAL RECOMMENDATIONS :
Based upon the foregoing analysis , the evidence indicates that
an alternative solution is more appropriate at this time.
Therefore , the staff recommends that the request for rezone
from B-1 to L-1 be denied and that the areas designated as L-1
and R-3 be rezoned to B-1 subject to the condition that a
detailed site and landscape plan is reviewed and approved by
the Planning Department prior to issuance of a building permit .

attached copy) which apply to the Shafram property (note
attached map) . Area #3 is presently under review by the
Hearing Examiner, and the restrictive covenants will apply
to said properties. The remaining portion,.. Area #2, which
includes two lots, remains, however, the property owners
presently living in Arizona. The twenty foot (20' ) setback
requirement along the Benson Highway would apply in any
N. event with or without the restrictive covenants.
It is, therefore, our recommendation that the City Council
accept said covenants and proceed with consideration of the
rezone request. .

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM LIGHT
INDUSTRIAL DISTRICT (L-1) AND RESIDENCE DISTRICT (R-3)
TO BUSINESS DISTRICT (B-1) R.-363-79 (ATLANTIC SERVICES,
INC.)
WHEREAS under Chapter 7, Title IV (Building Regulations) of. Ordinance -
No. 1628 Known -the "Code of General Ordinances of the City of Renton", as
- amended, and: the maps and reports adopted in conjunction therewith,' the property
hereinbelow described has heretofore been zoned as Light Industrial District (L-1) and
Residence District (R-3); and
WHEREAS a proper petition for change of zone classification of said property
•
_has been filed with the Planning Department on or about June 12, 1979, which petition
was duly referred to the Hearing Examiner for investigation, study and public hearing,
and a public hearing having been held thereon on or about July 17, 1979, and said
matter having ,been duly considered by the Hearing Examiner and said zoning request
being in conformity with the City's Comprehensive Plan, as amended; and the City
Council having duly considered, all matters relevant thereto, and all parties having been :
heard appearing in support thereof or in opposition thereto, NOW THEREFORE
THE CITY 'COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I: The following described property in the City of Renton is
hereby rezoned to Business District (B71) as hereinbelow specified; subject to the
findings, conclusions and decision dated August 10979; the Planning Director is hereby
authorized and directed to change the maps of the Zoning Ordinance, as amended, to
evidence said rezoning, to-Wit:
See Exhibit "A" attached hereto and made a part hereof
as if fully Set forth
(Said property being located at the Southwest corner of
South Grady Way and Main Avenue South)
AND SUBJECT FURTHER to those certain Declaration of Restrictive Covenants
executed by Petitioner-owners, on, or about October 8, 1979 and October 11, 1979 and
recorded in the office of the, Director of Records and Elections, Receiving Nos.

SE Quadrant Letter from Planning Director Ericksen presented Planning
Comprensive Plan Commission recommendations for the Southeast Renton Compre-
Adopted hensive Planning Area which is defined as area southerly
of the Cedar River, southeasterly of the FAI-405 and easterly
of the Valley Freeway. The southerly and easterly boundaries
were not specifically defined but include areas in King County
extending easterly to the Fairwood/Lake Youngs area and
southerly to Kent. The Comprehensive Plan as recommended
included Land Use, Community Facilities, Circulation, Utilities
of water, sewer and storm drainage. The letter explained
the plan as a guide for present and future actions relatinc to
growth and land development. Moved by Stredicke, Second by
Trimm, refer to the Planning and Development Committee for
for recommendation re presentation/public hearing. Councilman
Perry noted one and a half year study. MOVED BY PERRY, SECOND

Services Committee the Housing and Community Development Program: 10 loans made to
Home Repair Loans eligible city residents totaling $194,000 for this year.
Mayor Delaurenti announced next Council meeting would be held
November 5, 1979.

DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS, Paul E. Erzen and Margaret W. Erzen, his wife, are
the owners of the following real property in the City of Renton, County of /
King, State of Washington, described as follows:
(See attached legal. description)
WHEREAS, the owners of said described property desire to impose
• the following restrictive covenants running with the land as to use, present
and future, of the above described real property;
NOW THEREFORE, the aforesaid owners hereby establish, grant and
impose restrictions and covenants running with the land as to the use of the
land hereinabove described with respect to the use by the undersigned, their
successors, heirs and assigns, as follows:
SETBACKS
No buildings or structures shall be permitted or
located; (a) within twenty (20) feet of the easterly
property line adjacent to Main Avenue South.
Setback areas exclusive of required landscape area
may be utilized for ingress and egress and off-
street parking purposes as provided by the laws and "
ordinances of the City of Renton.
DURATION
These covenants shall run with the land and expire on
December 31, 2025. •
Any violation or breach of these restrictive covenants may be enforced by proper
legal procedures in the Superior Court of King County by either the City of
Renton or any property owners adjoining subject property who are adversely
