CORRESPONDENCE A letter was read from Margaret Odo, 4606 S.E. 4th Place, commending •
City Council the City Council for approving the installation of traffic signal
Commendation modifications at the intersection of N.E. 4th Street and Union Avenue
N.E. Also praised were quick city responses from other departments.
Mayor Shinpoch requested copies of the letter to distribute to
department heads.
OLD BUSINESS
Council Budget Council President Clymer presented a report of a motion passed at the
Committee November 17, 1982 Budget Meeting to refer to the Transportation Committee
Access Roadways the matter of access roadways to serve the sewage plant. The report
to Serve Sewage also noted intent to keep the committee informed on the subject.

RECOMMENDATION TO REFER THE MATTER OF ACCESS ROADWAYS TO SERVE THE
SEWAGE PLANT TO THE TRANSPORTATION COMMITTEE. CARRIED.
Planning & Planning & Development Committee Chairman Rockhill presented a report
Development recommending referral to the Ways and Means Committee for preparation
Committee of legislation amending the Mobile Home Park Ordinance as follows:
Mobile Home Park Lot Coverage (Section 4-2006. 1 . 1) - To meet standards applicable in
Ordinance other jurisdictions similar to single family residential zoning
classifications or approximately 30 to 50% for enclosed structures,
a reduction to 40% of any lot is recommended for coverage by a mobile
home and enclosed accessory structures. Accessory structures such as
carport canopies or patio covers having less than 50% perimeter wall
enclosure shall not exceed 20% coverage of any lot. Laundry
Facilities (Section 4-2006. 1 .Q) - Elimination of the requirement
for laundry facilities is recommended since they are considered
optional and will either be provided within each individual unit
or requested of the park owner. MOVED BY ROCKHILL, SECONDED BY
HUGHES, COUNCIL CONCUR IN THE RECOMMENDATION OF THE PLANNING AND
DEVELOPMENT COMMITTEE. CARRIED.
Densities in Chairman Rockhill advised that the matter of densities in R-3 and
R-3 and R-4 R-4 zones is still under study by the committee and the recommendation
Zones will be delayed.
Stop Sign Councilman Stredicke called the Administration's attention to a
N.E. 17th St./ stop sign which has been down at the intersection of N.E. 17th
Union Ave. N.E. Street and Union Avenue N.E. since the previous weekend. Captain
Don Persson advised that a portable sign will be located at the
subject corner until such time as a permanent replacement can be
installed.
Dale Nichols' Utilities Committee Chairman Mathews presented a report recommending
Request for that the request for review of water bill by Dale Nichols be referred
Review of Water to the Administration for further investigation and staff

WHEREAS under Chapter 7 , Title IV (Building Regulations) of
Ordinance No . 1628 known as the "Code of General Ordinances of the
City of Renton" , as amended, and the maps and reports adopted in
conjunction therewith, the property hereinbelow described has
heretofore been zoned as Residence District (R-3) ; and
WHEREAS Ordinance No . 3370 incorporated Restrictive Covenants
in the body of the Ordinance by reference , those Restrictive
Covenants automatically reverting the property to Residence
District (R-2) if construction was not commenced within three
years of the date of the Restrictive Covenants ; and
WHEREAS the three year period of time has passed without
construction commencing , NOW THEREFORE

Downtown number of downtown street lights, primarily on South 2nd and South
Christmas 3rd, during the Christmas season. Also recommended was referral
Lighting to the Administration for implementation of the matter. MOVED BY
REED, SECONDED BY MATHEWS, CONCUR IN THE RECOMMENDATION OF THE
COMMUNITY SERVICES COMMITTEE. Mayor Shinpoch advised expenditure
of $3,000.00 last year for purposes of Christmas lighting, with
anticipation of increased amount this season. MOTION CARRIED.
Aviation Aviation Committee Chairman Trimm recommended approval of a new
Committee temporary lease agreement for float unit storage space for Renton
Lease Agreement Aviation. The report stated need will be temporary, two to three
Renton Aviation . winter seasons with variable quantities of floats; use will be
normally inactive during summer months; 220 square feet. of space
is average space requirement; and flat rate of $3.00 per month
is recommended with Renton Aviation certifying with each payment
the number of stored floats used in calculating the lump sum due.
MOVED BY TRIMM, SECONDED BY ROCKHILL, CONCUR IN THE RECOMMENDATION
OF THE AVIATION COMMITTEE. Councilman Stredicke objected to the
method of calculation of the monthly rate since it creates need for
accounting which is difficult in airport operations. MOTION
CARRIED. Councilman Stredicke requested his NO vote be recorded.

CORRESPONDENCE AND CURRENT BUSINESS
Status Report on As requested by Council , Richard Houghton, Public Works Director,
S.W. 43rd Street presented a status report on the S.W. 43rd Street project,
Project and N. E. outlining construction progress and noting that completion ahead
4th & Union of schedule is anticipated in the spring of 1983. Status of the
Project N. E. 4th and Union Avenue N.E. project was reviewed by Mr.
Houghton, who advised violations cited by the Washington State
Department of Transportation have been resolved to date. Responding
to further Council inquiry, Mr. Houghton indicated that the impendinc
joint Renton and Tukwila federal funds Grady Way bridge project will
be awarded by the state, and a state engineer will be assigned to
oversee its progress.
OLD BUSINESS
Utilities Utilities Committee Chairman Mathews presented a report recommending
Committee that the entire Council study and determine the policy decision of
Utility rate utility rate options since increases are associated with budget
options recommendations by the Administration. MOVED BY MATHEWS, SECONDED
BY TRIMM, COUNCIL CONCUR IN THE RECOMMENDATION OF THE COMMITTEE.
CARRIED.
LID 320 Utilities Committee Chairman Mathews presented a report recommending
concurrence in the reconm endation of the Public Works Department that
all bids be rejected without prejudice onr'LID 320 - Water Project
//W-614 Bid Opening, and the project scope be reduced and rebid as
a Small Works Project. Further, it was requested that the committee
be kept advised- as to the progress of the LID. MOVED BY MATHEWS,
SECONDED BY TRIMM, CONCUR IN THE RECOMMENDATION OF THE UTILITIES
COMMITTEE. CARRIED.

Shoreline Master Councilman Reed advised receipt of a transcript of his testimony
Program at a Planning Commission meeting set to review the Shoreline Master
Program as well as a letter from the'City Attorney regarding a
possible violation of the Appearance of Fairness Doctrine, and he
is of the opinion following review that a violation has not occurred
and his future participation on the subject matter would be allowed.

CHG/Sunpointe Responding to Councilman Stredicke' s request for a status report
On and Off-site regarding off-site improvements and occupancy permit for the
Improvement Sunpointe development, City Attorney Warren explained the city' s
Progress ability to exert pressure upon the developer to complete improvement'
by calling the bond, and to date, approximately $2500.00 in fines
'have been paid for occupancy violations.
Dunlap Canyon Councilman Stredicke noted receipt of a complaint regarding
Improvements crosswalk modifications in Dunlap Canyon area which preclude
access across the -roadway from the Earlington area. Public Works
Director Houghton explained specifics of the improvement project
which resulted in restricted access due to undergrounding of
power lines. He noted that corrections will be made.
Planning rind Planning and Development Committee Chairman Rockhi11 presented a
Development report recommending that the Ways and Means Committee prepare
Committee appropriate legislation reverting Ordinance No. 3370 from R-3 to

Public Safety Public Safety Committee Chairman Hughes presented a report
Committee recommending that no policy changes be made in existing
Smoke Detector regulations governing smoke detector systems for day care
Systems centers although new provisions of the Washington Administrative
Code require installation of automatic smoke alarm systems in all
new licensed day care centers. The provision does not apply to
existing centers which require manual pull-type fire alarm systems.
MOVED BY HUGHES, SECONDED BY MATHEWS, COUNCIL CONCUR IN THE
RECOMMENDATION OF THE PUBLIC SAFETY COMMITTEE. Councilman Reed
questioned applicability of battery operated smoke detectors to
the new requirements. Councilman Hughes explained views of Fire
Marshal that such devices offer false sense of security and are
not easily monitored. MOTION CARRIED.
Police Mutual Public Safety Committee Chairman Hughes presented a report
Aid Agreement recommending authorization of the city to enter into the Police
Mutual Aid Agreement subject to approval of the City Attorney.
Agreement to voluntarily aid cities of Auburn, Des Moines, Kent,
Normandy Park, Renton, Tukwila and Port of Seattle based upon
urgency of the incident and availability of personnel and facilities.

COMMITTEE REPORT
NOVEMBER 1 , 1982
WIEMANN REZONE EXTENSION REQUEST (R-364-79) - Referred 10/4/82
The Planning and Development Committee has reviewed the request to extend the
time provisions of the above referenced rezone which was adopted by Ordinance
#3370 and contained covenants restricting the time limits of that rezone to
the commencement of construction on the property by November 5, 1982.
The City Attorney has concluded that there is no provision in law for extending
the rezone as requested. The Committee finds that the only action available to
the City Council is to adopt an ordinance providing for the reversion of Ordi -
nance #3370 to clarify the record. Without such action, the city' s records will
always be in conflict with the allowable provisions of Ordinance #3370 and its
restrictive covenants.
At such time as the applicants are prepared to develop the property, it would
be proper for them to make an application for rezoning the property to a classi-
fication appropriate to the development they choose. As with any rezone, a
public hearing before the Hearing Examiner would be required with City Council
concurrence in the zoning and adoption of a new ordinance.
RECOMMENDATION :
The Planning and Development Committee finds that the city is without power to
extend rezone R-364-79 (Ordinance #3370) as requested and recommends that the
Ways and Means Committee prepare appropriate legislation reverting Ordinance #3370
from R-3 to R-2 zoning. The applicant should be advised to make a new rezone
application at such time as development is imminent on the subject property.

Dear Mr. Wiemann:
The Renton City Council , at its regular meeting of November 1, 1982,
has concurred in the Planning and Development Committee report which
found the City is without power to extend the Wiemann Rezone approved
by Ordinance #3370 as requested in your letter of September 23, 1982.
The report recommended that in order to clarify the records, an ordi-
nance be adopted providing for the reversion of Ordinance #3370 from
R-3 to R-2 zoning.
Please make application for a new rezone at such time as development
is imminent on your property located at 110 Pelly North. A copy of
the reversion ordinance will be forwarded to you upon adoption.
If you have any questions or require additional information, please
do not hesitate to contact my office.

WIEMANN REZONE EXTENSION REQUEST (R-364-79) - Referred 10/4/82
The Planning and Development Committee has reviewed the request to extend the
time provisions of the above referenced rezone which was adopted by Ordinance
#3370 and contained covenants restricting the time limits of that rezone to
the commencement of construction on the property by November 5, 1982.
The City Attorney has concluded that there is no provision in law for extending
the rezone as requested. The Committee finds that the only action available to
the City Council is to adopt an ordinance providing for the reversion of Ordi-
nance #3370 to clarify the record. Without such action, the city's records will .
always be in conflict with the allowable provisions of Ordinance #3370 and its
restrictive covenants.
At such time as the applicants are prepared to develop the property, it would
be proper for them to make an application for rezoning the property to a classi-
fication appropriate to th.e development they choose. As with any rezone, a
public hearing before the Hearing Examiner would be required with City Council
concurrence in the zoning and adoption of a new ordinance.
RECOMMENDATION:
The Planning and Development Committee finds that the city is without power to
extend rezone R-364-79 (Ordinance #3370) as requested and recommends that the
Ways and Means Committee prepare appropriate legislation reverting Ordinance #3370
from R-3 to1R-2 zoning, The applicant should be advised to make a new rezone
application at such time as development is imminent on .the subject property.

SUBJECT: REZONE EXTENSION WIEMANN, FILE R-364-79
The City Council has received a request to extend the time provisions of the above
referenced rezone which was adopted by Ordinance #3370 and contained covenants
restricting the time limits of that rezone to the commencement of construction on the
property within three years. The subject covenants were filed on November 5, 1979,
and the three year period will expire on November 5, 1982.
• The covenants state in part, "in the event that construction is not undertaken within
the three year period, said property shall revert to.:the former R.-2 zoning, .. . . .
without further action or hearing thereon." We have reveiwed this covenant and the
ordinance with the City Attorney who has concluded that there is no provision in law
for extending the rezone as requested. The attorney's opinion is that the only action
available to the City Council is to adopt an ordinance providing for the reversion of
Ordinance #3370 to clarify the record. Without such action, the city's records will
always be in conflict with the allowable provisions of Ordinance #3370 and its
restrictive covenants. -
At such time as the applicants are prepared to develop the property, it would be
proper and appropriate for them to make an application for rezoning the property to a
classification appropriate to the development they choose. As with any rezone, a
public hearing before the Hearing Examiner would be required with the City Council
concurrence in the zoning and adoption of a new ordinance superseding both Ordinance
#3370 and its repealing ordinance.
RECOMMENDATION
I find that the city is without power to extend rezone R-364-79 (Ordinance ##3370) as
requested. Recommend that the 'Ways and Means Committee prepare appropriate
legislation reverting Ordinance #3370 from R-3 to R-2 zoning. Recommend to the
applicant that he make a new rezone application at such time as development is
imminent on the subject property.

Communications Manager, 15241 Pacific Highway South, Seattle,
addressed Council regarding the rate of return to be realized on
both a rate increase of $9.95 (including city tax) and $10.55 ($9.95
plus 6% city tax) , the methods of computing that rate of return
(including and not including premium services income) , and completion
dates of the construction schedule. Questions were raised regarding
Renton cable rates being comparable to surrounding areas and whether
a rate increase for Renton would bring a rate increase for those
communities. Following discussion, an ordinance was read approving
an increase in the basic service charge for cable TV services for
Group W Cable, Inc. , at the rate of $9.95 per month, including any
pass through of franchise or utility tax to the customers. A list
of connection, installation, and additional service rates was read
and incorporated into the ordinance by amendment of 9/27/82. MOVED

ment for variance (File #V-453-82) • Councilman Stredicke asked
whether the Frank's had been advised of appeal procedures. Mayor
Shinpoch reported that the letter was being handled by the Building
Department at the present time, and there would be a report back at
the next Council meeting, noting that Mr. and Mrs. Frank would be
well-advised of their alternatives.

Sign Councilman Rockhil,l reported that the Planning and Developm-nt
Ordinance/ Committee had discussed the sign ordinance and fee schedule, but .
Fee Schedule would have no committee report this evening. Both topics are
being investigated further by staff and would be discussed again
at the Planning and Development Committee meeting of 10/14 82.
Parking Space Councilman Hughes commended the job done on extending the tripes
Extensions that designate parking spaces in the downtown area to the lop of
the curb. He reported he has heard many favorable comment- as to
ease of parking now on the left-hand side of the street.

South King County Transportation Committee Chairman Trimm invited Council i put for
Task Force the newly-formed South King County Task Force. The Task orce was
formed to gain support for road improvements.
Councilman Councilman Trimm said thank-you for the "happy retirement ' cards
Trimm he received tonight. Mayor Shinpoch announced that Councilman
Retirement Trimm was retiring from Puget Power Company after 36 yeari of
service, wished him well and called attention to refresh nts

In the spring of 1979 we requested a rezone of our property at
110 Pelly N. in order to build a building with an office on the main
floor and two bedroom apartment on the second floor. The intent was
to tear down the structure that now exists on the property. There
was a three year time limit put on this city Ord. #3370 by the City
Council. The City Council finally passed on our request in November,
1979.
Due to the long delay in getting this rezone passed, we found in
early 1981 the interest rate had jumped so high it was not possible
to build and the interest rate is just now starting to go down.
We are therefore, requesting an extension of three years on Ord.
#3370. We feel this will give us a chance to do the building we wanted
to do on this property at an interest rate we can afford.
We would appreciate getting this rezone extension passed as soon
as possible as our present rezone runs out November 2, 1982.

CHANGING THE ZONING CLASSIFICATION OF .CERTAIN
PROPERTIES. WITHIN THE CITY OF RENTON FROM
RESIDENCE DISTRICT (R-2) TO RESIDENCE DISTRICT (R-3)

WHEREAS under Chapter 7, Title IV (Building Regulations) of Ordinance
No. 1628 known as the "Code of General Ordinances of the City of Renton", as
amended, and the maps and reports adopted in conjunction therewith, the property
hereinbelow described has heretofore been zoned as Residence District (R-2);• and
WHEREAS a proper petition for change of zone classification of said property
has been filed with the Planning Department on or about June 18, 1979, which petition
was duly referred to the Hearing Examiner for investigation, study and public hearing,
and a public hearing having been held thereon on or about July 31, 1979, and said
matter having been duly considered by. the Hearing Examiner and said zoning request
having been denied and the matter having been appealed to the City Council of the
City of Renton and said City Council having reversed the Hearing Examiner's Decision

DECLARATION OF RESTRICTIVE COVENANTS
WHEREAS , Bernard L. Wiemann and Waldemar F. Wiemann are
the owners of the following real property in the City of Renton,
County of King, State of Washington, described as follows :

WHEREAS the owners of said described property desire to impose
the following restrictive covenants running with the land as to use,
present and future , of the above described real property;

NOW THEREFORE, the aforesaid owners hereby establish, grant
and impose restrictions and covenants running with the land as to the
use of the land hereinabove described with respect to the use by
the undersigned, their successors , heirs and assigns , as follows :
HEIGHT RESTRICTION
No building or structure shall be constructed exceeding
a maximum height of twenty-five (25) feet .
CONSTRUCTION START
Construction shall commence within three years and be
completed within one year thereafter. In the event
that construction is not undertaken within the three-
year period, said property shall revert to former R-2
zoning, and said restrictive covenants shall become
void, without further action or hearing thereon.
These covenants shall remain in full force and effect , unless otherwise
. changed or amended by the parties in writing, for a period of twenty

Any violation or breach of any of these restrictive covenants ma'

The facts in the Hearing Examiner's conclusions are contested as foll w. ,;, G ,_-='1. Location of rezone is appropriate because all offices around the property
should technically be R-3 at this time. The only reason they are not R-3 is
because of the law at the time they were done. If they were done today, they would
be R-3 or similar.
As for the timing, we made our application June ld, 1979 at the Planning
Department and paid $218.00 for it at that time. We feel it is unfair to deny our
request because of a possible moratorium that was not put before the council until
July 23, 1979.
2. We have demonstrated that the present Comprehensive Plan for the area
appears to designate this area as potential R-3. The area may be subject to Change
but how can it be changed to anything but what has already been built around the
property on three sides.
3. The area is not going to deteriorate from the removal of a very old
house and the building of office space on the main floor and new apartment on the
second floor which we feel is getting the most out of the land available.
4. We do not feel we are intruding on an R-2 zone as only one residence
(letter attached) is next to our property. All other sides should be R-3 at this
time in any case. A new attractive building is not going to effect the one
residence in our area in any way. At times, we have thought about building a
duplex on the property. If this were done it would have a greater effect in
the area and traffic than the small office and apartment would. As the office is
usually only open five days a week and apartment access is thru the alley.
5. If apartments are built in the area this will also create an over
concentration of one type which seems to be the way the building has been going
lately o.. around this property The proposed office in this area is no different than
doctor and dental offices across the street, optmetric clinic north side and medical
clinic and drugstore at end of block. As for traffic, there will be less traffic
from our office than a duplex and at least all parking will be aff the street which
is a lot better than the office across the street, which use this block of Pelly
for a parking lot.
6. As far as timing is concerned, as we have said before we made our
original request on June 18, 1979. Three weeks before any possible moratorium was
put before the council. If there is to be a change in this small area it can
only to to R-3 or similar because that is the type of building and office that
is there now. How can w e be asking for a nonconforming use when the property is
almost surrounded by offices the same as we are asking to put on our property.
We don't feel we have reasonable use of our property as zoned. The old house
on the property now is not one that can be remodled, or used as is much longer.
An office and apartment instead of the present building is not an over concentration
of commercial use because the apartment will be still a residence 1-6 someone. It is
not financially possible to build a one residence home on this lot because of its
small size. We feel a new apartment will do more for the quality of the area than
the way it looks now. For these many reasons, we feel the rezone and special petnit
should be granted at this time. ° 62

I appeared before Mr. Paul Kaufman, the City of Renton Land use hearing
examiner, on July 31, 1979 to urge the approval of Mr. L.L. & Mr. :'T.P. Niemann's
request for rezoning and special permit of their property at 110 Pelly Ave, N.
next to mine at 112 Pelly Ave. N. In addition, I own the duplex two doors north
at 122 Pelly Ave. N. The Wiemann rezone request was denied by the examiner and
now I respectfully urge the City Council to reverse the examiner's ruling and
grant the Tiemann's the rezone and special permit request.
The rezone would be in the best interest of the neighborhood since the
proposed professional office and apartment building would be IN. keeping in line
with the character of adjoining properties. My building adjoining north is
essentially used as if the zoning were R 3.
The rezoning would also be in the best interest of the City of Renton as
it would replace a substandard dwelling with a modern tax producing professional
office. Also, by putting an apartment above the office, the Wiemann's are not elimin_atin€
a dwelling space which is at a premium in the North Renton area.

It has been brought to my attention that the owners of the property
north of me at 110 Pelly, have requested an: R-3 rezone and special permit
to build an optical office on the main floor and an apartment on the
second floor.
The house that is there now is very old and will probably not
get any better. I feel the new building will be an improvement
over what is there now, it should have no effect on my property in
any way.
I would like to go on record in favor of the proposed rezone
to R-3 and special permit.

The Planning. and Development Committee"has considered.the. appeal• of' the above- ,
mentioned decision dated August 6, 1979, and recommends 'that the. City Council' '
reverse the decision of the Hearing Examiner based upon .the'following errors of
fact and law: - .
1. Finding' No. 15 is in error in that there is no prohibition against
mixing commercial uses with residential uses so long -as the users
, are allowed in the particular zone. - •
2. Conclusions -No. .l, 2 and 6 are in error in that there does not .
• - exist any moratorium against construction in the North Renton
' area which should be' considered as a "de facto" amendment to
• the Comprehensive Plan'. ••
3. Conclusions No. 4 and' 5 are in error in that the rezone and . -
• special permit requested enhance the public health, safety, '
morals and general welfare. The predominant use in the area
• ' is similar to-the proposed use.
The. Committee recommends that the City Council reverse the decision of the Hearing
Examiner and approve the application for rezone of, the property to .R-3, and grant
the request for a special permit to operate an optical clinic, subject to the
following conditions: . .
1. That the location of the building, parking lot, landscaping,
and screening be required as specified in the revised site plan.
2. That a detailed landscaping plan be approved by• the Planning
Department prior to the issuance of an occupancy permit. •
3. Installation of a fire hydrant .or improvement of water main
as required by the Public works and Fire Departments.

Honeydew Letter from Stan McDonald, Executive Vice-President of NAN
Annexation Partners #692, Marysville, explained pursuit for 18 months
of 75% petition for Honeydew Annexation and claimed that apathy
in the area and fear of increased service costs made the 75%
petition unobtainable. The letter requested alternate method
of annexation by resolution (RCW 35A. 14.015) and requested the
Council deem annexation to best interest of the City and call
for election of voters in the area. Planning Director Ericksen
used wall maps to. explain area located north and east of the
Honeydew Elementary School , south of NE 12th St. between Union
Ave. NE and 140th Ave. SE. ; area of 66.45 acres; north of the
Cascadia area .annexation. Councilman Stredicke called attention
to previous annexation in area by the City via election method
which had failed. Mr. Lloyd Rongholt, 11414 137th SE, stated
he lived in area of proposed annexation, was owner of ,three acres
and had not been contacted to sign a petition, nor had his

advised some incorrect information had been given to the committee.

week pending further investigation.
Travel Councilman Stredicke called attention to need for Council approval

AUDIENCE COMMENT Kathy Koelker, 532 Cedar Ave. S. , requested clarification of
Condominium affect of condominium conversion on zoning, as well as Planned
and PUD's Unit Development. Councilman Perry noted apartments being
re converted to condominiums, as well as condominiums are located
Zoning in multiple zoning areas; that PUD's may be located in single
family areas. Councilman Clymer noted that when the PUD Ordinance
was adopted, Councilman Perry strongly opposed inclusion in

Honey Creek and The Utilities Committee report recommended that the city not

development charge of if per sq. ft. likewise be put into a
separate fund to finance the Honey Creek and Kennydale trunk
sewer lines. The report further recommended referral to the
Ways and Means Committee for legislation to create said fund
that provision be made for inflation and the systems development
charge and special percentage of 3 per sq. ft. for trunkage
charge be increased annually in accordance with the CPI to offset
the effects of inflation. (Councilman Perry determined possible
conflict of interest and left the Council Chambers and took no
part in any discussion or action.) MOVED BY TRIMM, SECOND
PROCTOR, COUNCIL CONCUR IN RECOMMENDATION.` Councilwoman Shinpoch
inquired regarding signatures on the committee report and was
advised by Councilman Trimm that all three members of the committee
favored the proposal at the committee meeting, however, Councilman
Shane had not signed the committee report due to absence, other
two members had signed(Proctor and Trimm) . Stredicke inquired and
Public Works Director Gonnason explained any property developed'
within usage area would be assessed additional 3 per sq.ft. ,
that 1G is already being charged; that 3t plus 1 would be raised
annually; that. present users of the Honeycreek pump facility which
is at maximum capacity will not be assessed; that all property as
it develops will be assessed; that Heather Downs area also has
surcharge system. -MOTION CARRIED and Councilman Stredicke

RESIDENCE DISTRICT (R-2) TO RESIDENCE DISTRICT(R-3)

WHEREAS under Chapter 7, Title IV (Building Regulations) of Ordinance
No. 1628 known as the "Code of General Ordinances of the City of Renton", as
amended, and the maps and reports adopted in conjunction therewith, the property
hereinbelow described has heretofore been zoned as Residence District (R-2); and
WHEREAS a proper petition for change of zone classification of said property
has been filed with the Planning Department on or about June 18, 1979, which petition
was duly referred to the Hearing Examiner for investigation, study and public hearing,
and a public hearing having been held thereon on or about July 31, 1979, and said
matter having been duly considered by the Hearing Examiner and said zoning request
having been denied and the matter, having been appealed to the City Council of the

WHEREAS, Bernard L. Wiemann and Waldemar F. Wiemann are
the owners of the following real property in the City of Renton,
County of King, State of Washington, described as follows:

WHEREAS the owners of said described property desire to impose
the following restrictive covenants running with the land as to use,
present and future, of the above described real property;
NOW THEREFORE, the aforesaid owners hereby establish, grant
� and impose restrictions and covenants running with the land as to the
use of the land hereinabove described with respect to, the use by
the undersigned, their successors, heirs and assigns, as follows:

HEIGHT RESTRICTION '
No building or structure shall be constructed exceeding
a maximum height of twenty-five (25) feet.
CONSTRUCTION START
Construction shall commence within three years and be

that construction is not undertaken within the three-

6. _ Land Use : An existing-single family dwelling is located on
the site with an optometry clinic on the parcel 'to the north,
a single' family ` residence adjacent to the south, and single
family residences and some multiple family units to the east.
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties contain a variety of land uses with
the trend being a transition from older single family dwellings
to a mixture of larger scattered single family homes, some small
multiple family buildings, and medical/dental clinics.
F. PUBLIC SERVICES :
1. Water and Sewer : 6" water mains are located on Pelly Avenue
adjacent to the subject site and along N. 1st Street within
200 feet to the south. An 8" sanitary sewer running north/
south is located approximately 150 feet to the west.
2. Fire Protection : Provided by the Renton Fire Department as
per ordinance requirements.
3. Transit : Metro Transit Routes 107, 155, and 240 operate along
Park Avenue North approximately one block to the east of the
subject site.
4. Schools: Schools would be unaffected by the proposed rezone
and clinic use.
5. Recreation : Recreation would be unaffected by the proposed
rezone and clinic use.

C. HISTORY/BACKGROUND:
The subject site was annexed into the City by Ordinance 156 in 1909.
D. PHYSICAL BACKGROUND:
1. Topography : The site is generally level.
2. Soils : Urban land (Ur) . This is soil that has been modified
by disturbance of the natural layers with additions of fill
material several feet thick to accommodate large industrial and
housing installations. The erosion hazard is slight to moderate.
No capability or woodland classification.
3. Vegetation : Lawn grass is the predominate feature with short
to medium shrubs scattered around an existing single family
dwelling and the perimeter of the site.

3. The site plan shows provision for the required seven parking
spaces. However, only two of those are usable, according to
R.M.C. 4-2210. The two parking spaces accessing Pelly Avenue
North do not have adequate maneuvering space on-site. Motor
vehicles will have to back onto the street. The parking lot
design at the rear of the building limits the maneuvering
area allocated to three of the five parking spaces. A 20-foot
wide aisle is created, where a 24-foot wide aisle is required.
Six parking spaces could be provided on-site and meet the
design standards. One parking space could be eliminated in
the rear, and the parking spaces in front would have to be
reoriented 90 degrees.
The additional parking space could be provided within 500
feet under a joint use agreement per R.M.C. 4-2204.6e, or
the apartment use could be discontinued and the space used
for dead storage space.
4. Landscaping and screening is shown on the site plan. Utilizing
44 feet of the 50-foot lot width for parking leaves inadequate
area for landscaping. Fences must be used to meet the screen-
ing requirement . Screening is used to buffer a more intense
use-. from another. R.M.C. 4-2204. 8B(1) establishes a minimum
of a 42" fence for site screen, when minimum landscaping
requirements cannot be met.
M. DEPARTMENTAL RECOMMENDATIONS :
The staff recommends that the request for a special permit to
operate a clinic be approved subject to the following conditions :,
1. Modification of the parking design to provide six parking
spaces on-site per standards stated in R.M.C. 4-22.
2. Provide one additional parking space within 500 feet under
a joint use agreement per R.M.C. 4-2204.6e.
3. That a four foot wide landscaping strip along with a five
foot high solid board fence be provided along the southern
property line adjacent to the single family residence.
4. That a two foot wide landscaping strip along with a 42" high
solid board fence be provided along the northern property
line adjacent to the existing clinic.
5. That detailed landscape plan be approved by the Planning
Department prior to issuance of an occupancy permit.
6. Approval based on installation of fire hydrant -or improve-
ment of water main as required by Public Works and Fire
Departments.

1. The applicant proposes to rezone from R-2 to R-3 a 5400 sq are
foot parcel of land on Pelly Avenue North to permit use of the
existing building as an optical clinic for the main floor a! d
a rental unit for the second level.
2. The subject request for rezone to R-3 is generally consistent
with the Comprehensive Plan Land Use Element , which designa es
the site and surrounding area as high density multiple family.
3. The proposed rezone and use is generally consistent with th-
R-3 parcel adjacent to the north, the R-4 properties to the
east , and the P-1 zoning and similar clinic uses to the wes
across Pelly Avenue.
4. The items addressed in #2 and #3 appear to indicate that th-
subject site is potentially zoned for the R-3 classificatio'
requested (Section 4-3014-B) .
5. The subject site has remained'zoned R-2 since the Zoning
Ordinance was adopted in 1953. This would seem to demonstr-te
that the designation_ has not been specifically considered fi
a previous area zoning or land use analysis (Section 4-3014 A) ,
other than the Comprehensive Plan adoption of 1965.
6. A letter from the applicant dated June 18, 1979 (copy attac ed)
identifies some similar private developments in the subject
area. These would appear to affirm (Section 4-3014-C) of t e
Land Use Hearing Examiner Ordinance.

The application submitted was interpreted improperly. The following
analysis and recommendation is submitted to replace that previously
provided by the Planning Department concerning the special permit.
PLANNING DEPARTMENT ANALYSIS: (SPECIAL PERMIT)
1. The applicant proposes to remove the existing structure and con-
struct a new two-story building. The first floor will be used
as an optical clinic and the second story as a two bedroom rental
unit on the site addressed in the accompanying rezone application.
2. Off-street parking is proposed off of Pelly Avenue North and the
alley. A total of 7 parking spaces are necessary for both the
1,000 square foot office and the apartment .
3. The site plan, as revised by the staff, shows provision for 7
usable parking spaces. The building has been moved back approxi-
mately 9 feet to allow for the rearrangement of the parking spaces
and a relocation of the curb cut . The parking stalls in the front
of the building are only 18 feet deep. They utilize a two foot
overhang into the landscaping on the north side of the property
adjacent to the existing clinic.
4. The landscaping and screening shown on the revised site plan with
staff comments complies with the landscaping requirement of R.M.C.
4-2204. 8.
DEPARTMENTAL RECOMMENDATION:
The staff recommends that the request for a special permit to operate
a clinic be approved subject to the following conditions:
1. That the location of the building, parking lot , landscaping, and
screening be required as specified in revised site plan.
2. That a detailed landscaping plan be approved by the Planning
Department prior to the issuance of an occupancy permit .
3. That the approval is based on the installation of a fire hydrant
or improvement of water main as required by Public Works and
Fire Departments.

Mr. Wiemann indicated concurrence in the report, but questioned the effect of the proposed
moratorium on the requested rezone. The Examiner indicated that such determination would
be made by the City Council although the timing of their action is unknown.
The Examiner requested testimony in support of the request. Responding was:

Mr. Sigeti, owner of an optometry clinic and a duplex located north of the subject site,
indicated support of the proposal which will be compatible with existing development and •
upgrade the neighborhood.
The Examiner requested further testimony in support or opposition to the request. There
was no response. He then requested further comments from the Public Works arid Planning
Department staff. Since there was no response, the hearing on File No.. R-364-79 and
SP-365-79 was closed by the Examiner at 9:27 a.m.
•
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for reclassification of +5,350 square feet from an 'R-2 (Duplex)
designation to an R-3 (Medium Density Multifamily) designation together with a •
Special Permit to permit construction of an ,optical clinic and separate apartment
unit.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
findings of fact, and departmental recommendations in this matter, is uncontested, and
is hereby attached as Exhibit #1 and incorporated in this report by reference as set
forth in full 'therein. •
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971., R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
•
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
•
7. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-709A of Title IV, Ordinance No. 1628, Code of General
Ordinances.
8. The subject property is located at 110 Pelly Avenue N. in an area known as North
Renton. '
•
9. The site is presently developed with a single family residence. The adjacent property
to the north is developed with another optometry' clinic, while directly to the west
across Pelly Avenue N. are a medical clinic and dental clinic. On the north end of
the block occupying a double lot is a medical clinic and drugstore. The adjacent
residence to the south is single family.
10. The' area is 'just north of the Central Business District across the Cedar River. The
general area in which the subject property is located consists of'moderately priced
homes which are generally well maintained. The new trail along the Cedar River and
the Senior Citizens Center are some recent developments in the area. The block in
which the subject parcel is located has undergone some redevelopment and consists of
the various health-related facilities described above and some relatively new duplex
development.

11. The Comprehensive Plan would seem to indicate that the area is suitable for the
development of. medium density multifamily residential development.
12. The subject property was annexed into the city by Ordinance No. 156 in 1909. The
R-2 zoning was applied to the subject property when the original zoning was 'enacted
in 1953,

checking the property and surrounding area, the Examine
• conducted a public hearing on the subject as follows: •
The hearing was. Opened on July 31, 1979 at 9:00 a.m. in the Council Chambers of t e
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and revi-wed the
Planning Department report and the supplement, and the reports were entered into he •
record as Exhibit #1.
Roger Blaylock, .Associate Planner, reviewed•Exhibit .#l, and entered the following additional
exhibits into the record:

Mr. Blaylock read Exhibit #7 into the record. The letter noted compatibility of proposed
development with other uses in the area. Mr: Blaylock also. advised a correction to the
original staff report which stated that. an existing building 'will be utilized fo the
proposed professional office use and rental unit, and noted that a new building ill be
constructed.
The Examiner inquired if the Declaration of Non-Significance which had been issu-d with
the understanding that an existing building would be utilized had changed with t e
knowledge that. a .new building would'be-constructed. Mr. Blaylock indicated that the
environmental significance would be minor due to the small scale of the proposal.
The Examiner advised that on July 23, 1979, the City Council had referred a prop•sed
moratorium for new construction in"the area of the proposal to the Planning and •evelopment
Committee for study; and inquired if the Planning Department's analysis of the r=zone
would be affected by action of the Council. 'David Clemens, Senior Planner, indi•ated his
understanding,that the matter had been referred. to the Planning Commission for f rther
.study although the review period and the specific language of the moratorium is et
unknown, and therefore, the effect on the applicant's proposal is also unknown.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

area which cannot be entirely and effectively screened adjacent to residential
properties would be unduly detrimental to adjacent and surrounding properties (Section
4-709A.A(3) ) .
6. The requested rezone and the Special Permit are at this juncture untimely. The
application should be denied at least until the Planning Commission and the City
Council have had the opportunity to study the North Renton area. After sufficient
study they may make appropriate recommendations to either change the Comprehensive
Plan for less intense use in the area or reaffirm the existing pattern for development.
To permit the rezone at this time would foreclose the opportunity to make a reasoned
choice about the subject parcel and the nearby parcels which would be adversely
affected by the more intense nature of the proposal. Further, reclassification and
subsequent establishment of the proposed clinic in the face of a changed Comprehensive
Plan could create a non-conforming use.
The applicant has reasonable use of his property as zoned and is not by right entitled .
to a more intense use of the subject property if the public welfare would suffer
thereby. Premature rezoning of the area in addition to overconcentration of
commercial uses in a residential zone by Special Permit ill serves the public welfare.
RECOMMENDATION:
The City Council for the reasons enumerated above should deny the rezone application and
the request for the Special Permit.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before August 20, 1979. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error
in judgment, or the discovery of new evidence which could not be reasonably available at
the prior hearing may make a written request for review by the Examiner within fourteen
(14) days from the date of the Examiner's decision. This request shall set forth the
specific errors relied upon by such appellant, and the Examiner may, after review of the
record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the Finance Department, first floor of City Hall, or same may be purchased
at cost in said department.

13. At the July 23, 1979 meeting of the Renton City Council a request was made to .
reconsider the Comprehensive Plan for the North Renton area and institute a m•ratorium
on building in the area: The Planning Commission has apparently begun consideration
of the area with respect to the present Comprehensive Plan. At the same time the
City.Council• has referred the subject of the moratorium to the Planning and D-velopment
Committee for consideration.
14. The area is still predominantly single family residential. There has not bee , a great
demand.to rezone portions of the area. Most rezones of the area have occurre• on a
single lot basis occurring over a period of about 10 years and occurring mai y between
. 1955 and 1967.
15. There does ,not appear to .be any modern precedent for mixing a commercial use ith a
residential use in the same structure. The only exception would be to estab ish the
office of a professional person in his or her home (Section 4-706(4) (a) ) .
CONCLUSIONS: ' •
1. The applicant for' a reclassification must demonstrate at least that the property is
potentially zoned for the requested change; or that it has not been specific-lly
considered at the last area land use analysis; or that significant and mater'al
changes have occurred either of a public or private nature in the area. .
The applicant, has to further,demonstrate, that the proposed reclassification 's
appropriate and bears. a substantial relationship to the public welfare, both in
terms of location and timing (Section 4-3014,(A) (2)) .
Both the timing and location of the proposed rezone•are• inappropriate.
2. While the, applicant in this case has demonstrated that the present Comprehen•ive. Plan
for the area appears to designate this, area for medium density multifamily r:sidential
development, there are. indications that the Comprehensive Plan for this area may be
subject to change.
The Planning Commission,, acting on City Council referral, has begun review'o the
Comprehensive' plan for North Renton (Minutes, Renton Planning Commission, Ju y 11,
1979) . The City Council has also begun consideration of the issues involved in the
• North Renton area and has under study a possible moratorium 'on building in t, e
.North Renton area. The building moratorium has been referred to .the Planning; and
\Development Committee (Minutes, Renton City Council, July 23, 1979) .
3. There have been some rezones in the area but these have generally been of an isolated .
nature And-have ,generally occurred between 10 and 20 years ago. While .these rezones
have been to the more intense R-3 and R-4 classifications and subsequent con truction
has been of a conforming nature, .the area remains one of predominantly moder:tely-
priced, single family homes: The new Cedar River Trail will probably revitalize the
area and stabilize the neighborhood.
4. There are' four medically related facilities developed on five lots on -the black in
..
which the subject parcel is located. Some of these facilities are developed on R-2
zoned property and were established when the Special Permit process could be ,used
to establish such clinics, in R-2 districts. The City Council has since'limi ed. the
establishment Of clinics and other professional offices to R-3 zones by Specl'al
Permit to prevent the intrusion of such uses into the R-2 districts. Sectio
4-709A.A(3) was,specifically amended in 1976 to accomplish that aim. The re'oning
of the subject lot to 'R-3 in the midst of predominantly R-2 zoning. and uses ould
• . defeat the' purpose' of the amended ordinance. Subsequent to a rezone, the.cl'riic
would be located in an R-3 zone as permitted, but would be adjacent to R-2' z•ning
and uses. The rezone would have the further potential' of driving out the less intense
single family uses remaining on the block. The predominant land use is single family
• residential of a transitional nature and the R-2 zoning fulfills 'the transi ional •
needs well.
• 5: The applicant must also demonstrate that the proposed rezone will bear a s •stantial
relationship. to the public health, safety, morals, 'and general welfare (Par ridge v.
• ` Seattle,.. 89 Wn. 2d 454,463, 1978) . A similar finding is required to approv= a
request .for a'Special Permit (Sections 4-.709A.A(3) and 4-722(B)) . '
The.proposed rezone does not bear the substantial relationship necessary., the
. ' public•welfare is not enhanced by an overconcentration of a particular type of use •
in,.one area. This is especially the case when the proposed use is of a co i+ercial
nature and the area for the proposed use is designated for residential purp•ses.
The proposal is to add a fifth clinic on a residentially designated block, .nd this
would be inappropriate. The increased traffic and the 'creation of a multi-•ar parking
