AN ORDINANCE OF THE CPPY OF RENTON, WASHINGTON
CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON FROM CIFNER AT,
CI,ASSTFTCATTON DISTRICT(G) •'B0,*BUSINESS. DISTRICT (B-1) •
ICI NEIL R-46.6-79
WHEREAS under Chapter 7, Title IV (Building Regulations) of Ordinance
No. 1628 known as the "Code of General Ordinances of the City of Renton", as •
amended, and the maps and reports adopted in conjunction therewith, the property
hereinbelow described has heretofore been zoned as General Classification District (G);
and
WHEREAS a proper petition for change of zone classification of said property •
has been filed with the Planning Department on or about December 13, 1979, which
petition was duly referred to the Hearing Examiner for investigation, study and public
hearing, and a public hearing having been held thereon on or about January 15, 1980,
and said matter having been duly considered by the Hearing Examiner and said zoning
request being in conformity with the City's Comprehensive Plan, as amended, and the
City Council having duly considered all matters relevant thereto, and all parties having
been heard appearing in support thereof or in opposition thereto, NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I: The following described property in the City of Renton is
hereby rezoned to Business District (B-1) as hereinbelow specified; subject to the
findings, conclusions and decision dated January 23, 1980; the Planning Director is

hereby authorized and directed'to change the maps of the Zoning Ordinance, as amended,
to evidence said rezoning, to-wit: '
See Exhibit "A" attached hereto and made a part hereof
as if fully set forth herein.
(Said property being located at Northeast corner of Sunset

ADMINISTRATIVE Mayor Shinpoch noted increase in telephone calls and requests'
REPORT for assistance of needy people, and asked requests be given to
Personnel Director (Social Service person) and Mayor's Office
for referral to the proper agency.
Low Income Mayor Shinpoch reported request from Housing Authority for
Housing Resolution to obtain Federal assistance of 50-unit low income
Addendum housing. Mayor recommended concurrence. MOVED BY STREDICKE,
SECOND TRIMM, REFER ITEM TO THE WAYS AND MEANS COMMITTEE. CARRIED.
Code of Ethics Mayor Shinpoch noted letter to Departments requiring enforcement
of the Code of Ethics; comments invited.
Board of Revision of the Board of Public Works in 1977 was noted and
Public Works Mayor Shinpoch recommended no action be taken at present time.
CORRESPONDENCE AND CURRENT BUSINESS
Solid Waste Letter from Puget Sound Council of Governments, King Subregional
Management Council and Solid Waste Management Board requested City partici-
pation in joint preparation of revision of King County Compre-
hensive Solid Waste Management Plan. The King Subregional
Council of Puget Sound Council of Governments has been designated
by the Governor and the Environmental Protection Agency responsi-
ble for comprehensive long-range solid waste management planning
in King County. The current Management Plan needs updating
due to major changes in solid waste handling and all jurisdictions
in King County are being asked to participate. Cost of plan
revisions is budgeted at $39,000 or 3. 167t per capita; Renton's
share approximately $994. MOVED BY HUGHES, SECOND CLYMER, REFER
MATTER TO THE COMMUNITY SERVICES COMMITTEE FOR REVIEW. CARRIED.
Drainage Letter from Gloria Maglietto, 2715 Talbot Rd. S. , replied to
Problems letter from Public Works Director Gonnason 1/21/80 calling atten-
Talbot Rd. S. tion to error in that Gonnason stated drainage system functioned
adequately during December storm. Mrs. Maglietto reported that on
12/14/79 Renton Fire Department was called to assist with flood-
ing at their home. Mrs. Maglietto noted Gonnason's letter claimed
the City would work with the property owners to install temporary
asphalt berms to guard against a reoccurrence of the flood situa-
tion until the permanent improvements are installed; however,
Mrs. Maglietto claimed she had received vague response in contact-
ing the Engineering Department. Maglietto told of problems in
selling their home because ofdrainage problems; and claimed no
water or mud problems existed until the new construction ,in
area was near completion. The letter asked solution be reached.

Utilities Utilities Committee Chairman Shane submitted committee report
Committee Report recommending that the Kennydale and Honeydew Interceptor Sewer
Kennydale Ordinance be approved as presented. Discussion ensued. The
Honeydew Sewer increase of area services from lC adding 3c ; removal of construction
Interceptor financing (revenue bonds) because of possibility of raising the
water and sewer rates throughout the City to guarantee the revenue
bonds was discussed. Councilman Stredicke inquired for record if,
Councilman Shane or family had substantial land holdings in subject
area. Councilman Shane volunteered the information that he had
no interest in any property in that drainage basin, nor did his
children. MOVED BY CLYMER, SECOND ROCKHILL, TO REFER ORDINANCE
TO THE WAYS AND MEANS COMMITTEE FOR RECOMMENDATION. Councilman
Clymer asked financial impact report be presented. CARRIED.
Kefer Short Plat The Utilities Committee report approved a latecomer's agreement
LCAG Continued as presented for the Kefer Short Plat. Due to request for
renewed information, it was MOVED BY CLYMER, SECOND ROCKHILL,
CONTINUE THE MATTER FOR ONE WEEK. CARRIED.
Public Safety Public Safety Committee Chairman Hughes presented committee
Committee Report report regarding sale of controlling interest in OK Cab Inc.
Sale of OK Cab as referred 2/11/80. The report stated Doretha Rood, President,
OK Cab has requested matter be withdrawn from Council considera-
tion as Mr. Reinhardt is unable to obtain necessary financing.

the Commission continue to meet as stat&! in City Code, further
that a full progress report be submitted by the Commission to

Administrative Mayor Shinpoch advised Department Heads that it will not be

Shinpoch thanked Public Works Engineer Richard Houghton for
commendable effort last Monday night re sewers public hearing.
Mayor Shinpoch also noted clarification as requested by Council-
man Shane regarding "ethics and the elected official ." City
Ordinance No. 2586 was explained along with procedure for declar-
ing conflict of interest and disqualification; also Board of
Ethics explained. Mayor Shinpoch reported the Suburban Mayors '
Association hosted Kent Swisher and Stan Finkelstein from Associ-
ation of Washington Cities 2/6/80 with Legislative update; Council-
man Hughes had also attended.
OK Cab Inc. Letter from Doretha Rood, President, OK Cab Inc. and Philip
Sale Reinhardt requested approval of the sale of controlling
interest in OK Cab Inc. , P. 0. Box 217, Renton, to Philip
Reinhardt in accordance with requirements of Ordinance 2074.
The letter_ explained that Mr. Reinhardt is leasee-operator of
the Rainier Union 76 Station at 320 Rainier Ave and that the two
businesses will operate compatibly. The letter requested
immediate action as closing date had been set at 2/15/80.

NEW BUSINESS Councilman Hughes called attention to invitation to meet with
State Legislators in Olympia 2/15/80, asking those Councilmen

hold orientation for new Council Members if possible.

The Examiner inquired if the single. family residence located on the northern portion of
the. site is proposed to be removed. Mr. Xenos advised that the building will remain
during the' Phase I development plan, but will be eliminated during final development of
the site. He submitted an additional exhibit to illustrate proposed site development.
The plan was entered as follows by the Examiner:

Exhibit #3: Site Plan
Mr. Xenos noted that existing vegetation had been' retained on the site, and a 10-foot
landscape buffer is proposed on the southeast corner to screen the development from
property to the east. He advised the applicant's intent to comply with city requirements,
and indicated the proposed initial development will include a real estate office and
a dental facility. He noted that the proposal meets all standards and .requirements for
a shopping center, and site plans will be presented to the Hearing Examiner for review
prior to issuance of a commercial building permit.
The, Examiner requested testimony in support of the application.' There was no response.
He then requested testimony in opposition to the application. Responding was:

ed med by the Examiner. She indicated concern regarding retention of
trees which may cause safety hazards on her adjoining property in the future, and inquired
if replanting of vegetation or fencing would be proposed on the site. Mr. Xenos referred
to Exhibit #3, and advised the applicant's intent to provide a 10-foot easement on the
eastern portion of the property; however, fencing is not proposed. He noted that future
public hearings would provide the opportunity for site plan review. Responding to Mrs.
Viaene's inquiry regarding disposition of exi.sting' residences on the site, Mr. Xenos
reiterated previous comments regarding removal upon full development of the site,
The Examiner requested clarification of whether the applicant .intends to provide landscaping
within an easement or within a buffer of which the applicant would retain ownership. Mr.
Xenos indicated the applicant's intent to conform to all requirements determined necessary
• ,by the city. '

The Examiner requested final comments from the Planning Department. Mr. Blaylock
indicated the departmental recommendation to reverse building layout denoted on Exhibit #3
in order to allow provision of .landscaping in the location now designated for utility •
easements, but further review of the matter could occur when the site plan is submitted.
The Examiner requested further comments. Since there were none, the hearing regarding •
File No. R-456-79 was closed by the Examiner at 10:40 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes arid enters the following:
FINDINGS:
1. The request is for approval of a reclassification of +2,2 acres of property from G
(General; Single Family Residential; minimum lot size 35,000 square feet) to B-1
(Business) ., The site is in the approximate northeast corner of the intersection of
Duvall Avenue N.E. and Sunset Boulevard N.E.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
and departmental recommendations in this matter, and is entered as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of, 1971, R.C.W. 43.21,C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.

7. The subject property was annexed into. the city in July of 1975 at which time the
current G zoning was applied. Prior to annexation the subject property was zoned
for business uses as part of unincorporated King County.
8. The Comprehensive Plan designates the area in which the subject property is located
as suitable for commercial development. •
9. The subject property slopes slightly downward from the northwest to the southeast.
It has been graded and cleared although some trees remain in the northern perimeter
of the subject site, The shape is generally rectangular with the extreme southwest
corner of the rectangle excluded from the subject proposal. This excluded area is
currently developed with a 7-11 store.
10. Uses surrounding the 'subject site include single family uses both to 'the north and
east; the previously mentioned 7-11 store to the southwest; and the Ernst-Malmo
shopping center kitty-corner from the subject site. There are also a number of
undeveloped parcels in the general area. The real estate office which occupied the
subject .site has been removed. There are two existing single family 'homes on the •
subject site which eventually will be removed.

'11. The zoning in' the area of the intersection of Duvall and Sunset consists, 'of- B-1 on
the northwest, and southwest corners of the intersection. The G district in ahich
• the subject property is located extends both north, .east and, south of the' intersection.
. and also ,includes an area west of the intersection.:; South of the Ernst-M'almo,.Site
there is: an_R-2 (Duplex Residential; minimum lot size 7200 square feet) district,
.west of that' is "Pt..-3 (Medium Density Multifamily)`, district-:; Across Duvall,, north

12. The applicant indicated that they would be willing to create a 10-foot landscape .
easement to buffer the single family areas to the north and east of the subject site.
13. The Planning Department recommended that the Hearing Examiner review site development
plans for any commercial development on the subject property.
•
• CONCLUSIONS:
1. The proponent of a reclassification must demonstrate compliance with at least one
of the three criteria listed in Section 4-3014 which provides in part that:
a. The subject site has not been considered in a previous area wide rezone.or land
use analysis; or
b. The subject site is potentially zoned for the new classification per the
Comprehensive Plan; Or
C. There, has been demonstrated change in the development pattern in the area since
the last rezoning action. •
•
The applicant has demonstrated that the necessary criteria to permit the rezone of
the subject property has been met.'
2. The Comprehensive Plan for the City, of Renton designates the area in which the
subject property is located as suitable for commercial development. The property
had previously been zoned for business Uses prior to annexation. The applicant
had used the property for a real estate business which has since been removed.
The applicant proposes re-establishing commercial uses on the property which is
compatible with the Comprehensive Plan.
3. Restoring the'property to a business classification will not adversely affect the
area nor the adjacent single family homes. The applicant has suggested creating
a 10-foot landscape buffer with the restoration of natural-type vegetation. 'This .'
would satisfy the Planning Department's concern about establishing a buffer between
the proposed commercial uses and the adjacent single family property.
4. The single family homes .in the G-7200 zone directly across Duvall Avenue N.E. should
also be effectively screened from the more intense commercial development, and a
landscape buffer planted with trees and shrubs should be provided along the northern
' 325 feet of the western property line.
5. —The use of this parcel (including the corner site of the 7-11 store) for commercial
purposes is compatible with the surrounding zoning which is B-1 on two of the three
corners.
Reclassification to B-1 also is suitable because the parcel is well located' on a major
roadway. The development of commercial properties in this area will create 'a small
regional node of commercial activity and will function to serve the multifamily
districts located just south, as well as the single family homes in the immediate area.
6. In order to assure compatibility of the proposed commercial development with the
• surrounding single family properties, the site plans for the proposed construction
should be reviewed by the Hearing Examiner after recommendation by the Planning
Department.
•
RECOMMENDATION:
The City Council should approve the proposed "reclassification of the subject property
from G to B-1 subject to the dedication of a 10-foot wide landscape easement along the
east, north, and northern 325 feet of the west property lines of the subject property,
and the. planting of suitable' natural-type vegetation. Approval of. the rezone should be
subject to a review of the specific development plans by the Hearing Examiner pursuant
to Section 4-3010.A.6.

The subject site was annexed into the. City by Ordinance #2945
of July 7, 1975 at which time the present zoning classification
was applied.
D. PHYSICAL BACKGROUND:
1. Topography : The subject site slopes slightly downward from
northwest-southeast .
2. Soils : Alderwood gravelly sandy loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow
in the substratum. Runoff is slow to moderate and the erosion
hazard is moderate . This soil is used for timber , pasture , berries ,
row crops and for urban development .

E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties consist of a mixture of commerci. l, low
density single family residential and undeveloped uses .
F. PUBLIC SERVICES :
1. Water and Sewer: An 12" water main is located or Duval Avenue
N.E. adjacent to the westerly boundary of the subject s . te ,
while another 12" main extends east of the intersection of Duvall
• and Sunset Blvd. N.E. on the north site of Sunset . . An 8' sanitary
sewer is located at the southwest corner of the intersection of
Duvall Avenue N.E. and Sunset Blvd N.E.
2. Fire Protection : Provided by the Renton Fire Departmenv per

3. Schools : Normally schools would not be impacted: However,
placement of a fast food restaurant on the subject site would
create a substantial modification of pedestrian movement and
high school students habits in the area.
4. Social : Unknown. Impacts dependent upon ultimate commercial
development of the subject site .
5 . Traffic : Unknown . Traffic volumes and patterns are dependent
upon the ultimate use of the site.
J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended, RCW 43-21C,
a declaration of non-significance has been prepared for the
subject proposal.
K. AGENCIES/DEPARTMENTS CONTACTED:
1. City of Renton Building Division .
2. City of Renton Engineering Division.
3. City of Renton Traffic Engineering Division .
4. City of Renton Utilities Division.
5. City of Renton Fire Department .
L. DEPARTMENTAL RECOMMENDATIONS :
1. The rezone request from "G" , General Classification District
is consistent with the Comprehensive Land Use Element , which
designates the subject site as commercial .
2. The other three corners of the intersection have been developed
commercially. Both the northwest and southwest corners have
been rezoned since the subject site was annexed in 1975.
The Central Highlands Plaza has been constructed on the south-
west corner after Ordinance #3152 rezoned the property in 1977.
The northwest corner was rezoned in 1978 by Ordinance #3225
to allow the expansion of a non-conforming commercial use .
3. The 7-11 Store, immediately adjacent to the south of the subject
site, and the Mobile Gas Station on the southeast. corner of the
intersection were constructed prior to their annexation in 1975 .
4. The items addressed in #1 , 2 and 3 appear to indicate that the
subject site is potentially zoned for the B-1 classification
requested. (Section 4-3014(A) (3) .
5 . The subject site has not been specifically considered in an area
wide land use or zoning analysis since the site was annexed in 1975.
This appears to comply with the requirement of Section
4-3014(A) (1) .
6. The subject site is adjacent to existing single family
residences. The Comprehensive Plan has designated these
adjacent areas as Low Density Multiple Family to provide
a buffer. However, the existing single families residences
should be protected from any commercial development . To
insure this, site plan approval should be required for any
commercial development with emphasis placed on screening
the residential uses .

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C. RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals. The Act also requires that an EIS be
prepared for, all major actions significantly affecting the quality of the environment.
