EASEMENT
Grantor is Drainage District Number One of King County, Washington, a Washington
municipal corporation (hereinafter called "District" or "Grantor') which owns and operates a
continuous storm water drainage system in King County, Washington.
Grantee is Longacres Park, Inc.. formerly Broadaxes, Inc, a Washington corporation
(hereinafter called "Longacres" or "Grantee"). which owns the following described real
property in King County, Washington (hereinafter "the Longacres property" or "Grantee's
Property"):
All that certain real property situate in the City of Renton, County of King.
State of Washington, being Government Lot 14, and a portion of Government Lot 8,
both in Section 24, Township 23 North, Range 4 East, W_M., and a portion of the
N.W. 114 of the S.E. 114 of said Section 24, and a portion of the N.E. 114 of the S.E.
1/4 of said Section 24, avid being more particularly described as :oi:c%vs:

Basis of Bearings for this description is the Record of Survey for Broadacres Inc.
recorded in Book 10 of Surveys at page 2, under Recording No. 7707289002, King
County records.
NOW, THEREFORE, Grantor, in consideration of One Dollar ($1.00), in hand paid, and the
terms and conditions contained herein, grants unto Longacres Park, Inc., as owner(s) of the
Longacres property, a non-exclusive permanent easement as herein limited, for the purpose
of constructing, reconstructing, installing, repairing, replacing, operating; maintaining and
cleaning a 36" reinforced concrete pipe (RCP) outfall structure over, under end across the
following described real property in Kmg County, Washington (hereinafter "the easement
property"):
A fifteen foot wide strip of land in the N.E. 114 of the S.E. 114 of Section 24,
Township 23 North, Range 4 East, W.M., beig also a portion of an existing drainage
ditch right-d-way condemned by King County Drainage District Number One,
October 1902 under King County Superior Court Cause No. 32912, said t;,3een foot
wide strip of land being more particularly descrbed as follows:
BEGINNING at a point on the southweslerty line of said drainage ditch right-
of-way, distant thereon S36"00'41 "E 6.04 feet from the northerly terminus of the
course sham as line 11 on the record of survey recorded in Book 85 of Surveys at
94 page 27, Kurg County records, thence from said POINT OF BEGINNING, lewi g
said soudraestery line N81"11'35"E 12.25 feet; thence S0804825"E 15.W feet;
thence S8101 135"W 4.57 feet to return to said southwesterly line; thence along said
southwesterly line N36"00'41"W 16.86 feet W the POINT OF BEGINNING, situated in
King County, Washington;
together with the right ofingress and egress thereto without prior in0tution
of any suit or proceedings cf law.
THIS GRANT is made on the following tens and conditions:
1. Grantee will install and from Nine to time, and at all fines herealer, ttaal% mpak

2. Grantee shall utilize the easerndm granted herein In a martw whfhlClt
hinder or prevent the proper and necessary use of said real property by Grantor as haft of a
continuous storm water drainage system.
3. Grantor retains the right to use said real property for the operation and
maintenance of its drainage system. and for such other uses as do not interfere with the
purpose for which this easement is granted.
4. The performance of all Grantee's work required or permitted hereunder shall be
performed in a timely, proper, substantial and workmanlike manner; and shall be done at the
sole cost and expense of Grantee.
5. Grantee shall have the right at times as may be necessary to enter upon said
property for the purpose of cleaning. repair and maintenance, provided that such cleaning.

repair and Maintenance shall be accomplished in such a manner that any private or public
improvements existing in said easement, including any ditch or ditches, shall not be disturbed,
damaged or destroyed.
6. Grantee shall utilize this easement in accordance with the requirements of all
laws: statutes, ordinances, rules and regulations which aught affect activity thereon, and shall
not conduct, allow or permit any activity thereon in violation of arty law, statute, ordinance,
rule or regulation.
7. Grantee shall indemnify and hold harmless Grantor against and from any and all
liability for claims, suits, costs, losses andfor expenses that may in any manner result from or
arise out of the use of said easement by Grantee, its express or implied employees, agents,
permittees or licensees to the extent arising out of the negligent ads or omissions of Grantee.
its employees, agents, permittees or licensees, or from failure to fulfill any of Grantee's
obligations or duties hereunder. -
This easement is for the benefit of, and appurtenant to, the real property identified
herein (the Longacres property). Its term shall commence upon the oate of execution of this
instrunnent, and thereafter it is intended that this easement shall be perpetual. In the event of
nmrrrse. the grants contained herein shall lapse. -
This easement shall be binding upon the parties, their heirs, successors in interest and
assigns.
This easement, and all rights, covenants and obligations contained herein, shall inure
to the benefit of, and be binding and obligatory )goon, the real properties described herein, the
beneficial owners thereof from fine to time. and, as b� owners, the Grantor and
i Grartee, their hears. successors and assigns.
