Th� rrantee shall, upon compietion of any work within the property covered by the easement, restare the surface of the easement,and any private improvements disturbed or destroyed during executian of the work, as nearly as practieable to the condition they were in immediate(y before ccsmmencement of the work ar entry by the Grantee. 2. Grantor shall retain the right to us� the surface of the easement as long as such use does not interfere with the easement rights granted t�the Grantee. Grantor shall not, however, have the right ta: a. Erect or maintain any buiidings or str�actures within the easement;or b. Plant trees, shrubs or vegetation having deep root patterns which may cause damag� to ar interfere with the utilities ta be placed within the easement by the Grantee;or c. t�evefop, landscape, or beautify the easement area in any way which would unreasonabiy increase the costs to the Grantee af restoring the easement area and any private improvements therein;or d. Dig, tunnel or perform ather forms of construction activities on th� Wroperty which would disturb the compaction or unearth Grantee's facilities on the right-of-way, or endanger the lateral support facilitfes;or e. Blast withira fifteen (15}fieet of the easement;or f. Erect g�nces in sueh a way as to prevent access by the Grantee's vehicles to the Grantee's facilities. Any fence construction must provide for an opening (gated, removable sections, barrlers, etc.)of at least ten (10)feet in width;ar g. Erect any abjects within fifteen(15}above the ground surface within the easement. This �asement shall run with the land described herein, and shall be binding upon the parties, their heirs, successors in interest and assigns. �rantor covenants that it is the lawful owner of the abave property(ies)and that it has a good and lawfui right to execute this agreerrrent. Grantor shall protect, save and hold harmless, and defend, with caunsel of its sole reasonable choice, Grantee, its tenant(s), and their su�:cessors, assigns, customers and invitees, from all ciaims, actions,filed or threatened, costs,damages,or expenses of any nature whatsoever arising aut of ar in eonnection with any acts or omissions of Grantor in cortnection with this easement. The obligation to protect, save and hold harmless, and d�fend shall not include such claims, actions, costs, darnages,or expenses whi�h may be caused by the sol2 negligence af Grantee or its tenant(s}, or their successors or assigns; Provided that if the ciaims actions, costs, damagesf or expenses are caused by or result from concurrent negiigence of(a)Grantee or its tenant(s), or their successors or assigns and {b) Grantar, its agents, contractars or assigns, and involves those actions covered by RCW 4.24.115,this indemnity provision shaN be valid and enforceabfe oniy ta the extent of the negligence of Grantor, its agents, contractors or assigns. Grantor shaf! promptly notify Grantee and its tenant(s} af any loss, damage, injury c�r death arising out af or in connection with any acts or omissions of Grantor ir� connection with this easement.
