Warren, City Attorney Date: February 6, 1996 Subject• Maplewood Heights School By memo dated January 26, 1996, you asked me to make an inquiry of the Boundary Review Board about providing temporary service to the Renton School District from Maplewood Heights Elementary School. After several telephone calls I have not received a reply. I therefore have authored the attached letter. I would think this is a more direct way of contacting the Boundary Review Board than sending them a copy of any service agreement. We certainly can provide them with a copy, but if we receive an opinion that the Bou.ndary Review Board does not have jurisdiction,then we need do nothing. Your second question is, whose signature from the school district would the City approve far a temporary service agreement. The answer depends on the school district's documentation. Anyone who has apparent authority can bind the school district. For example, the Director of Facilities probably would have the authority, and certainly Gary Kohwles. Likewise, if the school board has passed a resolution authorizing certain people to sign and bind the school district, we could accept signatures from those people. Not too long ago, Peninsula School District complied with a similar request made by their local sewer district and discovered upon State audit that they had violated State law. This caused considerable negative press for both parties. For this reason, it would be best if we negotiated a proportional arrangement with you, if the time comes that we wish to pursue this. The submittal and review terms are satisfactory to us, if timely of course. Sorry for not getting back to you sooner, I got a little buried, but had a great vacation. Approval was granted subject to the following conditions: 1. The school district will engineer and construct the sewer extension so that it may service the entire area that this extension would logically serve. 2. The school district will pay all engineering and construction costs. 3. The sewer system will be built to meet current City standards at the time of construction. 4. The school district will pay non-resident sewer rates. 5. The school district shall pay for all permits and fees, City and other agencies, required for the sewer extension. 6. At the time of application for permit, the school district executes and records a covenant agreeing to support any annexation that includes the Maplewood eights Elementary School parcel (if the City Attorney determines that such an agreement is valid and appropriate for a school district property.) In addition, preliminary sewer design plans shall be submitted to the City Council for review to ensure that the proposal meets the long-range plans envisioned by the Council for the area. Kolby - Correspondence was read from Frank Kolby and Sen Kolby, 16427 Benson Emergency Sewer Hook- Rd. S., Renton, 98058, requesting emergency hook-up to the City's sewer up system as their septic system has failed. David Christensen, Engineering Specialist, asked that, given the urgency of this matter, Council consider this request tonight rather than refer it to the Utilities Committee. Mr. Christensen explained that the Kolby property is located in King County adjacent to Renton's city limits. It is also adjacent to two of the City's sewer lines. Staff recommends that the Kolbys be allowed to connect to Renton's sewer system, with conditions, as follows: 1. Execution of a restrictive covenant agreeing to support any annexation that includes this property; 2. Connection must be made consistent with City codes, standards and policies; 3. All required permits must be obtained and paid for; and 4. Payment of one and one-half standard utility rate for non-residents. Councilman Edwards concurred with Council President Stredicke that maps showing the location of the property being considered, including City limits and adjacent properties, should be provided for Council's information in reviewing these types of requests. . OLD BUSINESS Planning and Development Committee Chair Keolker-Wheeler presented a Pl�nning & Develooment report recommending that the Purpose Statement of the Convenience Committee Commercial (CC) Zone be amended to remove the limitation of a one-half Comprehensive Plan: mile market area about the zone for retail and service establishments. The Convenience Commercial Committee further recommended adding language stating that uses serving a (CC) Zone Amendment targer area may be appropriate providing they serve the immediate area and fit the scale and character of the neighborhood. The Committee further recommended that the ordinance regarding these matters be presented for first and second reading. Because there are unresolved issues in the long-range planning of this portion of the City, it is the Committee's desire to review the plans to ensure itself that the School District's design of the sewers is appropriate for the vision Council has for this area. MOVED BY SCHLITZER, SECONDED BY CORMAN, COUNCIL CONCUR IN THE COMMITTEE REPORT.* Council President Stredicke suggested adding another condition prohibiting any residential lots outside the City limits from connecting to this sewer line. Councilmember Keolker-Wheeler noted that, if the line belongs to the City, anyone residing outside the City limits would have to obtain specific approval A from Council prior to connecting. Mayor Clymer added that if the sewer is built as a tight-forced line, it would helong to the School District but could not accommodate additional hook-ups. *MOTION CARRIED. Public Works: Release of Utilities Committee Chair Schlitzer presented�a report recommending Easement, Trillium concurrence with the recommendation of staff and the Board of Public Works Corporation that the City Council release a portion of an easement located in the Burlington Northern Industrial Park of Renton, Division 1, contained and described under King County Recording number 7809250902. The Utilities Committee also recommended concurrence with the recommendation of the Board of Public�Works that the City Council determine the classification of the subject easement to be Class B, which states: "Ali City of Renton easements for which no public funds have been expended in the acquisition, improvement or maintenance of same or easements originally dedicated or otherwise conveyed to the City by the present petitioner for the release of said easement for which no public expenditures have been made in the acquisition, improvement or maintenance thereof." Therefore, if Council determines the easement classification to be Class B, the City shall receive no further compensation other than the easement release filing fee which has been paid, and the processing fee, which is now due and payable. The Utilities Committee further recommended that Council authorize the Mavor and Citv Clerk to execute the partial release of easement document and that the City Clerk record the document with King County. As part of their upgrade, they are looking at the possibility of connecting this facility to the city's East Renton Sewer Interceptor at N.E. 4th St. and Duvall Avenue N.E. Since the school is located outside the city's corporate boundaries, they are requesting that the city authorize the school district the ability to connect the Maplewood Elementary School to the city's sanitary sewer system. RECOMMENDATION: Staff recommends that the city allow the Renton School District No. 403 to connect the Maplewood Elementary School to the city's sanitary sewer system with the following conditions: � The School District will engineer and construct the sewer extension so that it may service the entire area that this extension would logically serve. � The School District will pay all engineering and construction costs. � m The sewer system will be built to meet current city standards at the time of construction. 40 The School District will pay non-resident sewer rates (see BACKGROUND SUMMARI�. � The School District shall pay for all permits and fees, city and other agencies, required for the sewer extension. � � July 25, 1994 Page 2 BACKGROUND SUMMARY: The Renton School District No. 403 plans to remodel and renovate the Maplewood Heights Elementary School located at 13430 144th Avenue S.E., Renton. They are planning to apply for permits in the fall of 1995, begin construction in the summer of 1996 and re-open the school in the fall of 1997. The school is currently servetl by an on-site septic system. As part of the remodel, they are exploring two options. The first option is upgrading their current septic system. The second option is to connect the school to the sanitary sewer system. The City is beginning construction of the East Renton Sewer Interceptor this summer. Construction is scheduled to be completed by March of 1995. This new line will be the point of connection for the proposed school line. In order to connect to the city's system, the School District will be required to install approximately 2000 linear feet of 24 inch diameter sewer line, 500 feet of 8 inch diameter sewer line, 1500 linear feet of 4-6 inch force sewer line and a sewer lift station. The City of Renton currently provides sewer service to three schools outside of the city limits; Sierra Heights Elementary School, Apollo Elementary School and Renton Alternative High School. All of these schools have been served by the city's system since 1971 and pay non-resident rates. The school districts were required to engineer and install the systems which serve their schools.
