Variance for limited front yard setbacks
Dear Elizabeth:
Per our past conversations, we are proposing a reduction in the front yard setback for six
(6) of the"six-pack"lots in the Maplewood Estates preliminary plat. As noted on the
attached reduced preliminary plat map, there are six clusters of lots in the southeast
portion of the property that are accessed by a 26-foot wide easement. We are proposing
at the front yard—setback for one lot in each of these clusters be-reduced-from the
standard fifteen(15) feet to five(5) feet.
This reduction in the front yard setback would only affect one of the "back corner"lots in
the clusters. Please refer to the site plans prepared by the architects, The Bienz
Architectural Group, designated as Exhibit A and B. In the upper left hand corner of
these exhibits is a"back corner"lot with the footprint for Plan 5. This plan features a
side-in garage orientation as opposed to Plan 6 in the other"back corner"lot, which
includes a front entry garage. On Exhibit A,the Plan 5 footprint is shifted to within 5
feet of the common property line for Plan 2, with a 15-foot setback from the access
easement. On Exhibit B, the footprint for Plan 5 is shifted to a distance of 15 feet from
the common property line of Plan 2. With the side-in garage orientation of Plan 5, our
preference is for the setbacks noted on Exhibit A since this orientation will allow
smoother access to the garage for the future residents. As noted earlier,this reduction
would affect only one of the "back corner" lots (either left or right side),with the other
"back corner"lot having the setbacks per the approved preliminary plat.

Justification for the Variance Request
a.) The applicant does suffer undue hardship and the variance is necessary to
allow the use of side-in garage footprints in the"six-pack"building
clusters,which is an innovative solution that was approved as part of the
preliminary plat. This clustering results in a streetscape with very few
garage doors visible from the street, since the homes are accessed by way
of a T-shaped access easement. The "back corner"lots in the clusters are
dissimilar to the more conventional lots in the plat in that there is no street
directly in front of these homes and therefore,there is no conventional
front yard. If the side-in garage footprints are required to meet the
"standard" setbacks of the zone (or the setbacks approved as part of the
preliminary plat),the access to the garages from the access easement will
be very indirect and not a smooth movement for the residents accessing
their garages. Other property owners in the vicinity with the same zoning
classification can apply for a similar variance to allow for these innovative
solutions to address the visual impact of garage doors on the residential
streetscapes.
b. The granting of the variance will not be materially detrimental since it will
only affect six of the 218 lots contained in the preliminary plat and will
not be visible to the general public since it is removed from the public
streets. Only the adjacent lots will even be aware of this minor shift in the
building footprint.
c. As stated earlier, other properties in the area can apply for a similar
variance for a similar innovative solution. As a result,this variance does
not constitute a.grant of special privilege. Instead of measuring the front
setback from the adjacent lot, we are proposing to measure the front
setback from the access easement,which is substituting for the
conventional street in other parts of the plat.
d. The proposed variance is the minimum to accomplish the intended results
since this allows the 30 foot wide three car garage(or two car garage plus
flex-space)to better align with the 26 foot wide access easement. This
variance request does not allow full alignment with the access easement,
but it is close enough to provide a smooth motion for the residents to
access their garages.

Variance Submittal Requirements
This map will be used to identify the site location on public notices and to review compatibility with
surrounding land uses. The map shall also show: the property's lot lines, existing land uses,
building outlines, boundaries of the City of Renton (if applicable), north arrow(oriented to the top
of the plan sheet), graphic scale used for the map, and City of Renton (not King County)street
names for all streets shown.
Kroll Map Company(206-448-6277)produces maps that may serve this purpose or you may use
the King County Assessor's maps as a base for the Neighborhood Detail Map. Additional
information (i.e. land uses and building outlines for adjacent sites)will need to be added by the
applicant.

Varia Submittal Requirements
1 . Justification for the Variance Request: Please provide five(5)copies. The burden of proof as
to the appropriateness of the application lies with the applicant. The applicant must submit a
' `written statement addressing and justifying the issues to be considered by the Hearing
Examiner/Board of Adjustment. In order to approve a variance request,the Examiner/Board must
find that ALL the following conditions exist:
a. That the applicant suffers undue hardship and the variance is necessary because of
special circumstances applicable to subject property, including size, shape,topography,
and location or surroundings of the subject property; and the strict application of the
Building&Zoning Code is found to deprive subject property owner of rights and privileges
enjoyed by other property owners in the vicinity and under identical classification;
b. That the granting of the variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone in which subject
property is situated;
c. That approval shall not constitute a,grant of special privilege inconsistent with the
limitation upon uses of other properties in the vicinity and zone in which the subject
property is situated; and .
d. That the approval, as determined by.the Development Services Division, is the minimum
variance that will accomplish the desired purpose.

REVIEW PROCESS-FOR VARIANCE REQUESTS: Once the complete Variance application
package has been accepted for initial review,the Development Services Division will post three (3)notices
of the pending application at or near the subject site and mail notices to property owners within 300 feet of
the project site. The proposed plan will be routed to other City departments,jurisdictions or agencies who
may have an interest in the application. The reviewers have two(2)weeks to return their comments.
Development Services Division staff will issue a report and decision. This report and decision will be
mailed to the contact person named on the Master Application and any parties of record, and will also be
available for review by the public.
APPEAL PROCESS FOR ADMINISTRATIVE DECISIONS: Any person, including the
applicant, aggrieved by the granting or denial of a Variance may appeal the decision to the City Hearing
Examiner within fourteen (14)days of the date of the decision.
BUILDING AND CONSTRUCTION PERMIT ISSUANCE AND INSTALLATION OF
IMPROVEMENTS:
GENERAL: In the City of Renton, a Building Permit must be obtained to build buildings and structures.
A Construction Permit must be obtained to install utility lines,transportation improvements and work in •
City right of ways. Building and Construction Permits are separate permits.
Applicants may apply for building and construction permits concurrently with their requests for a Variance.
However,the applicant should be aware that conditions of the Variance may create a need for revisions to .
these other permit applications.

If no appeals or reconsideration requests are filed within fourteen (14)days of a decision to approve the
variance,the applicant will be eligible to obtain building and construction permits. A construction permit
for the installation of on and off-site utilities will be issued upon the City of Renton Public Works'review
and approval of civil engineering drawings and receipt of all applicable development and permit fees. The
applicant will also be eligible to receive a building permit upon City of Renton Building Department
approval of building plans and receipt of all applicable fees.

CODE SECTION: Section 4-2-110A, Development Standards for Single Family Residential

SUBJECT: Front yard requirement determination for single-family residential lots with
garage access from other than front yard street(s).
BACKGROUND: Section 4-2-110A of the Renton Municipal Code specifies that the
minimum front yard setback is 15 feet for the primary structure and 20
feet for attached garages, which access from the front yard street(s)
along streets created after September 1, 1995. However, clarification is •
necessary which determines if garages that do not gain access from the
front yard (e.g. side yard) are required to maintain a minimum 20-foot
setback as opposed to a 15-foot minimum setback. The 15-foot minimum
setback typically applies to primary structures; however, this
determination will clarify if the 15-foot setback could also apply to garages •
.—• that are not accessed from the front yard. -
JUSTIFICATION: Due to the ambiguous wording of this code provision, members of the
development community have questioned staff as to the actual setbacks
required for garages. Upon review of the code, staff has determined that •
if access to a garage were not proposed from the front yard, then the 15-
foot minimum setback would be applicable. The intent of this code
provision was to prevent cars from parking over public sidewalks and
creating an unattractive nuisance for pedestrians. Therefore, a vehicle
parked within the driveway of a side-loaded garage with a 15-foot front
yard setback would not protrude into the front yard and would satisfy the
intent of this code provision.
DECISION: Garages,which do not gain access from the front yard street, are eligible
for a 15-foot minimum front yard for the purposes of determining setback
