FIRST AMENDMENT TO
SEWER EASEMENT AND AGREEMENT
This FIRST AMENDMENT TO SEWER EASEMENT AND AGREEMENT (this "First
Amendment") is made this 24th day of August, 2001 by and between The City of Renton, a
Washington municipal corporation ("Grantee"), and The Quadrant Corporation, a
Washington corporation ("Quadrant") with respect to the following facts:
Recitals
A. Quadrant is the owner of certain real property located in the City of Renton, King
County, Washington (the "Property"), that is legally described as follows:
LOT A OF CITY OF RENTON LOT LINE ADJUSTMENT NO.
LUA-00-121-LLA, AS PER PLAT RECORDED UNDER
RECORDING NUMBER 20001025900008;
SITUATE IN THE CITY OF RENTON, COUNTY OF KING,
STATE OF WASHINGTON.
Quadrant is planning a multi-phase residential subdivision of the Property under the name
"Liberty Ridge".

B. An earlier owner of the Property and certain abutting properties, La Pianta
Limited Partnership, a Washington limited partnership, entered into a Sewer Easement and
Agreement with Grantee dated December 9, 1996 that was recorded under King County
Recording No. 9702191181 (the "Original Instrument"). The Original Instrument legally
described an "Easement Area" in Exhibit B attached thereto (referred to herein as the
"Existing Easement Area"). Subsequent to the recording of the Original Instrument, sanitary
sewer lines were constructed within the Existing Easement Area (the "Original Sewer
Installation").
C. Pursuant to sanitary sewer plans for Liberty Ridge Phase I approved by the
City of Renton in 2001, a segment of the Original Sewer Installation lying within the Property
has been removed and replaced by new sewer line segments lying within the Property.
Portions of those new segments lie both within and outside the Existing Easement Area.
D. Among other things, in this First Amendment, the parties wish to agree upon
the legal description of an amended easement area to reflect the changes to the Original
Sewer Installation described in Recital Paragraph C, above.
WHEREFORE, with respect to these facts, the Original Instrument is hereby amended
as follows:
1. The Existing Easement Area as described in Exhibit B of the Original
Instrument is hereby replaced in its entirety with the legal descriptions set forth on EXHIBIT
A attached hereto.
2. ' To the extent that the sewer drawings that are attached to the Original
Instrument as Exhibit C thereto are inconsistent with the changes to the Original Sewer
Installation described in Recital Paragraph C, above, those drawings shall be deemed to be
replaced for the Amended Easement Area with the sewer drawings for Liberty Ridge Phase
I on file with the City of Renton Department of Planning/Building/Public Works.
3. All portions of the Original Instrument that are not expressly modified or
amended by this First Amendment shall remain in full force and effect.

The City of Renton has approved the above referenced lot line adjustment and has forwarded the
final mylars to King County for recording.
Please note the recording of the lot line adjustment map alone does not transfer ownership of
property. If necessary, prepare and record a deed transferring ownership of the portion of land
depicted in the lot line adjustment map. We recommend that the legal description for this
document be prepared by a surveyor. It is the applicant's responsibility to ensure this document is
properly prepared and recorded with the County.

Comment Letter
Dear Ms. Nishihira:
In response to your September 27,2000 letter to me setting forth the City's review comments
concerning the initially-submitted drawings and application materials, I herewith enclose two sets of
copies of revised lot line adjustment drawings. Please route them for final review and approval as
soon as possible.
In regard to Comment 1 of your letter (and as I explained to you by phone last week),
proposed Lot D abuts the Maple Valley Highway (SR 169) and will gain access from it. Proposed
Lot F will have access across Lots A and E, with access easements across those two lots reserved
when La Pianta LLC (the owner of those two lots) next conveys them. (Liberty Ridge L.L.C. is
anticipated to acquire them from La Pianta LLC.) This is the same approach taken with the lot line
adjustment that the City approved for this same property in April, 2000 with the lot line adjustment
recorded under LUA-00-020-LLA. (Note that no easements were provided at the time of that lot
line adjustment but afterward, when La Pianta LLC conveyed Lots 1, 3, 4, 7 and 8 of that lot line
adjustment to Liberty Ridge L.L.C., easements were reserved across Lots 1 and 4 for the benefit of
Lots 5 and 6. A letter from La Pianta LLC's attorney,Ellen Dial of Perkins Coie, was submitted last
April in support of that approach and of not having easements added to the face of the lot line
adjustment drawings.) In view of the above, the form of Declaration of Covenant set forth on page
1 of your letter to me has not been added to the current lot line adjustment drawings.
In regard to Comments 2 through 6 of your letter, all of the requested changes have been
made.

Also, I hereby request that the City consent to having the bond that was provided to secure
staking of lot corners for the lot line adjustment recorded under LUA-00-020-LLA be rolled over to
secure staking of the lot corners for the new lot line adjustment. Please advise me as to whether that
will be acceptable.

As a follow-up to the phone conference that you and I had a few minutes ago, I am writing
to (a) forward to you a copy of an April 6, 2000 letter from attorney Ellen Dial of Perkins Coie and
(b) confirm our intention to have Triad Associates remove from the draft Lot Line Adjustment
drawings the "Access Easement" depicted thereon. I hereby request that the City approve the
removal.
As Ms. Dial points out in her letter, La Pianta will reserve easements in conjunction with its
phased sale of property to my client Liberty Ridge, LLC(a limited liability company with which the
Merlinos are involved). Hence, the depiction of easements on the lot line adjustment is unnecessary.
Please bear this in mind as you complete your review of the draft Lot Line Adjustment

This firm represents La Pianta Limited Partnership, which has applied for
boundary line adjustment LUA 00-020 for portions of Sections 16 and 17, Township
23 North, Range 5 East, WM. in the City of Renton. You have had a number of
conversations with Mr. David Halinen, who represents the prospective purchaser of
this property, concerning the boundary line adjustment.

LND-30-0215, respectively, on the drawing sheets on the spaces already provided.
Proposed Lot E, as noted on Sheet 4 of 5, is missing curve data on the east line of said lot. See the
attachment.
The legal description included in the City of Renton Land Use Permit Master Application is more
complete than that noted on Sheet 1 of 5. Revise the latter legal description accordingly. See the
attachment.
Sheet 1 of 5 uses"BOUNDARY LINE ADJUSTMENT" in the title block. The other sheets use
"LOT LINE ADJUSTMENT." Revise Sheet 1.

Liberty Ridge Lot Line Adjustment
Project Narrative
The approximately 127-acre subject site is located in the City of Renton north of Maple
Valley Highway, south of.NE 3rd/NE 4th Street, east of both Mt. Olivet cemetery and the
La Colina residential subdivision, and west of the King County shops/maintenance
facilities yard and other King County-owned property. The project site has been cleared
and graded in association with the previously-approved Cedar Crest manufactured
housing project,and previously-conducted gravel mining on the site.
The proposed lot line adjustment drawings encompass all of the lots (Lots 1 through 8) of
previously-approved and recorded City of Renton Boundary Line Adjustment No. LUA-
00-020-LLA. The new drawings contemplate adjusting the boundaries of four of those
existing lots (Lots 1, 4, 5 and 6). (See the accompanying drawings for the details of the
now-proposed lot layout.) The other four previous lots (Lots 2, 3, 7 and 8) will retain
their same geometry under the new proposal but are included in the subject drawings and
application with the new lot-lettering scheme so that all of the lots will conform to that
new lettering scheme.
The purpose of these additional adjustments is to create legal parcels that conform to a
revised proposed phased sale of portions of the subject property for subdivision and
development purposes, with the north boundary of proposed Lot D approximately
following the toe of 40% slope line along the base of the bluff at the property's south end.
