I do still have one question regarding the Applicant's reconsideration request. The sole reason for granting the extension was to account for delays caused by the decision making process on the extension request, in case the Applicant had to stand by and await a decision before deciding what to do with its timeline. The Applicant now takes the position that recent inclement weather and holidays diminishes the extra time given to complete the project. The Applicant references WSDOT Spec 5.04.3(1) as an example of problems caused by the weather, which places limits on the laying of hot mixed asphalt between October 1 and March 31 of every year. However, the Applicant didn't file its extension request until September 26th of this year. Consequently, the delays caused by the decision making process didn't push the Applicant into a bad weather situation under 5.04.3(1),. because the Applicant did that to itself by waiting until September 26th to file its request. However, the weather has gotten markedly worse since September 26th, including some snow days. Other WSDOT specs identified by the Applicant show that additional obstacles may be faced with the colder temperatures of late November through the present. The decision making process on the Applicant's extension request took about two months. Being amply generous with the Applicant and assuming a reasonable time frame of two weeks for a decision, my question to the Renton staff is whether the extra six weeks in decision making delay pushed the project into weather conditions that created a need for additional time, i.e. does the snow and cold temperatures of the last few weeks delay the construction process more than if the Applicant were issued a decision denying the extension request in mid October? Can the Hearing Examiner provide some additional time to the January 30, 2023 deadline "two - month extension" to account for these seasonal challenges? One of the biggest challenges is weather and the placement of concrete and asphalt. WDOT 2023 Standard Specs for 5-04.3(1) Weather Limitations - HMA Most all concrete needs to be placed when the and covered during curing if temperatures are going to reach freezing.
