After discussion on the proposed use, the following actions were taken: ACTION: Moved by Stredicke , seconded by Denzer, that the hearing closed. Motion carried. Moved by Stredicke, seconded by Cordell , that this re- zone be recommended to the City Council for approval , as the proposed rezone is in agreement with the Comprehensive Plan. Motion carried. Yakima, Washington Dear Mr. Richardson: In reply to your letter of March 9, which we have received this date, we are forwarding herewith excerpts from the minutes of the Renton City Council meeting of March 7, 1966. You state you were present when the City Council.metFon March 2nd, however, the City Council meets only on Monday nights and the Planning Commission meetings are held on Wednesday, In any event, the Planning Commission recommenda- tion submitted to the Council on March 7th recommended approval of your request, however, as you can see, from the minutes, the City Attorney advised that the Planning Commission has no jurisdiction to proceed with rezones if they do not agree with the Comprehensive Plan and Maps,and unless the Plan, and Maps are changed to agree, no rezone may be considered. We hope that this may somewhat clarify the action of the Council on the matter. As you will note, all other rezones not in agreement with the Comprehensive Plan were likewise referred back to the Planning Commission. If you have further inquiries/you may contact Planning Director Gordon Erickson and he will advise of action to be taken henceforth. Nelson City Clerk Renton, Washington Dear Mr. Nelson: I received a letter from you today dated March 9, 1966 which read as follows: "The Renton City Council, at its regular meeting of March 7, 1966 has re- ferred your rezone request back to the Planning Commission inasmuch as the proposed zoning is not in accord with the City's Comprehensive Plan and maps." I was present with Mr. Raymond Barrett when th ,ity Co c I met for their meeting on March 2, 1966 at which time the council v d and approved our request for rezoning. The only discussion was the matter.-pertaining to rezone to permit a service station which was going to be decidter. However, at this meeting they did approve the request to change the zoning from R to commercial property with some restrictions. ccording to my understanding the documents had been presented to the Planning Commission and they had approved it. It then went to the Council meeting at which time I was present and it was voted upon and approved. If my mmderstanding is not correct, please clearify the points which I have made above.
