Moved by Racanello , seconded by Busch, to continue the hear-
ing on this matter until the Planning Commission studies this
along with the other pending applications which do not agree with
the Comprehensive Plan. Motion carried.
( 5) George Bratko , Appl. No . R-314-66 , from R-1 to R-3 , of property
located on the SE corner of Earlington Street and 4th Avenue West.
Staff report : The Comprehensive Plan indicates the area in
question as single family residential. The proposed use would
be for the construction of an apartment building. The adjacent
uses within the immediate vicinity of the proposed property are
single family residential.
Committee report : The feasibility of the proposed property
being used for multiple family residential is questionable. It
iS recommended that the proposed rezone be denied, since it is
not in agreement with the Comprehensive Plan.
Chairman Garrison invited comments from the audience.
Mr. Clarence Davis , 505 4th Avenue West , presented a petition
protesting the proposed rezone , since this is essentially a
single family residential neikhborhood . This is on a steep
narrow street and the additional traffic caused by the .apart'=
ments would not be desirable.
ACTION :
Moved by Teegarden , seconded by Busch, that the hearing be
closed. Motion carried.
Moved by Teearden , seconded by StredickeE. ;that the request
for rezone be denied. Motion carried.
6). Realty Investors , Inc. , Appl. No. R-316-66 , property on 8th Ave.
North between H and J Streets .
Staff report : The Comprehensive Plan indicates this area as
multiple family residential. The Applicant proposes to construct
an apartment not to exceed two stories in. height. The Appli-
cant has previously been granted a special permit for the conHc,
struction of apartments on this site.

The construction of the gpartment building should entail greater
protection for these adjacent properties . Approval dB the use
of the property as proposed is questionable.
Chairman Garrison invited comments from the audience.,
Mr. Hallie Smiley, the Applicant , stated that he has previous-
ly been given a Special Permit for the construction of the
apartments . The Permit allows only one story in height ,or
a story and a half if more than one-half story is under-ground.
He is requesting the rezone in order to construct twouttories .
He did not feel that this would be incompatible with the surrounds
ing property.
Mr. Ericksen stated he felt that the adjacent property owners to
the north should be protected.
Discussion then followed relative to the setbacks . Mr. Busch

Ordinance requirements .
ACTION:
Moved by Stredicke , seconded by Teegarden that the hearing be
closed. Motion carried.
Moved by Stredicke , seconded by Busch , that the rezone be
denied. Motion carried.
( 7) :. Paul Houser, Apple No. R-317-66 , from G-7200 to R-3 , property on
the SE corner of SE 112th and 112th Avenue SE.
Staff report : The Comprehensive Plan indicates the proposed
area as single family residential. The existing use of the prop-
erty is a vacant partially demolished building and vacant land.
Adjacent uses are single family residential. The proposed use
is for the construction of an apartment building.
Committee report : The Committee recommends denial of the
rezone request on the basis that it is not in agreement with the
Comprehensive Plan, and the proposed use would not be compatible
with the surrounding area.
Chairman Garrison invited comments from the audience.
Mr. Al Tosco stated that he lives across the street from the
proposed apartment site , and he was not in favor of the con-
struction of the apartments . He felt this area should be
single family residential .
ACTION:
Moved by Stredicke , seconded by Teegarden that the hearing be
closed. Motion carried.
Moved by Stredicke , seconded by Teegarden , that the rezone
be denied. Motion carried.
( 8) Charles Bigley,Appl. No. R-318-66 , request for rezone from R-2 to
R-3 , property on North Williams between 2nd and 3rd Avenues N.
Staff re;ort : The Comprehensive Plan indicates the area as
multiple family residential. The Applicant proposes to construct
a 6-unit apartment building . The existing uses are predominaty
single family-residential.
Committee report : Recommends approval of the request on the
basis that the proposed rezone is in agreement withhthe Compre-
hensive Plan , and appears to be a logical development for this
area, in view of the present and future trends and needs .
ACTION :
Moved by Stredicke , seconded by Racanello, that the hearing
be closed. Motion carried.
Moved by Stredicke , seconded by Racanello , that the rezone be
recommended to the City Council for approval , since it is in
agreement with the Comprehensive Plan. Motion carried.
(9) Wigwam Stores and Highlands Enterprises , Appl. No. R-319t,66 , re-
quest for rezone from GS-1 to B-1 , property located north of
Sunset Boulevard E. and west of the Power Line right of way.

Petition for Reconsideration 4
Comes now the :undersigned, Hall1e Smiley, and respectfully
petitions the City Council for reconsideration of its decision
denying rezoning o,f certain properties to R-3 for the following
reasons:
1. That the only objection to the proposed rezoning
advanced by either the Planning Commission or the members
of. the Council was that your petitioner was not complying
with the set-back requirements of the ordinance. in the
preliminary plans submitted at the hearings'.
2 . That your petitioner has expressed hi's willingness to
comply with all the requirements of the Building Code in
every respect, including the setback requirements.
3 . That there were no objections from any residents or
property owners of the area and on_ the contrary the adjoin-
ing property owners have assured your, petitioner that' they
are pleased with the manner in which he has developed the
property and are favorable to what he is presently
proposing.
4 . That the denial of the rezoning will work a substantial
and unreasonable hardship on your petitioner by reason of
the fact that he will have to excavate a substantial quan-
tity of earth in order to comply with the requirements of
R-.2 zoning, thus requiring an expensive and unnecessary
investment in bulkheads and rockeries.
5 . That the denial of the rezoning has jeopardized the
proposed financing of the apartment units and that in all
probability, unless a.. reconsideration is granted by the
Council and the rezoning granted, your petitionerts applican

tion for financing will be denied and your petitioner
will thus be deprived of the opportunity of utilizing
this property to his best economic benefit and to the
benefit of the community as a whole.
6 . In the event the Council feels that further informa—
tion is necessary or desirable before granting this motion
for reconsideration, your petitioner respectfully requests
that the matter be referred back to the Planning Commission
for further recommendation.
7 . That the Planning Director was in full accord with the
application for rezoning after your petitioner agreed to
comply with all building code requirements.
WHEREFORE, your petitioner respectfully requests that the City
Council reconsider its prior decision and grant a hearing to further
consider this matter, or, in the alternative, refer the matter to
the Planning Commission for its further recommendation.

COMMUNICATIONS: (Cont.)
A letter read from Planning Director Gorden Ericksen, submitted Planning Commission
recommendations from its public hearing meeting of April 27, 1966 as follows:
(1) Rezone application No. R-311-66 by. A. W. Myers, property located on 90th Avenue
South between South 128th and South .129th Streets from. R-I: to,,R--3,..which- classification
would be in agreement with the Comprehensive Plan. .Moved by Poli, seconded by Morris,
to concur in the recommendation. Carried.
(2) Rezone application No. 312-66 by Charles Shane for property located on the
South side of Maple Valley Highway and extending East from Stoneway Dock Co. to the
existing gas station site and Northerly to existing apartments, from R-3 to B-1.
Moved by Morris, seconded by Burce, to concur in the recommendation. Carried.
This classification is in agreement with the Comprehensive Plan.
(3) Rezone request of Charles Bigley, Appl. No. R-318-66 for property on North
Williams Street between 2nd Avenue and 3rd Avenue North from R-2 to R-3 for 6-unit
apartment use which is in agreement with the Cumprehensive Plan. Moved by Morris,
seconded by Poli, to concur in the recommendation. Carried.
(4) Rezone application No. R-319-66 by Wigwam stores and Highlands Enterprises
on property located North of Sunset Blvd. East, lying West of the power line right-
of-way from GS-1 to B-1, which is in conformance with the Comprehensive Plan. Moved
by Morris, seconded by Hulse, to concur. Carried.
(5) Rezone request, Appl. No. R-320-66, Mike Potoshnik, Jr., on property located
on SW corner of Marian Street and Houser Way North from R-2 to L-1, in agreement with
the Comprehensive Plan. Moved by Schellert, seconded by Dahlquist, to concur in the
rezone. Carried.
(6) Rezone application No. R-321-66 by Peoples National Bank, Frank Bonnell and
Barbara Holt, on property in vicinity of Rainier Avenue and 92nd Avenue South from G
to B-1 which agrees with Comprehensive Plan. Moved by Morris, seconded by Delaureriti,
to concur in the rezone classification. Carried.

Moved by Hulse, seconded by Schellert that these six rezones be referred to the Law and
Ordinance Committee. Carried.
A letter from the Renton Housing Authority had reported no objection to the rezone of
the Wigwam property adjacent to its new housing development for the elderly.(Item 4)
A letter from Douglas K. Felker advised that Mr. Chester Biggigns had retained services
to appeal the adverse decision of the Planning Commission on variance request regarding
construction of an apartment building at 918 G Place. Date of hearing was requested.
Moved by Schellert, seconded by Dahlquist, that May 23rd be set for hearing on this
appeal. Carried.
/(7 Mr. Felker advised also of being retained by Realty Investors, Inc. to appeal Planning -
Commission
decision regarding denial of request for variance in apartment building
construction at Block 3, Fairview Terrace, Renton. Moved by Garrett, seconded by 7
Perry, that May 23rd be set for hearing on this matter. Carried.
A letter from Mr. Kay D. Jones, Executive Vice-President, Stoneway Concrete, appealed
decision of Planning Commission regarding variance request in construction of addition
to shop building at edge of property bordering the Maple Valley Highway. Moved by
Schellert, seconded by Dahlquist, that June 6th be set for hearing on this matter.
The motion carried.
A letter from Louis Barei submitted resignation from membership on the Board of
Trustees of the Renton Public 'Library, primary purpose of completion of the new
facility having been achieved. Mr. Barei expressed thanks to the City officials
and members of city government for cooperation and efforts in aiding to make the
library plan a reality. He expressed appreciation for the opportunity of serving
his community and steps down to give another interested citizen a chance to serve.
Moved by Poli, seconded by Perry, that the resignation be accepted with reluctance
and that a letter be forwarded to express the Council's thanks and commendation for
a job well done. Carried.
A letter from Gene L. Coulon, Parks and Recreation Director, advised on behalf of the
park Board that in event the Talbot Hill reservoir property becomes surplus, the
Board is interested in the site for park purposes providing it proves feasible for
such use. Moved by Schellert, seconded by Dahlquist, to refer the request to the
Property Committee. Carried.
PROCLAMATIONS:
A letter from Mayor Custer recognized the patriotic merits of the V.F.W. Poppy Sale
which profits benefit the disabled and needy veterans and widows and orphans of deceased
veterans and urged support by all patriotic citizens as evidence of gratitude to those
whr have risked their lives in defense of the freedom enjoyed as American citizens.
