Minutes - Renton City Council Meeting . October 10, 1966 COMMUNICATIONS: (Cont.) Claim was read,subm•itted by Mr. Edward L. Ware, for damages to hot water heater alleged to have been caused when water in the area was turned off by the City. Damages in sum of $33.97 were requested. Moved by Hulse, seconded by Bruce, to refer the claim to the City Attorney. Carried. A letter was read from Wm. P. Gavin, Maple Leaf Restaurant, appealing decision of the Planning..Commission denying variance for sign to project from the building. It was requested that the premises be inspected and surrounding signs taken into account. Moved by Hulse, seconded by Poli, that the date of October 17, 1966 be set ad date for hearing on the matter. Carried. A letter from Mayor Custer reported that salary account in the Building Department Budget is approximately S500.00 short of funds if the position of Electrical Engineer is to be filled by October 24th. In consulting with the Ways and Means Committee the following recommendation resulted: $500.CO be transferred from Building Department M. & 0. Account iSCO/405, Keating Fuels to Account 1000/110, Salaries & wages and the position filled as designated. Moved by Schellert, seconded by Garrett, to concur with referral to the Law and Ordinance Committee. The motion carried. Letter from William C. Schmidt, Executive Director, Western Pln:.b_ng Cfficials Association, extended invitation to Mr. Sven Johnson, En ilding Director, to attend 37th annual conference at the Hilton Hawaiian Village in Honolulu, Tian::ii during week of October 15 through 22nd. As this is a "Code's year it was urged that each jurisdiction have a representative present at the voting on many amendments to be incorporated into the new- 1967 edition. Sanction of Mr. Johnson's attendance was urged. Since no request to attend had been presented and budgetary funds were not available the Council took no further action on this matter. Carried. Alan Lurie, Consolidated General Company, Appl. R-355-66 request for rezone of property on Ripley Lane between S.E. 74th and S.E. 76th Streets from.G-6000 to R-4, for proposed 75-unit apartment complex. The Planning Commission recommended the rezone which is in agreement with the Comprehensive Plan. Discussion ensued regarding planning landscape area and screening and whether there was any protest which Director Ericksen reported to be inquiry rather than protest. Movedby .: Garrett, seconded by Poli, to concur with referral to the Law & Ordinance Committee. Carried. John Monaghan application R-357-66, property located on West side of 112th Ave. S.E. from R-1 to R-4, proposed use is for high density apartments. Area lies South of North Renton Interchange and is considered future multiple residential. Commission recommended approval reporting agreement with the Comprehensive Plan Moved by Delaurenti, seconded by Gianini, to concur and refer the rezone to the Law and Ordinance Committee. Carried. Variance request of Alan Lurie, Consolidated General Company, Appl. V-359-66, property on Ripley Lane between S.E. 74th and S.E. 76th Streets, re lot coverage requirement to allow two level parking deck. Commission recommended approval indicating appropriate screening should be provided. Committee comments : Recommended denial of the variance request. The City Attorney has indicated that the Planning Commission could grant a variance from the Trailer Park standards, Mr, Magstadt stated that there are several areas where varit ances would be needed, in addition to the variance requested on space. The Trailer Park presently is non-conforming and does not meet the City Ordinance. Mr. Felker stated that the Variance request applies -on.117 to a small area, which would be for the smaller fr,.ob :1e '. .t:rs.il=..- ers in use during the Long Acres Track season, ACTION: Moved by Stredicke, -seconded by Stone, that the hearing be closed, Motion carried unanimously. No. R-353-66 , request for rezone from R-1 to R-4, property located on 4th Avenue between Mill and Cedar Streets. The proposed use is for a 7-unit apartment, The Comprehensive Plan indicates Multiple Family Residential. Staff comment: The adjacent property to the west is pres- ently zoned R-3 . The area is predominantly single family res- idential. Committee comments : The general feeling of the Planning Commission members present on the field trip was that rezon- ing to R-4 was not realistic in view of the site area and the topographic problems:ox Rezoning to R-3 is also questionable, Chairman Garrison invited comments from the audience. Mrs, Brassi, resident across the street from the proposed re -:. zone, stated that most of the residents in the neighborhood would protest this rezone, but did not have sufficient notice. She voiced Objections to the proposed apartments,, because she felt that it would destroy the residential character of the area, add to conjestion of traffic, and decrease property wal- ues',by destrbyingthe view, Mr. Bert Davies, 404 Cedar Street, stated his objections as ' similar to those expressed, and requested a postponement of the hearing for further study of the area and to give others opportunity to voice objections to the rezone. ACTION: Moved by Stredicke, seconded by Racanello, that the hear- ing be continued until the meeting of October 26 . Motion carried. The proposed use is for a 93-unit apartment complex. The Comprehensive Plan indicates Multiple Family residential. Staff comment: Property to the west of the proposed site is presently zoned B-1, and to the north zoning is R-1, Single Family residential. It was requested that the Minutes note that Mr. Busch left the meeting at this time. Mr. Ericksen showed the property on the map and the development plans proposed. Chairman Garrison invited comments from the audience. Mr. Glenn Carlson, 1028 K Street, stated that he owns the resi- dence across the street from the proposed rezone, and he object- ed to the construction of apartments, because the height would destroy the view, and additional traffic engendered by the apartments would be objectionable. Others protesting for the same reasons were: Mr. Burelle, 1010 K Street, John Becker, 1034 K St. , Mr, DeFoe, 1024 K Street, The protesters indica- ted that they would not object to one or two story apartments, but would object to three or four stories. Mr. Alfred Simgnson, Architect representing the Applicants, displayed drawings of the proposed apartments and explained the layout. He indicated that the height would conform to R-3 rather than. R-4o - It was noted by the Commission that R-1, single family resi- dence zone, allows a height of 35 ° o The R-3 zone would allow 3 stories or 40 ° in height. The Commission members felt, since the property directly to the •:wes.t was already zoned B-1, that R-3 zoning would be appropriate zoning for the subject property, The Applicant agreed to amend his application to request R-3, and further agreed that there would be no access to the parking areas from K Street. It was stated that this would be up to the City Engineer regarding street access, • ACTION: • Moved by Denzer, seconded by Geegarden, that the hear- , ing be closed. Motion carried unanimously. Moved by Denzer, seconded by Stone, that the rezone to R-3 be recommended to the City Council for approval, since it would be in agreement with the Comprehensive Plano Motion carried unanimously. COUNCIL COMMITTEE REPORTS: (Moved by Hulse, seconded by Schellert, that the Pacific General Construction Company property rezone matter, deferred from action last week, be taken up at this time by the Council. Carried. The proposal was for construction of a 93-unit apartment com- plex to be located on the Northwest corner of 10th Avenue North and "K" Street. The Planning Commission had recommended R-3. Council Members reported investigation and Planning Director Ericksen pointed out the subject property on the wall map. The architectural representative, Mr. Simons stated that the developer has revised his plans in accord with requests of adjacent residents and requirements by the City and hopes to have a very fine addition to the City. Mr. Phillip Arnold, representing the developer requested that the zoning be granted, adding that the project is well planned and will be a valuable economic asset to the community. Objections were expressed by residents of the area with respect to density of the area and traffic and congestion such an addition might create, as well as obstruction of view and included John Becker, 1034 "K" Street, Henry Knight, 1022 "K" Street, Glenn Burrelle, 1010 "K" Street, Glen Carlson, 1028 "K" Street and William Fuller, 1016 "K" Street. Council discussion ensued and inquiry was made as to what zoning is shown on the Land Use Map prediction. Planning Director Ericksen stated a combination of Business and Multiple zonings are indicated and the Commission, in this instance, felt the apartments would be the better alternative. Moved by Delaurenti, seconded by Hulse, to concur in the recommendation of the Planning Commission for R-3 zoning. Carried. Perry opposed. Moved by Pedersen, seconded by Poll, to refer the matter to the Law and Ordinance Committee. Carried. Schellert inquired whether the developer is aware of requirements particularly in regard to sidewalks and curbing. Mr. Ericksen advised affirmatively including street improvements, curb, gutters, sidewalks and various utilities required and that he also is observing setback and eliminating of access on K Street to alleviate traffic. Mr. Isaac S. Capelouto, inquired regarding rezone of his property which matter had been referred to the Committee of the Whole on 9-12-66, and to the Planning Com- mission for carrying out administrative requirements in the matter on 9-26-66. Mr. Capelouto reported that the restrictive covenants had been filed and all require- ments have been fulfilled and requested Council action to implement the rezone. During discussion it was disclosed that the City Attorney had not received notice of the fulfillment of the requirements from applicant's attorney to justify further pursuance of the matter, which he had been waiting for. It was moved by Schellert in view of Mr. Capelouto's confirmed actions, seconded by Pedersen, that the rezone be referred to the Law and Ordinance Committee. Carried.
