Tejan Development Company purchased the piece of p rty f'al. F on
Avenue located between 90th Avenue South and 91st Avenue ' `It he
intention to build an apartment house to rent between $140 0 , ' ° .00 per
month. The property was zoned for commercial which would have enabled us to
build an apartment project, but we later found the property to be in fire zone
# 1. We could have built an apartment under this fire zone, but the costs would
have been considerably more and would have forced us to charge more rent.
We met with the Mayor, Mr, Don Custer, and discussed the problem and were
told that if we changed the zone to R-3 or R-4 zone, we could request a fire
zone change from the City Council. E:•
The zone change was approved by the Planning Commission on October 26, 1966 •
and Tejan Development Company hereby petitions the City Council to change the fire
zone on this property from zone # 1 to a residential fire zone.
The reasons Tejan Development Company feels this change would not cause any
adverse problems are as follows:
1. This property is adjacent to the westerly boundry of
the city of Renton.
2. There are no commercial structures adjacent to the property.
3. South of the property there are commercial projects
not in fire zone # 1.
4. The plans as submitted to the Planning Committee show this as
a beautiful aesthetic approach.

AN ORDINANCE OF THE CITY OF. RENTON, WASHINGTON, CHANGING
THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES WITHIN THE
CITY OF RENTON FROM BUSINESS DISTRICT (B-1) TO "APARTMENT
HOUSES AND MULTIPLE DWELLINGS"(R-4).
WHEREAS under Chapter VII, Title IV (Building Regulatbns) of Ordinance No.
1628 known as the "Code of General Ordinances of the City of Renton", as amended, and
the maps in conjunction therewith, the properties hereinbelow described have
heretofore been zoned as Business District (B-1); and
WHEREAS a pelitsoni for change of zone classification of sa1d'property has
been filed with the City Clerk on or about October 7, 1966, which petition was then
duly referred to the Planning Commission for investigation, study and public hearing
and a public hearing having been held thereon on or about October 26, 1966, and
said matter having been duly considered by the Planning Commission and said request
being in conformity with the Cityts Comprehensive Plan and all parties having been

The demand for apartments is acute, and the property in question is close in.

This property is in an extreme end of the present zoning and fire zone and there are
only existing single family residences adjacent - built under fire zone 3
* Also there is approximately a 25' fall from 90th to 95th Street facing Renton Avenue.
This makes for a beautiful view but is difficult to build commercial.

Members present: Dayle Garrison, James Denzer, John Racanello, John
Sterling, Clark._: Teegarden, Stan Stone, Gerald Cordell, Richard Stred-
icke. Absent: Wes Busch.
Staff present: Planning Director Gordon Ericksen, Assistant Director
James Magstadt.
Others present: Lyman Houk, Engineering Department.
The Minutes of the meeting of October 12 , 1966 were approved as
corrected: Page 2 , under "REFERRED FROM COUNCIL: " , delete the last
paragraph.
HEARINGS :
1. ITEMS CONTINUED FROM SEPTEMBER 28 MEETING:
(1) HAROLD CANFIELD, Appl. No. R-355-66 , request for rezone from
R-1 to R-4, property located on 4th Avenue between Mill and
Cedar Streets.
Committee comments : The Comprehensive Plan Study Commit-
tee indicated that the revised R-2 classification would be
feasible for the area in view of the topography and access
problems.
A petition,signed .by :9; residents in the area, was read
favoring the rezone to R-4.
Lyman Houk, Engineering Department, stated that the City
Traffic Engineer and Engineering Department have made studies
of the traffic situation regarding the Renton Hill area. Due
to the Aces,gaproblem, the -pile-up; of:;traffic at intersection
of Walla.(,Hain and Renton Street, ,and the steep terrain of the
general area, the Traffic Engineer has recommended-tagainst
Multiple zoning in this area.
Mr. Ericksen stated that the revised R-2 Classification
would allow 2 stories, permitting more flexibility of site
plans. He was in agreement with Mr. Houk' s report on the
traffic and access problems relative to the overall Renton
Hill area.
Mr. Canfield, Applicant present, stated he would be will-
ing to accept R-3 zoning, but not R-2 , as this would not be
beneficial to him.

closed. Motion carried unanimously.

(2) WILLIAM CLARKE, Appl. No. V-360-66 , request for Variance on
rear yard setback requirements , property located on the west
side of Lake Washington Blvd. and SE 73rd Place.
Mr. Ericksen advised that the Applicant has requested
withdrawal of the Application for Variance. No further action
is necessary by the Planning Commission.
2, NEW APPLICATIONS :
(1) JAN DEVELOPMENT COMPANY., Appl. No. R-362-66 , request for re-
zone from B-1 to R-4, property located on Renton Avenue between
90th Avenue and 91st Avenue South. The proposed use is for the
construction of a 20-unit apartment building. The Comprehensive
Plan indicates commercial use.

Staff comment: The property is:'.presently,:j_z.oned B-l :and
in Fire Zone 1. The Applicant desires to construct a Type 5
frame building. In order to construct Type 5 building revis-
ion of the Fire Zone boundaries would be required.
A memo from the Fire Chief stated that, after consulta-
tation with other Departments involved, it was agreed that a
change in the Fire Zones was not warranted at this time.
Therefore, the Fire zones ahown on the maps of April 11,
1966, will continue to be enforced.
Mr. Ericksen pointed out the subject area and the boun-
daries of--Fire Zone 1 in this area. He stated that the fire
zones are :not based upon the zoning, but upon concentration of
buildings and uses. He stated that he has indicated to the
Applicant that .achange in:..theLLand:..Use Zoning=did 'not change
the Fire Zone.
Mr. Rolly Kirkendall, 848 106th Northeast, Bellevue, rep-

resenting the Applicant, stated that they are asking for a
zone change and fire zone change in order to make the devel-
opment more econoinically feasible.

Fire Zone Map was not in the jurisdiction of the Commission.

3. OLD APPLICATIONS FOR RE-CONSIDERATION:
(1) MICHAEL MASTRO: , Appl. No. R-286-66 , request for rezone from
R-3 to B-1, property on the northeast corner of the intersection
of Benson Highway and SE 168th Street. . Comprehensive Plan in-
dicates area as Multiple Family Residential.
Staff comment: The proposed use would be located north of
the existing gas station. Access would be from the Benson
Highway. Present traffic conditions on the Benson Highway •
have reached a critical state during peak hours. The widen-
ing of Benson Highway will be necessary in this area within
the next 2 to 3 years.
Committee comments : The Study Committee generally felt
that existing traffic conditions and development in the area
preclude the proposed development at this time.
Mr. Roger Dunham, representing the Applicant, stated:.:that
the-r:easonfbr. requesting, B-ilis that no financing can be ob-
tained for apartments on this property, and they wish to ex-
tend the existing B-1 on the Benson Highway,
In the discussion that followed Mr. Lyman Houk, represent-
the City Engineer, stated that, because of the traffic hazard
the Traffic Engineer would be reticent to allow any access at
this point. He also pointed out that the Benson Highway would
have to be widened in the future.
ACTION:
Moved by Garrison, seconded by Cordell, that the hearing
be closed. Motion carried unanimously.
