AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CHANGING
THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES WITHIN THE
CITY OF RENTON FROM GENERAL CLASSIFICATION DISTRICT (G) TO
BUSINESS DISTRICT (B-1)
WHEREAS under.Chapter VII, Title IV (Building Regulations) cf Crdinance No.1628
known as the "Code of General Ordinances of the City of Renton", as amended, and the
maps in conjunction therewith, the properties hereinbelow described have heretofore
been zoned as General Classification District (G); and
WHEREAS a change for zone classification of said property has been filed with
the City Clerk on or about January 5, 1967, which petition was then duly referred to
the Planning Commission for investigation, study and public hearing and a public
hearing having been held thereon on or about January 250 1967, and said matter having
been duly considered by the Planning Commission and said request being generally in
conformity with the City's Comprehensive Plan and all parties having been heard
appearing in support thereof or in opposition thereto, NOW THEREFORE
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS
FOLLOWS:
SECTION I: The following described property in the City of Renton is hereby
rezoned to Business District (B-1); the City Engineer and the Planning Director are
hereby authorized and directed to change the maps of the Zoning Ordinance,as amended,
to evidence said rezoning, to-wit:
Commencing at the S.E. corner of Lot 58 of the Plat of C. D. Hillman's
lake Washington Garden of Eden Addition to Seattle No. 1, according
to plat as recorded in Volumell, page 63, in King County, Washington;
thence N. 89°55'30" W along the S line of said Lot 58, a distance of
30.00' and the true point of beginning; thence continuing N 89°55'30"
W along said S line of Lot 58, a distance of 276.50' ; thence N 00°57'00"
E., a distance of 302.75' ; thence S 89°55'30" E., a distance of 278.67' ;
thence S. 01°21'34" W. a distance of 302.81' to the true point of
beginning.

It was moved by Stredicke that the hearing be closed; seconded
by Cordell. Motion carried.
It was moved by Racanello, seconded by Stredicke, that the
Commission recommend to the City Council that the southern 423 . 97
feet of the described property be rezoned to B-1 and the remaining
northern portion of the described property be rezoned R-3 , as this
rezone is in agreement with the Comprehensive Plan. Motion carried
unanimously.
NEW REZONE APPLICATION
1. HUMBLE OIL & REFINING COMPANY, Appl. No. R-371-67 , rezone from G to
B-1, property located on the northeast corner of S.E. 94th St. and
State Highway 405.
Staff Report:
Mr. Ericksen presented a letter from the Traffic Engineer to
the Planning Director in which it was stated that the City
Engineer' s Office had reviewed the plan submitted to the Renton .
Planning Department by the Humble Oil Company, and that prior to
issuance of a building permit for additional buildings on the
property that Humble Oil Company should be notified that they
will be required to develop off-site improvements in accordance
with Ordinance 2295.
The Chair asked for comments from the audience with regard
to the application. Mr. Dominic Driano, appearing on behalf of
the applicant, presented plans of the proposed new building and
photos of the present layout and indicated the applicant' s willing-
ness to comply with all city requirements.
Action:
It was moved by Racanello, seconded by Stone, that the hearing
be closed. Motion carried.
It was moved by Teegarden, seconded by Stone, that it be
recommended to the City Council that the application for rezone
by Humble Oil & Refining Company be approved as it is in agree-
ment with the Comprehensive Plan. Motion carried.
PREVIOUS APPLICATION - REQUEST FOR RECONSIDERATION
VIRGIL R. FOX, Appl. No. R-369-66 , rezone from S-1 to R-3 ,
property located on 88th Pl. S. between S. 126th and S. 128th
Streets.
Chairman Garrison stated that the original rezone application
of Mr. Fox (S-1 to R-4) was heard and denied by the Commission on
December 28 , 1966; and that it was now pending hearing of appeal
by the City Council on February 6 , 1967 . There appeared to be
some confusion among the City Attorney, the City Council and the
City Clerk as to the status of the applicant' s new request for a
lesser zoning. The City Attorney had stated that it was discretion-
ary with the Commission whether they hear this amended application
or refer the matter back to the City Council for their hearing of
appeal of the original application. Councilmen Schellert and
Perry stated they believed the application should be heard under
appeal by the City Council before any new application is heard

Re: Re-zone request by Humble Oil Company located at S.E. 94th Street
and Interstate 405.
Dear Mr. Erickson;
We have reviewed the plat plan submitted to the Renton Planning Depart-
ment by Humble. Oil Company on S.E. 94th Street and Interstate 405, directly
across from the Kennydale Elementary School .
As you are aware, S.E. 94th Street is presently in very poor driving
condition because of the heavy vehicular traffic and the many grade school
children using this roadway.
It will be necessary to improve the facility to city standards , This
will include improvement of grade, surfacing curbs; gutters and sidewalks,
We think that Humble Oil Company should be notified that prior to issuance
of a building permit for additional buildings on this property, it will be
required to develop off-site improvements in accordance with Ordinance 2295,
which will require the installation of sidewalks, curbs, gutters and street
paving on S.E. 94th Street for the entire length of their property. The
Traffic Engineering Division will make recommendations on access control at
such time as an application is made for a building permit.
In summation, the Traffic Engineering Division has no objections to
any change of zone classification in this area as long as the Petitioner
is aware of the responsibilities connected with such a re-zone.

RENTON PLANNING COMMISSION
MEETING JANUARY 11, 1967
Members present: Dayle Garrison, James Denzer, John Racanello, Richard
Stredicke, Stan Stone, Gerald Cordell; Clark Teegarden, John Sterling,
Robert Brower (new member)
Staff present: Planning Director Gordon Y. Ericksen, Assistant Planning
Director James L. Magstadt

The administrative meeting of the Renton Planning Commission was
called to order by Chairman Garrison at 8 :00 P,M.
Referring to the Planning Commission meeting of December 28 , 1966,
and the recommendation for approval of the First Investment Company re,
zone application, Chairman Garrison suggested that the Minutes be amended
to read "the application for rezone be granted as it does not conflict
with the Comprehensive Plan" .
It was moved by Stredicke and seconded by Denzer that the Minutes
of the meeting of December 28 , 1966, be approved with the addition and
correction suggested by Garrison. Motion carried.
Chairman Garrison read a letter to the members of the City Council
from Mayor Custer appointing Mr. Robert Brower to fill the unexpired
term of Mr. Wes Busch on the City Planning Commission. Mr. Garrison
introduced himself and the other members of the Commission to Mr. Brower
and welcomed him to the Planning Commission.
HEARING CONTINUED FROM DECEMBER 28 , 1966 :
Rezone Application
J. DAVID JENSEN, Appl. No. R-370-66, rezone from G to B-1, property
located on 4th Ave. N. between 132nd Ave. S.E. and 134th Ave. S.E. (the
N.E. corner of intersection of 4th Ave. N. and 132nd Ave. StE. ) .
ACTION:
It was moved by Denzer, seconded by Racanello, that this hearing
be continued to the next public hearing meeting on January 25 in order
to give the Commission time to study the application. Motion carried.

HUMBLE OIL & REFINING COM'ANY, Appl. No. R-371-67 , rezone from G
to B-1, property located on N.E. corner of S.E. 94th and State Highway
405.
Staff comment:
Mr. Ericksen displayed the map prepared by the applicant and ex-
plained the circumstances resulting in the filing of the rezone applica-
tion. Upon request, Mr. Ericksen pointed out the location of the property
on the large city map. Mr. Magstadt explained that the State is condemning
a part of the property (gas station operation) and the applicant will have
to move his access and the gas station, which is why they are asking for
the rezone. Mr. Stredicke asked what the Comprehensive Plan shows for
this property. It was determined that it was part business and part
multiple-family and that the rezone would be compatible with the Compre-
hensive Plan. Mr. Stone asked what would be the better density zoning

for this area, B-1 or R-4. ; He was reminded that a service station could
not operate in R-4. Mr. Ericksen stated that the multiple use would
probably be equal to the service station use in density of traffic gen-
erated in and out of the area. The State is aware that the existing
condition of the street in this areais °very poor.
ACTION:
Chairman Garrison asked Mr. Ericksen to check into the matter of
the street condition further and requested that each member of the
Commission check the property individually before the next session.
No field trip was scheduled.
At this point Chairman Garrison recognized the presence of Mr. Bob
Shane, property developer, in the audience and asked if the Commission
could help him before going on to administrative matters.
Mr. Shane stated that with reference to his development Aloha
Ranch No. 2, he was unable to get his plat approved by the City
Engineer because he objected to the' developing of the short 50-foot
street he was to dedicate to the City. He said it was his understand-
ing that he was to dedicate the street to the City but that he would
not be required to finish it. Mr. Shane stated further that he had no
objection to dedicating the 50-foot street, but didn't feel he should
be asked to finish "a street to nowhere" . Mr. Shane reiterated his .
complaint and his position several -times.
The Commission discussed the matter,. and Chairman Garrison said
that while the Commission and the Planning Director may be in sympathy
with Mr. Shane' s problem, that the matter was completely out of the
jurisdiction of the Commission; that it was probably a matter for the
City Engineer or the City Council or both to resolve. Mr. Shane asked
the Planning Commission to make a recommendation to the Council, but
Chairman Garrison replied they could do this only if the matter were
referred back to the Commission by the City Council. Mr. Garrison asked
Councilman Schellert in the audience for his opinion, and Councilman
Schellert said that as the City Ordinance required the development of
the street, that the Planning, Commission had no jurisdiction in the
matter at that point. Mr. Shane thanked the Commission and said he
would bring it up before the City Council.
ADMINISTRATIVE MATTERS :
1. Mr. Robert Brower' s introduction to the Commission was handled
earlier in the meeting.
2. February public hearing date--Chairman Garrison noted that the
public hearing meeting in February would fall on a City holiday (Febru-
ary 22nd, Washington' s birthday) , and while several alternate dates
were available, it was his opinion that perhaps the February meeting
could be eliminated with the hope that requests for hearings would be
light and could be carried over into March. Mr. Denzer suggested that
two public hearings could be held in March.
ACTION:
Mr. Teegarden moved that if there is need for a public hearing in
February that it be postponed until March 8 ; motion seconded by Denzer.
-Mr. Denzer stated that this information should be published and that
this be added to the motion. $tredicke asked why the February public
hearing couldn' t be held on March 1 which would be a postponement of

surrounding this area which has been in part zoned for business in 1959 by King County.

been a business development here under previous zoning granted by King County.
