AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CHANGING
THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES, WITHIN THE
CITY OF RENTON FROM RESIDENTIAL DISTRICT (R-2) TO
RESIDENTIAL DISTRICT (R-3)
WHEREAS under Chapter VII, Title IV (Buifling Regulations) of Ordinance No.1628
known as the "Code of General Ordinances of the City of Renton", as amended, and the
maps in conjunction therewith, the properties hereinbelow described have heretofore
been zoned as Residential.Wstrict. .2,); and
WHEREAS a change for zone classification of said property has been filed with
the City Clerk on or about January 24, 1967, which petition was then duly referred to
the Planning Commission for investigation, study and public hearing and a public
hearing having been held thereon on or about March 1, 1967, and said matter having
been duly considered by the Planning Commission and said request being in conformity
with the City's Comprehensive Plan and all parties having been heard appearing in
support thereof or in opposition thereto, NOW THEREFORE
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS
FOLLOWS:
SECTION I: The following property is hereby rezoned to Residential District
(R-3); the City Engineer and the Planning Director are hereby authorized and directed
to change the maps of the Zoning Ordinance, es amended, to evidence said rezoning, to-wit:
Lot 31, block 46, Corrected Plat of Renton Highlands No. 2,
according to plat recorded in volume 57 of plats, pages 52.98
in King County, Washington
Situated on "H" Place between 12th Street and 13th Street.
SECTION II: This Ordinance shall be in full force and effect from and after
its passage, approval and legal publication.

try to resolve the various problems. Motion carried unanimously.
REZONES .
(c) ISAAC CAPELOUTO, Appl. No. R-373-67 , rezone from R-2 to R-3 ,
- property located at 1343 and 1345 K Street. -
Planning Director Ericksen pointed out the location of the property
on the zoning map and noted the property was surrounded on all sides
by the Highlands_ duplexes and some apartments. He. stated that the
- property directly south is presently zoned R-3 under recent action
by the Commission and is also owned. by Mr. Capelouto. Mr. Ericksen
stated that Mr. Capelouto has submitted a statement to- the effect
that he agrees to remove all existing structures on_ the property
before any new construction- is commenced.
The Chair asked for comments from the audience. Mr. George Perry,
resident of the area and City Councilman, spoke in opposition to
the proposed rezone for reasons of increase of traffic and danger
to children, insufficient water and sewer facilities, and spot
zoning.. Mr. Perry stated the entire area is zoned R-2 and rezon-
ing to R-3 would be a case of spot zoning.
Mr. Isaac Capelouto, the applicant,. spoke on behalf of his applica-
tion, stating that the area is run down and that his proposed
apartment would up-grade the neighborhood.
There -being no further comments from the audience, Denzer moved the
hearing be closed; seconded by Racanello. The motion carried
unanimously.
Action:
It was ,moved by Racanello, seconded by Denzer, that the rezone
application be granted as it agrees with the Comprehensive Plan,
and that it be. forwarded to the City Council for approval. Motion
carried unanimously.
(d) WESLEY BUSCH, Appl. No, R-374-67 , rezone from R-2 to -R-3,
property located on H Place between 12th Ave. N. and 13th Ave. N.
The Planning Director pointed out the location of the property on
the zoning map and displayed the. applicant' s plan for an apartment
building consisting of 9 units with an additional 5 units later as
a second story.
Mr. Wesley Busch, applicant, spoke on behalf of the rezone, indicat-
ing that it was the best use for the rather large piece of property.
He stated that the value of the property dictated the construction
of 14 or 15 un-its and that the rezone was necessary to accomplish
this.
A petition bearing 15 signatures was presented in opposition to the
rezone. Mr. Robert Allsopp of 2718 - 13th Avenue N. spoke in
opposition to the rezone stating that there would be an increase
in traffic and parking and that there were no street improvements
across the street from the property in question.

Mr. Sven Johnson, Director of the Building Department, stated that
the applicant would be required to develop off-site improvements on
his property -only.
Planning Director Ericksen stated that the Comprehensive Plan indi-
cates multiple-family use ,for this area (of medium density R-3 type) .
It was moved by Denzer-, seconded by Teegarden, that the hearing be
closed. Motion carried unanimously.
Action:
It was moved by Denzer, seconded by Racanello, that the application
be granted as it agrees ,with the Comprehensive Plan and that it be
forwarded to the City Council for approval. Motion carried
unanimously. .
(e) RAY H. BALL, Ap 1. No.: R-375-67 , rezone from`'GS-1 to R-3 ,
property located on 12th Ave. N. between 0 Street and N Place.
The Chair recognized Mr. Ray H. Ball, Sr. , 3505 12th Avenue N. , who
stated he was the applicant and presented 'a letter amending his
application to include only a 70 ' frontage on 12th Ave. N. by 130 '
deep along 0 Street to be rezoned to R-3. His letter stated that
his plan calls for the construction of one 4-unit apartment build-
ing and he didn' t need the, balance of the property rezoned.
- Chairman Cordell acknowledged receipt of two petitions in opposi-
tion to the proposed rezone bearing a . total of 242 signatures.
Planning Director Ericksen stated that this rezone application is
not in agreement with the Comprehensive Plan, which shows single-
family residential use for this area. He noted further that the
applicant was advised of this prior to his making application for
the rezone. ,
Mr. Stredicke noted that the area is a good single-family residential
area with newly constructed and well-kept homes.
Mr. Gerald Nichols of 1118 N Street spoke in opposition to the pro-
posed rezone citing increase of traffic, 'loss of privacy which present
home owners had anticipated would be theirs when they purchased their
homes in what they had assumed' would' be, maintained as a single-family
residential area. '
Mr. Leroy. Atwood of 1115N Place N. spoke in opposition to the re-
zone stating that the construction of apartment houses, in single-
family residential areas brings many problems of noise, traffic
density, etc. i which' he had purchased his home in the area to
avoid. '
It was moved by Stredicke, seconded by Denzer, that the hearing
be closed. Motion carried unanimously..
Action:
It was moved by Stone, seconded by Denzer, that the application for
rezone be denied as it does not conform to the Comprehensive Plan,

We would like to have this petition considered at the hearing for this area,
which is to be held on the 1st of March.
We the undersigned property owners , and or residents , surrounding the area
that is to be considered for rezoning from R2 to R3
GENERAL LOCATION: 44H" Place between 12th Ave No. and. 13th Ave No.
LEGAL DESCRIPTION: Lot 31 , Block 46, corrected plat of Renton Highlands #2 ,
according to plat recorded in Vol 57 of plats , pages 92 to 98 inclusive ,
records of King County , Wash.
Do hereby petition the City of Renton Planning Commission to deny the request-
ed rezoning. We feel that the asking of the rezone is premature and has not
given we owners ' enough time to upgrade our homes. Some of us have remodeled,
and others are in the process of considering remodeling. We also feel that
if R3 is granted at the present time that instead of the area gradually up-
grading itself it will remain as is.
We also object to the R3 rezoning for the following reasons:
1. R3 will be taken into consideration when the assessers next assessments
are made which will probably raise our taxes.
2. R3 will increase traffic flow on the street which was not considered for
R3 zoning when built.
3. Increased traffic' flow will endanger the lives of over 60 children that
live here plus the _additional children that use this street to go to the
Hillcrest school.
4. It will overburden the water and sewer lines that were installed to fac-
ilitate R2 and. not R3.
5. This will be the only lot in the area that will be zoned R3, which would
be considered spot zoning.
6 . We would also ask you not to consider any special permits that might be
asked for if the rezone is not granted that will conflict with the present
R2 zoning.

4. New business (continued) :
(a) pointed out the location on the zoning map. Discussion followed
regarding this and other churches in, Renton, their development,
parking facilities,. etc. Mr. Ericksen stated that the appli-
cant, Seventh Day Adventist Church, does not have the required
number of off-street parking spaces, but have submitted a
letter from the Lutheran Church across the way granting them
the right to use their parking facilities on their Saturday
meeting days on a reciprocal basis for the Lutheran Sunday
meetings. Mr. Ericksen stated further that the Seventh Day
Adventist spokesman said that should the Lutheran Church decide
to build on their parking Lot in the future, that the Seventh
Day Adventist Church would provide the necessary parking in an
alternate location. It was decided that a field trip would be
scheduled to view the property.
REZONE APPLICATIONS
(b) ISAAC CAPELOUTO, Appl. No. R-373-67, rezone from R-2 to R-3 ,
property located at 1343 and 1345 K Street. The Commission
recalled that they had rezoned an adjacent piece of property
owned by the applicant from R-2 to R-3 with a restrictive
covenant stating that no construction would commence prior
to complete removal of an existing duplex. In his present
application, Mr. Capelouto indicated informally that he would
be willing to sign a similar restrictive covenant. Mr. Stred-
icke suggested that the Planning Department should contact
Mr. Capelouto before the March 1 Public Hearing Meeting and
advise him that he should submit a formal statement regarding
his agreement to a restrictive covenant, complete with legal
description of the property involved. It was decided that a
field trip would be scheduled to view the property.-
(c) WESLEY BUSCH, Appl. No. R-374-67, rezone from R-2 to R-3 ,
property located on H Place between 12th Ave. N. and 13th
Ave. N. Mr. Ericksen pointed out the location of the prop-
erty on the zoning map and said the applicant indicated his
desire to build an apartment house on the site if granted
the rezone. It was decided that a field trip would be
scheduled to view the property.
(d) RAY H. BALL, Appl. No. R-375-67 , rezone from GS-1 to R-3 ,
property located on 12th Ave. N. between 0 St. and N Place.
Mr. Ericksen pointed out the location of the property on the
zoning map and stated the Comprehensive P]Tan indicated this .
area as single-family residential. He said that Mr. Magstadt
pointed out this fact to the applicant, who insisted on filing
the application in spite of this information. It was decided
that a field trip would be scheduled to view the property.
(e) WELHELM SCHWARTZENBERGER, Appl. No. R-377-67 , rezone from G
to R-4, property located on Shattuck Street between 6th and
7th Avenues. Mr. Ericksen pointed out the location of the
property on the zoning map arid showed how the property was
surrounded by R-3 , R-4 and L-1 zoning. The Comprehensive
Plan shows the area as multiple family residential. It was
decided to view the property on a scheduled field trip.
