Please submit two sets of an original mylar and a check for$15.29 made out to CD&L to me at the sixth floor counter of City Hall. Please verify that the mylars have been signed by all owners of record and have been notarized with an ink stamp (not embossed). The ink stamp must be legible so that King County will promptly record the lot line adjustment. This decision to approve the proposed lot line adjustment is subject to a fourteen (14) day appeal period from the date of this letter. Any appeals of the administrative decision must be filed with the City of Renton Hearing Examiner by 5:00 pm, April 25, 2001. Items 1., 2., and 4. — 12 are addressed on the attached revised survey. Item 3. — Renton Properties LLC recently purchased Two and Three Renton Place (Parcels C and B, respectively on the survey) from University Street Properties II LLC. Therefore, there is no relationship between the entities, only one of Buyer and Seller. The current owner of Parcels B and C is currently undergoing a restructuring. By the time we submit the final Mylar fir recording, the owner's name shown on the page one of the survey may will have changed again. Accordingly, you were given a letter from this office on Friday, March 23rd, signed by Renton Replacement Properties LLC and Renton Properties LLC (the new owners) acknowledging the lot line application. The Mylar to be submitted will include the names referenced in our letter of to you of March 23rd Item.13—As we discussed, the non-exclusive parking easement is an exhibit to the purchase and sale agreement between RVA CENTER LLC and the current owner of Two and Three Renton Place. Therefore, the easement will be recorded upon closing/recording of the sale between the two parties.. We appreciate your offer to record the easement, but it cannot be recorded until the sale closes. We spoke recently about the agreement existing between RVA CENTER LLC ("Buyer") and University Street Properties II LLC ("Seller"). Based on our discussions, fee title to the properties formerly owned by Seller has transferred to Renton Replacement Properties LLC. The Purchase and Sale Agreement includes the transfer of title to land situated along the east boundary of the shopping center and the west boundary of Two and Three Renton Place. As we discussed, RVA CENTER LLC had previously submitted to City of Renton, a Lot Line Adjustment for modification of property legal descriptions to reflect the legal descriptions in the Purchase and Sale Agreement. The Lot Line Adjustment application to the City included several forms signed by the former owner— notably, the Lot Line Adjustment Survey and the Master Application to the City (copies of these documents are attached for your review). In order for City of Renton to complete its review and approval of the Lot Line Adjustment, Renton Replacement Properties LLC must affirm to the City that it has knowledge of the Lot Line Adjustment filing and accepts the sale and transfer of title to the land involved, to RVA CENTER LLC. The property included all of the land between 1-405 and S. Grady Way, from the 1-405 / SR 167 interchange, east to the Talbot Rd. intersection with S. Grady Way. A joint venture between Puget Western (the development division of Puget Power) and Port Blakely Tree Farms owned the entire property. The property now includes of One, Two and Three Renton Place all owned by University Street Properties* II LLC, and Renton Village Shopping Center, Renton Village Cinemas and the Evergreen Building owned by three separate LLC's. The configuration and location of shopping center buildings and asphalt was completed (except for the McDonald's which opened in 1997) in 1969. At the time the shopping center was completed, the area immediately behind (east) of the shopping center and west of Two and Three Renton Place was paved to accommodate truck deliveries, staging and maneuvering, dumpster storage, parking and access specifically for the shopping center. The land used for development of One, Two and Three Renton Place was undeveloped at that time (1969). In 1986 or 1987, the property was sub-divided to facilitate a sale of Renton Village Shopping Center, Renton Village Cinemas and The Evergreen Building to Renton Village Associates, now called RVA CENTER LLC. Due to an oversight on the part of the former owner, the property line established in the original sub-division excluded, and did not transfer to RVA CENTER LLC, a portion of the paved parking, maneuvering and access area the shopping center tenants have used since 1969. The shopping center's unauthorized use of the paved area parking was first claimed by USP in 1998. The portion of property used by Renton Village Village Shopping Center, that is claimed by USP, has never been used by the One, Two or Three Renton Place, at any time in their developed history. The portion of property to be transferred to RVA CENTER LLC, through the lot line adjustment, lies for 2 to 4 feet below grade of the USP properties and is separated from the USP properties by an extensive landscaped berm. Thus, the property has no useful purpose to USP. Solution to the Boundary Dispute This request for approval of a lot line adjustment is the result of an agreement between USP and RVA CENTER LLC and resolves the dispute. For valuable consideration, USP will convey to RVA CENTER LLC the property within the disputed area. Terms of the Transfer As a condition to the transfer, USP will retain a non-exclusive parking easement on the transferred area. In addition, RVA CENTER LLC will grant to USP a non-exclusive parking easement on Renton Village Shopping Center property. Collectively, USP will acquire non-exclusive rights to 62 parking stalls. The area transferred to RVA CENTER LLC would support approximately 40 stalls. Thus, USP achieves a net parking gain of approximately 16 stalls. Condition of Property The area to be transferred under the lot line agreement is paved and is used for parking, storage and access. No additions to impervious area will be made. The area is already served with storm drainage systems. 4 • 8. The area involved has never been used for parking by Two or Three Renton Place. The property to be acquired from USP is not at grade with their adjoining property and access to the property is not developed from the USP properties. Further, Renton Village Shopping Center has never included the area in parking area calculations and has not used the area for customer parking. The shopping center currently has excess parking of about 138 stalls. The acquisition of USP property by RVA CENTER LLC will resolve a boundary dispute with USP. Landscape Discussion The lot line adjustment requested will not change or reduce any of the existing landscaping between Parcels A (shopping center), B (Three Renton Place) and C (Two Renton Place. Realignment of thee property boundary between these three parcels is coincident with the edge of the asphalt used by the shopping center since its initial construction in 1969. The common boundary area between the three parcels, east of the property acquired by the shopping center, is landscaped with grass and shrubs. Ownership of this area is retained by USP, who also retains maintenance responsibility.
