RE : EAST VALLEY MEDICAL SHORT PLAT
Meeting held with Gordon Y. Ericksen, Warren Gonnason, Jim
Mathews, Chief Geissler , Larry Gibson, Charles Gliege and
Gene , new manager of Vallis Investors. Vallis Investors
and Gliege Corporation met with City departments to inform
them that Vallis Investors had a new manager and would be
proceeding along to comply with the deferred off and on-site
requirements of the short plat. They will submit a detailed
plan locating the primary fire hydrants and timing for in-
stallation of all improvements within the next week to the
Department of Public Works with a copy to the Fire and Planning
Departments . They were informed that they would probably
not receive an extension on the deferrment which expires
on August 22nd .

RE: _ VALLIS INVESTOR' S CLINIC DEVELOPMENT-- (FORMER POPE
PROPERTY LOCATED AT 3713 TALBOT ROAD SOUTH)
Ronald Nelson, Building Division and Michael Smith-, Planning
Department inspected the subject site on March 6, 1978. Con-
siderable progress has been accomplished on the site within
the past several weeks in alleviating certain problems and
coordinating development activities with both the Planning
Department and Building Division. •
No further clearing activity has occurred, however, site clean
up has been undertaken. The large piles of excavated dirt have
been removed, together with most of the brush and tree debris
per city specifications.
A revised landscape plan- has been submitted by the applicant
and is being reviewed by the Planning Department. The trees
remaining around the site will be preserved and incorporated
into the landscaping theme for the clinic. It is both the
applicant' s and Planning Department' s intent to off-set any
tree removal during construction with proportionate additions
to the landscape plan.
The Planning Department and Building Division are presently
developing procedures to improve coordination of the permit
and inspection process per your request.

OFFICE OF THE LAND USE HEARING EXAMINER
.CITY OF RENTON
REPORT AND RECOMMENDATION.
APPLICANT: Vallis Investors FILE NO. Short Plat 113-77
LOCATION: Property located in the vicinity of 3713 Talbot Road South
immediately south of South 37th Street.
SUMMARY OF REQUEST: Applicant requests approval of a proposed four (4) lot
short plat.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on January 17, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on 'January 24, 1978 at 9:00 a.m. in the Council Chambers of
the Renton Municipal Building.
Parties wishing to testify were sworn.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

Exhibit #3: Short Plat Map

Mr. Smith referenced Item 0.3 and Item P.6 of Exhibit #1•pertaining to. a possible
inadequacy of parking area on Lot No. 2 upon conversion of the existing residence into
an office building. He noted that the westerly property line should be straightened
and shifted approximately 50 feet westward to provide additional parking per Planning
• Department approval.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Dansereau indicated basic concurrence in the report but requested clarification on
certain points relating to the 20-foot easement adjacent to South 37th Street. He
explained his request to retain ownership of the easement to maintain flexibility in
meeting :thecity's future street access requirements to Lot No. 4 since access to
South 37th Street is precluded by restrictive covenants,, and reported that Lots No. 1
and 2 will be sold in the future. Mr. Smith felt that the easement should be included
in the lot configurations and lines extended to South 37th Street.-
Mr. Dansereau'submitted a topographical survey map and overlay designating proposed
parking in relationship to the existing structure on Lot No. 2. The Examiner labeled
the map as Exhibit #4 and the overlay as Exhibit #5. The overlay depicted a total of
26 parking stalls on Lot No. 2 which the applicant reported was in excess of the city's
requirement for 17 stalls.
The Examiner asked for further testimony in support or opposition to the request. There
was no response. Mr. Smith was asked if he wished to submit additions, corrections or
revisions to Exhibit #1. Mr. Smith indicated a preference for submittal of a master
plan for the proposal rather than review of'Exhibits '#4 and #5 presented at the hearing.
He noted certain conflicts regarding ordinance requirements for parking provisions and
roadways which could be clarified through review of 'a master plan. The Examiner stated

that although the Subdivision Ordinance allows certain administrative flexibility to
staff in its review, a master plan would be helpful in reviewing the development site
plan for Lot No. 2. In response to the Examiner's inquiry relating to the timing of
the master plan, Mr. Dansereau indicated that the plan was in preliminary stages
of development and noted that legal descriptions in sales contracts for Lots No. 1 and
2 excluded the 20-foot easement on the north side of the property. The Examiner explained
that the applicant would be confined to the configuration designated on submitted
exhibits if the short plat application was approved, thereby establishing a master plan
through approval of the short plat. He also advised the applicant that unless an
exception to the Subdivision Ordinance is requested, all lots must front on a public
street. Mr. Dansereau indicated his desire to coordinate the matter with the Planning
Department to assure that no future access problems exist.
In response to the Examiner's inquiry regarding Fire Department comments, Mr. Smith
advised that proper fire flow and a fire hydrant would be required. The Examiner
noted that covenants included in Exhibit #1 require dedication of 20 feet adjacent
to South 37th Street which is currently 29 feet wide, totaling 49 feet for the right-
of-way. Mr. Smith reported that the recommendation would be revised to require a •
21-foot dedication.of property to total 50 feet for the roadway.
Mr. Smith restated departmental recommendations to postpone dedication of additional
right-of-way along South 37th until a master plan for a planned unit development is
• provided. The Examiner suggested certain alternatives that could apply to the situation
including stipulation on the plat map for future dedication or use of South 37th Street
for future development on the site. Mr. Smith concurred in the suggestion and emphasized
that requirements for access in the restrictive covenants would not be relinquished.
The Examiner .asked for further testimony. Since there was,none, the hearing on
Item #Short Plat 113-77 was closed by the Examiner at 9:50 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter,
the Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a four-lot short plat to continue development of a
medical clinic.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
(is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this
report by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the subject proposal by Gordon Y. Ericksen, responsible official.

4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the lot area requirements of Section 4-710 (P-1)
of Title IV, Ordinance No. 1628, Code of General Ordinances.
8. Per Section 9-1106.3.H. a plat certificate from a title insurance company has not
been submitted.
9. All of the proposed lots except Lot No. 2 have direct access to a dedicated public
street (Exhibit #3) . This application must comply with the minimum standards for
residential design, Section 9-1108.23 which specifies in Section 9-1108.23.F. (2)
that all lots are to directly front a public street of 50 feet in width
(Section 9-1108.7.H, Table 1) . • South 37th Street (shown originally as South 174th
Street on Exhibit #3) is less than 800 feet in length and of 29 feet in width.
A dedication of 21 feet from the subject site would be required to comply with the
Subdivision Ordinance.

The applicant proposes to retain a 20-foot strip along the southerly border of
South 37th Street as part of Lot No. 4 for•the purpose of control in the event
that the 20-foot strip is required to be dedicated for public right-of-way. In
the•planning stage is a private road (cul-de-sac) accessing onto Talbot Road S.
(shown as 96th Avenue S. on Exhibit #3) . Restrictive covenants imposed as a
result of rezoning the property (Exhibit #6) restrict access to Talbot Road S. , •

but require a 20-foot dedication for South 37th Street in the event access occurs
on South 37th Street.
10. A house exists on Lot No. 2 and a barn exists on Lot No. 1 (Exhibits #3 and 4) .
The barn will be demolished, but the house is intended to be converted to medical
clinic or office use. Some doubt occurred as to whether sufficient lot area
exists in Lot No. 2 to accommodate the required parking for the converted house.
(Exhibits #1 and 5)
11. Substantial coniferous vegetation exists on the site, which the covenants (Exhibit
#6) require to be included in landscape plans accompanying development proposals
in the special permit review process.
12. Storm drainage plans will be required at the time of submittal of the development
plans for the special permit review (Ordinance No. 3174) .
13. Restrictive covenants were not submitted by the applicant. The covenants in
Exhibit #6 continue in effect.
14. Per Section 9-1106.3.H. (3) a licensed land surveyor has surveyed the property
(Exhibit #3) .
15. Per Section 9-1106.3.H. (5) a deferment has not been granted by the Board of
Public Works for off-site improvements: All improvements are required to be
installed prior to final approval of the short plat by city staff (Section 9-1105.6) .
16. • Certification by the King County Health Department and the King County and Renton
Finance Departments (Sections 9-1106.3.H. (4) , (7) , and (8) normally occur prior
to final approval of the short plat by city staff or immediately upon recording
of the final short plat.
CONCLUSIONS:
1. The proposal conforms to the goals and objectives of the Comprehensive Plan.
2. Access requirements of Section 9-1108.23.F. (2) are specific. An Exception
(Section 971109) has not been requested from these requirements. However, the
covenants, Exhibit #6, add further restrictions'to access. Either 21 feet is
dedicated for South 37th Street or a 50-foot dedicated public street is provided
within the property and accessing to Talbot Road South. The proposal, Exhibit #3,
contains the conceptual location of such a road. Lacking an Exception application,
the Examiner is constrained to these two alternatives.
The preference established in the covenants, by the Planning Commission in
approving the rezone, was for access only to occur to Talbot Road South. Evidence
and testimony that was presented before the Examiner indicated the same preference.
It seems appropriate, therefore, that the short plat map (Exhibit #3) be revised
to provide a 50-foot public right-of-way to Talbot Road South.
While the revised short plat map would contain the exact location of the roadway,
staff possesses the administrative flexibility to relocate the roadway or other
property lines provided the density of four lots remains unchanged. This
flexibility should accommodate the impending master plan and prospective special
permit application for development of Lots 1 and 2. Any greater flexibility is
not apparently needed for, per the applicant's testimony, Lots No. 1 and 2 are
already sold, thereby establishing their property lines and in effect the master
plan for the easterly approximate 1/2 of the property.
If access to Talbot Road South is not included on the short plat, Lot No. 4, the
majority of the property is precluded from such access but is directed to South
37th Street. Again, the intent of the rezone appears clear that if at all
possible, access is to be confined to Talbot Road South. Testimony was presented
that this should and could be accomplished. Any deviation from this access to
accommodate future divisions of Lot No. 4 could be addressed at the required
hearing(s) where further subdivision is reviewed.
3. Of benefit to the applicant would be completion of a master plan for development
of the entire property. However, existing ordinances are silent in requiring
such a plan for the impending special permit review of buildings and site plans.
The Planned Unit Development approach for development is also available to the
applicant.

4. Specific parking requirements for the existing house on Lot No. 2 should be
coordinated with the Planning Department and necessary changes made on the short
plat map (Exhibit #3) .
5. The required information per Section 9-1105.3 must be submitted prior to final
approval of the short plat per Section 9-1105.7, except for that certification •
which would occur upon recording the final short plat.

6. Off-site improvements are necessary per Section 9-1105.6. Neither opposition to
this installation was .expressed nor was a Waiver requested. The necessary
improvements shall be specific and approved by the Public Works Department.
DECISION:
Based upon the record, testimony, findings and concusions, it is the decision of the
Examiner to approve the proposed short plat subject to:
1. Revision of the short plat map, Exhibit #3, to include a 50-foot dedicated public
right-of-way, serving all of the property, to Talbot Road South. Access is not

The subject site was annexed into the City on April 15 , 1959 , by
ordinance No . 1743 . The Comprehensive Plan in the area was studied
and amended on October 22 , 1974 . The subject site was rezoned to
P- 1 on July 11 , 1975 , by Ordinance No . 2944 . Certain restrictive
covenants dealing with retention of the natural character of the
site and ravine area , togetIer with certain developmental requirements ,
were filed on July 23 , 1975 , and run with the land . Site approval
was granted by the Hearing Examiner on November 18 , 1977 , on Parcel
3 subject to conditions .

E . PHYSICAL BACKGROUND :
1 . Topography : The northeast portion of the site is relatively
level . The southerly portion of the site contains an exist-
ing ravine area with steep slopes averaging approximately
35 percent. The westerly half of the site generally slopes
downward toward the west at an approximate ten percent
grade .
2 . Soils : A majority of the site consists of Indianola Loamy
Fine Sand ( InC ) . This soil has rapid permeability ; available
water capacity is moderate ; runoff is slow to medium; and
erosion hazard is slight to moderate . This soil is used
for timber and for urban development . The ravine area
consists of Alderwood Gravelly Sandy Loam (AgC ) . Runoff is
medium, and erosion hazard is severe . The slippage poten-
tial is moderate . This Alderwood Soil is used mostly for
timber . This soil does not appear to be appropriate for
urban-type development .
3 . Vegetation : There are a number of significant evergreen
and deciduous trees , both on the level areas of the site
around the existing residence and within the ravine area .
The restrictive convenants ( see attached ) designate the
existing significant trees and the ravine area for preser-
vation and incorporation into the development of the site .
The ravine area is to be preserved in its natural woodland-
type vegetation or enhanced with suitable native-type
vegetation .
4. Wildlife : Existing vegetation on the site may provide
some habitat for birds and small mammals .
5. Water : There is an existing year-around stream located
near the bottom of the ravine area near the southerly
portion of the subject site .
6. Land Use : There is an existing single family residence
located on the subject site . There are existing clinics .
located south and southeast of the subject site . Valley
General Hospital is located approximately 1/8 mile south
of the subject site . There are existing single family
residences located directly north of the subject site on
the north side of South 37th Street and east of the subject
site on the east side of Talbot Road South . Except for the
one existing single family residence , the subject site is
undeveloped .
F . NEIGHBORHOOD. CHARACTERISTICS :
The area is characterized by a mixture of single family residences
and public/quasi -public uses in the form of the Hospital and
supportive medical clinics .
G . PUBLIC SERVICES :
1 . Water and Sewer : There is an existing 20 . inch water main
located along Talbot Road South and an existing Metro Sewer
gravity line located along South 37th Street and Talbot
Road South . Storm sewers are not available in the area .
There are drainage ditches , however , and any development
on the site will be subject to suitable storm water reten -
tion. and oil /water separation facilities prior to out-flow
from the site .
2 . Fire Protection : Provided by the Renton Fire Department
as per ordinance requirements . See attached memorandum.

Pursuant to the City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1971 , as amended , RCW
43 . 21C , a Declaration of Non-significance has been issued for
the subject propsal ( see attached ) . This declaration is
based on development of the site consistent with the existing
vegetation and natural character of the site.. and incorporation
of these elements within site development . Retention of the
natural characteristics of the site , as per the restrictive
covenants , is essential in protecting the quality of the
environment of the area and reducing potential impacts to
surrounding properties .

1 . The subject 4-lot short plat is consistent with the Comprehensive
Plan and the P-1 zone for the subject site . The proposed lots
or tracts range in size from approximately one-half (2) acre
for lot #2 , approximately one ( 1 ) acre for lots #1 and #3 , and
approximately six ( 6 ) acres for lot #4 .
2 . A site plan approval request for a medical clinic was approved
for parcel three (3 ) by the Hearing Examiner on November 18 ,
1977 , subject to certain conditions . The development of this
portion of the site is proceeding based on the established
restrictive covenants running with the entire site ( see attached )
and the site approval conditions required by the Hearing
Examiner.
3 . An existing 'single family residences structure is located on
proposed lot #2 . . The existing structure with the lot as
proposed is consistent with the setback requirements of the P- 1
zone .

4 . The proposed short plat was considered necessary by the applicant
for development purposes . The ultimate site development is to
be achieved in several phases . A master plan approach to
Comprehensive site development has been encouraged by this
department . All the proposed lots or tracts have the necessary
frontage on a dedicated street required by the subdivision
ordinance . An additional thirty ( 30) foot access easement is
also proposed extending westward to tract four (4 ) from Talbot
Road between tract one ( 1 ) and two ( 2) . This easement or a
similar such access is proposed as the major access to the
ultimate medical park development . Actual width , location ,
and required improvement may very depending on the master plan
for development .
5 . Utilization of South 37th Street is restricted by covenant .
Access should be excluded from this street to protect the
adjacent single family area from infiltration of incompatible
uses (Comprehensive Plan Objective #1 , Page 17 ) . The proposed
private access road should be of a suitable width to provide
access ultimately to the entire site development .
6. Suitable utilities are available to the subject site .
7 . The Public Works Director has determined that drainage plans
are not necessary as part of the subject short plat approval
per Section VI of the drainage ordinance . This was primarily
based on the large size of the tracts and the opportunity for
more specific site development review at the time of site plan
approval via the requirements of the P- 1 zone and restrictive
covenants .

REPORT AND RECOMMENDATION.
•
APPLICANT: East Valley Medical Park Short Plat FILE NO. E-386-79
LOCATION: • Vicinity Of 3713 Talbot Road South.
SUMMARY OF REQUEST: The applicants are requesting an exception to the Subdivision
Ordinance to allow a reduction in the width of paving from
32 feet to a paved surface varying from 26 feet to 29 feet
along a meandering sidewalk in an effort to save several large
trees._ The request also designates a split pavement to
provide an entrance and exit lane.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with restrictive
covenants.
•

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
• REPORT: Examiner on July 31, 1979.
PUBLIC HEARING: After reviewing the Planning., Department report, examining
available information on file with the application, and field
checking .the property and surrounding area, the Examiner
conducted a public hearing on the subject as'follows:
The hearing was opened on August 7, 1979 at 9:12 a.m. in the Council Chambers of the Renton
Municipal Building.
•
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following
. additional exhibits into the record:

Referencing Section J. , Environmental Assessment/Threshold Determination, David Clemens,
Senior Planner, advised that the statement indicating that the 'Planning Director has
prepared a proposed,declaration of environmental significance was inadvertently copied
from a previous site plan application, Exhibit #2, and would not apply to the subject
application for street design which is part of a previously approved short plat request. •
He ,noted that short plats .are exempt from environmental determination, ,and a declaration
of non-significance, dated May 22, 1979, had been issued during site plan review,'based
upon certain mitigating measures and is contained within Exhibit #2 as part of the record.
Mr. Blaylock advised an addition to Section M. , Recommendation, to include Public Works
Department comments contained in Exhibit #4. The Examiner requested review of departmental
comments. Mr. Blaylock reviewed modifications which include revision of the entrance curve
onto Talbot Road, designation of one-way lanes, and modification 'of sidewalks on center
medians. The Examiner clarified that previous site approval (Exhibit #2) did not include
approval of an exception for street design.
The Examiner requested testimony by the applicant. Responding was: •

Mr. Gliege indicated concurrence in the recommendations contained in Exhibit #1 and the
Public Works Department comments included on Exhibit #4. He advised that approval of the
previous short plat had been conditioned upon retention of the existing trees and design .
of the entire project in a "campus-like atmosphere, " and the proposed meandering roadway
would be in keeping with the developer's attempt to conform to the original request.
The Examiner advised that the city regulations were established to provide more, direct
and. beneficial access, and requested the applicant to discuss physical difficulties of
the site which justify an exception to the Subdivision Ordinance. Mr. Gliege agreed that
street standards must be established, but in certain instances such standards are not in
the best interest of adjacent property which ,is served. He noted that the proposed access
roadway is not an arterial street but a short entrance road and cul-de-sac serving four
individual lots. . Mr. Gliege stated that conformance to Engineering Division standards
would require a curb-to-curb .paved roadway 50 feet wide and 300 feet long with provision
of sidewalks extending from one property line to the other through a heavily treed area,
and the nature of such a roadway would destroy the, aesthetics of the site.
The Examiner stated that because the applicant's corporation had applied, for the •
subdivision of property, a hardship had.been created by the proposal for pipestem into
the site: Mr. Gliege indicated that previous approval of the subdivision had been sought
by another company, and advised that the situation had been created because the property
is restricted by a'ravine on one side, and the City Council and Planning Department had
required that access not be allowed from existing public roadways on both sides of the
property. He noted that the developer would have preferred to utilize the existing
streets rather than create a new roadway.
The Examiner requested testimony in support of the application. Responding was:

Mr. Gibson,. property owner on the subject site, supported approval of the application to
retain the natural, campus-like setting and existing vegetation which would be destroyed
if a 50-foot right-of-way' through the property were required.
•
, The Examiner requested testimony in opposition to the request.. There was no response. Mr.
Clemens confirmed earlier statements made by,Mr. Gliege regarding access restrictions
which had .been imposed upon future site 'development at the time of. rezone approval. He
indicated the original intent to provide interior access by mutual access easements;
however, the Hearing -Examiner had required public right-of-way in lieu of the proposed
easement access in approving the site design and access. within the public right-of-way.
The Examiner inquired if restrictive covenants required as a condition of approval. of the
site plan (Exhibit #2) had been returned to the city. Mr. Gliege stated that conveyance
of the property to his corporation had occurred recently, and revision to the Ownership'
reflected on the covenants would. be required. The Examiner advised that upon completion,
restrictive covenants should be returned to the Office of the Hearing Examiner prior to
filing with King County by the City Clerk's office.
The Examiner requested further comments. Since there were none, the hearing on File No.
E-386-79 was closed by the Examiner at 9:35 a.m.
•
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following: •
FINDINGS:
1. The request is for an exception to the Subdivision Ordinance to permit- the construction
Of .a roadway of less than the required 32 -feet width, to permit the roadway to meander,
and to permit the construction of an island at the entry/exit to separate those entrance
and exit traffic movements. .
2. The Planning Department report sets forth the issues, applicable policies and provisions,
findings of fact, and departmental recommendations in this matter, is uncontested, .and
is hereby attached as Exhibit #1 and incorporated in this report by reference as set
forth in full therein.
•
3. Pursuant to the City of Renton's Environmental Ordinance, and the State Environmental
Policy Act of 1971, R:C.W. 43.21.C. , as amended, the subject proposal has. been determined
exempt from the threshold determination by Gordon Y. Ericksen, responsible official,.
4. ,Plans for the proposal have been reviewed by all city departments. affected by the impact
of this development.

5. All existing utilities are available and in close proximity.
6. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-710 (P-1, Public) of Title IV, Ordinance No. 1628, Code of
General Ordinances.
7. The subject property .is located at 3713 Talbot Road S. in the vicinity of the Valley
General Hospital. The subject parcel is quite heavily wooded and a rather deep,
meandering ravine runs through the property east to west along the .south portion of
the property.
8. This particular property is the result of a prior short plat (Short Plat 113-77) and
the site itself has been the subject of a site approval (SA-325-79) . In both of these
prior actions the subject property was made the object of restrictive covenants
regarding both the natural vegetation and the ravine as well as covenants restricting
. access to Talbot Road S.
9. The property where it fronts on Talbot Road S. is approximately,50 feet wide. The
roadway and required sidewalks would require the entire area to be paved pursuant to
Section 9-1108.7.H which requires a 32-foot roadway,, eight feet of planting strip, and
10 feet of sidewalk. Pursuant to Section 9-1109.1 the applicant has requested an
exception to the Subdivision Ordinance. .
' 10. The Public Works Department has modified the applicant's' submitted proposal to permit .
both pedestrian access and vehicular turning movements in a safe and expeditious manner.
CONCLUSIONS:
1. The applicant suffers undue hardship in developing. the subject ,property due to both
the 'physical topography of the area and the restrictive covenants executed by the
property owner to preserve the natural amenities of the property which include the
ravine and the natural vegetation. In addition, covenants restrict the right of access
to the subject property via Talbot Road S. instead of other more appropriate public
right-of-ways which, if used, would not require the removal of natural features.
2. Because of the various restrictions on development which were required by the city upon
subdivision, the applicant would be denied the aesthetic qualities the property
' possesses if required to provide a 50-foot right-of-way. At the same time, meeting
such requirements would jeopardize the qualities the restrictive covenants were
executed to protect, such as the vegetation and the ravine.
•
3. The exception which the applicant requests will provide a sufficient roadway to service
the facility. While the roadway is public, it is for all practical purposes a cul-de-
sac serving only the subject property and one or two parcels. The Public Works
Department indicated that the proposed roadway and associated sidewalks would be, as
• modified by that department, a safe and reasonable access method for the properties
involved. Granting the exception will not harm the public welfare nor injure
neighboring property.,
4. The topography is such that granting the exception will permit the applicant to use
his property as other property 'owners with similar property and similar restrictions
(restrictive covenants) use theirs.
DECISION: `
Exhibit #4 is approved as modified by the Public Works Department and subject to the
execution of the restrictive covenants required by the site approval (SA-325-79) .

Ordinance to allow a reduction in the width of paving from 32 feet
to a paved surface varying from 26 feet to 29 feet along with
a meandering sidewalk in an effort to save several large •trees .
The pavement is split into an entrance and exit lane as shown in
the attached access road map .

C . HISTORY/BACKGROUND:
The subject site was annexed into the City on April 15 , 1959 ,
by Ordinance No . 1743. The Comprehensive Plan in the area was
studied and amended on October 22 , 1974 . The subject site was
rezoned to P-1 on July 11 , 1975 , by Ordinance No . 2944 . Certain
restrictive covenants dealing with retention of the natural character
of the site and ravine area , together with certain developmental
requirements , were filed on July 23 , 1975 , and run with the land .
The subject parcel was part of Short Plat 113-77 approved by the
Hearing Examiner on January 31 , 1978 . Site approval for the
medical office facility was granted by the Hearing Examiner on
June 11 , 1979 (SA-325-79 ) .

D. PHYSICAL BACKGROUND :
- 1 . Topography : The site slopes downward to the west at approxi -
mately a 10% grade ,
2 . Soils : A majority `of 'the site consists of Indianola Loamy
Fine Sane ( InC ) . This soil has rapid permeability ; available
water capacity is moderate ; runoff is slow to medium; and erosion
hazard is slight to moderate . This soil is used for timber and
for urban development. The ravine area consists of Alderwood
Gravelly Sandy Loam (AgC ) . Runoff is medium, and erosion hazard
is severe . The slippage potential is moderate. This Alderwood
Soil is used mostly for timber. This soil does not appear
to be appropriate for urban-type development.
3. Vegetation : The site is heavily wooded with an abundant
cover of evergreen and deciduous trees . Groundoover consists
principally of brambles . Restrictive covenants designate
the existing significant trees and the ravine area for
preservation and incorporation into the development of the
site. The ravine area is to be preserved in its natural woodland-
type state or enhanced with suitable native-type vegetation .
4. Wildlife : Existing vegetation on the site may provide suitable
habitat for birds and small mammals .

5 , Water: A small stream runs '•along ' the southerly boundary of the
subject property .
6. Land Use : There is an existing single family residence located
to the east of the subject site . There are existing clinics
located south and southeast of the subject site . Valley General
Hospital is located approximately 1 /8 mile south of
the subject site . There are existing single family residences
located directly north of the subject site on the north side of
South 37th Street and east of the subject site on the east side
of Talbot Road South .
E . NEIGHBORHOOD CHARACTERISTICS :
The area Is characterized by a mixture of single family residences
and public/quasi -public uses in the form of the hospital and supportiv
medical clinics .
F . PUBLIC SERVICES :
1 . Water and Sewer : There is an existing 20 inch water main
located along Talbot Road South and an existing Metro Sewer
gravity line located along South 37th Street and Talbot Road
South . Storm sewers are not available in the area . There are
drainage ditches , however , and any development on the site
will be subject to suitable storm water retention and oil/water
separation facilities prior to out-flow from the site .
2 . Fire Protection : Provided by the Renton Fire Department per
ordinance requirements .
3. Transit: Metro Transit Route #145 operates along S .W . 43rd
Street approximately 1 /4 mile south of the subject site .
4 . Schools : The subject site is not in close proximity to any
existing schools , and the proposed project will not have an
effect on existing school population except possible indirectly
through increased employment opportunities in the area .

5 . Recreation : The subject site is approximately one mile south
of Talbot Hill Park .
H . APPLICABLE SECTIONS OF THE SUBDIVISION ORDINANCE :
1 . Section 9-1109 , Exceptions .
I . IMPACT ON THE NATURAL AND HUMAN ENVIRONMENT:
1 . Natural Systems : Development of the site will disturb soil
and vegetation , increase storm water runoff, and has .an effect
on noise levels in the area . However, these can be mitigated
by proper development controls and procedures and adherence
to the existing restrictive covenants and sound planning principals
and practices .
2 . Population/Employment: The nature of the use is" such that
there isn ' t likely to be any significant effect on population .
3 . Schools : Not Applicable .
4 . Social : Changing the use from low density , single family
si redential to quasi -public, medical clinic , may result in
additional social interaction at the site as well as in the
surrounding area .
5. Traffic : The proposed medical office facility will generate
approximately 3765 additional vehicle trips per day (75 trips
per 1000 square feet) between the S . 37th Street and Talbot Road
South. This is a 65% traffic increase over the existing 5775
daily traffic trips on Talbot Road South in this vicinity .
J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended RCW 43-21C ,
the Planning Director has prepared a proposed declaration of environ-
mental significance . Issues of traffic access , impact on the
adjoining single family homes , encroachment into the ravine area ,
and site development master plan remain to be resolved . An EIS
may be required to address these issues unless an amended application
is submitted .

L . PLANNING DEPARTMENT ANALYSIS :
1 . The exception request is a result of the existence of several
large trees and the intention of the ,property owners to provide
a relaxed park-like setting for their medical complex . R'o!M . C .
9-1109 (A) requires that the Hearing Examiner find that not
granting the exception will deprive the applicant of the
reasonable use of his land . The term reasonable is dependent
upon the individual interpreter ' s standards . What is functional
is not always equal with what is reasonable . The aesthetic
benefit of retaining the trees is viewed as a necessity by the
property owner to provide the reasonable development of the land .

2 . When a piece of land is purchased , the site generally
includes other factors such as water , minerals and vegetation .
These natural resources are in fact a portion of the
property and are therefore a portion of the property rights
purchased . The developer then has the option of using
or removing those natural resources .
In this case , the developer has decided to exploit
the aesthetic quality of the vegetation . Denying the exception
could in fact deny the property owner of the right he purchased .
3 . The Site Approval (SA-325-79) was reviewed and approved under the
concept proposed by this exception . The Hearing Examiner ' s decisi
on the Site Approval and conditions of approval reflect the standa
• contained in this proposed street cross-section .
4. Access for both the public and emergency service vehicles
will not be impaired . The cul -de-sac will still ,,function
as the design criteria of the subdivision ordinance intended ,
while preserving the aesthetic qualities of the site .
M . DEPARMENTAL RECOMMENDATION :
The staff recommends that the Hearing Examiner recommend to the
City Council that an exception be granted to the East Valley
Medical Park Short Plat to allow the reduction of pavement and
the construction of a meandering sidewalk as submitted in Access
Road plans dated June 1979 (Received July 12 , 1979 ), subject to
recording of restrictive covenants providing for compliance with
. condition #7 of Site Approval , SA-325-79 .

a meandering sidewalk in an effort to save several large •trees .

C . HISTORY/BACKGROUND :
The subject site was annexed into the City on April 1.5 , 1959 ,
by Ordinance No . 1743. The Comprehensive Plan in the area was
studied and amended on October 22 , 1974 . The subject site was
rezoned to P-1 on July 11 , 1975 , by Ordinance No . 2944 . Certain
restrictive covenants dealing with retention of the natural character
of the site and ravine area , together with certain developmental
requirements , were filed on July 23 , 1975 , and run with the land .
The subject parcel was part of Short Plat 113-77 approved by the
Hearing Examiner on January 31 , 1978. Site approval for the
medical office facility was granted by the Hearing Examiner on
June 11 , 1979 (SA-325-79 ) .

D. PHYSICAL BACKGROUND :
1 . Topography : The site slopes downward to the west at approxi -
mately a 10% grade .
2. Soils : A majority of the site consists of Indianola Loamy
Fine Sane ( InC ) . This soil has rapid permeability ; available
water capacity is moderate; runoff is slow to medium; and erosion
hazard is slight to moderate . This soil is used for timber and
for urban development. The ravine area consists of A] derwood
Gravelly Sandy Loam (AgC ) , Runoff is medium, and erosion hazard
is severe , The slippage potential is moderate , This, Alderwood
Soil is used mostly for timber. This soil does not appear
to be appropriate for urban-type development.
3. Vegetation : The site is heavily wooded with an abundant
cover of evergreen and deciduous trees . Groundcover consists
principally of brambles . Restrictive covenants designate
the existing significant trees and the ravine area for
preservation and incorporation into the development of the
site. The ravine area is to be preserved in its natural woodland-
type state or enhanced with suitable native-type vegetation .
4. Wildlife : Existing vegetation on the site may provide suitable
habitat for birds and small mammals .
5 . Water: A small stream runs along the southerly boundary of the
subject property .
6. Land Use : There is an existing single family residence located
to the east of the subject site . There are existing clinics
located south and southeast of the subject site . Valley General
Hospital is located approximately 1/8 mile south of
the subject site . There are existing single family residences
located directly north of the subject site on the north side of
South 37th Street and east of the subject site on the east side
of Talbot Road South .
E . NEIGHBORHOOD CHARACTERISTICS :
The area is characterized by a mixture of single family residences
and public/quasi -public uses in the form of the hospital and supportive
medical clinics .
F . PUBLIC SERVICES :
1 . Water and Sewer : There is an existing 20 inch water main
located along Talbot Road South and an existing Metro Sewer
gravity line located along South 37th Street and Talbot Road
South. Storm sewers are not available in the area . There are
drainage ditches , however , and any development on the site
will be subject to suitable storm water retention and oil/water
separation facilities prior to out-flow from the site .
2. Fire Protection : Provided by the Renton Fire Department per
ordinance requirements .
3. Transit: Metro Transit Route #145 operates along S .W . 43rd
Street approximately 1 /4 mile south of the subject site .
4. Schools : The subject site is not in close proximity to any
existing schools , and the proposed project will not have an
effect on existing school population except possible indirectly
through increased employment opportunities in the area .

5 . Recreation : The subject site is approximately one mile south
of Talbot Hill Park .
H . APPLICABLE SECTIONS OF THE SUBDIVISION ORDINANCE :
1 . Section 9-1109 , Exceptions .
I . IMPACT ON THE NATURAL AND HUMAN ENVIRONMENT:
1 . Natural Systems : Development of the site will disturb soil
and vegetation , increase storm water runoff, and has .an effect
on noise levels in the area . However, these can be mitigated
by proper development controls and procedures and adherence
to the existing restrictive covenants and sound planning principals
and practices .
2 . Population/Employment : The nature of the use is" such that
there isn ' t likely to be any significant effect on population .
3. Schools : Not Applicable .
4 . Social : Changing the use from low density , single family
residential to quasi -public , medical clinic , may result in
additional social interaction at the site as well as in the
surrounding area .
5. Traffic : The proposed medical office facility will generate
approximately 3765 additional vehicle trips per day (75 trips
per 1000 square feet ) between the S . 37th Street and Talbot Road
South . This is a 65% traffic increase over the existing 5775
daily traffic trips on Talbot Road South in this vicinity.
J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended RCW 43-21C ,
the Planning Director has prepared a proposed declaration of environ-
mental ;significance . Issues of traffic access , impact on the
adjoining single family homes , encroachment into the ravine area ,
and site development master plan remain to be resolved . An EIS
may be required to address these issues unless an amended application
is submitted .

L . PLANNING DEPARTMENT ANALYSIS :
1 . The exception request is a result of the existence of several
large trees and the intention of the ,property owners to provide
a relaxed park-like setting for their medical complex . RA . C .
9-1109 (A) requires that the Hearing Examiner find that not
granting the exception will deprive the applicant of the
reasonable use of his land . The term reasonable is dependent
upon the individual interpreter ' s standards . What is functional
is not always equal with what is reasonable . The aesthetic
benefit of retaining the trees is viewed as a necessity by the
property owner to provide the reasonable development of the land .

2 . When a `piece of land is purchased , the site generally
includes other factors such as water , minerals and vegetation .
These natural resources are in fact a portion of the
property and are therefore a portion of the property rights
purchased. The developer then has the option of using
or removing those natural resources .
In this case , the developer has decided to exploit
the aesthetic quality of the vegetation . Denying the exception
could in fact deny the property owner of the right he purchased .
3 . The Site Approval (SA-325-79) was reviewed and approved under the
concept proposed by this exception . The Hearing Examine.r ' s decision
on the Site Approval and conditions of approval reflect the standards
contained in this proposed street cross-section .
4. Access for both the public and emergency service v,,hicies
will not be impaired . The cul -de-sac will still function
as the design criteria of the subdivision ordinance intended ,
while preserving the aesthetic qualities of the site .
M. DEPARMENTAL RECOMMENDATION :
The staff recommends that the Hearing Examiner recommend to the
City Council that an exception be granted to the East Valley
Medical Park Short Plat to allow the reduction of pavement and
the construction of a meandering sidewalk as submitted in Access
Road plans dated June 1979 (Received July 12 , 1979 ), subject to
recording of restrictive covenants providing for compliance with
condition #7 of Site Approval , SA-325-79 .
