Councilman Perry, Chairman Planning and Development Committee requested letter from Mr. Rick Beeler, Hearing Examiner, be read re Renton Hill Rezone, questioning intent of Committee's recommendation and Council ' s action re PUD in the Renton Hill Rezone at August 14, 1978 Council meeting. Councilman Perry requested discussion by council re future and present considerations for a PUD in the area rezoned. Councilman Shane noted intent was R-1, single-family residental . Councilwoman Thorpe noted PUD can mean single-family development, does not necessarily mean other than single-family development; the ordinance stipulates it has to be compatible and allows for city and community involvement in the decision. Asst. City Attorney, Dan Kellogg, noted that council action does not imply that a PUD is an inappropriate means of 'development, just not required. PUBLIC HEARING Vacation Portion This being the date set and proper notices having been posted, of NE 14th published, and mailed, Mayor Delaurenti opened the public hearing to consider closure of a portion of 14th Ave. NE, petitioned by (West of Hazel W. Chenaur, Mr. George Rusk, and Mr. Del Bennett. Letter Edmonds Ave. read from Mr. Warren Gonnason, Chairman Board of Public Works, NE) stating present and future city street circulation does not require this portion of NE 14th St. ; a utility easement over the northerly 60 ft. is required; recommended vacation of the entire portion of NE 14th; vacation subject to sufficient ingress and egress for fire and emergency vehicles; and value of the property should be set at $.50 per sq. ft. Councilman Stredicke inquired re approval of proposed plat and planning for fire access. Mr. Warren Gonnason noted plat has been approved and fire access was consideration of Hearing Examiner; who concluded no need for NE 14th. Councilman Clymer inquired if Hazel Chenaur would be landlocked. Mr. Gonnason noted technically she would not be landlocked, because of the request to not include 30 ft. strip. Councilman Shane inquired proposed development in that area and width of easement to be reserved. Mr. Gonnason noted area probably would be developed with access to NE 16th and recommendation of a 60 ft. wide easement. Short Plat 186-78 E-187-78 LOCATION: Approximately 150 feet south of the southeast corner of Powell Avenue S.W. and S.W. Langston Road. SUMMARY OF REQUEST: Applicant requests approval of a proposed 4-lot short plat and an exception to the Subdivision Ordinance to allow two (2) 20-foot pipestems to provide access to separate rear lots. SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat with dedicated half-street. Hearing Examiner Decision: Approval of short plat with 50-foot right-of-way. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on July 11, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the ' Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 18, 1978 at 9:07 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Revised Short Plat Map Exhibit #3: •Short Plat Map as submitted. Mr. Smith indicated that the short plat map had been revised to eliminate the requirement for two pipestems and provide access via a half-street on the southern boundary of the property. He noted that the width of the half-street designated on Exhibit #2 had been revised from 20 tO 25 feet to provide access alternatives for future land use and subdivisions in the area, and although sidewalks would not be required, paving, curbs, gutters, and drainage control would be appropriate requirements for the request. Mr. Smith advised that departmental comments attached to Exhibit #1 pertained to Exhibit #3, short plat map as originally submitted by the applicant. the Examiner asked the representative for the applicant if he concurred in Exhibit #1. Responding was: John Norman Norman Associates, Inc. Evergreen Building, Suite 509 Renton, WA 98055 • Mr. Norman indicated certain objections to the report. He referenced departmental comments from the Engineering and Utilities Division which responded to configurations denoted on Exhibit #3, noting that revisions contained in Exhibit #2 would require improvement and requirements relating to the proposed half-street on the southern boundary of the property, including paving, curb and necessary sewer and water on the half-street. He also objected to requirements for installation of a large detention facility on the four-lot parcel as being unreasonable. The Examiner requested testimony in support or opposition to the request. There was no response. The Examiner asked Mr. Smith for clarification that the site contained sufficient acreage for the applicant to provide a 50-foot dedicated street. Mr. Smith advised that the size of the site was adequate for provision of the street, but lot size Short Plat its6-78 Page Two E-187-78 would be substantially impacted. The Examiner inquired if the L-shape configuration at the end of the half-street would require an exception from the Subdivision Ordinance. Mr. Smith felt that the configuration would be considered as part of the design of the half- street and, therefore, would not require an exception. The Examiner inquired if improvement of the half-street would be a design consideration upon completion of the entire street dependent upon development to the east and south of the subject site, and if the proposed configuration met design requirements of the Subdivision Ordinance. Mr. Smith indicated that for future development purposes a full hammerhead configuration consisting of 40 by 80-foot turning radius was possible, but the applicant proposed to pave the end of the hammerhead to provide a 20 by 40-foot turnaround which he felt met the intent of the requirements of the Subdivision Ordinance. The Examiner noted Mr. Norman's objection to provision of storm drainage facilities as recommended by staff and inquired regarding proposed alternatives. Mr. Norman indicated his concurrence in joining the existing storm drainage facilities in the area, but proposed that in lieu of a large detention facility, a small weir be constructed to control storm water run-off on the property. He estimated costs of construction of a detention facility which he felt were unreasonable for a four-lot plat. The Examiner asked Mr. Smith for revisions or modifications to Exhibit #1. Mr. Smith indicated that Exhibit #1 would remain as submitted, and noted that revisions regarding. design and storm drainage proposed by Mr. Norman could be reviewed with the Engineering Division. The Examiner requested further comments. Since there were none, the hearing on File No. Short Plat 186-78 and E-187-78 was closed by the Examiner at 9:30 a.m. FINDINGS, CONCLUSIONS, AND RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a short plat of four single family lots and an exception to allow two pipestem lots. A revised short plat (Exhibit #2) eliminated the pipestem lots. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible official, ,determined that the proposal is exempt from the threshold determination and EIS requirements of SEPA. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the setbacks, lot coverage and lot area requirements of Section 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. Parcel No. 1, the corner lot, is platted larger than the other lots per Section 9-1108.23.F. (4) . 8. Sufficient area exists within the subject site to accommodate a dedicated public ' right-of-way of 50 feet and still permit four single family lots. Per Section 9-1108.23.F. (2) , all of the lots must front on a ". . .public street or road with a width of not less than. . . " 50 feet. The proposal, as revised per Exhibit #2, features a 20-foot half-street and 20-foot by 40-foot L-shaped turn-around. Per Section 9-1108.23.A. (5) a street right-of-way should be 50 feet. Section 9-1108.23.A. (7) provides for hammerhead turn-arounds. of 40 feet by 80 feet. Section 9-1108.23.A. (8) provides for temporary turn-arounds of a diameter of 80 feet pending extension of the street or completion. ". . .beyond the boundary of the original subdivision." Private streets are expressly prohibited under Section 9-1108.23.A. (9) . Section IX.C, Ordinance No. 3174 (Renton Storm and Surface Water Drainage Ordinance) , requires retention/detention facilities for handling ". . .surface water in excess of the peak discharge. . .". The proposal does not fall within the exceptions of Section V. (A) of Ordinance No. 3174. Specific storm drainage control plans were not submitted into the record. 10. The applicant disagreed with the Public Works Department requirement that the existing substandard water main in Powell Avenue S.W. be replaced along the property (Exhibit #1, Staff Report) . It was contended that the utilities that are required should only be in the proposed half-street. 11. Restrictive covenants were not submitted (Section 9-1105.3.B) . 12. An affidavit was 'contained in the file of record attesting to the ownership of the subject property (Section 9-1106.3.H. (1) . 13. The proposed half-street has not been dedicated for public use (Section 9-1106.3.H. (2) . 14. A survey of the property has been made by a licensed land surveyor (Section 9-1106. 3.H. (3) . 15. Certification from the King County Health and Finance Departments and from the City of Renton Finance Department will occur just prior to, during, or immediately following filing of the plat with King County (Section 9-1106.3.H. (4) , (7) , & (8) . 16. Improvements have not been installed and a deferment or waiver have not been requested (Section 9-1106.3.H. (5) . 17. A title insurance policy has not been provided (Section 9-1106.3.H. (6) . 18. Bills of sale for utilities have not been provided (Section 9-1106.3.H. (9) . 19. Off-site improvements are required on Powell Avenue S.W. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan and the general character of the neighborhood. 2. Unless an exception application is filed and the criteria of Section 9-1109 found to be applicable, the Examiner lacks authority to approve half-streets under the Subdivision Ordinance, Chapter 11. Section 9-1108.23.F. (2) requires that each lot in the plat front on a public street or road, which per Section 9-1108.23.A. (5) must be 50 feet in width. The referenced short plat application, File No. 088-77 (Ross) , contained the same conclusions, which were upheld by the City Council upon appeal, and additional right-of-way was acquired to form a public street. The same conclusion is true for the proposed turnaround which does not meet the criteria of Sections 9-1108.23.A. (7) and (8) . An exception application is required. 3. The Public Works Department is required by Ordinance No. 3174 to review and approve the storm drainage plan for the proposal. This can be accomplished prior to final approval fo the plat per Section 9-1105.7. 4. The issue of replacing the water line in Powell Avenue S.W. can be resolved with the Public Works Department. Perhaps an LID for upgrading the water line should be instituted along the street. Testimony provided the Examiner with no specific information with which to draw a more specific conclusion. 5. Completion of the certification requirements of Section 9-1106.3.H. must occur prior to final approval by staff of the plat. 6. Although the applicant was following guidance by staff in revising the application (Exhibit #2) , the Examiner is prevented from approving the short plat without provision of acceptable access to the short plat. Either access and turn-arounds are provided per the requirements of the Subdivision Ordinance (dedicated 50-foot public right-of- way) or exception applications are filed for deviation from these requirements. Although the location of existing residences appears to block its ultimate exten- sion to Thomas Avenue South , such a street could extend to the east boundary of the subject site with an L-shaped turn- around . As other properties are platted and developed , additional right-of-way will be required to complete the roadway and turnaround . Such a configuration would result in four more compatible lots averaging approximately 9000 square feet each . APPLICANT: Russell Eager FILE NO. Short Plat 186-78 E-187-78 LOCATION: Approximately 150 feet south of the southeast corner of Powell Avenue S.W. and S.W. Langston Road. SUMMARY OF REQUEST: Applicant requests approval of a proposed 4-lot short plat and an exception to the Subdivision Ordinance to allow two (2) 20-foot pipestems to provide access to separate rear lots. SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat with dedicated half-street. Hearing Examiner Decision: Approval of short plat with 50-foot right-of-way. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on July 11, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 18, 1978 at 9:07 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Revised Short Plat Map Exhibit #3: Short Plat Map as submitted Mr. Smith indicated that the short plat map had been revised to eliminate the requirement for two pipestems and provide access via a half-street on the southern boundary of the property. He noted that the width of the half-street designated on Exhibit #2 had been revised from 20 tO 25 feet to provide access alternatives for future land use and subdivisions in the area, and although sidewalks would not be required, paving, curbs, gutters, and drainage control would be appropriate requirements for the request. Mr. Smith advised that departmental comments attached to Exhibit #1 pertained to Exhibit #3, short plat map as originally submitted by the applicant. The Examiner asked the representative for the applicant if he concurred in Exhibit #1. Responding was: John Norman Norman Associates, Inc. Evergreen Building, Suite 509 Renton, WA 98055 Mr.. Norman indicated certain objections to the report. He referenced departmental comments from the Engineering and Utilities Division which responded to configurations denoted on Exhibit #3, noting that revisions contained in Exhibit #2 would require improvement and requirements relating to the proposed half-street on the southern boundary of the property, including paving, curb and necessary sewer and water on the half-street. He also objected to requirements for installation of a large detention facility on the four-lot parcel as being unreasonable. The Examiner requested testimony in support or opposition to the request. There was no response. The Examiner asked Mr. Smith for clarification that the site contained sufficient acreage for the applicant to provide a 50-foot dedicated street. Mr. Smith advised that the size of the site was adequate for provision of the street, but lot size Short Pla.. -J6-78 Page Two E-187-78 would be substantially impacted. The Examiner inquired if the L-shape configuration at the end of the half-street would require an exception from the Subdivision Ordinance. Mr. Smith felt that the configuration would be considered as part of the design of the half- street and, therefore, would not require an exception. The Examiner inquired if improvement of the half-street would be a design consideration upon completion of the entire street dependent upon development to the east and south of the subject site, and if the proposed configuration met design requirements of the Subdivision Ordinance. Mr. Smith indicated that for future development purposes a full hammerhead configuration consisting of 40 by 80-foot turning radius was possible, but the applicant proposed to pave the end of the hammerhead to provide a 20 by 40-foot turnaround which he felt met the intent of the requirements of the Subdivision Ordinance. The Examiner noted Mr. Norman's objection to provision of storm drainage facilities as recommended by staff and inquired regarding proposed alternatives. Mr. Norman indicated his concurrence in joining the existing storm drainage facilities in the arga, but proposed that in lieu of a large detention facility, a small weir be constructed to control storm water run-off on the property. He estimated costs of construction of a detention facility which he felt were unreasonable for a four-lot plat. The Examiner asked Mr. Smith for revisions or modifications to Exhibit #1. Mr. Smith indicated that Exhibit #1 would remain as submitted, and noted that revisions regarding design and storm drainage proposed by Mr. Norman could be reviewed with the Engineering Division. The Examiner requested further comments. Since there were none, the hearing on File No. Short Plat 186-78 and E-187-78 was closed by the Examiner at 9:30 a.m. FINDINGS, CONCLUSIONS, AND RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a short plat of four single family lots and an exception to allow two pipestem lots. A revised short plat (Exhibit #2) eliminated the pipestem lots. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible official; determined that the proposal is exempt from the threshold determination , and EIS requirements of SEPA. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7.. .The proposal is compatible with the setbacks, lot coverage and lot area requirements of Section 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances. Parcel No. 1, the corner lot, is platted larger than the other lots per Section 9-1108.23.F. (4) . 8. Sufficient area exists within the subject site to accommodate a dedicated public right-of-way of 50 feet and still permit four single family lots. Per Section 9-1108.23.F. (2) , all of the lots must front on a ". . .public street or road with a width of not less than. . . " 50 feet. The proposal, as revised per Exhibit #2, features a 20-foot half-street and 20-foot by 40-foot L-shaped turn-around. Per Section 9-1108.23.A. (5) a street right-of-way should be 50 feet. Section 9-1108.23.A. (7) provides for hammerhead turn-arounds of 40 feet by 80 feet. Section 9-1108.23.A. (8) provides for temporary turn-arounds of a diameter of 80 feet pending extension of the street or completion ". . .beyond the boundary of the original subdivision. " Private streets are expressly prohibited under Section 9-1108.23.A. (9) . Short Plat 186-78 Page Three E-187-78 9. Opposition was expressed by the applicant of the requirement to provide on-site storm water retention system. Section IX.C, Ordinance No. 3174 (Renton Storm and Surface Water Drainage Ordinance) , requires retention/detention facilities for handling ". . .surface water in excess of the peak discharge. . . ". The proposal does not fall within the exceptions of Section V. (A) of Ordinance No. 3174. Specific storm drainage control plans were not submitted into the record. 10. The applicant disagreed with the Public Works Department requirement that the existing substandard water main in Powell Avenue S.W. be replaced along the property (Exhibit #1, Staff Report) . It was contended that the utilities that are required should only be in the proposed half-street. 11. Restrictive covenants were not submitted (Section 9-1105.3.B) . 12. An affidavit was contained in the file of record attesting to the ownership of the subject property (Section 9-1106. 3.H. (1) . 13. The proposed half-street has not been dedicated for public use (Section 9-1106.3.H. (2) . 14. A survey of the property has been made by a licensed land surveyor (Section 9-1106. 3.H. (3) . 15. Certification from the King County Health and Finance Departments and from the City of Renton Finance Department will occur just prior to, during, or immediately following filing of the plat with King County (Section 9-1106.3.H. (4) , (7) , & (8) . 16. Improvements have not been installed and a deferment or waiver have not been requested (Section 9-1106.3.H. (5) . 17. A title insurance policy has not been provided (Section 9-1106.3.H. (6) . 18. Bills of sale for utilities have not been provided (Section 9-1106.3.H. (9) . 19. Off-site improvements are required on Powell Avenue S.W. CONCLUSIONS: 1. The proposal conforms to the Comprehensive Plan and the general character of the neighborhood. 2. Unless an exception application is filed and the criteria of Section 9-1109 found to be applicable, the Examiner lacks authority to approve half-streets under the Subdivision 'Ordinance, Chapter 11. Section 9-1108.23.F. (2) requires that each lot in the plat front on a public street or road, which per Section 9-1108.23.A. (5) must be 50 feet in width. The referenced short plat application, File No. 088-77 (Ross) , contained the same conclusions, which were upheld by the City Council upon appeal, and additional right-of-way was acquired to form a public street. The same conclusion is true for the proposed turnaround which does not meet the criteria of Sections 9-1108.23.A. (7) and (8) . An exception application is required. 3. The Public Works Department is required by Ordinance No. 3174 to review and approve the storm drainage plan for the proposal. This can be accomplished prior to final approval fo the plat per Section 9-1105.7. 4. The issue of replacing the water line in Powell Avenue S.W. can be resolved with the Public Works Department. Perhaps an LID for upgrading the water line should be instituted along the street. Testimony provided the Examiner with no specific information with which to draw a more specific conclusion. 5. Completion of the certification requirements of Section 9-1106.3.H. must occur prior to final approval by staff of the plat. 6. Although the applicant was following guidance by staff in revising the application (Exhibit #2) , the Examiner is prevented from approving the short plat without provision of acceptable access to the short plat. Either access and turn-arounds are provided per the requirements of the Subdivision Ordinance (dedicated 50-foot public right-of- way) or exception applications are filed for deviation from these requirements. 1� s Short Flat 186-78 Page Four E-187-78 \_-------- DECISION: Based upon the record, testimony, findings and conclusions, it is the Examiner's decision to approve the short plat subject to: 1.
