County of King, State of Washington, described as Exhibit 'A'
attached hereto.
WHEREAS , the owner(s) of said described property desire to
impose the following restrictive covenants running with the land as
to use, present and future, of the above described real property.
NOW, THEREFORE , the aforesaid owner(s) hereby establish ,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by the undersigned,
their successors , heirs , and assigns as follows :
INSTALLATION OF OFF-SITE IMPROVEMENTS
The owner(s) of the above described property, their suc-
cessors , heirs and assigns , hereby agree and covenant to
participate in , sign a petition in support of, and accept
any future Local Improvement District (LID) or city initia-
ted proposal , and pay their fair share therefore, for the
purposes of providing the necessary off-site improvements
° required by the Renton Subdivision Ordinance. Said improve-
ments shall include but may not be limited to the installa-
tion of curbs , gutters , sidewalks , street paving, sanitary
sewers , storm sewers , undergrounding of utilities , and
street lighting.
These covenants are imposed in lieu of Section 9-1105(6)
of Title IX of Ordinance #1628 of the City of Renton .
DURATION
These covenants shall run with the land and expire on
December 31 , 2025. If at any time improvements are
installed pursuant to these covenants . the portion of
Athe covenants pertaining to the specific installed improve-
® ments as required by the Ordinances of the City of Renton
r` shall terminate without necessity of further documentation.

• Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of King '
County by either the City of Renton or any property owners adjoining

SUMMARY OF REQUEST: Applicant requests approval of a proposed four (4) lot short
plat, and a waiver of the required off-site improvements.
SUMMARY OF ACTION: Planning Department Recommendation: Approval of the short plat;
Denial of waiver and recommend granting of indefinite deferral
with restrictive covenants.
Hearing Examiner Decision: Approval of the short plat;

PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on July 6, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on July 11, 1978 at 11:55 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

A. B. Allper, dated May 16, 1978,
regarding request for waiver.
Exhibit #3 was read into the record by Mr. Smith. He also indicated additions to Exhibit
#1, Section B.1. , to include Globe Development Company as an owner of record, and to
Section P. , Recommendation, to include a requirement for designation of utilities and
easements on the plat map.
The Examiner asked the representative for the applicant if he concurred in Exhibit #1.
Responding was:

Mr. Humble indicated his concurrence in the report and explained the necessity for
deferral of off-site improvements until a later date. The Examiner inquired if the
Planning Department recommendation for installation of improvements on Harrington Avenue
N.E. within a one or two year period, pending the outcome of the decision of the Board
of Public Works, would be acceptable to the applicant. Mr. Humble indicated a preference
for indefinite deferral of improvements on that roadway because of conditions of the
purchase and the possibility that improvement of an existing building located on Parcel 1
may not occur within that period.
The Examiner requested clarification of the Planning Department recommendation for
designation of utility lines and easements on the plat map. Mr. Smith explained that
although the recommendation from the Utilities Division had not been clarified, the
request ensured that .information regarding location of easements would be received. Mr.
Humble further clarified the departmental recommendation by reviewing location of vacated

streets in which easements and utility lines may not have been surveyed in the past. He
indicated that records designating these locations could be provided.
The Examiner requested additional comments. Since there were none, the hearing on File
No. Short Plat 188-78 and W-189-78 was closed by the Examiner at 12:15 p.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a four-lot short plat and a waiver of off-site
improvements.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
(is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this
report by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, found the proposal exempt from the threshold determination and EIS
requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and lot area
requirements of Section 4-711 (B-1) of Title IV, Ordinance No. 1628, Code of
General Ordinances.
8. Restrictive covenants were not submitted (Section 9-1105.3.B) .
9. Affidavits were supplied in the file of record certifying ownership of the property
(Section 9-1106.3.H. (1) ) .
10. All streets are dedicated public streets, except Index Avenue N.E. which was vacated
(Section 9-1106.3.H. (2) ) .
11. Certification by a licensed land surveyor per Section 9-1106.3.H. (3) was not
submitted.
12. Certification by the King County Health and Finance Departments and City of Renton
Finance Department will occur just prior to, at or immediately following filing
the final plat (Sections 9-1106.3.H.4, 7, and 8) .
13. A title insurance statement has not been submitted per Section 9-1106.3.H. (6) .
14. Utilities were provided several years ago (Section 9-1106.3.H. (9) ) .
15. Per Exhibit #3 a waiver was requested per Section 9-1105.6.B on the basis of:
a. Probable future vacation of Jefferson Avenue N.E.
b. Impending improvements of the property or future decisions regarding.,',access;
points and curb cuts.
Off-site improvements exist along Harrington Avenue N.E. on much of Lot 1 and most,
if not all, of Lot 2. Non-conforming off-site improvements exist along the west
side of Harrington Avenue N.E. and the south side of N.E. 9th Street. Off-site
improvements exist on the portion of Lot 1 on Sunset Boulevard N.E.
CONCLUSIONS:
1. The proposal conforms to the Comprehensive Plan and zoning regulations.
2. Complete certification, except as noted, per Section 9-1106.3.H. must be provided
prior to approval of the final plat per Section 9-1105.7.

•• 3. concerning the requested waiver of off-site improvements, existing conditions and
the tesimony did not support the required conditions. Existing improvements do
exist on the property and within a "'. . .reasonable distance. . ." (Section 9-1105.6.B) .
It was not claimed that ". . .undue hardship. . ." would be inflicted on the existing
and future,property owners (Section 9-1109.1) , only that the timing of the
improvements would be more timely when remodeling occurred on Lot 1. No ". . .
special circumstances. . ." were allged such that the construction (or deferral via
the Board of Public Works) of the improvements would ". . .deprive the applicant of
• the reasonable use or development. . .." of the properties (Section 9-1109.1.A) .
Substantial development has already occurred. Infringement of property ". . .rights
and privileges. . ." was not claimed (Section 9-1109.1.B) . .
And on the other side of the issue no testimony purported that the ". . .public
welfare. .." on other properties would be harmed by not installing the improvements.
(Section 9-1109.1.C) .

' The vacation of the southern portion of Jefferson, Avenue N.E. was indicated as
probable conjecture, but not definite. Until such time as it is .vacated, the .
. Examiner must consider it as the city street it is. Admittedly, the impending
purchase of Lot 4 by the adjacent Highland Community Church may eventually produce
the vacation.
It is -reasonable to expect in this situation for improvements to be constructed
within the time frame given the Board of Public Works in review of the deferral
application.
• Under these circumstances it appears most appropriate for 'off-site improvements to
be considered by the Board of Public Works in the deferral process of Section
9-1108.21.. The'waiver application should be denied for lack of justification under
the existing conditions.
DECISION:
Based upon the record; testimony, findings and conclusions, it is the Examiner's decision
to:
1. Approve the short plat subject to completion of certification per Section 9-1106.3.H.
and showing all existing utility easements on the final plat map.
2. Deny the waiver of off-site improvements.

2 . Soils : Urban Land ( Ur) , the erosion hazard is slight to
moderate . No capability or woodland classification. The' soil
is used for urban development . Ragnar- Indianola Association ,
sloping (RdC ) , the erosion hazard is slight to moderate and the
runoff is slow to medium. This soil is used for timber and .
urban development.
3 . Vegetation : The site contains several large decidious trees
and a few shrubs .
4 . Wildlife : The site may provide suitable habitat for birds and
small mammals .
5 . Land Use : Proposed lot #1 of the subject site includes two
existing dining establishments , one real estate office and a
store of commercial nature . The remaining proposed lots are
undeveloped . The surrounding area is a combination of various
residential dwellings and commercial uses .

O. PLANNING DEPARTMENT ANALYSIS :
1. The proposal is consistent with the Comprehensive Plan,
zoning, and subdivision regulations.
2. The entire site is zoned B-1 , business . Existing
shopping center and commercial development exists on
parcels 1 and 2 ; parcels 3 and 4 are presently undeveloped.
It is anticipated that Highlands Community Church, located
directly east of Jefferson Avenue N.E. , will purchase lot 4
for future development.
3. Off-site improvements have been installed along Sunset
Boulevard N.E. and Harrington Avenue N.E. as part of
the existing commercial development. Similar improvements
would be more appropriately installed on the remainder of
the site along N.E. 9th Street, N.E. 10th Street, and
Jefferson Avenue N.E. at the time of development of these
parcels. This is primarily because of the. commercial
zoning designation as opposed to a standard residential •
platting situation. Any commercial development would be
subject to the requirements of the Off-site improvement
ordinance. In any event, the standard restrictive
covenants should also be employed if a waiver is granted.

4 . A portion of Jefferson Avenue N.E. near N.E. 10th Street
was recently vacated. It can be reasonably assumed that
the remainder of the street will be vacated at some future
point in time, depending upon future ownerships and
development patterns . Suitable access for most development
appears to be provided along N.E. 9th Street.
5. Suitable utilities are available to the subject site.
6. Utilities Division comments are appropriate for future
development of the site . Storm drainage and utilities
are provided for the existing developed portion of the
site. Such utilities will be required for any future
site development.
7. The Engineering Division comment is .correct in stipulating
Board of Public Works authority for off-site improvement
deferrals. However, the Board can only grant a 1-year
deferral and possibly a 1-year extension. The timetable
for development of the site is. uncertain. The proposed
short plat was only submitted to legalize sale of parcel
no. 2 and 4. Therefore , the Hearing Examiner should
review the subject request and possibly grant an indefinite
deferral until the property is further developed. As
previously stated, this is not the standard residential
plat for which the subdivision ordinance was primarily
designed.
P. PLANNING DEPARTMENT RECOMMENDATION :
Recommend approval of the short plat. Also recommend denial
of full waiver request and instead grant an indefinite
deferral with the filing of restrictive covenants which
require installation of the required improvements at the
time of development of each of the undeveloped parcels.
The required improvements must be installed along any
existing developed portion of the site which does not have
such improvements .

1 . Topography : The site slopes slightly downhill to the southwest .
2 . Soils : Urban Land ( Ur) , the erosion hazard is slight to
moderate . No capability or woodland classification . The' soil
is used for urban development. Ragnar- Indianola Association ,
sloping ( RdC ) , the erosion hazard is slight to moderate and the
runoff is slow to medium. This soil is used for timber and
urban development.
3 . Vegetation : The site contains several large decidious trees
and a few shrubs .
4 . Wildlife : The site may provide suitable habitat for birds and
small mammals .
5 . Land Use : Proposed lot #1 of the subject site includes two
existing dining establishments , one real estate, office and a
store of commercial nature . The remaining proposed lots are
undeveloped . The surrounding area is a combination of various
residential dwellings and commercial uses .
F. NEIGHBORHOOD CHARACTERISTICS :
The area is primarily residential in nature but containing a
significant number, of commercial uses .

1 . Water and Sewer : An existing twelve ( 12 ) inch water main
extends along Harrington Avenue N . E . , a ten ( 10 ) inch main
is located on Sunset Blvd . N . E . , a fourteen ( 14 ) inch main on

on the northeast edge of the property along N . E . loth . Exist-

SUMMARY OF REQUEST: Applicant requests approval of a proposed four (4) lot short
plat, and a waiver of the required off-site improvements.
SUMMARY OF ACTION: Planning Department Recommendation: Approval of the short plat;
Denial of waiver and recommend granting of indefinite deferral
with restrictive covenants.
Hearing Examiner Decision: Approval of the short plat;
Denial of waiver.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on July 6, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on July 11, 1978 at 11:55 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: Short Plat Map
Exhibit #3: Letter to Planning' Department from
A. B. Allper, .dated May 16, 1978,
regarding request for waiver.
Exhibit #3 was read into the record by Mr. Smith. He also indicated additions to Exhibit
#1, Section B.1. , to include Globe Development Company as an owner of record, and to
Section P. , Recommendation, to include a requirement for designation of utilities and
easements on the plat map.
The Examiner asked the representative for the applicant if he concurred in Exhibit #1.
Responding was:

Mr. Humble indicated his concurrence in the report and explained the necessity for '
deferral of off-site improvements until a later date. The Examiner inquired if the
Planning Department recommendation for installation of improvements on Harrington Avenue
N.E. within a one or two year period, pending the outcome of the decision of the Board
of Public Works, would be acceptable to the applicant. Mr. Humble indicated a preference
for indefinite deferral of improvements on that roadway because of conditions of the
purchase and the possibility that improvement of an existing building located on Parcel 1
may not occur within that period.
The Examiner requested clarification of the Planning Department recommendation for.
designation of utility lines and easements on the plat map. Mr. Smith explained, that
although the recommendation from the Utilities Division had not been clarified, the
request ensured that information regarding location of easements would be received. Mr. '
Humble further clarified the departmental recommendation by reviewing location of vacated

streets in which easements and utility lines may not have been surveyed in the past. He
indicated that records designating these locations could be provided. .
The Examiner requested additional comments. Since there were none, the hearing on File
No. Short Plat 188-78 and W-189-78 was closed by the Examiner at 12:15 p.m.
•
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a four-lot short plat and a waiver of off-site
improvements.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
(is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this
report by reference as set forth in full therein. •
3. Pursuant to .the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, found the proposal exempt from the threshold determination and EIS •
requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and lot area
requirements of Section 4-711 (B-1) of Title IV, Ordinance No. 1628, Code of
General Ordinances. •
8. Restrictive covenants were not submitted (Section 9-1105.3.B) .
9. Affidavits were supplied, in the file of record certifying ownership of the property
(Section 9-1106.3.H. (1) ) .
10. All streets are dedicated public streets, except Index Avenue N.E. which was vacated
(Section 9-1106.3.H. (2) ) .
11. Certification by a licensed land surveyor per Section 9-1106.3.H. (3) was not
submitted.
12. Certification by the King County Health and Finance Departments and City of Renton
Finance Department will occur just prior to, at or immediately following filing
the final plat (Sections '9-1106.3.H.4, 7, and 8) .

13. A title insurance statement has not been submitted per Section 9-1106.3.H. (6) .
14. Utilities were provided several years ago (Section 9-1106.3.H. (9) ) .
15. Per Exhibit #3 a waiver was requested per. Section 9-1105.6.B on the basis of:
a. Probable future vacation of Jefferson Avenue N.E.
b. Impending improvements of the property or future .decisions regarding ,.access
points and curb cuts.
Off-site improvements exist along Harrington Avenue N.E. on much of Lot 1 and most, •
if not all, of Lot 2. Non-conforming off-site improvements exist along the west •
side of Harrington Avenue N.E. and the south side of N.E. 9th Street. Off-site
improvements exist on the portion of Lot 1 on Sunset Boulevard N.E.
CONCLUSIONS: •
1. The proposal conforms to the Comprehensive Plan and zoning regulations.
2. Complete certification, except as noted, per Section 9-1106.3.H. must' be provided '.
. prior to approval of the final plat per Section 9-1105.7.

3. Concerning the requested waiver of off-site improvements, existing conditions and
the tesimony did not support the required conditions. Existing improvements do
exist on the property and within a ". . .reasonable distance. . ." (Section 9-1105.6.B) .
It was not claimed that ". . .undue hardship. . ." would be inflicted on the existing
and future property owners (Section 9-1109.1) , only that the timing of the
improvements would be more timely when remodeling occurred on Lot 1. No ". . .
special circumstances. . ." were allged such that the construction (or deferral via
the Board of Public Works) of the improvements would ". . .deprive the applicant of
the reasonable use or development. . ." of the properties (Section 9-1109.1.A) .
Substantial development has already occurred. Infringement of property ". . .rights
and privileges. . ." was not claimed (Section 9-1109.1.B) .
And on'the other side of the issue no testimony purported that the ". . .public
welfare. . ." on other properties would be harmed by not installing the improvements.
(Section 9-1109.1.C) .
The vacation of the southern portion of Jefferson Avenue N.E. was indicated as
probable conjecture, but not definite. Until such time as it is vacated, the .
Examiner must. consider it as the city street it is. Admittedly, the impending
purchase of Lot 4 by the adjacent Highland Community Church may eventually produce
the vacation.
It is reasonable to expect in this situation for improvements to be constructed
within the time frame given the Board of Public Works in review of the deferral
application.
Under these circumstances it appears most appropriate for off-site improvements to
be considered by the Board of Public Works in the deferral process of Section
9-1108.21. The waiver application should be denied for lack of justification under
the existing conditions.
DECISION:
Based upon the record, testimony, findings and conclusions, it is the Examiner's decision
to:
1. Approve the short plat subject to completion of certification per Section 9-1106.3.H.
and showing all existing utility easements on the final plat map.
2. Deny the waiver of off-site improvements.

1 . Topography : The site slopes slightly downhill to the southwest .
2 . Soils : Urban Land (Ur ) , the erosion hazard is slight to
moderate . No capability or woodland classification . The' soil
is used for urban development. Ragnar- Indianola Association ,
sloping ( RdC ) , the erosion hazard is slight to moderate and the
runoff is slow to medium. This soil is used for timber and
urban development.
3 . Vegetation : The site contains several large decidious trees
and a few shrubs .
4 . Wildlife : The site may provide suitable habitat for birds and
small mammals .
5 . Land Use : Proposed lot #1 of the subject site includes two
existing dining establishments , one real estate office and a
store of commercial nature . The remaining proposed lots are
undeveloped . The surrounding area is a combination of various
residential dwellings and commercial uses .
F. NEIGHBORHOOD CHARACTERISTICS :
The area is primarily residential in nature but containing a
significant number of commercial uses .
G. PUBLIC SERVICES :
1 . Water and Sewer : An existing twelve ( 12.) inch water main
extends along Harrington Avenue N . E . , a ten ( 10 ) inch main
is located on Sunset Blvd . N . E . , a fourteen ( 14 ) inch main on

0. PLANNING DEPARTMENT ANALYSIS :
1. The proposal is consistent with the Comprehensive Plan,
zoning, and subdivision regulations .
2. The entire site is zoned B-1 , business. Existing
shopping center and commercial development exists on
parcels 1 and 2; parcels 3 and 4 are presently undeveloped.
It is anticipated that Highlands Community Church, located
directly east of Jefferson Avenue N.E. , will purchase lot 4
for future development.
3. Off-site improvements have been installed along Sunset
Boulevard, N.E. and Harrington Avenue N.E. as part of
the existing commercial development. Similar improvements
would be more appropriately installed on the remainder of
the site along N.E. 9th Street, N.E. 10th Street, and
' Jefferson Avenue N.E. at the time ' of development of these
parcels. This is primarily because of the commercial
zoning designation as opposed to a standard residential
platting situation. Any commercial development would be
subject to the requirements of the off-site improvement ?'
ordinance. In any event, the 'standard restrictive
covenants should also be employed if a, waiver is granted.

4 . A portion of Jefferson Avenue N.E. near N.E. 10th Street
was recently vacated. It can be reasonably assumed that
the remainder of the street will be vacated at some future •
point in time, depending upon future ownerships and
development patterns . :• Suitable access for most development
• appears ' to be provided along N.E. 9th Street.
5,. Suitable utilities are available to the subject site. ' •
6 . Utilities Division comments are appropriate for future •
development of the site. Storm drainage and utilities
are provided for the existing developed portion of the
site. Such utilities will be required for any future
site development.
7. The Engineering Division comment is correct in stipulating
Board of Public Works authority for off-site improvement
deferrals. However, the Board can only grant a 1-year
• deferral and possibly a 1-year extension. The timetable
for development of the site is uncertain. . The proposed •
short plat was only submitted to legalize sale of parcel
no. 2 and 4. Therefore , the Hearing Examiner should
review the subject request and possibly grant an indefinite
deferral until the property is further developed. As
previously stated, this is not the standard residential
plat for which the subdivision ordinance was primarily
designed.
P. PLANNING DEPARTMENT RECOMMENDATION :
Recommend approval of the short plat. Also recommend denial
of full waiver request and instead grant an indefinite
deferral with the filing of restrictive covenants which
require installation of the required improvements at the
time of development of each of the undeveloped parcels .
The required improvements must be installed along any
existing developed portion of the site which does not have
such improvements.
