REPORT AND RECOMMENDATION .
APPLICANT: Bitney Realty (Undsderfer Short Plat) FILE NO. Short Plat 190-78

LOCATION: Located on Cedar Avenue South between South 4th Street and
South 6th Street.
SUMMARY OF REQUEST: Applicant requests approval of a proposed three-lot short plat
and an exception to the Subdivision Ordinance to allow two 50-
foot lots fronting Cedar Avenue South.

SUMMARY OF ACTION: Planning Department Recommendation: Approval.
Hearing Examiner: Approval.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on July 11, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a. public hearing on the subject as
follows:
The hearing was opened on July 18, 1978 at 9:35 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: Short Plat Map
Exhibit #3: Letter to Planning Department from Robert L.
Undsderfer, received June 19, 1978, regarding
request for exception.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Undsderfer indicated his concurrence with the exception of a staff notation contained
in Section 0.6, Planning Department Analysis, of Exhibit #1, which stated that Lot No. 1
must remain as one lot due to the location of an existing house near the center of the
lot. Due to the possibility of the desire to subdivide Lot No. 1 in the near future,
Mr. Undsderfer objected to the restriction of the subdivision. The Examiner noted that
because the statement was contained in the staff analysis and not the final recommendation,
the possibility for future subdivision existed.
The Examiner requested testimony in support of the application. Responding was:

Mrs. Telban read a letter from Kathy Keolker, President of the Renton Hill Community
Association, dated July 17, 1978, which indicated support of the application which would
perpetuate single family residential development in the Renton Hill area in accordance
with the desires of the residents and maintain the existing character of the neighborhood.
The Examiner requested testimony in opposition to the request. There was no response.
He then requested a final recommendation from Mr. Smith. Mr. Smith indicated that the
Planning Department staff report, Exhibit #1, would remain as submitted.

The Examiner requested further comments. Since there were none, the hearing on File No.
Short Plat 190-78 and E-191-78 was closed by the Examiner at 9:45 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a three-lot short plat and exception from the
Subdivision Ordinance minimum lot width requirement.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference
as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, found the proposal to be exempt from the threshold determination and EIS
requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the lot size, area and dimension requirements of
Section 4-706 , (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances.
Section 4-706. (6) requires a 50-foot minimum lot width, but Section 9-1108.23.F. (3) . (c)
(Subdivision Ordinance) requires a 60-foot minimum lot width. The proposal complies
with the zoning criteria but not the Subdivision Ordinance.
8. In the file of record is contained an affidavit attesting to the ownership of the
property (Section 9-1106.3.H, (1) .
9. Access is via existing dedicated public streets (Section 9-1106.3.H. (2) ,
9-1106.3.H. (5) , and 9-1108.23.F. (2) ) .
10. A survey was made by a licensed land surveyor (Section 9-1106.3.H. (3) ) .
11. Certification by the King County Health and Finance Departments and Renton Finance
Department will occur just prior to, at or immediately following filing of the
approved plat with King County (Sections 9-1106.3.H. (4) , (7) and (8) ) .
12. A title insurance policy was not provided per Section 9-1106.3.H. (6) .
13. Bills of sale for utilities were not submitted (Section 9-1106.3.H. (9) ) .
14. Restrictive covenants were not submitted (Section 9-1106.3.H. (10) ) .
15. Several existing lots in the vicinity are of a depth less than the required 60 feet.
The development patterns in the Renton Hill community appear to be of a mixture
of lot sizes, many of which are approximately 50 feet in width.
CONCLUSIONS:
1. The proposal conforms to the Comprehensive Plan,zoning requirements,, character of
the neighborhood, and Subdivision Ordinance with the exception of lot width.
2. The width of the property permits only two 50-foot lots since acquisition of additional
property on either side appears unlikely. Prevention of dividing the property under
these circumstances would ". . .deprive the applicant of the reasonable use or
development of his land. . . " (Section 9-1109.1.A) . It is reasonable to subdivide
this particular property.
3. A short plat of this configuration conforms to the previous subdivision on Renton
Hill whereby property owners have created 50-foot lots (Section 9-1109.1.B) .
4. Detriment or injury to the public welfare or other properties was not evident
(Section 9-1109.1.C) .

DECISION:
Based upon the record, testimony, findings and conclusions, it is the decision of the.
Examiner to approve the short plat (Exhibit #2) and exception to allow 50-foot wide lots.
ORDERED THIS 21st day of July, 1978.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before August 4, 1978. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or -fact, error
in judgment, or the discovery of new evidence which could not be reasonably available
at the prior hearing may make a written request for review by the Examiner within
fourteen (14) days from the date of the Examiner's decision. This request shall set
forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

B. GENERAL INFORMATION:

C. PURPOSE OF REQUEST:
To permit subdivision of the subject site into three single family residence lots
for future development of single family residences. In order to allow such sub-
division, the applicant is also requesting an exception to the Subdivision Ordi-
nance.
D. HISTORY/BACKGROUND:
The subject site was part of the original plat of the City at the time of incor-
poration.
E. PHYSICAL BACKGROUND:
1. Topography: The site rises steeply from west to east at approximately an
18% slope.
2. Soils: Beausite Gravelly Sandy Loam (BeD). Runoff. is very rapid, and the
erosion hazard severe'. This soil is used for timber and pasture.
3. Vegetation: The western portion of the site is dominated by heavy scrub grass
and some small shrubs, while the eastern portion includes a few deciduous and
evergreen trees with the same ground cover.
4. Wildlife: The existing vegetation of the site provides suitable habitat for
small birds and mammals.

5. Water: There is no surface water evident on the site.
6. Land Use: The subject site is presently undeveloped with adjacent land uses
consisting principally of single family residences.
F. NEIGHBORBHOOD CHARACTERISTICS:
The area is primarily single family residential in nature.
G. PUBLIC SERVICES:
1. Water and Sewer: A 6" water main extends north-south along Cedar Avenue
South:and a similar main is situated on South 5th Street. A 24" sanitary
sewer runs along Cedar Avenue south of the subject site, and an 8" sewer
is located on the same street north of the site. Another 8" pipe runs
east-west through the applicant's property, and a 6" pipe extends north-
south through the site.
2. Fire Protection: Provided by the City of Renton Fire Department as per
ordinance requirements.
3. Transit: Metro Transit Route 145 operates along Main Avenue South' to
South Grady Way within 1/4 mile west of the subject site.
4. Schools: The subject site is located approximately 14 miles northeast of
the Talbot Hill Elementary School and 14 miles north of Nelson Middle
• . School, and 1/2 mile southeast of Renton High School .
5. Parks: Phillip Arnold Park is located within 1/2 mile to the southeast
of the subject site and the Cedar River and Liberty Parks are within 1/2
mile to the north*.

Development of the subject site into single family residences will disturb vege-

be mitigated through proper development practices.

Development of the subject site will provide opportunity for increased social
interaction among the area residents.
L. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION:
Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended, RCW 43-21C, the subject proposal is exempt from the
threshold determination and EIS requirements of SEPA.

1. The proposed subdivision for single family residence lots is consistent
with the Comprehensive Plan Land Use Element which designates the site and
area as single family residential .

3. The proposed lots are consistent with the minimum requirements of the R-1
zone and the Subdivision Ordinance except that the proposed width of 50
feet for lots two and three does not meet the minimum 60 foot lot width
requirement of Section 9-1108.23. F.3(C). However, the proposed lots one
and three exceed the minimum lot size (7200 sq. ft..) and depth require-
ments of the Zoning Code and Subdivision Ordinance. (Lot 1=15,000 sq. ft. ;
Lot 2=7500 sq. ft. ; Lot 3=7500 sq. ft..)
•4. Section 4-706(6) of the Zoning Code provides for a minimum lot width of 50
feet. However, the Subdivision Ordinance, for platting.purposes, super-
sedes the Zoning Code in requiring the 60 foot minimum lot width.
5. Existing lots adjacent to the site and along Cedar Avenue South are 50 feet
or smaller in lot width. The granting of an exception will be compatible
to adjacent properties and will not adversely impact such properties. The
increased lot depth and size will serve to mitigate any potential impacts.
6. , Requiring that lots two and three be retained as one lot would create a
larger lot than most existing lots in the area. Lot one must remain as
one lot due to the location of an existing house near the center of the
lot.
7. Existing utilities and improvements are suitable for the proposed subdivi-
sion.
P. STAFF RECOMMENDATION:

analysis.

LOCATION: Located on Cedar Avenue South between South 4th Street and
South 6th Street.
SUMMARY OF REQUEST: Applicant requests approval of a proposed three-lot short plat
and an exception to the Subdivision Ordinance to allow two 50-
foot lots fronting Cedar Avenue South.
SUMMARY OF ACTION: Planning Department Recommendation: Approval.
Hearing Examiner: Approval.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on July 11, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on July 18, 1978 at 9:35 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: Short Plat Map
Exhibit #3: Letter to Planning Department from Robert L.
Undsderfer, received June 19, 1978, regarding
request for exception.
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Undsderfer indicated his concurrence with the exception of a staff notation contained
in Section 0.6, Planning Department Analysis, of Exhibit #1, which stated that Lot No. 1
must remain as one lot due to the location of an existing house near the center of the
lot. Due to the possibility of the desire to subdivide Lot No. 1 in the near future,
Mr. Undsderfer objected to the restriction of the subdivision. The Examiner noted that
because the statement was contained in the staff analysis and not the final recommendation,
the possibility for future subdivision existed.
The Examiner requested testimony in support of the application. Responding was:

Mrs. Telban read a letter from Kathy Keolker, President of the Renton Hill Community
Association, dated July 17, 1978, which indicated support of the application which would
perpetuate single family residential development in the Renton Hill area in accordance
with the desires of the residents and maintain the existing character of the neighborhood.
The Examiner requested testimony in opposition to the request. There was no response.
He then requested a final recommendation from Mr. Smith. Mr. Smith indicated that the
Planning Department staff report, Exhibit 41, would remain as submitted.

The Examiner requested further comments. Since there were none, the hearing on File No.
Short Plat 190-78 and E-191-78 was closed by the Examiner at 9:45 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a three-lot short plat and exception from the
Subdivision Ordinance minimum lot width requirement.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference
as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, found the proposal to be exempt from the threshold determination and EIS
requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the lot size, area and dimension requirements of
Section 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances.
Section 4-706. (6) requires a 50-foot minimum lot width, but Section 9-1108.23.F. (3) . (c)
(Subdivision Ordinance) requires a 60-foot minimum lot width. The proposal complies
with the zoning criteria but not the Subdivision Ordinance.
8. In the file of record is contained an affidavit attesting to the ownership of the
property (Section 9-1106.3.H. (1) .
9. Access is via existing dedicated public streets (Section 9-1106.3.H. (2) ,
9-1106.3.H. (5) , and 9-1108.23.F. (2) ) .
10. A survey was made by a licensed land surveyor (Section 9-1106.3.H. (3) ) .
11. Certification by the King County Health and Finance Departments and Renton Finance
Department will occur just prior to, at or immediately following filing of the
approved plat with King County (Sections 9-1106.3.H. (4) , (7) and (8) ) .
12. A title insurance policy was not provided per Section 9-1106.3.H. (6) .
13. Bills of sale for utilities were not submitted (Section 9-1106.3.H. (9) ) .
14. Restrictive covenants were not submitted (Section 9-1106.3.H. (10) ) .
15. Several existing lots in the vicinity are of a depth less than the required 60 feet.
The development patterns in the Renton Hill community appear to be of a mixture
of lot sizes, many of which are approximately 50 feet in width.
CONCLUSIONS:
1. The proposal conforms to the Comprehensive Plan,zoning requirements, character of
the neighborhood, and Subdivision Ordinance with the exception of lot width.
2. The width of the property permits only two 50-foot lots since acquisition of additional
property on either side appears unlikely. Prevention of dividing the property under
these circumstances would ". . .deprive the applicant of the reasonable use or
development of his land. . . " (Section 9-1109.1.A) . It is reasonable to subdivide
this particular property.
3. A short plat of this configuration conforms to the previous subdivision on Renton
Hill whereby property owners have created 50-foot lots (Section 9-1109.1.B) .
4. Detriment or injury to the public welfare or other properties was not evident
(Section 9-1109.1.C) .

Based upon the record, testimony, findings and conclusions, it is the decision of the
Examiner to approve the short plat (Exhibit #2) and exception to allow 50-foot wide lots. ,
