Clemens , Associate Planner RE : REQUEST. FOR. REVISION OF PLAT Ken Oyler and the property owner ' s representatives met with me on Tuesday , November 28th at about 2 : 30 p . m. They requested that the Planning Department process the revised final short plat for recordation . I reviewed the file and noted that the plat had been revised from the. Hearing Examiner ' s decision . We then discussed the problems that the applicant had noted with the Examiner ' s approved location for the pipestem related to heavy vegetation and physical construction prob- lems . I indicated that Mike Smith had prepared the staff report and , after reviewing the staff report , I discussed with them the background of the staff recommendation , which the Examiner ultimately approved . They indicated that they couldn ' t agree with the approved location and made various arguments in favor of their proposed revised location . We then discussed procedure and alternatives . I indicated that this department had no authority to change the Examiner ' s decision . I indicated that they could request from the Exami - ner an interpretation of his decision ; otherwise a new hearing would be necessary. The meeting lasted approximately 20 minutes , and they stated that they would review the matter with the Hearing Examiner . Expiration Period. If the plat is not filed within one year of the date of sub- mission, the plat shall be null and void. Upon proper application by the sub- divider, the Planning Department may grant one extension of not more than six (6) months. To revitalize any expired plat, it must be resubmitted. (Ord. 2667, 10-4-71;amd. Ord. 2823, 1-21-74,eff. 1-30-74) 9-1106: TENTATIVE, PRELIMINARY AND FINAL PLAT REQUIREMENTS: 1. Tentative Plat Requirements. A., as amended: Proposed Plat, Fee. The application for a Tentative Plat shall be submitted in an original and seven (7) copies to the Planning Department who shall record the date received and assign a file number. The application shall be accompanied by a fee of fifty,dollars ($50.00) plus two dollars ($2.00) per acre. (Ord. 3105, 1-24-77,eff. 1-1-77) B. Referrals,. Recommendations of Departments. The Planning Department shall transmit two (2) copies of the Tentative Plat to the Department of Public Works, one copy to the Traffic Engineering Department, one copy to the Building Department, one copy to the Health Agency, one copy to the Fire Department and copies to other departments and agencies as necessary for their review and recommendation. One copy shall be retained for the use of the Planning Department. These departments and agencies shall make their respective recommendations regarding the Tentative Plat to the Planning Department and to the subdivider. These departments and agencies shall notify the Planning Department when they have approved the Tentative Plat. C. Revisions. The departments and agencies in accordance with their re- sponsibilities cited in Section 9-1106, 1.B. may have the subdivider revise his proposed subdivision to conform to the requirements of this Or- dinance.The departments and agencies may require revision of the proposed subdivision to promote public safety and the general welfare of the City. APPLICANT: Bill Dunn FILE NO. Short Plat 197-78 E-206-78 W-198-78 LOCATION: ' Between State Route 167 and Springbrook Road approximately one-third of a mile south of the intersection of South 26th • Street and Talbot Road.' SUMMARY OF REQUEST: The applicant requests approval of a four-lot short plat and an exception to the Subdivision Ordinance to permit a 20-foot pipestem, together with a waiver of off-site improvements. SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat and exception subject' to conditions; denial of waiver. Hearing Examiner Decision: Approval of short plat and • exception subject to conditions; denial of waiver. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on August 16, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 22, 1978 at 10: 35 a.m. in the Council Chambers of the Renton Municipal Building. The applicant reported delay in receipt and review of the Planning Department report and requested continuance of the public hearing in order to allow receipt of additional supportive data from the consulting civil engineer for the application. The Examiner, the applicant, and the Planning Department representative concurred in establishment of the date of September 5, 1978 for continuance of the public hearing. The meeting was subsequently closed at 10:40 a.m. CONTINUANCE: • • The hearing was opened on September 5, 1978 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed.by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map with topography Exhibit #3: Short Plat Map as submitted Exhibit #4: Letter to Planning Department from Kenneth Oyler, dated July 7, 1978, request for waiver and exception. Exhibit #5: Letter to Planning Department from Kenneth Oyler, dated June 19, 1978, request for waiver. Mr. Smith read departmental comments attached to Exhibit #1 into the record, advising that all comments should be added to the Planning Department recommendation. The Examiner noted an additional attachment to Exhibit #1, revised short plat map. Mr. Smith indicated Short Plat 197-78 Page Two E-206-78, W-198-78 that the map had been revised by Planning Department staff to designate lot lines and proposed location of the pipestem configuration. The Examiner entered the map as follows: Exhibit #6: Short Plat Map as revised by staff The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:. Bill Dunn 8616 116th Avenue S.E. Renton, WA 98055 Mr. Dunn indicated his .concurrence in the report. He explained the necessity for continuance of the previous hearing to a1'low sufficient review of the Planning Department report which had been delayed in mailing. Referencing Section 0.6 of Exhibit #1 regarding requirements for water and sewer lines, Mr. Dunn inquired regarding the necessity for an additional 12-inch water main in addition to two already existing lines. Mr. Smith contacted a representative from the Utilities Division to respond to the inquiry later in the public hearing. Mr. Dunn inquired regarding the extent of off-site improvement requirements. The Examiner explained requirements for curbs, gutters, sidewalks as well as paving of half of Talbot Road and the entire pipestem roadway. Mr. Dunn inquired regarding imposition of the one-cent per square foot charge for water and sewer on the proposed greenbelt area in the westerly portion of the site which cannot be utilized for development. The Examiner advised that the matter would be referred to a representative from the Utilities Division later in the hearing. The Examiner requested testimony in support of the application. There was no response. The Examiner requested testimony in opposition to the application. Responding was: Don Tatro 3211 Talbot Road Renton, WA 98055 Mr. Tatro was affirmed by the Examiner. He reported that he is the adjacent property owner to the south of the subject site. He objected to provision of the pipestem road at the southern boundary of the property referenced in Section 0.5 of Exhibit #1 for the purpose of allowing for potential future roadways if necessary, noting that access through the adjacent property will be provided through the center of the site. Mr. Tatro also objected to granting of a waiver of off-site improvements, noting prior drainage problems in the area. The Examiner requested a representative from the Utilities Division to testify. Responding was: Dick Houghton Utilities Division ' Mr. Houghton was affirmed by the Examiner. Responding to the Examiner's inquiry regarding requirement for installation of an additional 12-inch water main, Mr. Houghton reported that the existing 20-inch water main is strictly a transmission main located in Talbot Road for the purpose of transporting water from Springbrook Dam to Talbot Reservoir. He advised that the existing comprehensive utilities plan requires all developers to extend a water main along the frontage of their property in accordance with fire flow requirements, noting that the city assumes the cost for the difference in oversize to increase the main to a 12-inch capacity. The Examiner inquired if the one-cent per square foot charge for water and sewer would apply to the westerly unuseable portion of the site. Mr. Houghton indicated that only the useable portion of the site would be subject to the charge. Mr. Smith inquired if the applicant had considered the possibility of designating the marsh area as open space classification for tax purposes which could be established on the plat prior to filing with King County. Mr. Dunn indicated that he had been unaware of the possibility, but concurred in Mr. Smith's suggestion. Mr. Smith indicated that he would review the minimum size requirements of the open space classification to assure eligibility for tax relief and review the matter further with the applicant. Regarding Mr. Tatro's testimony relating to waiver of off-site improvements, Mr. Smith clarified that the applicant had concurred in the staff report which recommends the waiver not be approved in accordance with requirements of the Public Works Department that installation of curbs, gutters, and sidewalks along Talbot Road be accomplished, as well as submittal of a drainage plan to alleviate existing drainage problems in the area. Mr. Tatro reiterated previous comments regarding provision of the pipestem road to provide potential access upon development of adjacent properties, noting that access would be provided in alternative locations on the site. ry . . . Short Plat 197-76 Page Three E-206-78, W-198-78 The Examiner questioned Mr. Smith regarding ,the possibility of allowing certain flexibility in the final report on the application to preclude the necessity of conducting a subsequent public hearing to review the dedication of the westerly portion of the property for open space classification: Mr. Smith felt that because the matter had been reviewed and discussed during the public hearing, dedication could be designated on, the plat if the'property were found eligible for tax exemption. He .also advised that subsequent action regarding the matter would occur through a separate procedure and application. • . The .Examiner requested further comments. Since there were none, the hearing on File No.' Short Plat 197-78, E-206-78, and W-198-78 was closed, by the Examiner at. 9.:50 a:m., . • FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the, Examiner now makes and enters the following: FINDINGS: • 1. The request is for approval of a four-lot short plat, a waiver of off-site improvements, ' and an exception to allow one pipestem lot. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and staff recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible official, determined the proposal to be exempt from the threshold determination and • EIS requirements. . . 4. Plans for the proposal have been reviewed by all city departments affected by the . - impact of this development and their comments are contained in Exhibit' #1. • 5. All existing utilities are available and in close proximity. The Utility Division, in conformance with the utilities comprehensive plan, recommended construction of .a 12-inch water rain in Talbot Road S. . Since the applicant only needs an 8-inch water main at his property, the Utility Division will pay for the difference between the two sized lines. . . 6. The proposal- is compatible with the lot area and dimension requirements of Sections 4-729 (G) and 4-706 (R-1) of Title IV, Ordinance. No. 1628, Code of General Ordinances; except that Lots A and B are less than the required 9600 square feet area. Staff testified that minor adjustments (Exhibit #6) could resolve the • deficiency. ' • 7. The official file of record contains an affidavit that Mr. Alix Milonas is the owner of record of the subject property (Section 9-1106. 3.H. (1) ) . In Exhibit #1, staff report, Mr. Bill Dunn was listed as the property owner. 8. A survey of the property by a licensed land surveyor has not been made per Section 9-1106. 3.H. (3) ) . . 9. Required off-site. iMprovements have not been •installed per Section 9-1106.3.H. (5) ) . The applicant expressed agreement, despite the requested waiver, to completing these improvements on Talbot Road S. Off-site improvements are being installed • immediately northeast of the site (across Talbot Road S. ih Victoria Park Division No. 4) and north of the property (west side of Talbot Road S. in Short Plat #054-77) . 10. .A title insurance policy was not provided per. Section 9-1106.3.1I. (6) ) . • 11. Certification by the King County Health' Department and the King County and City of Renton Finance Departments will occur immediately prior to, at or following filing of the final short plat (Sections 9-1106.3.H. (4) ,' (7) and (8) ) . 12. The short plat map. (Exhibit #3) omitted a sanitary sewer easement on the property. 13. Restrictive covenants were not submitted (Section 9-1105.3.B. ) . 14. Staff found (Exhibit #1) that the proposed pipestem (Exhibit #3) presents access problems. Revision of the short plat to feature a, pipestem along the southerly . prolier'ty .line was recommended (Exhibits #1 and #6) . The applicant expressed • agreement to this revision. . Short Plat 197-78 Page Four E-206-78, W-198-78 15. The easterly 70 to 130 feet of proposed Lot D is sufficiently level for a building site. Westerly of this level area is an area of steep slope descending to a level peat bog or swamp area abutting SR-167. These conditions render the westerly approximate 3/4 of Lot D unbuildable or extremely difficult for construction. 16. The applicant indicated that per staff suggestions the possibility of current use taxation or dedicating the swamp area for open space would be pursued. CONCLUSIONS: 1. The proposed short plat conforms to the Comprehensive Plan. As revised by staff, the proposal will conform to the zoning and Subdivision Ordinance requirements, except for pipestem Lot D. 2. Examination of Exhibits #2, 3 and 6 substantiates that dedication of a 50-foot right- of-way for access through the property would serve only the subject property. Natural constraints (Finding No. 17) render only the easterly 1/3 of the site useable for development. The cul-de-sac that would be created by this right-of-way would only serve three lots. This seems less desirable than the proposed pipestem Lot D which would produce less hardship upon the applicant (Section 9-1109.1) in response to the unique natural circumstances of the property (Section 9-1109.1.A) . Other properties in the city have been permitted pipestem lots (Section 9-110.1.B) . Detriment or injury to the public welfare or other properties is not evident (Section 9-1109.1.C) . Therefore, the exception for a pipestem lot should be granted. Staff did not express any problems regarding direct access for the four lots onto Talbot Road South. 3. Sufficient flexibility exists for staff revision of the short plat map to include dedication of open space of the westerly portion of Lot D. Current use taxation would not require this revision. 4. Lots A and B must be revised to incorporate the minimum lot area of 9600 square feet. 5. Certification per Section 9-1106. 3.H. must be completed. 6. Since the applicant agreed to installing the off-site improvements along Talbot Road South the waiver application does not require consideration. The recommended 12-inch sewer line should be considered a part of these improvements. 7. A storm water drainage plan is required per Ordinance No. 3174. This should be submitted for approval by the Public Works Department prior to approval of the final short plat per Section 9-1105.7. 8. The Fire Department recommendation for an access road width (pipestem of Lot D) greater than the 10-foot requirement of Section 9-1108.23.F. (3) . (d) was largely unsupported. In the aforementioned section of the Subdivision Ordinance 10-foot minimum pavement is specified. The testimony did not satisfactorily justify a larger width; however, the Fire Department may have grounds per the Uniform Fire Code to require a larger width. Only the Subdivision Ordinance lies within the jurisdiction of the Examiner. DECISION: Based upon the record, testimony, findings and conclusions, it is the decision of the Examiner to approve a short plat as revised per Exhibit #6 subject to: 1. All lots containing a minimum of 9600 square feet per approval of the Planning Department. 2. Completion of certification per Section 9-1106. 3.H. 3. Installation of off-site improvements and utilities as required and approved by the Public Works Department for conformance with the Subdivision Ordinance. 4. Placement of the sewer easement on the final short plat as required and approved by the Public Works Department. 5. Submission to and approval by the Public Works Department of a storm water drainage system per Ordinance No. 3174. Short Plat 197-78 Page Five E-206-78, W-198-78 Furthermore, it is the decision of the Examiner to approve the requested exception to allow one pipestem lot, subject to conformance with the requirements of Section 9-1108.23.F. (3) . (d) as approved by the Planning Department. The application for waiver of off-site improvements was rendered void by the applicant agreeing to install the improvements. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision.' This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to, the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. Copies of this ordinance are available for inspection in the City Clerk's office, first floor of City Hall, or same may be purchased at cost in said office. KENNETH J. Notice was properly published in the Record Chronicle and posted in three places on or near the site as required by City Ordinance. C. PURPOSE OF REQUEST; To permit subdivision of the subject site into four single family residence lots for future development of single family residences. In order to allow such development, the applicant is also requesting an exception to the Subdivision Ordinance and a waiver. D. HISTORY/BACKGROUND: The subject site was annexed into the City by Ordinance No. 1743 dated April 15, 1959. Topography: The site slopes downward from east to west at approxi- mately a 7.5% grade. 2. Soils: Tukwila muck (Tu); Runoff is ponded, and the erosion hazard is slight. There is a seasonal high water table at or near the surface. If drained, this soils is used for row crops. It is also used for pasture. 3. Vegetation: The site is heavily wooded with native groundcover and shrubs. There are numerous alders and other deciduous trees on site with some evergreens also present. 4. Wildlife: The existing vegetation of the site provides suitable habitat for birds and small mammals. 5. Water: There is no surface water evident on the site. 6. Land Use: The site itself is presently undeveloped. Single family homes are located to the north, south, and east. The western boundary fronts on State Route 167. F. NEIGHBORHOOD CHARACTERISTICS: The area is principally single family residential in nature. G. PUBLIC SERVICES: 1. Water and Sewer: An existing 8-inch sanitary sewer runs north-south through the property approximately 200 feet west of Springbrook Road while a 20-inch watermain extends north-south along Springbrood Road. 2. Fire Protection; Provided by the Renton Fire Department as per. ordinance requirements. 3. Transit: METRO Transit route 150 operates along Springbrook Road adjacent to the subject site. 4. Schools: Talbot Hill Elementary School is located within 2 mile to the north of the subject site and Fred Nelsen Junior High School is situated approximately one mile to the northeast with Lindbergh Senior High School approximately 34 miles to the northeast. 5. Parks: Talbot Hill Park is located approximately 2 mile to the north of the subject site and Philip Arnold Park approximately two miles to the northeast and Tiffany Park within 22 miles to the northeast. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, the subject proposal is exempt from the threshold determination and EIS requirements of SEPA. M. ADDITIONAL INFORMATION: A vicinity map and a site map are attached. N. AGENCIES/DEPARTMENTS CONTACTED: 1.. City of Renton Building Division. 2. City of Renton Engineering Division. 3. City of Renton Traffic Engineering Division. 4. City of Renton Utilities Division. • 5. City of Renton Fire Department. 0. PLANNING DEPARTMENT ANALYSIS: 1. The subject proposal is consistent with the Comprehensive Plan which designates the site and surrounding areas as single family residential . 2. Lot "C" of the proposed short plat exceeds the minimum lot size and dimension requirements of the G-9600 zone and the Subdivision Ordinance. According to the survey, however, lots "A" and "B" do not meet the minimum lot size requirement. Adjustments to the proposed pipestem road location and individual lot lines can be made to attain conformance to the minimum lot size requirement. 3. The proposed short plat is compatible with the adjacent single family residential land use pattern in the area and is a reason- able use of the land. 4. Establishment of a fully dedicated and improved public street to the site would not be reasonable for the subject short plat because of the limited number of lots involved, •the shape of the parcel , the orientation of the existing parcels of land and structures, and majority of the site (parcel D) consisting of undeveloped marshland designated as greenbelt on the Comprehensive Plan. 5. Construction of the pipestem at the proposed location is not desirable given the entrance angle to Lot "D". Various city departments have requested an alternate access and the Fire Department in particular has advised that the proposed access is unacceptable (see attached comments from other departments. ) A more appropriate location for a 20' wide pipestem to parcel D is along the south boundary of the subject site to provide potential for a future street if necessary. 6. ., Sewer is available to the subject site. In addition, an existing sewer easement will need to be shown on the plat as per Utilities Department request. Utilities also advises that water in the ex- isting 8" main is for transmission only and not domestic service. In addition, owners of the proposed lots must pay a fee of one cent (1fl per square foot for water and sewer prior to any excavation or construction. 7. A storm drainage retention/detention plan plus calculations will be required. On-site drainage should be directed to the west. These must be approved by the Public Works Department prior to filing of the plat. (See Public Works Department comments. ) 8. Off-site improvements are required, on Springbrook Road consisting of curb, gutter, sidewalk, paving and storm drainage as per Engi- neering Department comments. 9. Any future structures built on the property shall meet Fire De- partment fire flow requirements and number of fire hydrants to be provided. P. PLANNING DEPARTMENT RECOMMENDATION: Recommend approval of the short plat subject to: 1. Adjusting the lot sizes of lots "A" and "B" to meet the minimum requirements of the G-9600 zone. 2. Final Public Works Department approval of utilities and storm drainage plans. Recommend approval of the exception for pipestem as revised in Planning Department Analysis, item no. 5. It is recommended that an alternative be approved which provides a minimum 20-foot (16-foot paved width) access to parcel D along the south line of the subject site. This will provide better access for emergency vehicles and facilitate future residential development of adjacent properties. (See attached map example. ) Granting of waiver of off-site improvements is not recommended in view of Public Works Department comments as noted in item no. 8 above. SUMMARY OF REQUEST: The applicant requests approval of a four-lot short plat and an exception to the Subdivision Ordinance to permit a 20-foot pipestem, together with a waiver of off-site improvements. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on August 16, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the . Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 22, 1978 at 10: 35 a.m. in the Council Chambers of the Renton Municipal Building. The applicant reported delay in receipt and review of the Planning Department report and requested continuance of the public hearing in order to allow receipt of additional supportive data from the consulting civil engineer for the application. The Examiner, the applicant, and the Planning Department representative concurred in establishment of the date of September 5, 1978 for continuance of the public hearing. The meeting was subsequently closed at 10:40 a.m. CONTINUANCE: The hearing was opened on September 5, 1978 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map with topography Exhibit #3: Short Plat Map as submitted Exhibit #4: Letter to Planning Department from Kenneth Oyler, dated July 7, 1978, request for waiver and exception. Mr. Smith indicated Short Plat 197-78 Page Two E-206-78, W-198-78 that the map had been revised by Planning Department staff to designate lot lines and proposed location of the pipestem configuration. The Examiner entered the map as follows: Exhibit #6: Short Plat Map as revised by staff The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Bill Dunn 8616 116th Avenue S.E. • Renton, WA 98055 Mr.. . Dunn indicated his concurrence in the report. He explained the necessity for continuance of the previous hearing to allow sufficient review of the Planning Department report which had been delayed in mailing. Referencing Section 0.6 of Exhibit #1 regarding requirements for water and sewer lines, Mr. Dunn inquired regarding the necessity for an additional 12-inch water main in addition to two already existing lines. Mr. Smith contacted a representative from the Utilities Division to respond to the inquiry later in the public hearing. Mr. Dunn inquired regarding the extent of- off-site improvement requirements. The Examiner explained requirements for curbs, gutters, sidewalks as well as paving of half of Talbot Road and the entire pipestem roadway. Mr. Dunn inquired regarding imposition of the one-cent per square foot charge for water and sewer on the proposed greenbelt area in the westerly portion of the site which cannot be utilized for development. The Examiner advised that the matter would be referred to a representative from the Utilities Division later in the hearing. • The Examiner requested testimony in support of the application. There was no response. The Examiner requested testimony in opposition to the application. Responding was: • Don Tatro • 3211 Talbot Road Renton, WA 98055 ' ' • Mr. Tatro was affirmed by the Examiner. He reported that he is the adjacent property owner to the south of the subject site. He objected to provision of the pipestem road at. the southern boundary of the property referenced in Section 0.5 of Exhibit #1 for the purpose of allowing for potential future roadways if necessary, noting that access through the adjacent,property will be provided through the center of the site. Mr. Tatro also objected to granting of a waiver of off-site improvements, noting prior drainage problems in.the area. The Examiner requested a representative from the Utilities Division to testify. Responding was: ' Dick Houghton Utilities Division • Mr. Houghton was affirmed by the Examiner. Responding to the Examiner's inquiry regarding requirement for installation of an additional 12-inch water main, Mr. Houghton reported that the existing 20-inch water main is strictly a transmission main located in Talbot Road for the purpose of transporting water from Springbrook Dam to Talbot Reservoir. He advised that the existing comprehensive utilities plan requires all developers to extend a water main along the frontage of their property in accordance with fire flow requirements, noting that the city assumes the cost for the difference in oversize to increase the main . to a 12-inch capacity. The Examiner inquired if the 'one-cent per square foot charge for water and sewer would apply to the westerly unuseable portion of the site. Mr. Houghton indicated that only the useable portion of the site would be subject to the charge. Mr. Smith inquired if the applicant had considered the possibility of designating the marsh area as open space classification for tax purposes which could be established on. the plat prior to filing with King County. Mr. Dunn indicated that he had been' unaware of the possibility, but concurred in Mr. Smith's suggestion. Mr. Smith indicated that he would review the minimum size requirements of the open space classification to assure eligibility for tax relief and review the matter further with the applicant. Regarding Mr. Tatro's testimony relating to waiver of off-site improvements, Mr. Smith clarified that the applicant had concurred in the staff report which recommends the waiver not be approved in accordance with requirements of the Public Works Department that installation of curbs, gutters, and sidewalks along Talbot Road be accomplished, as well as submittal of a drainage plan to alleviate existing drainage problems in the area. Mr. Tatro reiterated previous comments regarding provision of the pipestem road to provide potential access upon development of adjacent properties, noting that access would be provided in alternative' locatibns on the site. • Short Plat 197-78 Page Three E-206-78, W-198-78 The Examiner questioned Mr. Smith regarding the possibility of allowing certain flexibility in the final report on the application to preclude the necessity of conducting a subsequent public hearing to review the dedication of the westerly portion of the property for open space classification. . Mr. Smith felt ,that because the matter had been reviewed and discussed during the public hearing, dedication could be designated on the plat if the property were found eligible for tax exemption. He also advised that subsequent action regarding the matter would occur through a separate procedure and application. The Examiner requested further comments. Since there were none, the hearing on File • No. Short Plat 197-78, E-206-78, and W-198-78 was closed• by the Examiner at 9:50. a.m: FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a four-lot short plat, a waiver of off-site improvements, and an exception to allow one pipestem lot. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and staff recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible official, determined the•proposal to be exempt from the threshold determination and EIS requirements. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and their comments are contained in Exhibit #1. 5. All existing utilities are available and in close proximity. The Utility Division, in conformance with the utilities comprehensive plan, recommended construction of a 12-inch water rain in Talbot Road S. Since the applicant only needs an 8-inch water main at his property, the Utility Division will pay for the difference between the two sized lines. 6. The proposal is compatible with the lot area and dimension requirements of Sections 4-729 (G) and 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances; except that Lots A and B are less than the required 9600 square feet area. Staff testified that minor adjustments (Exhibit #6) could resolve the • deficiency. 7. The official file of record contains an' affidavit that Mr. Alix Milonas is the owner of record of the subject property (Section 9-1106. 3.H. (1) ) . In Exhibit #1, staff report, Mr. Bill Dunn was listed as the property owner. 8. A survey of the property by a licensed land surveyor has not been made per Section 9-1106. 3.H. (3) ) . 9. Required off-site improvements have not been installed per Section 9-1106. 3.H. (5) ) . The applicant expressed agreement, despite the requested waiver, to completing these improvements on Talbot Road S. Off-site improvements are being installed immediately northeast of the site (across Talbot Road S. in Victoria Park Division No. 4) and north of the property (west side of Talbot Road S. in Short Plat #054-77) . 10. A title insurance policy was not provided per Section 9-1106.3.H. (6) ) . 11. Certification by the King County Health Department and the King County and City of Renton Finance Departments will occur immediately prior to, at. or following filing of the final short plat (Sections 9-1106.3.H. (4) , (7) and (8) ) . 12. The short plat map (Exhibit #3) omitted a sanitary sewer easement on the property. 13. Restrictive covenants were not submitted (Section 9-1105.3.B.) . • 14. Staff found (Exhibit #1) that the proposed pipestem (Exhibit #3) presents access problems. Revision of the short plat to feature a pipestem along the southerly property line was recommended (Exhibits #1 and #6) . The applicant expressed agreement to this revision. - . , Short Plat 197-78 Page Four E-206-78, W-198-78 15. The easterly 70 to 130 •feet of proposed Lot D is sufficiently level for a building site. Westerly of this level area is an area of steep slope descending to a level peat bog or swamp area abutting SR-167. These conditions render the westerly approximate 3/4 of Lot D unbuildable or extremely difficult for construction. 16. The applicant indicated that per staff suggestions the possibility of current use taxation or dedicating the swamp area for open space would be pursued. CONCLUSIONS: 1. The proposed short plat conforms to the Comprehensive Plan. As revised by staff, the proposal will conform to the zoning and Subdivision Ordinance requirements, except for pipestem Lot D. 2. Examination of Exhibits #2, 3 and 6 substantiates that dedication of a 50-foot right- of-way for access through the property would serve only the subject property. Natural constraints (Finding No. 17) render only the easterly 1/3 of the site useable for development. The cul-de-sac that would be created by this right-of-way would only serve three lots. This seems less desirable than the proposed pipestem Lot D which would produce less hardship upon the applicant (Section 9-1109.1) in response to the unique natural circumstances of the property (Section 9-1109.1.A) . Other properties in the city have been permitted pipestem lots (Section 9-110.1.B) . Detriment or injury to the public welfare or other properties is not evident (Section 9-1109.1.C) . Therefore, the exception for a pipestem lot should be granted. Staff did not express any problems regarding direct access for the four lots onto Talbot Road South. 3. Sufficient flexibility exists for staff revision of the short plat map to include dedication of open space of the westerly portion of Lot D. Current use taxation would not require this revision. 4. Lots A and B must be revised to incorporate the minimum lot area of 9600 square feet. 5. Certification per Section 9-1106.3.H. must be completed. 6. Since the applicant agreed to installing the off-site improvements along Talbot Road South the waiver application does not require consideration. The recommended 12-inch sewer line should be considered a part of these improvements. 7. A storm water drainage plan is required per Ordinance No. 3174. This should be submitted for approval by the Public Works Department prior to approval of the final short plat per Section 9-1105.7. 8. The Fire Department recommendation for an access road width (pipestem of Lot D) greater than the 10-foot requirement of Section 9-1108.23.F. (3) . (d) was largely unsupported. In the aforementioned section of the Subdivision Ordinance 10-foot minimum pavement is specified. The testimony did not satisfactorily justify a larger width; however, the Fire Department may have grounds per the Uniform Fire Code to require a larger width. Only the Subdivision Ordinance lies within the jurisdiction of the Examiner. DECISION: Based upon the record, testimony, findings and conclusions, it is the decision of the Examiner to approve a short plat as revised per Exhibit #6 subject to: 1. All lots containing a minimum of 9600 square feet per approval of the Planning Department. 2. Completion of certification per Section 9-1106.3.H. 3. Installation of off-site improvements and utilities as required and approved by the Public Works Department for conformance with the Subdivision Ordinance. 4. Placement of the sewer easement on the final short plat as required and approved by the Public Works Department. 5. SUMMARY OF REQUEST: The applicant requests approval of a four-lot short plat and an exception to the Subdivision ordinance to permit a 20-foot pipestem, together with a waiver of off-site improvements. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on August 16, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 22, 1978 at 10:35 a.m. in the Council Chambers of the Renton Municipal Building. The applicant reported delay in receipt and review of the Planning Department report and requested continuance of the public hearing in order to allow wipt of additional supportive data from the consulting civil engineer for the application. The Examiner, the applicant, and the Planning Department representative concurred in establishment of the date of September 5, 1978 for continuance of the public hearing. The meeting was subsequently closed at 10:40 a.m. CONTINUANCE:. The hearing was opened on September 5, 1978 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. The Examiner entered the map as follows: Exhibit #6: Short Plat Map as revised by staff The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Bill Dunn • 8616 116th Avenue S.E. Renton, WA 98055 Mr,. Dunn indicated his concurrence in the report. He explained the necessity for continuance of the previous hearing to allow.sufficient review of the Planning Department • report which 'had been delayed in mailing.' Referencing Section 0.6 of.Exhibit #1 regarding requirements'for water and sewer lines, Mr. Dunn inquired regarding the necessity for an additional 12-inch water main in addition to two already existing lines. Mr. Smith contacted a representative from the Utilities Division to respond to the inquiry later in the public' hearing. Mr. Dunn inquired regarding the extent of off-site improvement • requirements. . The Examiner explained requirements for curbs, gutters, sidewalks as well as paving of half of Talbot Road and the entire pipestem roadway. Mr. Dunn inquired regarding.imposition of the one-cent per square foot charge for water and sewer on .the proposed greenbelt area in the westerly portion of the site which cannot be utilized for 'development. The Examiner advised that the matter would be referred to a representative from the Utilities Division later in the hearing. The Examiner requested testimony in support of the application. There was no response. The Examiner requested testimony in opposition to the application. Responding was: Don Tatro • 3211 Talbot Road Renton, WA 98055 • Mr. Tatro was affirmed by the Examiner. He reported that he is the adjacent property .owner to the south of the 'subject site. He objected to provision of the pipestem road •at the southern boundary of the property referenced in Section 0.5 of Exhibit #1 for the the of purposefor potential future roadways if necessary, noting that'access through f# adjacent property will be provided through the center of the site. Mr. Tatro also objected to granting of a waiver of off-site improvements, noting prior drainage problems in the area. The Examiner requested a representative from the Utilities Division to testify. Responding was: Dick Houghton • Utilities Division Mr. Houghton was affirmed by the Examiner. Responding to the Examiner's inquiry regarding requirement for installation of an additional 12-inch water main, Mr. Houghton reported that the existing, 20-inch water main is strictly a transmission main located in Talbot Road for the purpose of transporting water from Springbrook Dam to Talbot Reservoir. He advised that the, existing comprehensive utilities plan requires all developers to extend a water main along the frontage of their property in accordance with fire flow requirements, noting that the city assumes the cost for the difference in oversize to increase the main to a 12-inch capacity. The Examiner inquired if the one-cent per square foot charge for.water and sewer would , apply to the westerly unuseable portion of the site. Mr. Houghton indicated that only, the useable portion of the site would be subject to the charge. Mr. Smith inquired if the applicant had considered the possibility of designating the marsh area as open space classification for tax purposes which could be established on the plat prior to filing „with King County. Mr. Dunn indicated that he had been unaware of the possibility, but concurred in Mr.. Smith's suggestion. Mr. Smith indicated that he would review the minimum size requirements of the open space classification to assure eligibility for tax relief and review the matter further with the applicant. Regarding Mr. Tatro's testimony relating to waiver of off-site improvements, Mr. .Smith clarified that the applicant had concurred in the staff report which recommends the waiver not be approved in accordance with requirements of the Public Works Department that installation of curbs, gutters, and sidewalks along Talbot Road be accomplished, as well as submittal of a drainage plan to alleviate existing drainage problems in the area. Mr.Tatro reiterated previous comments regarding provision of the pipestem road to provide f,potential'access upon development of adjacent properties, noting that access would be provided in alternative locations on the site. Short Plat 197-in Page Three ' E-206-78, W-198-78 It The Examiner questioned Mr. Smith regarding the possibility of allowing certain flexibility in the final report on the application to preclude the necessity of conducting a subsequent public• hearing to review the dedication of the westerly portion of the property for open space classification. Mr. Smith felt that because the matter had been reviewed and discussed during the public hearing, dedication could be designated on the plat.if the property were found eligible for tax exemption. He also advised that subsequent action regarding the matter would occur through a separate procedure and application. The Examiner requested further comments. Since there were none, the hearing on File No. Short Plat 197-78, E-206-78, and W-198-78 was closed by the Examiner at 9:50 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: ' 1. The request is for approval of a four-lot short plat, a waiver of off-site improvements, and.an exception to allow one pipestem lot. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions,. findings of fact, and staff recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C., Gordon Y. Ericksen, responsible official, determined the proposal to be exempt from the threshold determination and EIS requirements. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and their comments are contained in Exhibit #1. 5. All existing utilities are available and in close proximity. The Utility Division, in conformance with the utilities comprehensive plan, recommended construction of a 12-inch water main in Talbot Road S. Since the applicant only needs an 8-inch water main at his property, the Utility Division will pay for the difference between the two sized lines. 6. The proposal is compatible with the lot area and dimension requirements of Sections 4-729 (G) and 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of General Ordinances; except that Lots A and B are less than the required 9600 square feet area. Staff testified that minor adjustments (Exhibit #6) could resolve the deficiency. 7. The official file of record contains an affidavit.that Mr. Alix Milonas is the owner of record of the subject property (Section 9-1106.3.H.(1)). In Exhibit #1, staff report, Mr. Bill Dunn was listed as the property owner. 8. A survey of the property by a licensed land surveyor has not been made per Section, 9-1106.3.H. (3)). 9. Required off-site improvements have not been installed per Section 9-1106.3.H.(5)). The applicant expressed agreement, despite the requested waiver, to completing these improvements on Talbot Road S. Off-site improvements are being installed immediately northeast of the site (across Talbot Road S. in Victoria Park Division No. 4) and north of the property (west side of Talbot Road S.' in Short Plat #054-77). 10. A title insurance policy was not provided per Section 9-1106.3.H.(6)). 11. Certification by the King County Health Department and the King County and City of Renton Finance Departments will occur immediately prior to, at or following filing of the final short plat (Sections 9-1106.3.H.(4), (7) and (8)). 12. The short plat map (Exhibit #3) omitted a sanitary sewer easement on the property. 13. Restrictive covenants were not submitted (Section 9-1105.3.B.). 14. Staff found (Exhibit #1) that the proposed pipestem (Exhibit #3) presents access J. problems. Revision of the short plat to feature a pipestem along the southerly property line was recommended (Exhibits #1 and #6). The applicant. expressed agreement to this revision. Short Plat 197-78 Page Four E-206-78, W-198-78 15. The easterly 70 to 130 feet of proposed Lot D is sufficiently.level for a building site. Westerly of this level area is an area of steep slope descending to a level peat bog or swamp area abutting SR-167. These conditions render the westerly . approximate-3/4 of Lot D unbuildable or extremely difficult for construction. 16. The applicant indicated that per staff suggestions the possibility of current use taxation or dedicating the swamp area for open space would be pursued. • CONCLUSIONS: • 1. The proposed short plat conforms to the Comprehensive Plan. As revised by staff, • the proposal will conform to the zoning and Subdivision Ordinance requirements, except for pipestem Lot D. • • 2. Examination of Exhibits #2, 3 and 6 substantiates that dedication of a 50-foot right- of-way for access through the property would serve only the subject property. ' Natural constraints (Finding No. 17) render only the easterly'1/3 of the site useable for development. The cul-de-sac that would be created by this right-of-way • would only serve three lots. This seems less desirable than the proposed pipestem Lot D which would produce less hardship upon the applicant (Section 9-1109.1) in • response to the.unique natural circumstances of the property (Section 9-1109.1.A). Other properties in the city have been permitted pipestem lots (Section 9-110.1.B). Detriment or injury to the public welfare or other properties is not evident (Section 9-1109.1.C). Therefore, the exception for a pipestem lot should be granted. Staff did not express any problems regarding direct access for the four lots onto Talbot'Road South. ' 3. Sufficient flexibility exists for staff revision of the short plat map to include . dedication of open space of the westerly portion of Lot D. Current use taxation would not require this revision. . 4. Lots A and B must be revised to incorporate the minimum lot area of 9600 square feet. .5. Certification per Section 9-1106.3.H. must be completed. • 6. Since the applicant agreed to installing the off-site improvements along Talbot Road South the waiver application does not require consideration. The recommended 12-inch sewer line should be considered a part of these improvements. • 7. A storm water drainage plan is required per Ordinance No. 3174. This should be ' submitted for approval by the Public Works Department prior to approval of the final short plat per Section 9-1105.7. 8. The Fire Department recommendation for an access road width (pipestem of Lot D) greater than the 10-foot requirement of Section 9-1108.23.F.(3).(d) was largely unsupported. In the aforementioned section of the Subdivision Ordinance 10-foot minimum pavement is specified. The testimony did not satisfactorily justify a larger,width; however, the Fire Department may have grounds per the Uniform Fire Code to require a larger width. Only the Subdivision Ordinance lies within the jurisdiction of the Examiner. DECISION: Based Upon the record, testimony, findings and conclusions, it is the decision of the Examiner to approve a short plat as revised per Exhibit #6 subject to: • 1. All lots containing a' minimum of 9600 square feet per approval of the Planning Department. 2. Completion of certification per Section 9-1106.3.H. 3. Installation of off-site improvements and utilities as required and approved by the Public Works Department for conformance with the Subdivision Ordinance. 4. Placement of the sewer easement on the final short plat as required and approved by the Public Works Department. • • 5. Submission to and approval by the Public Works Department of a storm water drainage system per Ordinance No. 3174. J' Short Plat 197-ia Page Five E-206-78, W-198-78 .s Furthermore, it is the decision of the Examiner to approve the requested exception to allow one pipestem lot, subject to conformance with the requirements of Section 9-1108.23.F.(3).(d) as approved by the Planning Department.
