Pursuant to our telephone conversation of November 20 ,
1978 , you will find enclosed check No. - 1688 on the
account of J. Robert Walker, Attorney at Law, in the '
sum of $25 . 00, payable to the 'City of Renton, being
the filing fee for recording Short Plats , per your
letter of November 3, 1978 .
At this point, it appears that the 'only matter to be
resolved is that of off-site improvements . We have
contacted Mr. Dick Houghton of the Engineering Department
in that respect , and are awaiting figures on the estimated
costs of such improvements , and the sum of the performance
bond that will be required in this instance.

Dear Dr . Brain :
The subject short plat was approved by the Hearing Exmainer
subject to restrictive convenants on September 20 , 1978, and
we have yet to receive the short plat mylar and eight copies
for filing with King County. We would appreciate your submitting
these documents as soon as possible , so we may clear our files .
The procedure for recordation of short plats has been revised
recently , and we must charge an additional $25. 00 fee for that
recording process . Please remit that amount at such time as you
are ready to record your plat documents .

10. Expiration Period. If the plat is not filed within one year of the date of sub-
mission. the plat shall be null and void. Upon proper application by the sub-
divider, the Planning Department may grant one extension of not more than
six (6) months. To revitalize any expired plat, it must be resubmitted. (Ord.
2667, 10-4-71;arnd. Ord. 2823, 1-21-74,eff. 1-30-74)
9-1106: TENTATIVE, PRELIMINARY AND FINAL PLAT REOUIREMENTS:
1. Tentative Plat Requirements.
A., as amended: Proposed Plat, Fee. The application . for a Tentative Plat shall
be submitted in an original and seven (7) copies to the Planning Department
who shall record the date received and assign a file number. The application
shall be accompanied by a fee of fifty dollars ($50.00) plus two dollars ($2.00)
per acre. (Ord. 3105, 1-24-77,eff. 1-1-77)
B. Referrals, Recommendations of Departments. The Planning Department
shall transmit two (2) copies of the Tentative Plat to the Department of Public
Works, one copy to the Traffic Engineering Department, one copy to the
Building Department, one copy to the Health Agency, one copy to the Fire
Department and copies to other departments and agencies as necessary for
their review and recommendation. One copy shall be retained for the use of
the Planning Department. These departments and agencies shall make their
respective recommendations regarding the Tentative Plat to the Planning
Department and to the subdivider. These departments and agencies shall
notify the Planning Department when they have approved the Tentative
Plat.
C. Revisions. The departments and agencies in accordance with their re-
sponsibilities cited in Section 9-1 106, 1.B. may have the subdivider
revise his proposed subdivision to conform to the requirements of this Or-
dinance.The departments and agencies may require revision of the proposed
subdivision to promote public safety and the general welfare .of the City.
D. Approval Period. Tentative Plats shall be approved or disapproved within
six (6) months from the date of submission. Upon proper application, the
Planning Department may grant one extension of not more than three (3)
months.
E. Expiration Period. The approval of the Tentative Plat shall lapse unless
a Preliminary Plat based upon the Tentative Plat is submitted within six (6)
months from the date of approval by all the departments cited in Section
9-1106, 1.B.

(6) It seller's title to said real estate is subject to an existing contract or contracts under which seller is purchasing said real estate,
or any mortgage or other obligation,which seller is to pay, seller agrees to make such payments in accordance with the terms thereof, and
upon default,the purchaser shall have the right to make any payments necessary to remove the default, and any payments so made shall
be applied to the payments next falling due the seller under this contract.
(7) The seller agrees, upon receiving full payment of the purchase price and interest in the manner above specified, to execute and

condition or agreement hereof or to make any payment required hereunder promptly at the time and in the manner herein required, the
seller may elect to declare all the purchaser's rights hereunder terminated, and upon his doing so, all payments made by the purchaser
hereunder and all improvements placed upon the real estate shall be forfeited to the seller as liquidated damages, and the seller shall
have right to re-enter and take possession of the real estate; and no waiver by the seller of any default on the part of the purchaser shall
be construed as a waiver of any subsequent default.
Service upon purchaser of all demands, notices or other papers with respect to forfeiture and termination of purchaser's rights may be
made by United States Mail, postage pre-paid, return receipt requested, directed to the purchaser at his address last known to the seller.
(11) Upon seller's election to bring suit to enforce any covenant of this contract, including suit to collect any payment required
hereunder,the purchaser agrees to pay a reasonable sum as attorney's fees and all costs and expenses in connection with such suit, which
sums shall be included in any judgment or decree entered in such suit.
If the seller shall bring suit to procure an adjudication of the termination of the purchaser's rights hereunder, and judgment is so
entered, the purchaser agrees to pay'a reasonable sum as attorney's fees and all costs and expenses in connection with such suit, and also

the clinic which show the Medical Clinic to have been constructed
in 1952 and finished in 1958 .

The hearing was opened on September 5, 1978 at 9:50 a.m.- in the Council Chambers .of the
Renton Municipal Building.
Michael Smith, Planning Department, reported that due to a technicality in acquisition
of all pertinent data included in the application, continuance of the hearing for one
week was requested. The Examiner subsequently continued the bearing to September 12,
1978 at 9:00 a.m. The hearing was closed at 9:55 a.m.
CONTINUANCE, SEPTEMBER 12, 1978:
The hearing was opened on September 12, 1978 at 9:20 a.m. in the Council Chambers of the
Renton Municipal Building. .
The Examiner inquired if all pertinent. information had been submitted to enable review
Of. the application. Mr. Smith reported that the information had not been received to
date. The Examiner inquired .if the applicant's representative was amenable to
continuance of the public hearing for one week. 'The representative indicated his • •
concurrence. The Examiner subsequently continued the public hearing to September 19,
1978 at 9:00 a.m. The hearing was closed at 9:25 a.m.
CONTINUANCE, SEPTEMBER 19, 1978: •

Parties wishing to testify were affirmed by the Examiner.

It was reported that the ,Hearing Examiner and the representative for the applicant had
received and reviewed the. Planning Department report, and the report was entered into
the record as Exhibit #1.

Dave Clemens, Planning Department, reviewed Exhibit #1, and entered the following

regarding off-site improvements.
.The Examiner inquired if all pertinent information had been received to complete the
application file. Mr. Clemens indicated that all material had been received, including .
an affidavit of ownership for the property.
The Examiner asked the representative for the applicant if he concurred in Exhibit #1.
Responding was:

Mr. Pain, legal counsel for Public Hospital District No. 1, indicated his concurrence in
the Planning Department report, Exhibit #1, and the proposed restrictive covenants and
recommendations contained in Exhibit #4.
The Examiner requested testimony in support or opposition to the request. There was no
response. Referencing Section 0.3 of Exhibit #1, which states that the proposed short
plat will allow the hospital .to purchase the approximate northerly 290 feet of Parcel C
from Dr. Brain for future expansion, the Examiner requested clarification of the location
of the property. Mr. Clemens designated the location of the northern 290 feet of Parcel
C on Exhibit #2. The Examiner inquired if the existing wooded ravine is designated
precisely on Exhibit #3'. Mr. Clemens reported that although the location is approximated
on the map, the ravine extends through Parcel A and from 75 to 100 feet of the extreme
northern end of Parcel C.
The Examiner requested further comments. Since there were none, the hearing on File No.
Short Plat 213-78 was closed by the Examiner at 9:22 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a three-lot short plat.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report
by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, has determined that the proposal is exempt from the threshold determination
and EIS requirements.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and their comments are contained in Exhibits #1, 4 & 5.
5. There was no opposition' to the proposal expressed.
6. All existing utilities are available and in close proximity. Per Exhibit #5, the
Public Works Department requested water and sewer easements on the property.
7. The proposal appears compatible with the required setbacks of Section 4-710.5 (P-1)
of Title IV, Ordinance No. 1628, Code of General Ordinances (Exhibit #1) .
8. The file of record contains two affidavits attesting to ownership of the property
(Section 9-1106.3.H. (1) ) .
9. The record did not contain certification that a licensed land. surveyor had completed
a survey of the property per Section 9-1106.3.H. (3) .

10. Off-site improvements that have not already been installed are required and have not
been deferred or waived (Section 9-1106.3.H. (5) ) .
11. A title insurance policy was not submitted per Section 9-1106.3.H. (6) .
12. Certification by the King County Health Department and the King County and City of
Renton Finance Departments will occur just prior to, at or immediately following
filing of the final short plat with King County (Sections 9-1106.3.H. (4) , (7) and
(8) ) .
13. Restrictive covenants were not submitted by the applicant per Section 9-1105.3.B.
14. Each. lot in the short plat contains over 35,000 square feet; therefore, the proposal
does not require a storm drainage plan (Section VI, Ordinance No. 3174 - Renton
Storm and Surface Water Drainage Ordinance) .
15. A wooded ravine exists along the northerly approximate 75 to 100 feet of the property.
16. The Valley General Hospital and a medical clinic exists on Lot C. Lots A and B
are undeveloped.
CONCLUSIONS:
1. The proposed short plat conforms to the Comprehensive Plan and zoning requirements.
2. Of principal concern to staff is the natural ravine at the northern perimeter• of the
site. Attached to Exhibits #1 and #4 were pertinent excerpts from the restrictive
covenants previously imposed upon the northerly abutting property (Site Plan
Approval No. 092-77, Exhibit #4, Vallis Investors) . These covenants were imposed
as the result of rezoning the property to P-1 (Ordinance No. 2944) and essentially
required preservation of the natural ravine by control of clearing, grading and
building in that area. Such covenants have not been imposed upon the property
currently under review, but the applicant agreed to the same restrictions upon the
subject property.
It is appropriate that this steep and wooded ravine be protected (Objective No. 2,
page 17, Comprehensive Flan, Land Use Report, July, 1965, and Section 9-1108.19.B) .
Structures should not be constructed in the ravine area and the existing vegetation
should be retained. Compliance with these can be reviewed by the Examiner in review
per Section 4-710 of the site plan for development abutting the ravine.
3. Certification per Section 9-1106.3.H must be completed.
4. The Public Works Department request (Exhibit #5) for water and sewer easements on
the property appears to relate to future use of the property, not necessarily the
short plat. Development proposals were not discussed in the public hearing. At
this time it is unreasonable to require beyond the normal compliance with applicable
city ordinances and regulations relative to installation of water and sewer services
to the three lots and development upon each lot. Justification for additional
requirements was lacking.
DECISION:
Based upon the testimony, record, findings and conclusions, it is the decision of the
Examiner to approve the requested short plat (Exhibit #3) subject to:
1. Completion of certification per Section 9-1106.3.H per approval of the Planning
Department.
2. Completion of off-site improvements per approval of the Public Works Department, and
3. Restrictive covenants stipulating that. structures are not to be constructed or
clearing or grading occur in the existing ravine along the northerly portion of the
property except as approved by the Examiner.

2. Soils: Alderwood (AgC). Permeability is moderately rapid in the
surface layer and subsoil . Runoff is slow to medium, and the erosion
hazard is moderate. This soil is used for timber, pasture, row crops,
and urban development.
3. Vegetation: The site is dominated by developed lawn grass with scat-
tered stands of young growth deciduous trees.
4. Wildlife: Existing vegetation on the site may provide suitable habi-
tat for birds and small mammals,
5. Water: There is no surface water evident on the site. However, a
drainage ditch extends from east to west in the northerly 1/3 of the
property.
6. Land Use: In the middle and southern portions of the property is
located the Valley General Hospital , At the northeastern corner if
situated a dental clinic. State Route 167 is adjacent to the western
boundary line and an existing single family residence is located on
the property adjacent to the north.
F. NEIGHBORHOOD CHARACTERISTICS:
Containing a regional hospital , the area is primarily a medical-dental
complex of related professional uses.
G. PUBLIC SERVICES:
1. Water and Sewer: An existing 10-inch watermain extends north-south
from the northeast corner of the property for a distance of approxi-
mately 450 feet along Talbot Road South at which point.a 16-inch
main begins and continues the length of the property to the inter-
section of S.W. 43rd Street. A second 16-inch main extends east-west
on S.W. 43rd Street. From the northeast corner of the property, an
8-inch sanitary sewer runs south on Talbot Road South for approxi-
mately 450 feet, A 12-inch sewer extends south from the northwest
corner a distance of approximately 400 feet along the western bound-
ary line.
2. Fire Protection: Provided by the Renton Fire Department as per
ordinance requirements.
3. Transit: METRO Transit Route 150 operates along Talbot Road South
adjacent to the eastern boundary of the subject property.
4. Schools: Talbot Hill Elementary School is located approximately one
mile north of the subject site with Fred Nelsen Junior High School
located within 11/2 miles to the northeast and Lindbergh Senior High
School situated slightly over 2 3/4 miles to the northeast.
5. Parks: Talbot Hill Park is located within 14 miles to the north of
the subject site while Phillip Arnold and Tiffany Parks are approxi-
mately 3 miles to the northeast.

A technicality between the Valley General Hospital and Dr. Brain has
arisen; both parties have requested that the hearing be continued for
one week to resolve the situation. However, if and when such situation
is resolved, the staff will recommend approval of the short plat based
on the above analysis subject to completion of necessary requirements
and certifications per the subdivision ordinance prior to :filing of the
plat, together with the provision of restrictive covenants which will
preserve the existing wooded ravine and stream, similar to those at-
tached on other property north of the site.

Purusant to the City of Renton's Environmental Ordinance and the State
Environmental Policy Act of 1971, as amended, RCW 43-21C, the subject
proposal is exempt from the threshold determination and EIS requirements
of SEPA.

0. PLANNING DEPARTMENT ANALYSIS:
1. The subject short plat request is consistent with the Comprehensive
Plan and P-1 zoning of the site and general area.
2. The proposed lots conform to zoning and subdivision ordinance stan-
dards.
3. The subject ,property originally consisted of three parcels of property
together with the existing hospital property to the south.. The pro-
posed short plat will allow, the hospital property to purchase approxi-
mately the northerly 290 feet of parcel "C" from Dr. Brain for future
' expansion. 'Parcels A and B will be retained .by 'Dr. Brain for, future
clinic development.
4. Off-site improvements have been installed along Springbrook Road
(Talbot Road) to within approximately 150 feet of the north property
line of parcel A. Improvements will be required along the remaining
frontage of the site to the north property line. (See Engineering
Division comments. )
5. Certain utilities will also require extension. (See Utility Division
comments. )
6. ' Fire Department has also submitted comments attached and made a part
of this report.
7. An existing natural wooded ravine is located along the northerly
portion of the subject site. The adjacent property to the north also
extends into this ravine and covenants have been established as part
of development of the adjacent property which preserve and protect
the ravine from development encroachment. Similar covenants should
be established for the subject site and filed with the short plat.
Section 9-1108.19.B pertains. to such preservations. (See attached
example from adjacent, property. )

main begins and continues the length of the property to the inter-
section of S.W. 43rd Street. A second 16-inch main extends east-west
on S.W. 43rd Street. From the northeast corner of the property, an
8-inch sanitary sewer runs south on Talbot Road South for approxi-
mately 450 feet. A 12-inch sewer extends south from the northwest
corner a distance of approximately 400 feet along the western bound-
ary line.
2. Fire Protection: Provided by the Renton Fire Department as per
ordinance requirements.
3. Transit: METRO Transit Route 150 operates along Talbot Road South
adjacent to the eastern boundary of the subject property.
4. Schools: Talbot Hill Elementary School is located approximately one
mile north of the subject site with Fred Nelsen Junior High School
located within 1' miles to the northeast and Lindbergh Senior High
School situated slightly over 2 3/4 miles to the northeast.
5. Parks: Talbot Hill Park is located within 14 miles to the north of
the subject site while Phillip Arnold and Tiffany Parks are approxi-
mately 3 miles to the northeast.

Purusant to the City of Renton 's Environmental Ordinance and the State
Environmental Policy Act of 1971 , as amended, RCW 43-21C, the subject
proposal is exempt from the threshold determination and EIS requirements
of SEPA.

0. PLANNING DEPARTMENT ANALYSIS:
1. The subject short plat request is consistent with the Comprehensive
Plan and P-1 zoning of the site and general area.
2. The proposed lots conform to zoning and subdivision ordinance stan-
dards.
3. The subject property originally consisted of three parcels of property
together with the existing hospital property to the south. The pro-
posed short plat will allow the hospital property to purchase approxi-
mately the northerly 290 feet of parcel "C" from Dr.. Brain for future
expansion. Parcels A and B will be retained by Dr. Brain for future .
clinic development.
4. Off-site improvements have been installed along Springbrook Road
(Talbot Road) to within approximately 150 feet of the north property
line of parcel A. Improvements will be required along the remaining
frontage of the site to the north property line. (See Engineering
Division comments. )
5. Certain utilities will also require extension. (See Utility Division
comments. )
6. Fire Department has also submitted comments attached and made a part
of this report. '
7. An existing natural wooded ravine is located along the northerly
portion of the subject site. The adjacent property to the north also
extends into this ravine and covenants have been established as part
of development of the adjacent property which preserve; and protect
the ravine from development encroachment. Similar covenants should
be established for the subject site and filed with the short plat.
Section 9-1108.19.B pertains to such preservations. (See attached
example from adjacent. property. )

A technicality between the Valley General Hospital and Dr. Brain has
arisen; both parties have requested that the hearing be continued for
one week to resolve the situation. However, if and when such situation
is resolved, the staff will recommend approval of the short plat based
on the above analysis subject to completion of necessary requirements .
and certifications per the subdivision ordinance prior to filing of the
plat, together with the provision of restrictive covenants which will
preserve the existing wooded ravine and stream, similar to those at-
tached on other property north of the site.

This matter has been continued from Hearing Examiner ' s
public hearings on September 5 and 12, 1978 in order to
receive additional documentation on this matter. The
Planning Department has received the additional documents
that are required to allow action on this matter to commence.
Therefore, the Planning Department' s recommendation on this
Short Plat application, #213-78 is as follows:
1) Approval of the short plat based upon the
Planning Department's analysis contained in
the staff report for the meeting of September 5,
subject to completion of necessary requirements
and certifications per. the Subdivision Ordinance
prior to filing of the plat.
2) Compliance with those special conditions recom-
mended to the Hearing Examiner contained in the
memorandum dated September 12, from the Public
Works Director
3) Subject to restrictive covenants which will
preserve the existing wooded ravine and stream,
similar to those attached on the following page.

Subject : Valley General Hospital Short Plat

We have met with Mr. Bill Murray and Mr . Larry Ward of
the hospital administration to discuss the matter of
water and sewer facilities to serve that short plat and
the general area.
Off-site improvements including curbs , gutters , sidewalks
and storm drains would be a standard requirement on the
Talbot Road frontage . The additional water and sewer
facilities to serve the hospital expansion will be the
subject of further design and agreement with the hospi-
tal. It is therefore recommended that, as a condition
of approval of the preliminary plat , appropriate ease-
ments for water and sewer facilities be granted and delin-
eated as a part of the final short plat .

Re: Short-Platting of Brain Property
Dear Mr. Erickson:
Our Board of Commissioners has approved the hospital joining
in the short-platting, with Dr. Lwai, of the Brain property,
basically because it is our intent to purchase from Dr. Lwai
the Brain property he presently has a contract to acquire.
In the submittal of this short-platting application, we have
been guided by your department as this being probably the most
expedient way of short-platting the property.
In examining the short plat map, you will note that the hospital
intends to acquire practically all the Brain property with the
exception of two locations on the Springbrook/Talbot Road,
which will be retained by Dr. Brain, and also a lot which will
be retained by Dr. Lwai in the exchange.
This additional property that is being made .available to the
hospital, is sorely needed for the future growth of Valley
General and actually is the only property adjoining our site.
We would appreciate any expidiency that can be added to the
processing of this short plat application, the urgency being
one that relates to putting in some access roads and parking,
hopefully before the winter weather would make such a project
most undesirable.
