Short Plat 227-78 LOCATION: Vicinity of 2408 Union Avenue N.E. SUMMARY OF REQUEST: Applicant seeks approval of a proposed two-lot short plat. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. • PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on January 24, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the t Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 30, 1979 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and. reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: King County Assessor's Map • Exhibit #3: Short Plat Map Dave Clemens, Associate Planner, referenced Section 0.2 and P.1 of Exhibit #1 regarding approval ,by the Board of Adjustment of the applicant's variance request for reduction of lot width, and indicated that the variance had beentapproved by the board on January 24, 1979. • The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Ray Brown 1309 Monroe N.E. • Renton, WA 98055 Mr. Brown indicated his concurrence in the report including the recommendation for installation of off-site improvements on Lot B. The Examiner requested testimony in support or opposition to the request. There was no response. He then requested a .final recommendation from' the Planning Department staff. Mr. Munson indicated the Planning Department report would remain as submitted with deletion of Section 0.2 and P.1 regarding approval of the requested variance. The Examiner requested further comments. Since there were none, the hearing on File No. Short Plat 227-78 was closed by the Examiner at 9:17 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: , FINDINGS: 1. The request is for approval of a two-lot single family short plat. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter,, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. Sh Plat 227-78' Page Two 3, Pursuant to the City of Renton's Environmental Ordinance and the State Environmental • Policy Act of 1971, 'as amended by R.C.W. 41.21.C.,, the responsible official has determined the proposal to be. exempt from the threshold determination and EIS requirements of SEPA. • 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition'to the proposal expressed. • 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required lot design requirements of Section 4-704 (SR-1) except for minimum lot frontage, of Title IV, and the requirements of Section 9-1108 (Subdivision Ordinance) , Title IX, Ordinance No. 1628, Code of General Ordinances. On January 24, 1979, the Board of Adjustment granted a variance from the minimum lot frontage requirement (V-359-79) . 8. Off-site improvements along Lot 8 will be 'installed by the application (Section 9-1106.3.A. (5) ) . These improvements, exist along Lot A. 9. Complete certification per Section,9-1106.3.H has not been accomplished. An affidavit of ownership was provided (Section 9-1106.3.H. (I) ) . 10. Restrictive covenants were not submitted (Section 9-1105.3.B) . 11. The existing mobile home on the property will be removed within a few months. CONCLUSIONS: . 1. The proposal conforms to the Comprehensive •Plan and, pursuant to the action of the Board of Adjustment, to the zoning regulations. 2. Certification can be completed prior to, at or immediately following filing of the final' plat with King County per review and approval-of the Planning and Public Works Departments-. • 3. During the normal building permit process, the Public Works Department will review the storm drainage plans for the proposal. DECISION: • Approval of Exhibit #3, subject to: • 1. Topography: The site slopes downward from west to east very slightly at approximately a 3% grade . 2. Soils : Alderwood gravelly sandy loam, 6-15% slopes (AgC ) . Permeability is moderately rapid in the surface layer and subsoil and very slow in the substratum. Runoff is slow to medium and the erosion hazard is moderate . The subject proposal is consistent with the Comprehensive Plan which designates •the site and surrounding area as single family residential . 2. Although the proposal exceeds the minimum lot size requirement of the SR-1 zone, it does not meet the minimum frontage requirement of 75 feet . The applicant has applied for a variance of 10 ' (total lot width 65 ' each lot) in application V-359-79 . The Board of Adjustment failed to have a quorum for their meeting of January 18, 1979 , and the variance application was continued to January 24 , 1979 . This continuance was unexpected , however, the Hearing Examiner ' s action on this short plat can be conditioned upon Board approval , thus expediting this request. 3. The proposal is compatible with adjacent single family residential uses and similar subdivision patterns in the area (Section 9-1109 , B & C ) . 4. The size of the property as presently existing is large enough that the proposed short plat is a reasonable use of the land . Lots "A" and "B" are planned to be approximately 8,450 square feet each . Thus exceeding the required minimum lot area . 5. An existing house is located on Lot "A" while a mobile home is presently situated on Lot "B" . It is the applicant ' s intent to remove this mobile home from Lot "B" and construct a dwelling similar to that of Lot "A" . 6 . Utilities are available to the subject site . However, drainage plans must be approved by the Public Works Department prior to filing the plat. 7 . All off-site improvements in Union Avenue N. E . exist on Lot "A" . The Engineering Division advises that these be installed for Lot "B" as well . 8. Additional comments from other departments are attached for consideration. P . DEPARTMENTAL RECOMMENDATIONS : Based upon the foregoing analysis , recommend approval of the short plat as requested subject to : 1 .
