filing. Restrictive covenants will be filed by the City Clerk with
King County.

REPORT AND RECOMMENDATION . •

SUMMARY OF REQUEST: Applicant requests approval of a proposed two-lot short plat
and waiver of the required off-site improvements.

PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on-November 8, 1978. •
•
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
• follows:
The hearing was opened on November 14, 1978 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building:
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

Mayetich, dated October 23, 1978, regarding
short plat and waiver request.

request for waiver.

The Examiner asked the representative for the applicant if he concurred in Exhibit #1.
Responding was:
•

Mr. Callero indicated his concurrence in the report. He advised that the purpose of
the short plat request was not to create additional lots or building sites. Because of
the necessity for expediting the application, he requested clarification of the
established time periods for issuance of the Examiner's report and the subsequent appeal
period. The Examiner explained that although issuance of the report would be possible
prior to the 14-day period allowed for publication, the 14-day appeal period is enforced
by the Hearing Examiner Ordinance and cannot be waived.
•
The Examiner requested testimony in support or opposition to the request. There was no
response. He then questioned Mr. Clemens regarding creation of additional non-conformance
with the zoning ordinance of established setbacks and property lines if the proposal .
is approved as recommended. Mr. Clemens indicated that the proposal conforms with
the zoning ordinance. The Examiner asked .the representative for the applicant if he
concurred in the Planning Department recommendation for execution of, restrictive covenants

to assure participation by the property owner in any future Local Improvement District
(LID) in the area. Mr. Callero responded affirmatively.
The Examiner requested further comments. Since there were none, the hearing on File No.
Short Plat 240-78 and W-241-78 was closed by the Examiner at 9:21 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following: ;
FINDINGS:
1. The request is for approval of a two-lot short plat and waiver of off-site
improvements.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
(is uncontested) , and is hereby attached as Exhibit #1 and incorporated in this
report by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, determined the subject proposal to be exempt from the threshold
determination and EIS requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the setbacks, lot area and lot dimension requirements
of Section 4-706 (R-1) of Title IV and lot dimension requirements of Section
9-1108.23.F of Title XI, Ordinance No. 1628, Code of General Ordinances.
8. Existing on the southernmost.parcel are two duplex structures built in 1942 and 1952.
These structures constitute a nonconforming use of the property due to existing
zoning of R-1, single family. The proposed short plat does not increase this
nonconformity.
9. An affidavit of ownership was submitted (Exhibit #5) per Section 9-1106.3.H. (1) .
10. Necessary streets have been dedicated (Section 9-1106.3.H. (2) ) .
11. Survey of the property has not occurred by a licensed land surveyor (Section
9-1106.3.H. (3) ) .
12. Off-site improvements are required on S.W. 3rd Place, Stevens Avenue S.W. and Sunset
Boulevard W. In lieu of these improvements the applicant requested a waiver
(Exhibits #4 and 6) and completion of restrictive covenants agreeing to
participation in a Local Improvement District (LID) for these improvements (Section
9-1106. 3.H. (5) ) . (Restrictive covenants were submitted following the public hearing
and are attached to this report. )
Existing off-site improvements in S.W. 3rd Place consist of pavement and thickened
edge. On Sunset Boulevard W. exists sidewalk, gutter and pavement. Stevens Avenue
S.W. contains only pavement. Per Section 9-1108.3 each street requires curb,
gutter, sidewalk and paving. These improvements exist approximately 250 feet from
the subject site on the south side of S.W. 3rd Place.
13. Certification by the King County Health Department and King County and City of
Renton Finance Departments will occur immediately prior to, at, or following filing
of the final short plat with King County (Sections 9-1106.3.H. (4) , (7) , and (8) ) .
14. A title insurance policy was not provided per Section 9-1106.3.H. (6) .
15. Utilities have been installed (Section 9-1106.3.H. (9) ) .
CONCLUSIONS: •
1. The proposal conforms to the Comprehensive Plan and does not adversely impact the
public health, safety, welfare and aesthetics (Section 9-1101.2) .

2. Completion of certification per Section 9-1106.3.H can be accomplished prior to,
at or immediately following approval of the final short plat by staff per Section
9-1105.7. A survey by a licensed land surveyor must be completed prior to
submittal of the final short plat to the Planning Department. The title insurance
policy can be submitted at that time as well.
3. Off-site improvements that are required by Section 9-1108.3 do not exist within a
reasonable distance on Sunset Boulevard .W. and Stevens Avenue S.W. (Section
9-1105.6.B) . An LID approach for constructing these improvements appears most
reasonable under. these circumstances. Therefore, the requested waiver should be
granted subject to the attached restrictive covenants which agree to participation •
in an LID.
The required off-site improvements appear to be located within a reasonable distance
(200-250 feet) on the south side of S.W. 3rd Place (Section 9-1105.6.B) . However,
only a half of this street (south half) has been paved adjacent to the subject
site (Exhibit #2) . The existing aforesaid improvements appear to be unique to
this block of the neighborhood. Under these circumstances it seems most reasonable
to waive the requirement for construction of off-site improvements in lieu of the
attached restrictive covenants (Section 9-1109.1 and 9-1109.1.A) . An LID appears
to be the most reasonable and logical approach to implementing this requirement.
4. This application and decision by the Examiner does not address the nonconforming
use of the property since the proposed short plat does not affect the nonconformity.
Consideration of this issue appropriately rests with the City Attorney.
DECISION:
Approve the short plat (Exhibit #3) subject to completion of certification per Section
9-1106.3.H. (Conclusion No. 2) .
Approve the requested waiver of off-site improvements subject to filing the attached
restrictive covenants agreeing to participation in an LID for these improvements.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before November 29, 1978. Any aggrieved person feeling that
the decision of the Examiner is based on erroneous procedure, errors of law or fact,
error in judgment, or the discovery of new evidence which could not be reasonably
available at the prior hearing may make a written request for review by the Examiner
within fourteen (14) days from the date of the Examiner's decision. This request shall
set forth the specific errors relied upon by such appellant, and the Examiner may,Iafter
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

direction on the southerly portion of the property .

0. PLANNING DEPARTMENT ANALYSIS :
1 . The subject site is zoned R-1 single-family residence with
a minimum lot area of 7200 square feet.
2 . The subject site is developed with a single family residence
and two non-conforming duplexes .
3 . The applicant ' s proposal is to divide the property such that
the single family dwelling is located on a '10 ,000± square foot
parcel facing S . W. 3rd Place , and the duplex units to be .
located . on an 18 ,000 square foot area fronting Stevens Avenue
S . W. and Sunset Blvd . Both parcels. contain the required
minimum lot width .
4 . The existing ownership encompasses several lots platted prior
to the City ' s subdivision ordinance. The approval of the plat
should include a requirement that the superfluous interior
• lot lines be removed at the time of recordation .
5 . The applicant has proposed a waiver of the off-site
improvement requirements for this plat . The applicant states
that no physical development is proposed , and that no impact
will occur to the existing public improvements .
6 . A review of the existing street improvements shows that full
street improvements exist on S . W. 3rd Place west of the subject
property , but not adjoining this property . The street
improvement on S . W. 3rd across this property appear to be a
half-street on the north side , but no curbs , gutter or sidewalk .
Street improvements on Stevens consist of .paving without
curb , gutter and sidewalk ; likewise , Sunset is paved with
sidewalk and an asphalt transition .
P . PLANNING DEPARTMENT RECOMMENDATION :
It is recommended that the proposed short plat be approved based
upon its exceeding the minimum requirements for both the zoning and
subdivision ordinances for the proposed lots . The following
condition is recommended :
1 . That all interior lot lines be deleted at the time of
recordation of the two lot plat.
It is also recommended that the waiver be approved , but restrictive
covenants be applied to insure the street improvements at the time of
an LID in the subject area . This recommendation is based upon the lack
of adjoining improvements , that no development will occur as a result
of this plat and that the public welfare will be protected by
future improvements .

Dear Mr. Erickson:
Enclosed is the Mayetich Short Plat application, As explained in our
letter to you, dated,August 29th and our meeting with you and your planner .
Dave Clemens -on- September 21st., the Mayetichs are selling the back bal f
of their property, including the two existing buildings.
Mr. & Mrs. Mayetich are'retired and find it difficult to maintain the
grounds and buildings in the condition to which they are accustomed.
There are no new lots for building sights being created by this Short Plat.
All buildings and imerovsments are existing aed have been for 25 to 30
years. The sale of the south portion of the leayetich property is scheduled
to close on or before November 15, 1978. Because a simple tax segregation
is not acceptable by the City, it is requested and will, be greatly appre-
ciated, to have this Short Piet approved in time to meet the scheduled
closing date,

1 . Topography : The site slopes from north to south at approxi -
mately a 14% slope.
2 . Soils : Beausite gravelly sandy loam (BeC ) , 6-15% slopes .
Permeability is moderately rapid . Runoff is medium and the
erosion hazard is moderate . This soil is used for timber ,
pasture , and for urban development.

short to medium height deciduous trees located in an east-west
direction on the southerly portion of the property .
4 . Wildlife : The existing vegetation provides suitable
habitat for birds and small mammals .
5 . Water : No surface water was evidenced on the subject
site.
6 . Land Use : The land use of the site consists of a single
family residence and two duplex structures . Surrounding
properties contain single family residences .
F. NEIGHBORHOOD CHARACERTISTICS :
The neighborhood is basically single family residential in
nature .
G . PUBLIC SERVICES :
1 . Water and Sewer : A 4" water main runs east-west on S . W .
3rd Place and a 6" main extends east-west along Sunset Blvd .
West at the south border of the property . Eight inch sanitary
sewers are located on S . W. 3rd Place and Sunset Blvd . West.
2 . Fire Protection : Provided by the Renton Fire Department
as per ordinance requirements .
3 . Transit : Metro Transit Route #142 operates along Renton
Avenue South approximately 3/4 of a mile to the north .

0 . PLANNING DEPARTMENT ANALYSIS :
1 . . The subject site is zoned R-1 single-family residence with
a minimum lot area of 7200 square feet.
2 . The subject site is developed with a single family residence
and two non-conforming duplexes .
3 . The applicant ' s proposal is to divide the property such that
the single family dwelling is located on a 10 ,000± square foot
parcel facing S . W. 3rd Place, and the duplex units to be
located on an 18 ,000 square foot area fronting Stevens Avenue
S . W. and Sunset Blvd . Both parcels contain the required
minimum lot width .
4 . The existing ownership encompasses several lots platted prior
to the City ' s subdivision ordinance. The approval of the plat
should include a requirement that the superfluous interior
lot lines be removed at the time of recordation .
5 . The applicant has proposed a waiver of the off-site
improvement requirements for this plat . The applicant states
that no physical development is proposed , and that no impact
will occur to the existing public improvements .
6 . A review of the existing street improvements shows that full
street improvements exist on S . W. 3rd Place west of the subject
property , but not adjoining this property . The street
improvement on S . W. 3rd across this property appear to be a
half-street on the north side , but no curbs , gutter or sidewalk .
Street improvements on Stevens consist of paving without
curb , gutter and sidewalk ; likewise , Sunset is paved with
sidewalk and an asphalt transition .
P . PLANNING DEPARTMENT RECOMMENDATION :
It is recommended that the proposed short plat be approved based
upon its exceeding the minimum requirements for both the zoning and
subdivision ordinances for the proposed lots . The following
condition is recommended :
1 . That all interior lot lines be deleted at the time of
recordation of the two lot plat.
It is also recommended that the waiver be approved , but restrictive
covenants be applied to insure the street improvements at the time of
an LID in the subject area . This recommendation is based upon the lack
of adjoining improvements , that no development will occur as a result
of this plat and that the public welfare will be protected by
future improvements .
