SUMMARY OF REQUEST: Applicant requests approval of a proposed two-lot short
plat and a waiver of the required off-site improvements.

PLANNING DEPARTMENT The Planning Department. staff report was received by the
REPORT: Examiner on October 17, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on October 24, 1978 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties. wishing to testify were affirmed by the Examiner. '
It was reported that the Hearing Examiner and the representative for the applicant had
received and reviewed the Planning Department report, and the report was entered into
the record as Exhibit #1.
David Clemens, Associate Planner,, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

Exhibit #4: Letter to Renton Planning Department from

regarding request for waiver of off-site
' improvements. .

The Examiner inquired if the applicant concurred in Exhibit #1. Responding was:

Mr. Benson; the applicant's son-in-law, indicated Mrs,. McWilliams ' concurrence in the
staff report, Exhibit #1.
The Examiner requested additional testimony in support of the request. There was no
response. He then requested testimony in opposition to the application. Responding was:

Mr. Gathmann, resident to the west of the subject property, reported that a survey of
the applicant's .property had occurred in June of 1964 by McKiddy Surveying Company of
• Kent, Washington to establish the centerline of the Pacific Coast Railroad right-of-way.
He indicated that the survey established the western property line of .the subject
' property a distance of 25 feet further to the east than previously recorded. . The .

Examiner advised that if the short plat is approved, a survey must be accomplish to
establish accurate lot lines and determine impact to the properties. Mr. Clemens
indicated that although the Planning Department did not have previous knowledge of the
survey, the Engineering Division would be contacted to investigate the matter.
The Examiner asked Mr. Benson if Mrs. McWilliams concurred in the requirement for filing
restrictive covenants to ensure future participation in a local improvement district in
the area. Mr. Benson indicated her concurrence.
The Examiner advised that he would close the public hearing but that unusual circumstances
relating to the railroad survey may require reopening the hearing to review possible
revision to the plat configuration.
The Examiner requested further comments. Since there were none, the hearing on File No.
Short Plat 228-78 and W-229-78 was closed by the Examiner at 9:27 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the
Examiner now makes and enters the following:
FINDINGS:
1. The request is for approval of a two-lot short plat and waiver of off-site
improvements.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations .in this matter,
is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report
by reference as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , Gordon Y. Ericksen, responsible
official, determined the proposal to be exempt from the threshold determination and
EIS requirements.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development and no adverse comment was expressed.
5. There was no opposition to the proposal expressed.
. 6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and lot area
of Section 4-729 (G) and 4-706 (R-1) of Title IV, Ordinance No. 1628, Code of
General Ordinances.
8. An affidavit of ownership was submitted (Section 9-1106.3.H. (1) ) .
9. Dedication of additional street right-of-way is not required (Section 9-1106.3.H. (2) ) .
10. A survey of the property has not been completed by a land surveyor and entered into
the record (Section 9-1106. 3.H. (3) ) . It was asserted that a survey accomplished
in June of 1964 by McKiddy found the centerline of the Pacific Coast Railroad to
be 25 feet easterly of the location indicated in the short plat (Exhibit #2) . This
survey document was not submitted. In the attached memorandum of October 27, 1978,
the Public Works Director stated that the centerline location specified in Exhibit
#2 is correct.
11. Certification by the King County Health Department and the King County and City of
Renton Finance Departments will occur immediately to, at or following filing of the
final approved short plat map with King County (Sections 9-1106.3.H'. .(4) , ' (7). and. (8) ) .
12. Off-site improvements have been requested to be waived since such improvements do
not exist in the immediate vicinity (Section 9-1106.3.H. (5) ) .
13. A title insurance policy was not provided per Section 9-1106.3.H. (6) ) .
14. A bill of sale for utilities constructed has not been provided per Section
9-11O6.3.H. (9) ) .
15. Restrictive covenants were not submitted (Section 9-1105.3.B. ) .

CONCLUSIONS:
1. The proposal serves the public health, safety, welfare and esthetics (Section
9-1101.2) . ,
2. Complete certification per Section 9-1106.3.H can be provided to the Planning
Department prior to final approval of the short plat by staff per Section 9-1105.,7 •
or filing of the plat with King County.
3. The required survey by a licensed land surveyor per Section 9-1106.3.H. (3) should .
resolve any questions regarding the westerly property line of the proposal.
Deviations in the centerline of the railroad right-of-way should be found in this
survey.
If deviations are found, the proposal does not necessarily require further review
by the Examiner. As long as Parcel B contains. 6000 square feet in area, .is' 60
feet in width, etc. per applicable zoning and subdivision regulations, the
Planning Department may review and approve the revised short plat. This extent
. of deviation from Exhibit #2 is minor since the configuration of the plat is not
affected, except to decrease the lot area of one parcel. Otherwise, the Examiner
should review a revised short plat.
4. Off-site improvements do not exist within a reasonable distance of the property
(Section 9-1105.6.B) . A waiver of these improvements will produce development '
similar to that in the area (Section 9-1109.1.B) . Detriment to the public welfare
of other properties, was not alleged or found to exist due to this waiver (Section
9-1109.1.C) . Therefore, the waiver should be granted.
However, it is reasonable to request that the applicant attest in restrictive
• covenants to participation in a Local Improvement District (on a fair and
equitable basis) for installation of the off-site improvements at some future
date. •
DECISION: •
Based upon the testimony, record, findings and conclusions, it is the Examiner's decision
to approve the requested short plat (Exhibit #2) subject to:
1. Completion of certification per Section 9-1106.3.H.
2. Verification of'property lines by survey by a licensed land surveyor.
Furthermore off-site improvements are waived per Section 9-1105.6.B subject to
completion of restrictive covenants agreeing to participate in an LID.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before November 13, 1978. Any aggrieved person feeling that
the decision of the Examiner is based on erroneous procedure, errors of law or fact,
error in judgment, or the discovery of new evidence which could not be reasonably
available at the prior hearing may make a written request for review by the Examiner
within fourteen (14) days from the date of the Examiner's decision. This request shall
set forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

C . PURPOSE OF REQUEST: •
To permit subdivision of the subject site into 2 single family
residence lots for future development of an additional single
family residence . In order to achieve such subdivision , the
applicant is also requesting a waiver of required off-site
improvements .
D . HISTORY/BACKGROUND : •
The subject site was annexed into the City by Ordinance No . 1821 ,
dated March 31 , 1960 .
E . PHYSICAL BACKGROUND :
1 . Topography ; The site slopes downward from east to west at
approximately a 9% grade .
2 . Soils : Indianola loamy fine sand , 4-15% slopes ( InC ) .
Permeability is rapid . Runoff is slow to medium and the erosion
hazard is slight to moderate. This soil is used for timber
and urban development .

3 . Vegetation : The site is composed almost entirely of low
scrub grass with only a few medium sized deciduous trees .
4 . Wildlife : Existing vegetation may provide suitable habitat
for birds and mammals .
5 . Water: No surface water was observed on the subject site.
6. Land Use : An existing single family residence is located
on Lot "A" of the proposed short plat.
F. NEIGHBORHOOD CHARACTERISTICS :
The area is primarily single family residential in nature.
G . PUBLIC SERVICES :
1 . Water and Sewer : An existing 6" water main and an 8"
sanitary sewer extend east-west along North 26th Street.
2. Fire Protection : Provided by the City of Renton Fire
Department as per Ordinance requirements .
3 . Transit: Metro Transit Route #240 is located along Lake
Washington Blvd . North within 3/4 of a mile to the
west of the site.
4. Schools : Kennydale Elementary School is located within
3/4 of a mile to the northeast of the subject site and McKnight
Junior High is approximately 1 3/4 miles to the southeast
while Hazen Senior High School is within 3 1 /2 miles to the
east.
'5 . Parks : Kennydale Lions Park is located within one mile to
the east of the site and Lake Washington Beach Park is approx-
imately 3/4 of a mile to the west while North Highlands Park
is approximatelyl 1 /2 miles to the southeast.

0. PLANNING DEPARTMENT ANALYSIS :
1 . The proposal is consistent with the Comprehensive Plan which
designates the site and surrounding area as single family
residential .
2 . The proposal is compatible with adjacent single family
residential uses and like subdivision patterns in the area
(Section 4-1109 B and C ) .
3 . Relative to item (2) above , 'Lot "A" exceeds the minimum standards
of 6 ,000 square feet and is somewhat smaller than Lot "B"
which substantially exceeds the minimum. Consequently , the
proposal as a whole can be considered as consistent with the
established areadevelopment .
4. Utilities are available to the subject site. Drainage plans
must be approved by the Public Works Department prior to filing
the plat.
5 . Off-site improvements do not generally exist along North
26th Street .
P . RECOMMENDATION :
'Recommend approval of the short plat and waiver subject to :
1 . Final Public_ Works Department approval of utilities and storm
drainage plans .
2. The approval of the waiver of the standard street improvements
being subject to the filing of restrictive covenants running
with the land which state that the property owner shall
participate in any future L . I . D . for such street dedication
and improvements .
