PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
field checking the' property and• surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on February 20, 1979 at 9:50 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.

Steve Munson, 'Planning Department, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

Referencing Section L.9 (Short Plat) of Exhibit #1, regarding Fire Department requirements
for a 45-foot turnaround radius on the proposed pipestem, Mr. .Munson indicated that a
hammerhead configuration would accommodate departmental requirements.
The Examiner asked the applicant if she concurred in Exhibit #1. Responding was:

Mrs. Hanbey indicated nonconcurrence in the Planning Department recommendation to locate
the proposed pipestem on the southerly portion of the property. She submitted a photograph
denoting the location,of an existing driveway on the northern portion of the site. The
photograph was labeled as follows by the Examiner:

Mrs. Hanbey reported plans for remodeling the structure situated 'on Lot 3 in the southerly
portion of the property which include relocating the house as close as possible to the
southern boundary in order to facilitate utilization of the centrally located pipestem by
all three residences. She indicated that provision of the pipestem on the southern
boundary would require removal of part of an existing driveway located 'on the northern
portion within two feet of the property line. Mrs. Hanbey also noted that an existing
utility pole in the preferred central location of the pipestem would require slight
modification in the proposed access plans. She submitted a rough sketch of the proposed
pipestem configuration. The sketch was labeled as follows by the Examiner:

Mrs. Hanbey denoted on the sketch the proposed driveway configuration as well as a proposed
four-foot planter median to accommodate the existing utility pole near the entrance to
the pipestem. She reviewed the purpose of acquiring the home on the southern portion of
the property to upgrade its appearance and noted that disruption of the existing concrete
driveway would defeat the purpose of enhancement of the appearance of the neighborhood.
The Examiner requested testimony in support or opposition to the request. There was no
response. He then requested additional comments from Mr. Munson._ Mr. Munson indicated •
that the applicant's proposal for location of the pipestem would.be acceptable to the
Planning Department subject to relocation of' the existing home on the southern. portion.
David Clemens, Associate Planner, advised that the recommendation was originally predicated
upon the possible creation of an "S" curve in the lot line if the pipestem were located
in the center of the property, but relocation of the existing southerly residence would
eliminate that concern and would be satisfactory to the department.
The Examiner inquired if creation of a public street would occur by combining three
driveways into one accessway and, therefore, not conform to the intent of the Subdivision
Ordinance for pipestem lots. Mr. Clemens stated his opinion that the proposal is
compatible with the intent of the pipestem ordinance regulations to provide legal access
to proposed Lot No. 2 in the eastern portion of the site and reduce the number of
• driveways onto Monroe Avenue N.E.'

FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request, is for approval of a 'three-lot short plat, waiver of off-site improvements
and exceptions for one pipestem lot and two lots of less than the required width.
This request is pursuant to reclassification application, File No. R-288-79, for
R-1 zoning, heard the same day.
2. The Planning Department report accurately sets forth the issues, applicable' policies
and provisions, findings of fact, and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference
as set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
• Policy Act of 1971, as amended by R.C.W., 43.21.C. , Gordon Y. Ericksen, responsible
official, found the proposal to .be exempt from the threshold determination and EIS
• requirements of SEPA.
4. 'Plans for the proposal. have been reviewed by all city departments .affected by the
impact of this development.
•
5. There.was no opposition to the proposal expressed.
6.. Allexisting utilities are available and in close proximity. •
• 7. ;The proposal is compatible with the requirements of Section 4-706 (R-1) of Title IV, '
and Section 9--1108.23 of Title IV; Ordinance No. 1628, Code of General Ordinances .

The proposal possesses insufficient area to subdivide the property to conform to the
35,000 square.feet minimum lot size of the GS-1 zone currently existing on the property.
Therefore, _this review is predicated upon the final approval by the City Council of
approval of reclassification of the property to R-1. •
•
,8. An, exception to permit Lot 2, to be a pipestem lot and Lots 1 and 3 to be 56 feet wide
were requested by the applicant (Exhibits #9 and 10) . .To avoid conflict with building
setback requirements, the applicant stated that the existing house on Lot 3 will .be
moved southerly to conform with these requirements. 'The applicant also testified
that an existing concrete driveway poses difficulty if the pipestem is located along
the southerly property line (Exhibit #4) . This driveway and proposed pipestem are
intended to serve the three lots (Exhibit #5) .
9.. Off-site improvements are located along Monroe Avenue N.E. approximately one block
north of the applicant's property.
10. Certification per Section 9-1106.3.H has not been completed except for submittal of
an affidavit of ownership (Exhibit #6) .
11. Staff' recommended that the Fire Department requirement of a 45-foot radius turnaround
on Lot 2 be satisfied by a hammerhead configuration.
12. Restrictive covenants were not submitted (Section 9-1105.3.B) .
CONCLUSIONS:
•
1. The proposal generally conforms to the Comprehensive Plan. With approval of the
requested exceptions, compliance with the zoning regulations and Subdivision Ordinance
is achieved.
•
2. A pipestem configuration for Lot 2 is reasonable and appropriate. The 'narrow width
of the property ,and relatively considerable length produce difficulty in accomplishing
a subdivision without a pipestem lot (Section 9-1109.1.A) . Other'properties in the
area have been subdivided into similar, if not smaller, parcels and only few
properties remain of the size of the subject site (Section 9-1109.1.B) . Detriment
or injury to the public or other properties is not evident (Section 9-1109.1.C) .
3. Permitting Lots 1 and 3 to be four feet less in width than required by the Subdivision
Ordinance appears,reasonable under the circumstances. The narrow width of the
property' creates difficulty for dividing the property into 'three lots without.
necessitating a pipestem and the requested exception (Section 9-1109.1.A) . Other
alternatives to the subdivision would include a dedicated public street, but this,
appears unreasonable to impose for a three-lot short plat. Other properties in the
vicinity have been divided into smaller lots with less lot width (Section 9-1109.1.B) .
Detriment or injury to the public or other properties is not apparent (Section
9-1109.1.C) .
4. The proposed use of the pipestem for• joint access to the three lots appears to
contradict the intent• and purpose of a pipestem. A pipestem is an owned portion of
a single lot'and utilized for access' to a dedicated street from the buildable portion
of that lot (Section 9-1108.23.F. (3) . (d) ) . In order for joint access to occur across
the pipestem, an easement would be required or an "alley" per Section 9-1102.1
dedicated for private use of the three lots. A private alley is not permitted
outright by Sections ,9-1108.23.A. (9) and (10) . The authority to approve private
easements for access to meet short plat requirements is not contained in the
Subdivision Ordinance. '
5. Certification.per Section 9-1106.3.H can be completed prior to, at or following
• filing of the' final. plat in' King County per' approval of the Planning and Public
Works Departments. .
•
. 6, .A hammerhead turnaround improvement on Lot 2 appears' sufficient to meet Fire Department

requirements. Flexibility should be allowed the future owner of Lot 2 to design the
improvement to fit in with the desired landscape plan for the site.
7. Off-site improvements do not exist within a reasonable distance from the subject
property (Section 9-1105.5.B) . Incomplete off-site improvements (curbing only)
exist between N.E. 9th Street and N.E. 10th Street, one block north of the site.
Complete improvements do not exist south of N.E. 10th Street. Other properties in
in the immediate vicinity have not installed these improvements (Section 9-1109.1.B) .
Detriment or injury to the public or other properties is not evident (Section
9-1109.1.C) . Improvement of Monroe Avenue N.E. is included in the Six Year Street
Improvement Program.
Therefore, the requested waiver of off-site improvements should be granted. However,
it appears reasonable to: require completing the normal restrictive covenants agreeing
to participate in a Local Improvement District for installation of the improvements
should this be required at a later date.
DECISION:
Approve the short plat, Exhibit #2, subject to:
1. Relocation of the existing house on Lot 3 to conform to zoning regulations per
review and approval of the Planning Department.
2. Completion of certification per Section 9-1106.3.H per approval of the Public Works
and Planning Departments.
3. City Council approval of a rezone of the property to R-1 (File No. R-288-79) .
Approval of an exception to permit pipestem Lot 2.
Approval of an exception to permit Lots 1 and 3 to be 56 feet in width as shown in
Exhibit #2.
Approval of a waiver of off-site improvements subject to completion of the normal
restrictive covenants per approval of the Planning Department agreeing to participate
in an LID for completion at a future date of these improvements.
This decision is conditioned upon compliance with all other applicable ordinances and
regulations of the City of Renton.

Pursuant to the City of Renton ' s Environmental Ordinance .a,n.d

short plat , however , a declaration of non-significant impact has been
prepared for the rezoning due to its scope .

#1 and #3 with the existing dwellings are approximately 8 ,400
square feet and Lot #2 is approximately 19 , 575 square feet.
4 . Al:though the lots of the proposed short plat do exceed the
minimum lot size requirement of the R-1 zone and the subdivision
ordinance , the amount of frontage on Monroe Avenue N . E .
is not sufficient to meet the 60 foot standard for each lot .
The applicant is therefore proposing Lots 1 and 3 with 56-foot
'frontages and Lot #2 as a pipestem lot with the required 20
- foot minimum width and maximum 150 foot length .
5 . In addition to the insufficient frontage on Monroe Avenue , the
existing dwelling on proposed Lot #3 would extend northerly
beyond the proposed lot line into the future pipestem road . The
applicant was advised that she intends to retain this structure
on site , improve it , and eventually sell it . Given this
location , the existing situation in number 4 and the location of
the dwelling on proposed lot #1 , it would seem that reasonable
justification can be provided for the proposed exception (Section
9-1109 . 1A) . Although the pipestem must be rearranged to conform
to 9-1108-23-F-3(d ) or moved to adjacent to the south property line .
6 . The establishment of a fully dedicated and improved public
street to the site is not desirable given the close proximity
of the surrounding single family residences and existing subdivision
pattern for the area .
7 . Off-site improvements are limited to a few locations along
