This is to notify you that the above referenced requests, which were
approved subject to restrictive covenants as noted on the Examiner's
report of April 9, 1979, have not been appealed within the time
period established by ordinance. Therefore, this application is
considered final and is being submitted to the City Clerk effective
this date for permanent filing. Restrictive covenants will be
filed by the City Clerk with King County.

impose the following restrictive covenants running with the land as
to use, present and future, of the above described real property.
NOW, THEREFORE, the aforesaid owner(s) hereby establish ,

REPORT AND RECOMMENDATION .
APPLICANT: Francis J. Briere FILE NO. Short Plat 307-79
E-308-79, W-309-79

LOCATION: Vicinity of 1800 Duvall Avenue N.E.
SUMMARY OF REQUEST: The applicant requests, approval of a three-lot short plat,
an exception to the Subdivision, Ordinance to permit two
25-foot pipestem roads, and request for waiver of the required
off-site improvements. •
SUMMARY OF ACTION: Planning Department Recommendation: Approval subject to
restrictive covenants.
•
Hearing Examiner Decision: Approval of short plat and waiver
subject to restrictive covenants; denial of exception.
PLANNING DEPARTMENT The• Planning Department staff report was received by the
REPORT: Examiner on March 1, 1979.
•
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and
• field checking the property and surrounding area, the
• Examiner conducted a public hearing on the subject as
follows: -
•
The hearing was opened on March 6, 1979 at 9:50 a.m. in the Council Chambers of the
Renton Municipal Building.
•
Parties wishing to testify were affirmed by the.Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
David Clemens, . Associate Planner, reviewed Exhibit #1; and entered the following
additional exhibits into the record:
Exhibit #2: Letter to Planning Department from Kenneth J.
• Oyler, dated February 9, 1979, regarding
request for exception and waiver.

•Exhibit #3: Short Plat Map as submitted
Exhibit #4: Short Plat Map with staff comments
Mr. Clemens added two recommendations to the existing conditions contained in Exhibit #1
consisting of dedication of 20 feet for future right-of-way on Duvall Avenue N.E. and
approval of the short plat be contingent upon rezone of the property (File No. R-306-79,
public hearing this date) .
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

• Mr. Briere requested clarification. of the requirement for dedication. of 20 feet of right-
Of-way on Duvall Avenue N.E. designated on Exhibit #4. •Mr. Clemens explained the proposal
for dedication of an additional 20 feet on both sides of Duvall Avenue, N.E. to provide for
future widening of that roadway if determined necessary. Mr. Briere inquired if
compensation would be made' for such dedication, noting that other residents had not been
required to provide .similar dedication. Mr. Clemens indicated that approval of the
proposed development would require provision of right-of-way as well as installation of
appropriate off-site improvements. The Examiner advised that the possibility of acquiring
compensation had not been precluded, but would be the option of the applicant. Mr. Briere
requested additional time •to review the requirement of dedication since it had not been
included in the Planning Department recommendation, although it had appeared in staff
comments attached to the report. .

The Examiner subsequently continued the hearing until 9:00 a.m. in March 13, 1979. He
then entered the following exhibit into the record:
Exhibit #5: Affidavit of Ownership
The Examiner requested further comments. Since there were none, the hearing on File No.
Short Plat 307-79, E-308-79 and W-309-79 was closed at 10:03 a.m. and continued to
March 13, 1979.
CONTINUANCE:
The hearing was reopened on March 13, 1979 at 9:12 a.m. in the Council Chambers of the
Renton Municipal Building. Mr. Clemens advised that he had received a request for
additional review period from the applicant, and suggested that the public hearing be
continued until 9:00 a.m. on April 3, 1979.
The hearing was subsequently closed at 9:15 a.m. by the Examiner and continued to
9:00 a.m. on April 3, 1979.
CONTINUANCE:
The hearing was reopened on April 3, 1979 at 9:00 a.m. in the Council Chambers of the •
Renton Municipal Building. The Examiner noted that although neither the applicant nor
his representative was in attendance, the hearing would proceed as scheduled since the
applicant had specifically requested the continuance, and had been notified of the
hearing date and time.. Mr. Clemens advised his understanding from discussion with the
applicant's attorney that it was the intention of the applicant to proceed with the
short plat application as submitted.
The Examiner requested additional comments or new information from Mr. Clemens. Mr.
Clemens entered the following exhibit into the record:
Exhibit #6: King County Assessor's Map
designating subject site and
surrounding area
Mr. Clemens designated on Exhibit #6 the location of the proposed right-of-way line on
Duvall Avenue N.E. established by King County prior to annexation of the area into the
city. He advised that the existing 60-foot right-of-way, proposed to be widened to 100
feet, would require a 20-foot dedication by the applicant on the easterly side of Duvall
Avenue N.E.
The Examiner requested a representative of the Public Works Department to respond to the
subject of whether or not off-site improvements should be required as a condition of
approval of the request in view of a recent legal opinion from the City Attorney that
such improvements must be justified by reason of public health, safety and welfare.
Responding was:

Traffic Engineering Division
Public Works Department
Mr. Lumbert indicated that although off-site improvements currently do not exist along
Duvall Avenue N.E. , provision of sidewalks would be desirable to accommodate pedestrians
of school age utilizing the route to neighboring schools. He advised that open ditch
drainage currently existing along the side of the roadway appears to be adequate and
installation of pipe or update of the drainage facility would not be necessary at the
present time. The Examiner requested clarification that only sidewalks and not other
off-site improvements would be required at this time. Mr. Lumbert responded affirmatively.
Mr. Clemens indicated concurrence with the analysis of the Public Works Department due to
marginal justification of off-site improvements. However, he noted that at some future
time when full improvements of Duvall Avenue N.E. to right-of-way standards occur,
improvements should include installation of curbs, gutters, sidewalks, street paving,
street lighting and drainage. Mr. Clemens indicated that requirement of full improvements
for the subject request should be deferred until such time as a larger development is
proposed or a local improvement district formed, but the applicant should agree to
participate in the project by signing restrictive covenants.
Referencing Exhibit #4, the Examiner inquired if an existing storage shed located six
feet from the northerly property line in Parcel 2 is in conformance with existing setback
requirements. Mr. Clemens advised that the SR-1 zone requires a five-foot sideyard
setback for one-story structures; therefore, the existing shed complies with ordinance
requirements. The Examiner inquired if the location of the existing residence conforms
to setback requirements in view of the required street dedication on Duvall Avenue N.E.
Mr. Clemens responded affirmatively. The Examiner recalled existence of an additional

storage shed within Parcel 1, not designated on Exhibit #4, and inquired if it would be
removed. Although Mr. Clemens could not specifically respond to the inquiry, he felt
that compliance with Exhibit #4 was intended by the applicant, and therefore, the
structure would probably be removed.
The Examiner requested a final recommendation from the Planning Department representative.
Mr. Clemens indicated the recommendation contained in Exhibit #1 would remain as submitted.
The Examiner requested that the applicant be contacted by the Planning Department and
requested to submit written comments no later than Friday morning, April 6, 1979. Mr.
Clemens indicated that the applicant will be so notified. •
The Examiner requested further comments. Since there were none, the hearing on File No.
Short Plat 307-79, E-308-79, and W-309-79 was closed by the Examiner at 9:25 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request is for approval of a three-lot short plat, an exception for two pipestem
lots and a waiver of off-site improvements.
2. The Planning Department report accurately sets forth the issues, applicable policies
and provisions, findings of fact, and departmental recommendations in this matter,
and is hereby attached as Exhibit #1 and incorporated in this report by reference as
set forth in full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , the subject proposal is exempt from
the threshold determination and EIS requirements of SEPA.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed. .
6. All existing utilities are available and in close proximity except that sanitary
sewer is located 1,000 feet north of the site.
7. The proposal is compatible with the setback and lot area and dimension requirements
of Section 4-704 (SR-1) of Title IV, and Section 9-1108.23 (Subdivision Ordinance -
Minimum Standards for Residential Design) , Title IX, Ordinance No. .1628, Code of
General Ordinances; except for Pipestem Lots 1 and 2 (Section 9-1108.23.F. (3) . (d) .
8. With the exception of an affidavit of ownership (Exhibit #5) certification per
Section 9-1106.3.H has not been completed.
9. Off-site improvements do not exist in the reasonable vicinity of the property and
have been requested by the applicant to be waived.
10. Restrictive covenants were not submitted (Section 9-1105.3.B) .
11. Staff and Exhibit #4 indicated that for some time dedication of additional right-of-way
along Duvall Avenue N.E. has been planned. Twenty feet was recommended for dedication
of the applicant's property. The dedication produces no conflict with building
setback regulations of Section 4-704 (SR-1) .
12. The existing storage shed located on Lot 2 conforms to the building setback regulations
of Section 4-704 (SR-1) . It is unknown if the existing storage.building on Lot 1 also
conforms to these regulations.
13. Per Exhibit #4 sufficient property frontage exists along Duvall Avenue N.E. for
dedication of a public road (50-foot right-of-way) into the property while apparently
conforming to building setback regulations for the existing home on Lot 3. Pavement
of approximately 20-25 feet in width apparently exists within what will be the
pipestem area.
CONCLUSIONS:
1. The proposal as herein decided appears to conform to the Comprehensive Plan, zoning
regulations and Subdivision Ordinance and protects the ". . .public health, safety,
welfare and aesthetics. . ." (Section 9-1101.2)..
2. Certification per Section 9-1106.3.H. can be completed per staff review and approval

prior to, at or immediately following filing of the final plat with King County.
3. The amount of property frontage along Duvall Avenue N.E. is insufficient to permit
more than a single lot width. However, this frontage is sufficient to permit one
lot width and the normal 50-foot wide dedicated public street without reducing the
proposed density of the short plat or ,potential development of the remainder of the
property. It appears that "undue hardship" does not exist for the applicant to
dedicate the right-of-way in lieu of two pipestems to serve the large lots of Lot 1
and 2 (Section 9-1109.1) . The "physical circumstances" that exist and dedication
of the right-of-way do not appear to ". . .deprive the applicant of the reasonable use
or development of his land;" (Section 9-1109.1.A) . Development of a three-lot short
plat will be unaffected, in terms of design and potential density, by the dedication
in compliance with the Subdivision Ordinance. It has not been claimed or substantiated
that the dedication would interfere with the applicant's "rights and privileges"
(Section 9-1109.1.B) . Injury to other properties or the public welfare is not
apparent as a result of the pipestems or dedication.
Recognizable is the monetary impact of improvements to this dedicated public street.
However, this impact is greatly reduced by the existing 20-25 feet of pavement in
apparently the street and pipestem areas. This amount of paving is unusual in the
area and has not been witnessed in short plat applications before the Examiner in
the past two years. It seems that the substantial amount of off-site improvements
to the right-of-way have been completed previously. The issue then becomes a waiver
of these improvements.
4. The public notice in the file of record does not specify which' street(s) for which
a waiver of off-site improvements was requested by the applicant. Testimony in the
public hearing addressed improvements along Duvall Avenue N.E. exclusively. However,
it appears reasonable that the waiver of improvements within this new dedicated
street can be included in the application and can be acted upon by the Examiner.
Since driveway access of Lot 3 fronts on the new right-of-way, a total of three lots
will utilize this new street and the existing pavement. This density does not appear
to necessitate full improvements, which would seem to inflict "undue hardship" upon
the applicant (Section 9-1109.1) . For such a low density full improvements would
appear to severely reduce the short plat potential which is a ". . .reasonable use or
development of his land; " (Section 9-1109.1.A) . A waiver will preserve the "Rights
and privileges" of the applicant (Section 9-1109.1.B) . Detriment to the public
welfare and other properties is not evident (Section 9-1109.1.C) . What improvements
are necessary beyond paving at this time is uncertain for the public health, safety
and welfare.
On this basis, it appears appropriate to waive off-site improvements. However, due
to the ultimate potential development of Lots 1 and 2 by further subdivision, the
waiver should be conditioned upon completion of restrictive covenants agreeing to
participate in an LID for these off-site improvements if required by the city or as
a result of further subdivision of Lots 1 and 2.
5. Relative to off-site improvements along Duvall Avenue N.E., the absence of these
improvements in the immediate vicinity strongly suggests that the improvements should
be waived (Section 9-1105.6.B) . Testimony indicated that sidewalks would be necessary
for public health, safety and welfare because a public school is located northwest
of the site. However, this would appear to more strongly suggest that sidewalks are
necessary along the west side of Duvall Avenue N.E. , not the east side (along the
applicant's property) . Therefore, it appears that sufficient justification is lacking
for requiring off-site improvements along Duvall Avenue N.E.
6. The reclassification decision approving SR-1 zoning on the property (R-306-79) to
allow the proposed short plat has not been finally approved by the City Council.
Pending this approval, the short plat can be approved.
7. Dedication of additional right-of-way for Duvall Avenue N.E. appears a tenuous request
on the basis of the record. Insufficient evidence was submitted to weigh public
benefit and the impact of this development to draw the conclusion that additional
right-of-way along Duvall Avenue N.E. is necessary. The scale and intensity of the
proposal does not appear to warrant additional right-of-way.
DECISION:
Approval of a short plat subject to:
1. Revision to Exhibit #3, submitted short plat, to include a 50-foot dedicated right-
of-way along all. of Lot 3.
2. Approval of the reclassification to SR-1 (R-306-79) .

3. All existing structures and buildings conforming to applicable building setback
regulations. .
4. Completion of certification per Section 9-1106.3.H.
5. Final approval of the final plat by the Planning and Public Works Department for
conformance with this decision.

Approval of a waiver of improvements within the aforementioned 50-foot public right-of-
way until such time as Lots 1 and 2 are further subdivided. Restrictive covenants are
to be completed attesting to participation in 'an LID for installation of these improvements
when required by the City of Renton and/or upon subdivision of Lots 1 or 2.
Approval of a waiver of off-site improvements along Duvall Avenue N.E. since insufficient
justification was provided for requiring these improvements which do not exist within a •
reasonable distance (Section 9-1105.6.B) .
Denial of the exception for two pipestem. lots.

into lots 9, 000 to 13 , 000 square feet . All properties -
in the applicant ' s proposed short plat would. exceed
18 , 000 square feet . The proposed rezone to SR-1 appears
consistent with the existing properties in the area and ,
therefore , appropriate for the site. . The Land Use
Report , 1965 , advises : "Encourage the development and
utilization of land to its highest and best use in such
a way as to promote the best interest of the community
and contribute to its overall attractiveness and desir-
ability as a place in which to work , shop , live , and
play. " (Objective 6, p . 18 )
5 . Suitable water supply is available to the subject site.
However , the nearest sewer line is approximately 1/4 mile
to the north of the site , and the Utilities Engineering
Division advises that pumping would be required .

6. All the departments reviewing this proposal indicate no
objections other than the situation in #5 above .
7 . Analysis items 3 and 4 appear to comply with Section
4-3014 , thus substantiating the proposed rezone .
M. DEPARTMENTAL RECOMMENATIONS :
Approval of the requested rezone from "G" to " SR- 1" based on
the compatibility of the proposed use with the existing uses
and that the site has not been previously considered by an
area-wide zoning review.
. N . PLANNING DEPARTMENT ANALYSIS ( SHORT PLAT ) :
1. The subject proposal is consistent with the Comprehensive
Plan , which designates the site and surrounding area as
single family residential .
2 . The proposal is compatible with adjacent single family
residential uses and similar patterns in the area . '
3. The size of the existing property is large enough that
the proposed short plat is a reasonable use of the land .
Proposed Lot #1 is approximately 21 , 605 square feet , and
Lot #2 is approximately 105 ,460 square feet. Lot #3 with
the existing residence is approximately 18 ,496 square feet.
4 . Although the lots of the proposed short plat do exceed
the minimum lot size requirement of the SR-1 zone and the
Subdivision Ordinance , the amount of frontage on Duvall
Avenue N. E. is not sufficient to meet the 75 foot standard
for each lot. The applicant is therefore proposing Lot #3
with a 125-foot frontage with Lots #1 and #2 designed as
pipestem lots with 25-foot frontages and 125 foot and 145
foot pipestem lengths respectively.
5 . The parcel immediately west and north of proposed Lot #1
is separate and apart from the subject site and contains
frontage on Duvall Avenue N . E . Because of this location ,
proposed Lots #1 and #2 cannot meet the frontage require-
ment of the SR- 1 zone . It would seem, therefore , that
reasonable justification can be provided for the exception
as proposed in #4 above . (Section 9-1109. 1A)
6 . The Engineering Division of the Public Works Department
advises that if and when Lot #2 is developed , the additional
25 feet of right-of-way in Lot #1 will have to be acquired
to provide for a full 50-foot wide street with improvements .
7 . At this time off-site improvements along Duvall Avenue N . E.
are very limited . Therefore , deferring improvements until '
a future time appears warranted . Thus , the waiver of off-
site improvements subject to restrictive covenants providing
for future LID participation appears satisfactory .
8 . At such time as Parcel #2 is further developed by a street
extension , area-wide circulation can be addressed to insure
access , if required , to the east of this parcel .
9 . At the time of this report preparation , we have received no
written comments from outside departments .

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.

you believe an explanation would be helpful to government decision makers , include your

The subject site was annexed into the City by Ordinance 2945 dated
July 17 , 1975.
D . - PHYSICAL BACKGROUND :
1 . Topography: The site is generally level .
2. Soils : Alderwood Gravelly Sandy Loam (AgC ) . Permeability is
moderately rapid in the surface layer and subsoil and very
slow in the substratum. Runoff is slow ,to medium, and the
erosion hazard is moderate. This soil is used for timber ,
pasture , berries , row crops , and for urban development.

3. Vegetation : Low scrub grass dominates the property with a
dense stand of Douglas Fir Trees extending the length of the
east boundary. Parts in the north portion have been cleared
and graded .
4. Wildlife : Existing vegetation on the site may provide suit-
able habitat for birds and small mammals .
5. Water : No surface water was observed on the subject site .
6. Land Use : An existing single family residence and a large
shed are located in the southwest portion of the property.
Another single family residence is located immediately north
of the site. Additional single family dwellings are found
to the south, and west while the property immediately east
remains largely undeveloped.
E . NEIGHBORHOOD CHARACTERISTICS :
The area is composed principally of widely scattered single family
residences .
F. PUBLIC SERVICES :
1 . Water and' Sewer : An existing 12" water main extends north-
south on the east side of Duvall adjacent to the subject site
and a 3" main is located on the west side. An 8" sanitary
sewer runs east-west on S. E. 101st Street approximately
1 ,000 feet north of the subject site .
2. Fire Protection : Provided by the Renton Fire Department as
per ordinance requirements .
3. Transit : Metro Transit Route 107 operates along Union Ave-
nue N. E. approximately 3/4 of a mile to the southwest of the
subject site.
4. Schools : Honeydew Elementary School is approximately one
mile southwest of the subject site , and McKnight Middle
School is 'within 1 3/4 miles to the west , while Hazen HIgh
School is within one-half mile to th.e south .
5. Recreation : Kiwanis Park is located approximately one mile
to the southwest of the subject site and North. Highlands Park
is within 2 miles west.

20 additional vehicle trips per day on Monroe Avenue N . E .
This would increase traffic flow by less than 1% per day on
this arterial .
J . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the Cityof Renton ' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
no determination of environmental significance is required for
the short plat. However , a declaration of non-significant
impact has been prepared for the rezoning due to its scope .

L . PLANNING DEPARTMENT ANALYSIS - REZONE :
1 . The proposed rezone is consistent with the Comprehensive Plan
map element which designates the site and general area as
single family residential . ,
2. The applicant proposes to subdivide the subject site into
three parcels . This will require the approval of a short
plat by the Hearing Examiner . In addition , exceptions for
two pipestem roads and a request for waiver of off-site
improvements will be required.
3. The subject site has been zoned "G" since it was annexed
in 1975 .. Review of the Planning Department records does
not indicate an areawide zoning review of the site since
that time.
4. The subject site is located on the east side of Duvall
Avenue N . E . The land on the west side of Duvall within
the City is presently zoned "G" also . Some properties
in King County on the west side of the street are zoned
Suburban Residential with a minimum lot size of 7200
square feet with sewers and 15 ,000 square feet without
sewers . Portions of the properties have been subdivided
into lots 9, 000 to 13 , 000 square feet . All properties
in the applicant ' s proposed short plat would exceed
18, 000 square feet. The proposed rezone to SR-1 appears
consistent with the existing properties in the area and ,
therefore , appropriate for the site . . The Land Use
Report , 1965 , advises : " Encourage the development and
utilization of land to its highest and best use in such
a way as to promote the best interest of the community
and contribute to its overall attractiveness and desir-
ability as a place in which to work , shop , live , and
play. " (Objective 6, p . .18)
5 . Suitable water supply is available to the subject site.
However , the nearest sewer line is approximately 1/4 mile
to the north of the site , and the Utilities Engineering
Division advises that pumping would be required .

6. All the departments reviewing this proposal indicate no
objections other than the situation in #5 above .
7 . Analysis items 3 and 4 appear to comply with Section
4-3014 , thus substantiating the proposed rezone .
M. DEPARTMENTAL RECOMMENATIONS :
Approval of the requested rezone from "G" to "SR-1" based on
the compatibility of the proposed use with the existing uses • ;;'
and that the site has not been previously considered by an
area-wide zoning review.
N . PLANNING DEPARTMENT ANALYSIS (SHORT PLAT ) :
1. The subject proposal is consistent with the Comprehensive
Plan , which designates the site and surrounding area as
single family residential .
2. The proposal is compatible- with adjacent single family
residential uses and similar patterns in the area .
3. The size of the .existing property is large enough that
the proposed short plat is a:reasonable use of the land .
Proposed Lot #1 is approximately 21 ,605 square feet , and
Lot #2 is approximately 105 ,4,60 square feet. Lot #3 with
the existing residence is approximately 18 ,496 square feet .
4. Although the lots of the proposed short plat do exceed
the minimum lot size requirement of the SR-1 zone and the
Subdivision Ordinance , the amount of frontage. on Duvall
Avenue N. E. is not sufficient to meet the 75 foot standard
for each lot. The applicant is therefore proposing Lot #3
with a 125-foot frontage with Lots #1 and #2 designed as
pipestem lots with 25-foot frontages and 125 foot .and 145
foot pipestem lengths respectively..
5. The parcel immediately west and north of proposed Lot #1
is separate and apart from the subject site and contains
frontage on Duvall Avenue N . E . Because of this location ,
proposed Lots #1 and #2 cannot meet the frontage require-
ment of the SR-1 zone . It would seem , therefore , that
reasonable justification can be ,provided for the exception
as proposed in #4 above . (Section 9-1109. 1A)
6. .: The Engineering Division of the Public Works Department
'advises that if and when Lot #2 is developed , the additional
25 feet of . right-of-way in Lot #1 will have to be acquired
to provide, for a full 50-foot wide street with improvements .
7 . At this time off-site improvements along Duvall Avenue N . E .
are very limited . Therefore , deferring improvements until
a future time appears warranted. Thus , the waiver of off-
site improvements subject to restrictive covenants providing
for future LID participation appears satisfactory .
8. - At such time as Parcel '#2 , s , further developed by a street
