P1. 345-79; Anton & Millie Althoff Request for Short Plat. • Dear Mr. Brown: • I have reviewed your letter of June 15, 1979, and find that the methods you propose for buffering the remaining properties, Lots 2 and 3, would meet the intent of the conditions imposed by the decision. Your office may prepare the, necessary restrictive covenants. These covenants are to include a total buffer of 25 feet which is either to be landscaped or left in a natural state subject to the approval of the City of Renton Planning Department. You and the property owner • • may apportion the 25 feet between the properties as you may mutually agree, a's long as the buffer separates the two zones along both property lines. • The covenant should be submitted to the Hearing Examiner for review before the decision is. finalized. • It is not possible to discuss the possible future rezone of the remaining parcels at this time, but the covenants may be drafted so as to dissolve if that eventuality occurs. On Page Three you indicate the condition of a 25 foot buffer. My question regards its location on Lots 1-3. As shown by the attached site plan, the McDonald's Corporation had planned an 8 foot planting buffer on the west side of Lot 1. They have since revised this to a width of between 11 and 12 feet. Therefore, if the owner accepts a restrictive covenant on Lot 2 providing for a 13 or 14 foot landscape buffer, will this meet the intent and purpose of your determination? Also, with regard to the south side of Lot 1, may a restrictive covenant be placed on Lot 3 which provdes for the reserving of the 25 foot buffer and subsequent planting when Lot 3 is developed; that is, leaving the buffer area in its natural state? And finally, the ownermquests a reply as to permission from the City of Renton to remove the/1Y foot and 25 foot landscaping if he so chooses should either Lot 2 or 3 be rezoned to B-1. APPLICANT: Anton and Millie Althoff FILE NO. Short Plat 345-79' LOCATION: Southwest corner of Sunset Boulevard N.E. and Anacortes Avenue N.E. SUMMARY OF. REQUEST: Applicant seeks approval of a proposed four-lot short plat for future commercial and residential uses. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. • Hearing Examiner Decision: Approval with conditions. • PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on May 24, 1979. • PUBLIC HEARING: After'reviewing the Planning Department report, examining available information on file with the application, and field • Checking the property and surrounding area,' the'Examiner conducted a public hearing On the subject as follows: The hearing was opened on May 29, 1979 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. ' Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner. and the appliant had received and reviewed the planning. Department report, and the report was entered into the record as Exhibit #1. Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional exhibit into the record: • Exhibit #2: Short Plat Map • The -Examiner referenced the Subdivision Ordinance which requires that corner' lots 'be platted wider than interior lots,' and inquired if an exception to the ordinance had been requested to allow the proposed configuration. Mr. Munson 'advised that an exception had not been requested. David Clemens, Senior Planner, stated the applicant's intent to separate the B-1 zoned parcel from the remainder of the lots, and therefore, was the rationale for the existing shape of Lot 1 in the plat. • The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:• • Larry Brown Western Pacific Properties • 11715 N.E., 145th Street Kirkland, WA 98033 - Mr. Brown, indicated concurrence in ,the report. He advised that because the applicant had been unaware of Subdivision Ordinance requirements for platting the corner lot wider than interior lots, an exception had not previously been requested; however; he indicated that . the exception was desired at this time. He noted-that the potential tenant of Lot 1 had requested a one-acre parcel which had provided the rationale for the• lot configuration. Referencing.the summary' and purpose of the request contained in Exhibit #1 which indicates the proposed use of. the site for future commercial development, Mr. Brown advised that three-quarters of the site is zoned for residential use, although further study and recommendation by the Planning Department for Comprehensive Plan revision. may eventually allow additional rezone action on the site. • The Examiner inquired if the applicant concurred in the recommendation for completion' of full off-site improvements. Mr. Brown indicated. 'his concurrence. The Examiner advised that.if an exception is determined necessary to allow the configuration of Lot 1; separate legal publication. and hearing will be necessary regarding the matter. • • The Examiner requested testimony in support or opposition to the application. There was no response. He then requested a final recommendation from the' Planning Department representative. Mr. Munson advised. that subsequent to publication of Exhibit #1, the ;r; following departmental comments were received: Engineering Division recommends that Short Plat=-;i45-79 Page Two • Anacortes Avenue N.E. must be, completed with full off-site improvements; and on-site retention/detention systems will be required upon development; Building Division/Traffic Engineering Division have no objection to the proposal. Mr. Brown requested a copy of the departmental comments. The Examiner advised that further review of commercial/residential requirements contained in the Subdivision Ordinance will be required to determine the necessity of an exception, and the applicant will be notified if further public hearing is required. The Examiner requested further testimony. Since there was none, the hearing on File No. Short Plat 345-79 was closed by the Examiner at 9:24 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a four-lot short plat. 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the.State Environmental Policy Act of 1971, R.C.W. 43.21..C. , as amended, the subject proposal was determined to be exempt by Gordon Y. Ericksen, responsible official. • 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity.• 7. The, proposal is compatible with the required setbacks, lot coverage and height . requirements of Sections 4-709A and 4-711 of Title IV; and Sections 9-1105 and 9-1106 of Title IX, Ordinance No. 1628, Code of General Ordinances. 8. The subdivision is generally consistent with development in the area. There is commercial development to the east arid multiple family residential to the north and south of the subject property. 9. The rezone provided that Honeydew Creek and existing natural trees be retained if review by the Planning Department indicated that was possible. 10. The B-1 designation of the northwest corner of the property appears to conflict with the Comprehensive Plan for the area. 'This is identified as Lot 1 on the plat map (Exhibit #2) . • • The B-1 lot intended to be developed as a fast food restaurant is adjacent to Lots 2 and 3 which are zoned R-3, a residential designation. 11. Sunset. Boulevard N.E. is developed with off-site improvements. The intended use of the subject property is such that similar improvements will be necessary along Anacortes Avenue N.E. The Engineering Division states that the installation of curb, gutter, sidewalk, storm drainage, street lighting and paving is required along the west side of Anacortes. ' 12. Approved sewer ,service will, be required to ,be extended to Lot 3, subject to standard fees and a late comers fee computed at $5.23/ft. is required for water service along Sunset Boulevard. CONCLUSIONS: 1. The short plat. presented by the applicant appears to satisfy the requirements of the Subdivision Ordinance. There is some conflict between the existing B-1 zone and the Comprehensive Plan and a possible incompatibility of uses between the B-i use proposed • and the ,R-3 zoning• to the west and south. • ' To avoid conflict between these adjacent zones the applicant `should'provide a buffer both to- the south and west between these zone boundaries "to provide for wholesome environmental conditions in the .community" as provided in Section 9-1101.2. "The ' location of shopping areas should, generally,' be such that protection is given to .' residential areas from unwarranted business encroachment (Page 6, Renton Urban Area sp • Short Pl__.-345-79 Page Three Comprehensive Plan, 1965) . A 'fast food restaurant is the type of commercial establishment which has a large impact on the area in terms of traffic and litter.
