REPORT AND' RECOMMENDATION.

APPLICANT: Albert R. James FILE NO. Short Plat 348-79,

LOCATION: 1416 Jones Avenue N.E.

SUMMARY OF REQUEST: Applicant requests approval of a proposed two-lot short plat
together with exceptions to the Subdivision Ordinance to permit
a 20-foot pipestem to provide access to a proposed rear lot and
to allow a 50-foot lot width. The applicant also seeks a
waiver of the required off-site improvements.
SUMMARY OF ACTION: Planning Department: Approval with restrictive covenants.
Hearing Examiner: Approval with restrictive covenants.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on May 31, 1979.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding' area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on June 5, 1979 at 9:40 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
Steve Munson, Planning Department, reviewed Exhibit #1, and entered the following additional
exhibits into the record:
Exhibit #2: Short Plat as submitted
Exhibit #3: Short Plat with staff comments .
The Examiner inquired. regarding the method of access for the residence located south of
Lot 1. David Clemens, Senior Planner, advised that the lot Was created prior to annexation
of the property, is fully landlocked and access is provided by private easement.
The Examiner requested testimony by the applicant. Responding was:

The Examiner asked the applicant if he concurred in Exhibit #1. Mr. James indicated his
concurrence. with the exceptiori'of immediate provision of off-site improvements, and advised
his intent to participate in a future LID for improvement of Jones Avenue N.E. The Examiner
inquired if the existing residence on the pr.operty. is proposed to be removed. Mr. James
. responded affirmatively. The Examiner inquired if emergency vehicle turnaround area will
be provided on the rear lot. Mr. James responded affirmatively.

The Examiner requested further testimony from the Planning Department representatives.
Mr. Munson indicated that the request for exception had not been included with Exhibit #1
and it was entered into the record as follows:

The Examiner requested testimony in support or opposition to the application. There was
no response. He then asked Paul' Lumbert, representing the Public Works Department, if
the department was amenable to a delay in improvements to Jones Avenue N.E. until an LID
is formed. Mr. Lambert indicated that the department had no objection to future participation
in an LID.

The Examiner requested a final recommendation from the Planning Department. Mr. Munson
advised that the recommendation contained in Exhibit #1 would remain as submitted.
The Examiner requested further comments. Since there were none, the hearing on File No.
Short Plat 348-79, E-349-79 and W-350-79 was closed by the Examiner at 9:50 a.m.
FINDINGS, CONCLUSIONS AND DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1. The request is for approval of a two-lot short plat for +.41 acres; and exceptions
to allow a 20-foot pipestem access and a 50-foot lot width.
2. The Planning Department report sets forth the issues, applicable policies and provisions,
findings of 'fact, and departmental recommendations in this matter, and is hereby
attached as Exhibit #1 and incorporated in this report by reference as set forth in
full therein.
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal was determined
to be exempt by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and height
• requirements of Section 4-729 of Title IV, Ordinance No. 1628, Code of General
Ordinances.
8. The subject property is located at 1416 Jones Avenue N.E. in a G-7200 district. The
subject property is 70 feet wide by 258 feet deep, for a total area of 18,060 square
feet.

9. The subject site was annexed into the city by Ordinance No. 1818, dated March 17, 1960.
10. The applicant proposes subdividing the subject parcel into two lots. One of the
resulting lots will front directly on Jones Avenue N.E. The other lot would be an
. interior lot with access to Jones via a pipestem extension- which is subject to approval
by the Examiner (Section 9-1108.23. (F) .3 (d) ) .
The required pipestem would be 20 feet in width and 150 feet in length. The twenty
foot width would result in the front lot being only 50 feet wide whereas Section
9-1108.23(F) .3(c) requires a minimum lot 'width of 60 feet. An exception is therefore
required to plat a lot less than the required width. •
The applicant has submitted a letter requesting the above two exceptions (Exhibit #4) ,
and outlining the reasons why they are needed.
11. The block in which the subject property is located is a large block without any access
to interior properties. Most of the lots in the block are the minimum 7200 square
foot size required in the G-7200 zone. Public access via an approved street would
require considerable expense and would require a considerable amount of square footage
from each of the lots. . . There already exist some pipestem lots on the north end of the
block in which the subject property is located.
12. Each of the proposed lots would provide more than the minimum required building
envelope.
13. There are no off-site improvements in the area of the proposed short plat but further
subdivision of the lots in this area will create larger demands on the street. The
applicant indicated that he would be willing to participate in an LID when.one is
warranted by future conditions but has requested a waiver of improvements pursuant to
the provisions of Section 9-1105.6. (B) . The Public Works Department has indicated that
such a waiver is currently warranted.

CONCLUSIONS:
•
1. The proposed short plat is compatible with the Comprehensive Plan which designates
the area as single family residential, with the zoning which is G-7200, single family
residences on 7200 square foot lots, and with the actual land use of the area.
2. The proposed lots will each be larger than the minimum requirements for the zone.
The lot fronting on Jones Avenue N.E. will have a building envelope of approximately
4,000 square feet. The interior lot will provide a lot of about 7600 square feet
not including the pipestem portion of the lot.
3. Because of the configuration of the existing block, it is impractical to develop a
through street in the vicinity of the interior lots. The only means of access to the
interior parcels is through the creation of pipestem lots, as is the case with some
lots on the north end of the block.
The proposed pipestem will meet the requirements for size and access. As indicated
other such lots exist in the vicinity. The approval of this exception will not
adversely affect the. public welfare or neighboring properties.
4. The front lot will, if the exception is approved, provide a 50-foot frontage along
Jones Avenue N.E. Other than that, 'the lot will meet or exceed the other code
requirements for coverage, yards, and area. The alternative of providing an
easement would have the same practical effect, 50 feet of useable lot width, but
create unnecessary legal problems for each of the two resulting lots.
Again, .there will be no adverse effect upon either the public welfare or neighboring
properties. This lot would still provide a'reasonable developable area without
overcrowding the neighborhood, or adjacent lots.
5. The requested waiver for the provision of off-site improvements appears justified
in light of the lack of any similar improvements in the area at the present time.
Further development or subdivision may create traffic and pedestrian conflicts in
the area and therefore, future participation in an LID, which the applicant indicated
willingness to join in, is reasonable. The Public Works Department has approved this
approach.
DECISION:
Exhibit #2 is approved subject to the standard requirements of the Public Works and Fire
Departments with the provision that the applicant execute a covenant to participate in
an LID for off-site improvements when conditions warrant such action.

The subject site was annexed into the City by Ordinance #1818 dated
March 17 , 1960 .
D . PHYSICAL BACKGROUND :
1 . Topography : The site slopes from northeast to southwest at about
10%. No major topographic breaks exist on the site .
2 . Soils : Indianola loamy fine sand , 4-15% slopes ( InC),. Permeability
is rapid . Available water capacity is moderate . Runoff is slow to

L . PLANNING DEPARTMENT ANALYSIS : '
1 . The applicant proposes to 'subdivide a 70 ' by 258 ' parcel
( 18,060 square feet) into two parcels. In order to provide access
to the parcel at the rear, a 20 ' pipestem' of 150 ' length is
proposed . The remaining frontage of 50' provides access to
the lot facing Jones Avenue NE .
2 . The proposed arrangement requires approval of exceptions to allow
pipestem access to the rear lot area , and due to the reduction in
frontage , the remaining lot width is less than the 60 ' minimum
lot width requirement. The applicant ' s letter of May 7 , 1979
addresses the justification for this variance .
3. The subject lot exceeds the minimum lot area required for two
lots by approximately 3600 square feet (2 lots at 7200. square feet
and 14 ,400 square feet) .
4. Because of the design of this residential block , provision of
a public street running north-south does not appear to be
reasonable . Minimum size lots back onto these larger lots and
total depth is not sufficient to provide for a greater number of
lots even with public access . In the case of this lot , a 50' street
would use 3500 square feet of lot area , require substantial
initial cost of construction , and continuing costs fo the public
for maintenance . Therefore , the pipestem access appears warranted .
5. Since access to the rear is required to be a minimum of 20' in
width , the remainder of the lot is only 50 ' wide . Although this
is the minimum width of the zoning ordinance , it is less than the
60 ' required by the subdivision ordinance . The lot is proposed
to exceed the minimum lot area of the G-7200 District. This would
appear to provide ample area for a single family residence of
38 ' by 105 ' (4000± square feet) . Should the exception be
disallowed , the development potential of the site would be reduced
to one-half.
6. The applicant has also requested a waiver of the requirement for
off-site improvements . The Engineering Division indicates that
these improvements should include curbs , gutter , sidewalk , storm
drainage , street lighting and. paving . Based upon the current
use of this street and the potential large increase (possibly
100% with further division of lots on this block) in traffic ,
these improvements appear to be warranted to protect the public
health , safety and welfare . However , the immediate need is not
as crucial as future improvement of this street area . Therefore ,
waiver subject to covenants , providing for future development by LID
or similar appears warranted .
7 . The Fire Department notes that access and fire protection must
be provided . Turnaround details on the rear lot should be, finalized
with review of specific building plans . '

C . HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance #1818 dated
March 17 , 1960 .
D . PHYSICAL BACKGROUND :
1 . Topography : The site slopes from northeast to southwest at about
10%. No major topographic breaks exist on the site .
2 . Soils : Indianola loamy fine sand , 4-15% slopes ( InC ) . Permeability
is rapid . Available water capacity is moderate . Runoff is slow to
medium and the erosion hazard is slight to moderate . This soil
is used for timber and for urban development.

3 . Vegetation : The westerly portion of the site consists of scrub
grass and a few small deciduous and evergreen trees . To the rear
of the existing dwelling the cover is principally scrub grass
with medium growth deciduous trees, along the perimeter .
4. Wildlife : Existing vegetation on the site may provide suitable
habitat for. birds and small mammals .
5 . Water : No surface water was observed on the subject site .
6 . Land Use : An existing single family residence is located in •
the westerly portion of the property. Lots to the east , north and
south contain other single family residences . To the west across
Jones Avenue are additional single family dwellings .
E . NEIGHBORHOOD CHARACTERISTICS :
The surrounding area is principally single family residential in
nature .
F . PUBLIC SERVICES:,
1 . Water and Sewer : A 6" water main extends north-south on Jones
Avenue NE and an 8" sanitary sewer is also located on Jones Avenue .
2 . Fire Peotecti,on : Provided by the Renton Fire Department as per
ordinance requirements .
3 . Transit : Metro Transit - Route #107 operates along Sunset Blvd . NE
within 3/4 of a mile to the southest of the subject site .
4 . Schools : The Kennydale Elementary School is approximately 3/4 of
a mile north of the subject site and McKnight Junior High School .
is. withi.n 3/4 of a mile to the east while Hazen Senior.- High School.
is' approximately 3 miles to the east.
5. Recreation : Kennydale Lions Parks is within 3/4 of a mile to the
north and the North Highlands Park is approximately 3/4 of a mile

L . PLANNING DEPARTMENT ANALYSIS :
1 . The applicant proposes to subdivide a 70 ' by 258 ' parcel
( 18, 060 square feet) into two parcels . In order to provide access
to the parcel at the rear, a 20 ' pipestem of 150 ' length is
proposed . The remaining frontage of 50 ' provides access to
the lot facing Jones Avenue NE .
2 . The proposed arrangement requires approval of exceptions to allow
pipestem access to the rear lot area , and due to the reduction in
frontage , the remaining lot width is less than the 60 ' minimum,
lot width requirement . The applicant ' s letter of May 7 , 1979
addresses the justification for this variance .
3. The subject lot exceeds the minimum lot area required for two
lots by approximately 3600 square feet (2 lots at 7200 square feet
and 14 ,400 square feet) .
4. Because of the design of this residential block , provision of
a public street running north-south does not appear to be
reasonable . Minimum size lots back onto these larger lots and
total depth is not sufficient to provide for a greater number of
lots even with public access . In the case of this lot , a 50 ' street
would use 3500 square feet of lot area , require substantial
initial cost of construction , and continuing costs fo the public
fortmaintenance . Therefore , the pipestem access appears warranted .
5. Since access to the rear is required to be a minimum of 20 ' in
width , the remainder of the lot is only 50 ' wide . Although this
is the minimum width of the zoning ordinance , it is less than the
60 ' required by the subdivision ordinance . The lot is proposed
to exceed the minimum lot area of the G-7200 ' Distr.ict . This would
appear to provide ample area for a single family residence of
38' ' by 105 ' (4000± square feet ) . Should the exception be
disallowed , the development potential of the site would be reduced
to one-half.
6 . The applicant has also requested a waiver of the requirement for
off-site improvements . The Engineering Division indicates that
these improvements should include curbs , gutter , sidewalk , storm
drainage , street lighting and. paving . Based upon the current
use of this street and the potential large increase (possibly
100% with further division of lots on this block) in traffic ,
these improvements appear to be warranted to protect the public
health , safety and welfare . However , the immediate need is not
as crucial as future improvement of this street area . Therefore ,
waiver subject to covenants , providing for future development by LID
or similar appears warranted. .
7 . The Fire Department notes that access and fire protection must
be provided . Turnaround details on the rear lot should be finalized
with review of specific building plans .
