1. CALL TO ORDER - The meeting was called to order by Chairman Gonnason at 9:00 a.m.
2. APPROVAL OF MINUTES - Moved by DAVE CLEMENS, seconded by JOHN WEBLEV, the minutes ob
August 8, 1979 be appkoved as mitten. MOTION CARRIED.
3. CORRESPONDENCE - Letter from A. Daniel Dansereau, Manager, Vallis Investors, requested that
the deferral the Board granted June 7, 1978 for the East Valley Medical Park, 3713 Talbot Road S.
be continued for another year because of the time required for the preliminary planning and the
approval of the various City departments. The letter noted the final engineering plans will be
finished shortly and construction will start soon after. Moved by DAVE CLEMENS, seconded by

4. REFERRALS FROM COUNCIL:
a. Proposed Vacation of Right-of-Way Between NE 4th St. and Union Ave. NE, Michael Mastro,
VAC-15-79, Public Hearing - September 7, 1979 - Planning Department report recommended that the
vacation be granted subject to the creation of a standard cul-de-sac at the end of the vacated
right-of-way for turnarounds and the landscaping of all other right-of-way areas that are vacated.
Discussion was held of the areas to be landscaped, it being noted that the matter of using the
area is subject to the Hearing Examiner's decision. There are utilities in the area so ease-
ments will be required. Moved by DAVE CLEMENS, seconded by PAUL LUMBERT, the matter be continued
bon one week. MOTION CARRIED.
b. Proposed Vacation of a Portion of SW 12th St.L East of Oaksdale Ave. SW, David A. Sabey,
VAC-16-79, Public Hearing - September 24, 1979 - The Planning Department report noted the appli-
cant was requesting vacation of a portion of SW 12th St and the alley within Block 41 to con-
struct an office complex and associated parking lots and recommended the vacation be granted
subject to appropriate purchase by the applicant. Mr. Gonnason noted that this was the last
piece of unvacated right-of-way in that area. Discussion was held regarding the value of the
land, it being noted that it was zoned B-I. Moved by DAVE CLEMENS, seconded by JOHN WEBLEV,
that the Board recommend to the Counai.t that the street be vacated subject to any easements
nequ led and at a valuation ob $1.80 pen square boot, noting the street and alley were not
neces4any to the City's t4ab6.ic citcwtatLon. MOTION CARRIED.
c. Proposed Vacation of a Portion of Tacoma Ave. NE, North of NE 17th St. Between Shelton
AVe. NE 6 Union Ave. NE (VAC-17-79)1 Public Hearing - October 1 1979 - It was noted that the
departments had not had time to review this item. Moved by DAVE t CLEMENS, seconded by JOHN WEBLEV,

a. Deferral of Off-Site Improvements, SE Corner of NE 19th St. at Shelton Ave. NE Kienle
Short Plat - Planning Department report noted the applicant is requesting a deferral of all
off-site improvements based on the fact that there are no other improvements in the area and
the property is the key to the access of most of the surrounding neighborhood and recommended
the request for deferral be denied based on the fact that both the condominium complex and the
subdivision are under construction at this time and the approval of the short plat gives the
applicant one year from the date of application which would give them until June, 1980, for
completion. Mr. Houghton noted that they were working on the improvements right now on Shelton
and they are only responsible for half a street. Mr. George Oberholtzer, the contractor for
the property, explained that he was putting in the improvements on Shelton Ave. now, but they

Request for Reconsideration.
Dear Mr. Robison:
I have this date received and reviewed your request for reconsideration.
Upon review I have determined that the arguments you make in your letter
requesting reconsideration are persuasive and that the short plat should
have been approved as submitted. .
The proposed lots with their generally more expansive areas are more
compatible with the area and surroundings: Also the lots are easier
to construct residences upon and would permit wider side yards and
more privacy for the occupants. As you indicate, uniform building line .
is preferable to the staggered building line that the Examiner's decision
would. necessitate:
The pipestem lot is not favored since it too infringes on privacy, but
because of the layout of the subject property it presents a reasonable
alternative for access. As you pointed out, there is another similar
lot in the area which uses a pipestem for access, and therefore, the
approval of,the pipestem lot would not convey a privilege to the
applicant.
The decision shall be changed to reflect the matters considered in this
response to your request for reconsideration. ,
DECISION:
Exhibit #2 is approved.
The Exception for the pipestem lot (Lot No.. 1) is .approved.
The requested Waiver of the required off-site improvements is denied.

' , . The propaed 58.33 foot, Pots would be barely sufficient for
average 'Size houses and' would require either, putting houses in
with very small.sideyards, or.staggering the distances the houses
.are set back from the street. Either alternative would produce
an irregular,orowded, or jumbled appearance. This would run against
the. envisioned development. of this property, which was for .larger.
than average'.houses'on lots with wide sideyards. The narrower lots
however would require; smaller,. ,lo•Wer coat houses, than those envisioned,
and that, combined with their crowded or jumbled appearance,, would-
be detrimental to the values. of: the properties. to the East and -
West and would also wake development of this property unfeasible,
or less feasible, by reducing .the value and.saleability of the
homes to be built, without reducing the land development coat.
• Item Two of the conclusions states that three 58.33.x 160 'foot
lots are considered.superior to a 60 x 175 foot pipestem lot which: .
. • would be 'unduly elongated' . The first question is whether a 60 x

' lot, and the .second question is whether three such elongated. lots

In conclusion reconsideration of Short Plat 368-79, and Exception
E-370-79, and approval of the Short Plat, with a pipestem lot, as
originally submitted, is requested on the basis that division into
three such narrow lots as those set by the examiner would be aesthetically
damaging to the neighborhood, and would reduce property values of
the subject property, and the adjacent properties.

SUMMARY OF REQUEST: Applicant requests approval of a proposed three-lot short plat
together with an exception to the Subdivision Ordinance for a
20-foot pipestem lot and a waiver of the required off-site
improvements. • •

SUMMARY OF ACTION: Planning Department Recommendation: Approval of short plat and
'exception with conditions; Denial of waiver.
Hearing' Examiner Decision: Approval of short plat with conditions;
Denial of exception; Denial of waiver.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on July. 16, 1979.

. PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on .file with the application, and field
checking the property and surrounding area, the Examiner
conducted .a public hearing on the subject as follows:
The hearing was opened on July '17, 1979 at 9:00 a.m. in the Council Chambers of the Renton
Municipal Building.
•
It was determined by the Examiner that the hearing should be continued because receipt
of Public Works Department staff comments had not occurred prior to the 'scheduled hearing.
The Examiner requested an estimated date .of receipt of comments from Paul Lumbert,
representative from the Public Works Department. Mr'. Lumbert ,indicated that the comments
could be• transmitted in a timely manner to allow continuance for one'week. The Examiner
subsequently continued the hearing to July 24, 1979 at 9:00 a.m. to be held in the Council
Chambers of the Renton Municipal Building.
CONTINUANCE:
The hearing was opened on July 24, 1979 at 9:45 a.m. in the Council Chambers of the Renton
Municipal Building.
Parties wishing to testify were affirmed by the Examiner. •
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report, and the report was entered into the record as Exhibit #1. -
Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following
additional exhibits into the record:

as modified
Mr. Blaylock corrected Exhibit #1 as follows: Section L.3, second line, change "Lot #2"
to "Lot #1"; Section M.1,• delete requirement of dedication of 15-feet of right-of-way on
N.E. 19th Street;and revision of approval of waiver to denial. The Examiner also noted an
error contained in Section B. which refers to location of the property on the "Northwest
corner of Union Avenue N.E.- and. N.E. 19th Street" which was corrected to "West of Union
Avenue N.E. along the south side of N.E,. 19th'Street."

The Examiner requested testimony by the applicant. Responding was:

Mr. Robinson indicated concurrence in the report, and referencing Section L.4 which

pertains to Fire Department requirements for a turn-around for emergency equipment at the
southerly end of the pipestem road, he noted that: adequate area exists to meet the
requirement. He indicated that the applicant will seek a deferral of improvements until
such time as an LID is formed at a later date. Responding to the Examiner's inquiry, •
Mr. Robinson advised, that restrictive covenants have been submitted agreeing to
participate in an LID.
The Examiner requested testimony in support or opposition to the application: There was
no response. He then requested final comments from the Public Works and Planning
Department representatives. Since there were no further comments, the hearings regarding
File No. Short Plat 366-79 and W-367-79 (prior agenda item) and File No. Short Plat 368-79,
E-370-79 and W-369-79 were closed by the Examiner at 9:55 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
. 1. The request is for approval of a three-lot short plat together with an exception to
the Subdivision Ordinance for a 20-foot pipestem lot and a waiver of the required off-
site improvements on a +64 acre parcel just west of Union Avenue N.E. along N.E. 19th
Street.

2. The Planning•Department report sets forth the issues, applicable policies and provisions,
findings of fact, and departmental recommendations in this matter, and is hereby
attached as Exhibit #1 and incorporated in this report by reference as set forth in
full therein.
3. Pursuant to the City of Renton's Environmental, Ordinance and the State Environmental
• Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal 'h'as'been
determined to be exempt by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of' this development.
5. All existing utilities are either available or capable of being extended to the subject
site.
6. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-729 of Title IV, Ordinance No. 1628, Code of'General
Ordinances.
•
7. The applicant proposes subdividing the +64 acre lot into three lots which would meet
the minimum requirements of the subdivision ordinance except that one lot will have
less than the minimum lot frontage and will have access provided via a 20-foot by
100-foot pipestem extension (Lot No. 1) .
8. The subject parcel is basically level and is covered with high scrub grass, some
medium shrubs and a few Douglas fir trees.
9. The subject parcel is zoned G-7200, a classification applied when the parcel was
annexed into the city by Ordinance No. 2472 on March 28, 1969.
10. The Comprehensive Plan designates the area in which the subject property is located
as suitable for single family residential development:
11. The subject parcel itself is undeveloped which is generally the case to the north of
the subject property. The areas to the east, south, and west are largely developed
with single family residences. Forest Brook Townhouses for which Shelton Avenue N.E.
serves as fire access are presently under construction on the same superblock towards
the south.

12. Section 9-1109 of the Subdivision Ordinance requires that the applicant demonstrate
that undue hardship would result if an exception were not granted and further that
special physical conditions affect the property in such a manner that the applicant
would be denied reasonable use of the subject property.
13. The square footage of the subject parcel is 28,000 square feet and the parcel is a
rectangle of 175 feet wide by 160 feet deep. The parcel could be divided into three
equal parcels of +9330 square feet each.

14. The Department of Public Works, has recommended that off-site improvements be installed
along N.E. 19th Street. The applicant has applied for a waiver of off-site improvements
'pursuant to Section 9-1105.6B of the Subdivision Ordinance. There are generally no

off-site improvements along N.E. 19th Street but the developer of Sierra Terrace
Division No. 1 is installing off-site improvements along Shelton Avenue N.E. and the
Public Works Department indicated that N.E. 19th Street will eventually service
areas west of the city limits in this vicinity.
Further, this applicant is also proposing to subdivide an adjoining lot with frontage
along both N.E. 19th Street and Shelton Avenue N.E., and off-site improvements will be
similarly required on this development.
15. The applicant has executed a restrictive covenant to participate in any future LID
initiated in this area.
16. The, Planning Department indicated that there would be no adverse impacts resulting
from the creation of the pipestem lot. The Fire Department indicated that turnaround
provisions are required at the end of the pipestem.
CONCLUSIONS:
1. A short subdivision of the subject property appears to meet, the goal of the
Comprehensive Plan and is compatible with the subject lot's zoning classification.
The Comprehenisve Plan and the zoning both indicate that the area should be developed
with single family residences.
2. Each of the lots approved by this decision will provide lot area (+9330 square feet)
and dimensions (+58.33 feet by 160 feet) to meet the requirements of the zoning,
G-7200 (Sections 4-729(D) (2) (b) and 4-706(6) ) and Subdivision Ordinance, (Section
9-1108.23.F(3) ) . The lots will also be compatible with the existing single family
character of the surrounding development.
Section 9-1108.23.F of the Subdivision Ordinance contains various permitted and
proscribed lot sizes and shapes. When read in conjunction with the Zoning Ordinance,
Section 4-706(6) , it would appear that three uniform,regularly-shaped lots are
favored over a pipestem lot which would also be unduly elongated (See Conclusion
No. 6 below) .
3. Services are generally available and may be extended by the applicant to serve the
proposed short subdivision.
4. A three-lot subdivision will provide additional housing, is compatible with the zoning
and Comprehensive Plan and surrounding development, and therefore, will serve the
public interest.
5. The applicant has not demonstrated a need to waive off-site improvements in as much
as a nearby development, Sierra Terrace Division No. 1, is installing them in
conjunction with that project, and heavier demand is expected to develop, along
N.E. 19th Street. The applicant may instead apply to the Board of Public Works
for a deferral of off-site improvements. The deferral would achieve a similar
effect and provide the Public Works Department oversight ability on this proposal.
6. The above cited sections (See Conclusion No. 2, above) also appear to permit the
lots approved by this decision without an exception and are therefore favored.
The applicant has failed to demonstrate that he would suffer undue hardship in
making reasonable use of the subject property if an exception were denied.
In addition, there are no physical conditions associated with the subject property
which would necessitate the granting of an exception.
7. Standing alone, the fact that a pipestem addition would not cause any adverse impact
does not provide sufficient justification for granting the exception if no unique
physical condition exists. In addition, permitting the exception would grant the
applicant a special privilege. '
The applicant may divide the lot without difficulty (to all appearances, since no
facts were presented to the contrary) into three +9330 square foot lots, each having
sufficient frontage along an improved city street, N.E. 19th Street. The lots can
be divided along the subject property's width, thereby eliminating the need for the
pipestem extension for access for Lot No. 1. The resulting lots will be +58.33 feet
wide and 160 feet deep.

DECISION:
•
The short plat is approved• as provided in the conclusions above. The subject parcel is to
be divided into three fairly equal lots, each with approximately 58.33 feet of frontage
along N.E. 19th Street (See Attachment A) . The applicant must install off-site improvements
which may be deferred subject to approval of the Board of Public Works. Sewer, water and
utility hookups must be approved by the Public Works Department.
The requested waiver of off-site improvements is denied.
•
The exception for the pipestem extension for Lot No. 1 is denied.
•

C. HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance #2472 dated
March 28 , 1969.
D. PHYSICAL BACKGROUND:
1. Topography : The site is essentially level.
2 . Soils : Alderwood Gravelly Sandy Loam (AgC) . Permeability is
moderately rapid in the surface layer and subsoil and very slow in
the substraum. Runoff is slow to medium and the erosion hazard is
moderate. This soil is used for timber , pasture , berries , row
crops , and for urban development .
3 . Vegetation : High scrub grass is the dominant feature with some
medium shrubs and a few Douglas Fir.

birds and small mammals.
5. Water: No water was evidenced on the subject site .
6 . Land Use : The subject site is undeveloped. To the east , south
and west are single family residences. The property to the north
is largely undeveloped except for some scattered single family
dwellings to the east .
E. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are principally single family residential in
nature.
F. PUBLIC SERVICES :
1. Wa;ter. and Sewer: An 8" sanitary sewer is located approximately 100'
northeast of the subject site along Union Avenue N.E. A 3" water
mains runs east-west along N.E. 19th Street while a 6" main extends
north-south on Shelton Avenue NE and a 12" main runs north-south
on Union Avenue NE.
2. Fire Protection : Provided by the Renton Fire Department as per
ordinance requirements.
3. Transit : Metro Transit Route #107 operates along Union Avenue SE
within 1/2 mile to the south of the subject site .
4. Schools : The Sierra Heights Elementary School is within 1/2 mile
to the north of the subject site while McKnight Junior High School
is approximately one mile to the southeast .
5. Recreation : Kiwanis Park is approximately 3/4 of a mile south of th
subject site and North Highlands Park is approximately 14 miles
to the west .
6. Roads : N.E. 19th Street has 45-feet of right-of-way , while
Shelton Avenue N.E. has 50-feet of right-of-way.

Pursuant to the City of Renton' s Environmental Ordinance and the
State Environmental Policy Act of 1971 , as amended, RCW 43-21C,
the subject proposal is exempt from the environmental assessment/
threshold determination process.

L. PLANNING DEPARTMENT ANALYSIS :
1. The proposed shortplat is consistent with the Comprehensive Plan
which designates the site and surrounding area as single family
residential.
2. The proposal is compatible with existing single family residences
and subdivision patterns in the vicinity.
3. All of the lots meet or exceed the minimum requirements of the
Subdivision Ordinance for size and frontage except for Lot -#
for which exception has been requested.
4. The Fire Department advises that a turn-around for emergency
equipment will be required at the southerly end of the pipestem
road.
5. Suitable utilities are available to the subject site. However,
detailed sewer, water and drainage plans will require review and
and approval by the Public Works Department . Standard hook-up
fees will also apply.
6. The applicant has requested an exception to the Subdivision Ordinance
to permit a pipestem lot arrangement for Lot #1. The lot conforms. ; ,
to the 20'x 150' criteria established by Section 9-1108-23F3(d)
of the Subdivision Ordinance. No known adverse impacts will result
from the creation of this pipestem lot .
7. Both Shelton Avenue N.E . and N.E. 19th Street service basically
deadend areas. There is potential residential development west of
the City Limits which would have to be serviced by N.E. 19th Street .
Forest Brook Townhouses is presently under construction at the end
of Shelton Avenue N.E. south of this short plat . Fire access to the
Forest Brook Townhouses has been required off of Shelton Avenue N.E.
M. DEPARTMENTAL RECOMMENDATION:
Based upon the above analyais, recommend that the subject short plat
and exception be approved and the requested waiver for off-site
improvements be subject to the following conditions :

To Whom It May Concern,
A waiver of offsite improvements requirements, for the
shortplat applications to which this letter is attached, is
hereby requested on the following grounds:
There are presently no sidewalks, curbs, or storm drains
on the West side of Union Ave. NE in the area of
this property. .
There are about 10 houses served by the same streets as
this property,and they are adequately served by the
present improvements.
The neighborhood of this property presently has a rural-
suburban character which would be disrupted by urban
type improvements.
In keeping with the other properties in this neighborhood
these shortplats would add 5 new homes, at a density
of approximately 4 homes per acre.
In addition,to the above requested waiver, an exception
allowing a pipe stem lot in the shortplat of tax lot 259 is
required for the best utilization of that property. The
requested pipe stem will be 20 feet wide by 100 feet deep,
and will allow for ingress, egress and utilities to Lot 1
