AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CHANGING
THE ZONING CLASSIFICATION OF CERTAIN PROPERTY WITHIN THE
CITY OF RENTON FROM GENERAL CLASSIFICATION DISTRICT (G-wool
TO RESIDENTIAL DISTRICT (R-3)
WHEREAS under Chapter VII, Title IV (Building Regulations) of
Ordinance No. 1628, known as the "Code of General Ordinances of the City
of Renton" as amended, and the maps adopted in conjunction therewith, the
property hereinbelow described has heretofore been zoned as General
Classification District (G-6000) , and
WHEREAS under the aforesaid Ordinance a proper petition for change
of zone classification of said property has been filed with the City
Clerk of the City of Renton on or about February 5, 1963, which Petition
was thereupon referred to the Planning Commission for investigation and
study and thereafter a public hearing having been held before said
Planning Commission on or about April 24, 1963, all pursuant to notice
of hearing duly published and posted as provided by law; and said
Planning Commission having duly considered and recommended said rezoning
and all parties having been heard appearing in support thereof or in
opposition thereto; NOW THEREFORE
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
RENTON AS FOLLOWS:
SECTION I: The following described property in the City of Renton
is hereby rezoned to Residential District (R-3) ; the City Engineer and
the Planning Director are hereby authorized and directed to change the
maps of the zoning ordinance, as amended, to evidence said rezoning; said
property being described as follows :
That portion of the SE. of the NA of Section 18, Twp 23 N. ,
R 5 E. ,W.M. , described as follows:
The North 80' of Lots 3 and 4, Block 30, Earlington Acre
Tracts, as recorded in Vol. 15 of Plats, Page 84, records
of King County, Washington, lying westerly of 90th Avenue
South, all located in Renton, King County, Washington
And said rezoning to be further subject to the laws and ordinances of the
City of Renton.

SECTION II: This Ordinance shall be in full force and effect from
and after its passage, approval and legal publication.

COMMUNICATIONS: (cont. ) Planning Commission Recommendations - Rezones
Albert Balch Property Rezone:
There were no ob:jections to the rezone of this property. Moved by 'Dahlquist, and
seconded by Custer, to refer the matter to the Ordinance Committee. Carried.
Jay Holmes property - vicinity of South 120th Street and Rainier Avenue as des-
cribed in Application No. R-117-63 dated 3-1-63, from G and G-6000 to 1-1.
Moved by Custer, seconded by Delaurenti, to concur in the rezone and to refer
the matter to the Ordinance Committee . Carried.
Nick Vidos property - Tracts 3, 4 and 5, Block 30, Earlington Acre Tracts from G-6000
to R-3. Moved by Garrett, seconded by Poli, to concur in the Planning Commission rec-
ommendation and to refer the matter to the Ordinance Committee . Carried ,
Douglas suck property - Lots 52, 53, 54, 55, 56, 57 and 58, Block 19, C. D. Hillman's
Earlington Gardens #l, from G to L-1, with restrictive covenants relative to rear
yards and setback effective until December 31, 1975. Moved by Bruce, seconded by
Poli, to concur in the Planning Commission recommendations. Carried. Moved by
Garrett, seconded by Hulse to refer the matter to the Ordinance Committee. ;Carried.
Variances recommended by the Planning Commission and/or Permits:
John Burkheimer property - recommended that a Revokable Permit be granted in lieu of
rezone - for carwash installation adjoining Union Oil Station at intersection of
Renton and Rainier Avenues. Moved by Poli, seconded by Bruce, to concur in the
Planning Commission recommendations, the applicant having indicated his willingness
to accept such Permit. Carried. Moved by'Pali., seconded byiruce, to refer the
matter to the Ordinance Committee . Carried.
Knute Beckstrom property - Lot 1, Block 13, Renton Highlands, fdt-•variance relative
to rear property line allowing construction 15' therefrom. Moved by Bruce, seconded
by Custer, to concur in the recommendation of the Planning Commission. Carried.
Tom Farmer - Band sox Restaurant, Rainier Avenue;.,- Revokable Permit to allow sign
construction 10' behind front property line. Moved by Poli, seconded by Dahlquist,
to concur in the Planning Commission recommendation. Carried.
A letter was read from Raymond P. Rosa requesting building permit to locate a house
on property in the Talbot Hill area which permit had previously been held by the
Planning Commission pending completion of State Highway acquisition in order that
determination might be made as to whether lot size requirements would be met. An
Engineer's sketch of the proposed lot plans was attached to the letter and Planning
Director Jensen advised that the permit would probably be allowed by the Planning
Commission in view thereof. Protest was made verbally by Mr. D'Agosto to the house
being moved so close to his property. Engineer Oyler's plans provided the proper
setback requirements however, and it was• moved by Trimm, seconded by Dahlquist, that
the party be allowed to store the structure on their property with the Permit being
held pending Planning Commission consumation of the matter. After further discussion
the motion carried.
A letter from Mr. Wilbur L. Repp requested permission to locate a structure on
property located at 1019 1st Ave. North. Upon inquiry Mr. Repp advised the matter
had been presented to the building department. Mr. Highton, Bldg. Supt. , advised
that the building was a frame structure not meeting requirements o: the code insofar-
as the fire zone was concerned. Mr. Repp advised of features of the structure which
provided a higher degree of fire resistance including plastered interior and asphalt
composition roofing his plan to be also to reside the building with asbestos fire re-
sistant materials.
Moved by Hulse, seconded by Bruce, to refer the matter to-the Planning Commission.
Carried.
A letter was read from Sup't. of Utilities Schroeder, requesting permission to
call for bids for pipe line materials with date of May 20, recommended for the bid
openings.
Moved by Dullahant, seconded by Dahlquist, to authorize the call for bids as
requested and the date for opening of the bids. Carried.
A letter from Mr. and Mrs. Robert L. Edwards was read demanding return of deed
which had been submitted with option granted the City to purchase real estate) which
option expired May 1, 1963. (Access street to Renton Shopping Center from Rainier
Ave. ) City Clerk Nelson had surrendered the Deed upon receipt of the demand for same.

It is the recommendation of the rezone committee that this request
bg denied. This property is surrounded by residential on three sides
and a Church in front and rezoning of this property would not be good
zoning.

5) The proximity of the tract to the Central City justifies
consideration of the land for higher density and more intensive land
uses.
Slides of the area were shown and Mr. Jensen stated that this is
an area previously proposed for rezone to R-3 and approved by the
Council.The ordinance was held up until the right of way for the road
through this area was defined. This matter has now been resolved,
and the area is ready for development.
Chairman Felker asked if there were any written or oral protests
to the rezone. There were none.
In the discussion that followed relative to the width of the
proposed road, City Engineer Wilson stated that most of the road is
80 ' to 100 ' and the portion going through the Balch property is 100 '
to 130 ' in width.
It was then moved by Racanello, seconded by Denzer, that we re-
commend to the City Council that the R-4 be granted. Motion carried.
7 . Jay Holmes property on Rainier Avenue in the vicinity of 89th South,
17om G a' na G=6000 to Bml.
As an interested party in this matter, Mr. Holmes excused him-
self from the discussion.
The Committee reported recommending approval of the request for
B-1 zoning.
The Planning Department report was read recommending that the '
request for rezone to B-1 be approved for the following reasons
1) A portion of the property was previously zoned for business
in the County and adjacent property to the north is presently zoned
and used for business in the county.
2) The relationship of the property to Rainier Avenue together .
with the general terrain is evidence of the suitability of the land
for commercial or high density residential purposes.
Slides of the area -and of the plot plan showing the proposed
restaurant on the property were shown.
chairman Felker asked if there were any objections to this rezone.
There being none, it was moved by Lotto, seconded by Denzer to concur
in the Committee and Director ' s reportsand to recommend to the City
Council the rezone of -the subject property to Bml. Motion carried.
Mr. Holmes abstained from voting.
7) Nick Vidos Tracts 3 , 4 , Block 30, Earlington Acre Tracts , from
G-6001 to R-3 .
This application was amended from the previous request for L®1 Zon-
ing, which the Planning Commission had denied at the hearing on Feb-
ruary 27 .
The Committee report was read recommending approval of the re-
quest for R-3 zone.
The Planning Department report was to recommend approval of
the rezone application as amended to R-3 for the following reasons.

1) The land abuts upon a major road and an important intersection.
2) The land is in close proximity to the Central .City and Business
zoned property, and
3) The area is suitable for the proposed use because of the-.terrain
and the above listed items„—which are not conducive to utilization of the
property for single family residential purposes.. .
Slides of the area were shown.
Chairman Felker asked if there were any objections to this rezone.
There being none , it was moved by Denzer, seconded by Holmes to con-
cur in the Committee and Director' s reports and recommend to the City
Council the rezone to R-3 for reasons as stated in the report.
Motion carried.
9 . John Burkhei.mero property on Rainier Avenue between Renton Avenue and
7st P ace ou fh, from B-1 to Lml .
Committee report was read as follows° Recommend the granting
of a permit by the Council to allow construction of the proposed
facility, in lieu of the rezone.
The Planning Department report was to recommend that the request
for an L-1 zone be denied, but that a permit to be approved by the
Council be recommended to allow construction of the proposed car-wash-
ing operation.
Slides of the area and of the plot were shown. In reply to the
question as to whether traffic problems might be created by this
proposed operation, City Engineer Wilson stated that he did not foresee
any problems in so far as traffic is concerned.
Chairman Felker asked if there were any objections to this re-
zone. There were no objections, oral or written.
It was stated that the reason that the Planning Director and
Committee have recommended that a permit be granted in lieu of the
rezone was that it was felt that this type of operation belongs in
the Bml .zone, being similar in type to a gas station or garage. The
Commission had recommended that an amendment be made to the Ordinance
to allow such an operation in the Bml District. Mr. Burkheimer' s rep-
resentative agreed for his client that the Permit would be acceptable
to him.
It was moved by Holmes, seconded by Denzer, to recommend to the
City Council the granting of the Conditional Permit to allow the
operation of the car-washing facility. Motion carried.
10. E..syTond Rosa Lots 10 through 15 and the west 23. 5 ' of Lot 16 , Block 10
C. D. Hi1lEanas Earlington Gardens #1 , Less State Highway, from GS®1
to SR-1-
The Committee report was read recommending approval of the rezone
to SR-1.
The Planning Director' s report recommended approval of the re-
quested rezone for the reason that this proposal is consistent with
the average standards for building sites in the Talbot Hill district.
Slides of the area were shown. Mr. Jensen stated that the Com-
mission some time ago recommended that the Talbot Hill area in gen-
eral be rezoned from S-1 to SR®1 because much of the area has an
average lot size of 7500square feet. Mr. Jensen stated that Lots 10
and 11 could be divided and still comply with lot size requirements.
Several people in the audience protested the rezone to SR-1 .
Mrs. Ang Busato asked regarding the size of the lots. Mr. Rosa
