Site Battle Under Way
A major campaign boiled up this week to force Renton Schoe
District to abandon plans to build a high school on its 29-acre
site in the Highlands.
Led by Renton city councilman John Malgarini and home
builder Rudy Zaputil, the campaigner§ are making strenuou
efforts to derail plans to build Renton's second high schoo
in the next five years.
For several years the school district has owned the sit
on Cemetery Road. Plans to build a school there for occupanc:
about 1967 have been well publicized during the past year.. Bu
neighborhood opposition made itself felt only this week who;
Zaputil carried around a petition.
Opponents' tactics are to attempt to prevent the city counci
from deeding over streets within the site to the school district
Unless the rutted, unusable streets are given to the schoo
district, the site would probably be too small. Including three
acres of streets, the site covers about 29 acres, a minimun
size for a high school.
Zaputil's petition asks the city not to vacate the streets
It was signed by 48 persons who live at 26 addresses. Resident;
of 16 of the homes live across the street from the proposed
site, along the west edge of the site.
Another eight families live one block away and two of the
couples who signed, defeated council aspirant Ron Regis and hi;
wife, and councilman and Mrs. Malgarini, live two to thred
blocks away.
On the north the tract is bounded by 7th Ave. N., on the soutl
by Cemetery Road, on the east by M St. and on the west by
and K Sts.
Zaputil's 'petition- now rests in the hands of the counci
Ordinance Committee, which will meet at 10 o'clock Saturday
morning to consider it. The council may vote on the matted
Monday.
The council was all set to pass the street-vacation ordinance
last week when Malgarini was able to delay passage by claiming
that opponents hadn't had a chance to make their views known,
There was no outcry against'the site at public hearings or
the street vacation held on February 14, 1961, and again or
January 9 of this year. Malgarini says this is because residents
didn't know about the hearings. Hearing no public objections,
school officials went ahead and hired an architect.
Malgarini is frank about his role as a leader in the fight
with school officials:
I'm more or less behind the petition," Malgarini said,
Rudy (Zaputil) and I talked it over quite a while ago. These
people came to me about it first, though.
I'm looking at it from two viewpoints, as a councilmar
and as a real estate man," Malgarini continued. "T,his area
could be residential and could bring in income for the city,
There is no room to expand a school on this site. Abetter
site might possibly be to the south of Cemetery Road or out or
132nd Avenue near Honey Dew School."
The petition argues that the Cemetery Road site "is not it
keeping with good planning for the cityor for the area involved."
It adds that the property is "residential,"with water and sewer
lines already laid and that the land could become taxable,
Other arguments in the petition are: that streets in the.area
are inadequate to handle the flow of cars to and from the school;
and that parking for 100 cars would be necessary and that streets
around the site "are not wide enough to cope with this problem.
The petitioners,also feel there are more desirable sites
elsewhere.
To these points, School Superintendent Oliver M. Hazer
replied Tuesday that the school board conducted extensive
surveys for a site. The county planning department and state
school authorities were also consulted. All picked the High-
lands site as the best and the state later approved the site.
Here are views of a sampling of the residents who signed
the petition:
Dwayne•Christensen, 559 K St.: "I'm afraid they take part
of my property because they'd probably widen K Street."
Mrs. Robert B. Todd, 425 J St.: "I feel there's not enough
room over there for a 'high school . . .there's only a few
acres . . . "
Mrs. William R. Knedler, 541 K St.: "We live across the
street and we'd rather have homes over there . . . I'm afraid
they might widen the street and there'd bea lot more traffic . ."
Mrs. Norton R. Smith, 523 K St.: "Traffic will be heavier
and I have two young children, one and three years old . . ."
Another woman who asked that her name be withheld said
she "really didn't want to sign"the petition. "The lot across
the-street is not very nice to look at now but we think it would
look better with-a school on it than a,.lot of homes," she said.
She claimed she signed it because of"neighborhood pressure."
As to the rumor that K Street might be widened, Hazen
replied that the school officials haven't begun to consider that
point. Hazen said he had "no idea" where the residents had
gotten that idea.
Malgarini said the opponents will probably send a spokesman
to the school board meeting tonight to try to convince school
board members to change their minds.
Hazen said that Zaputil has talked to him about the.site
only once. The school superintendent said Zaputil was involved
in an attempt several months ago to arrange an exchange of
land. The owner wanted to trade land south of Cemetery Road
for the school's site, Hazen said. Zaputil was not the owner of
the tract offered.

The meeting opened at 8 : 30 P.M. due to not having a quorum of mem-
bers until this time. It was then moved by Busch, seconded by Cordell ,
that the minutes of the previous meeting of April 8 be approved as cor-
rected. Motion carried.
REZONES:
1 . GAYLE HALSEN: From R-1 to R-3 , property located on Renton Street
between 8th and 9th Avenues , as described in Appl . No. R-155-63 .
This request was continued from the January 22 meeting for 3
months for further study.
The Committee' s report was read recommending approval,
The Director's report was read recommending approval for the
following reasons:
a. The property is adjacent to R-3 zoned land lying immedi-
ately to the west.
b, It is in an area deemed suitable for multiple residential
structures.
Chairman Denzer asked if there were any protests to this re-
zone.
Mr. Grubisich , resident in the voiced objection to the rezone,
stating that a petition had been submitted at the previous hearing
meeting objecting to the proposed use. Since this is an area of
single family homes , they wished to keep it this way.
Mr. Wayne Pinkley at 741 Grant Street also objected to the pro-
posed rezone to multiples . He questioned if this would not be a
spot zone.
Mr. Jensen stated a spot zone is a zone which is out of place
with the surrounding uses, or a single use surrounded by incompati-
ble uses. In this case it is not a spot zone , because it is related
to an already zoned R-3 use immediately to the west.
In reply to a question if the Commission members have looked
at this area , Mr, Denzer stated that the members have inspected the .
property, and feel that the best use of the property would be for
multiple residential . Further,this is in accordance with the Com-
prehensive Plan land use for the area.
Chairman Denzer informed the objectors that they have a right
to appeal the decision of the Commission to the Council within the
10-day period as provided by law.
It was then moved by Peretti , seconded by Busch , that we recom-
mend to the City Council the granting of the rezone request from
R-1 to R-30 Roll Call Vote being called, all members voted "Aye" and
the motion passed unanimously.

The Committee reported recommending approval of the request,
The Directors report was as follows:
The granting of a business use on this property would be in con-
flict with the text of the Comprehensive Plan and also the proposed
land use map, in that this would encourage the development of strip
zoning between the Highlands Shopping area and the developing shopp-
ing area at the intersection of POSH. #2 and 136th Avenue So E.
The Comprehensive Land Use plan adopted by the Planning Commission
envisions the use of this area for multiple residential and related
uses such as offices„ It is therefor: recommended that a use district
such as R-3 or R-4 would be reasonable and in harmony with the com-
prehensive plan,
Chairman Den'zer asked if there were any objections to the rezoned

The Commission then considered the MARK HOKENSON request for re-
zone from G-7200 to B-1 at the same time, since it was stated that
this property is adjoining the School property and the same condi-
tions would pertain and be applicable on both properties,
The MARK HOKENSON_property is located on Sunset Highway between
132nd Avenue S , E. and 135th Avenue So E. as further described in
Appl, No, R-179-64 ,
Chairman Denzer asked if there were any written or oral objec-
tions to this rezone. There were no objections .
It was then moved by Cordell , seconded by Peretti , to recommend
7 to the City Council the rezoning of both the School property and the
Mark Hokenson property from G-7200 to B_l , )
On the question, Mr. Jensen stated the reason,as stated in his
report , for his recommendation is that the Comprehensive Plan for
this area shows the best use would be for R-3 or R-4 . He felt that
zoning to business in this location would encourage strip zoning
and with this in mind the Commission had recommended against the
Business zoning when the area was in the County, and the County had
subsequently denied a Business zoning in this area ,
Mr. Cordell voiced his opinion that this is a small area and
he did not feel that this would be a problem.
Question being called, the motion carried ,
CONDITIONAL PERMITS;
3 , FAYE GIBSON; For a permit to operate an existing beauty shop in an
R-1 zone at 932 K Street , as described in Appl , No. P-180-64
The Committee report was read recommending denial of the request.
The Director' s report was read recommending denial of the request
for the following reasons ;
a, This is a commercial use in a wholly single family residen-
tial area, and is an operation not consistent with the character of
the neighborhood in which it is located,
b. The installation of equipment and modification of the resi-
dence to a business use was apparently done without permits as re-
quired by the City,
Chairman Denzer asked if there was anyone who wished to speak
for or against this request,

COMMUNICATIONS: (cont. )
The Clerk advised that the Downtown Merchants requested permission to string
advertising banners across 3rd Avenue in the vicinity of the Renton and Roxy
theatres and on Bronson Way, in promotion of their Moonlight Sale which is to be
held on May 29th.
Moved by Garrett, seconded by Morris, to grant the request with installation
under supervision of the Street Commissioner and Chief of Police.
Moved by Dahlquist, seconded by Delaurenti, that the motion be amended to
include requirement of a Hold Harmless Agreement. The Amendment carried and sub-
sequently the motion as amended.
The Clerk reported receipt of a Letter of Intent to annex properties to the City of
Renton as signed by C. E. Dolman and Marjorie G. Dolman and submitted by Peter V.
Gulick. Upon inquiry, City Engineer Wilson advised that the property is comprised
of approximately 120-130 acrea and is mostly undeveloped property with about 15 houses
and abuts the City at 125th S.E. and lies basically north of the golf course, being
known as Heather Downs No. 2.
Moved by Schellert, seconded by Poli, that the date of June 1, 1964 be set for
the preliminary meeting with the property owners,(pursuant to Ch. 282, Session laws
of 1961, Sec. 18, to determine whether the city will accept the proposed annexation
and whether the assumption of existing City indebtedness shall be required.) Carried..
A letter from Renton School District No. 403, Oliver M. Hazen, Sup't. requested that
the Council reconsider its denial of the School District's request for rezoning fromG-7200 to B-1 of its property located on 132nd Avenue S.E. between Sunset Hwy. and
S.E. 112th as described in Application No. R-173-64.
Moved by Garrett, seconded by Morris, to refer the communication to the Committee
of the Whole and that the President set a meeting date for discussion with the- School
Board. Discussion ensued regarding position of the Council in relation to the recent
adoption of a Comprehensive Plan. Mr. Dalpay and Mr. Hokensen, owners of land in the
same area advised of business operating in the area since 1924 and urged that in the
event rezone is considered the other properties should be included as per owners desire.
Upon inquiry City Attorney Shellan advised that such rezone would be improper and ileg 1
without hearings and amendment of the Comprehensive Plan as Multiple Dwelling usage isdesignatedforthisareaonthelandusemapsatpresent. Further inquiry was made by'
Dahlquist as to whether County zoning is assumed when an area is annexed and City
Attorney Shellan advised that one Municipal body,although it assumes jurisdiction
when annexation occurs, and does allow operations as non-conforming uses as before,
would not just automatically retain zoning that had been given by another Muncipality.The pending motion carried.
A letter read from Catherine Kindred gave notice that she will be terminating her lease
on the City Hall Cafe on July 1, 1964.

1. The Council As A Whole met with Sup't. of School District No. 403,
Oliver Hazen, and Members of the School Board, regarding the Vacating t"'•
of certain streets in the Highlands area, as requested by the District for 1:,
use as a part of their new school site. The Committee recommends that
the subject be referred to the Planning Director, Sup't. of Utilities, City
Attorney and the Engineering Department to work out a plan with the vl
School District and report back to the Council with findings and recom-
mendations.

Minutes of the Renton City Council Meeting 5-18-64
COMMUNICATIONS: (cont. )
The Clerk advised that the Downtown Merchants requested permission to string
advertising banners across 3rd Avenue in the vicinity of the Renton and Roxy
theatres and on Bronson Way, in promotion of their Moonlight Sale which is to be
held on May 29th.
Moved by Garrett, seconded by Morris, to grant the request with installation
under supervision of the Street Commissioner and Chief of Police.
Moved by Dahlquist, seconded by Delaurenti, that the motion be amended to
include requirement of a Mold Harmless Agreement. The Amendment carried and sub-
sequently the motion as amended.
the Clerk reported receipt of a Letter of Intent to annex properties to the City of
Renton as signed by C. E. Dolman and Marjorie G. Dolman and submitted by Peter V.
Gulick. Upon inquiry, City Engineer Wilson advised that the property is comprised
of approximately 120-130 acrea and is mostly undeveloped property with about 15 houses
and abuts the City at 125th S.E. and lies basically north of the golf course, being
known as Heather Downs No. 2.
Moved by Schellert, seconded by Poli, that the date of June 1, 1964 be set for
the preliminary meeting with the property owners,(pursuant to Ch. 282, Session laws
of 1961, Sec. 18, to determine whether the city will accept the proposed annexation
and whether the assumption of existing City indebtedness shall be required. ) Carried.
A letter from Renton School District No. 403, Oliver M. Hazen, Sup't. requested that
the Council reconsider its denial of the School District's request for rezoning from
G-7200 to B-1 of its property located on 132nd Avenue S.E. between Sunset Hwy. and
S.E. 112th as described in Application No. R-173-64.
Moved by Garrett, seconded by Morris, to refer the communication to the Committ e
of the Whole and that the President set a meeting date for discussion with the School.
Board. Discussion ensued regarding -position of the Council in relation to the recent
adoption of a Comprehensive Plan. Mr. Dalpay and Mr. Hokensen, owners of land in the
same area advised of business operatiing in the area since 1924 and urged that in the
event rezone is considered the other properties should be included as per owners desire.
Upon inquiry City Attorney Shellan advised that such rezone would be improper and illeg.l
without hearings and amendment of the Comprehensive Plan as Multiple Dwelling usage is
designated for this area on the land use maps at present. Further inquiry was made by
Iahlquist as to whether County zoning is assumed when an area is annexed and City
Attorney Shellan advised that one Municipal body,although it assumes jurisdiction
when annexation occurs, and does allow operations as non-conforming uses as before,
would not just automatically retain zoning that had been given by another Muncipality'.
The pending motion carried.
A letter read from Catherine Kindred gave notice that she will be terminating her lease
on the City Hall Cafe on July 1, 1964.
Moved by Delaurenti, seconded by Hulse, to refer the letter to the Property
Committee for report back. Carried.
A letter from Puget Properties, Inc., E. D. Greathouse, Development Engineer, requsted
approval of the City on water system plans for the Plat of Talbot Crest. Drawings of
the proposed installations were attached.
Moved by Poli, seconded by Gianini, to refer the request to' the Fire and Water
Committee and the Director of Utilities with power to act. Discussion ensued regarding
favored policy of requiring cast iron pipe and establishment of same upon Committee
recommendation. Moved by Morris, seconded by Hulse to amend the motion by striking
the words "power to act" and report back to be inserted. The amendment carried and
subsequently the motion as amended.
A letter was read from the State Highway .Commission, directed to City Attorney Shellan
with copy to City Engineer Wilson, advising that investigation as requested had been
made on the condition along Main Street where retaining walls were left at abutment
of Secondary State Highway 5-C and the new Freeway, The walls are in poor condition
and should be removed or reconstructed however, soil and foundation examinations are
yet needed in order to determine procedure for permanent construction and will be
completed as soon as possible.

Mr. Grubisich , resident in the voiced objection to the rezone,
stating that a petition had been submitted at the previous hearing
meeting objecting to the proposed use. Since' this is an area of
single. family homes , they wished to keep it this way. ;
Mr,; Wayne Pinkley at 741 ' Grant 'Street also .objected to the pro-•,
posed rezone to multiples. He questioned if this would not be a
spot zone,
Mr. Jensen "stated a spot zone is a zone which, is out of place .
with the surrounding uses , or `a single use surrounded by incompati-
ble uses . In this case it is not a spot zone , because it is related,
4171 to an already zoned R-3 use immediately to the west.
In reply to a question if the Commission members have .-looked..
at this area , Mr, Denzer stated that the members have inspected the
property," and feel that the best use of the property would: be for
multiple residential. Further,this is in accordance with the Corn -
prehensive Plan land use for the area.:
Chairman Denzer informed the objectors' that they have a right
to appeal the decision of . the Commission to the Council within the
10-day period as provided by law. ,
It was then moved'by ,Peretti , seoonded by Busch , ' that we recom-
mend to the City Council the, granting of, the rezone request from
R-1 to R-3 . Roll Call Vote being called', .all members voted. t9Aye" and
the motion passed unanimously.
