AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CHANGING
THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES WITHIN THE
CITY OF RENTON FROM RESIDENTIAL DISTRICT (R-2) TO BUSINESS
DISTRICT (B-1)
WHEREAS under Chapter VII, Title IV (Business Regulations) of Ordinance
No. 1628 known as the "Code of General Ordinances of the City of Renton", as amended,
and the maps adopted in conjunction therewith, the properties hereinbelow described
have heretofore been zoned as Residential District (R-) , and
WHEREAS a proper petition for change of zone classification of said properties
has been filed with the City on or about January 22 , 1965, which petition was then
referred to the Planning Commission for investigation, and a public hearing having been
held thereon on March 24, 1965, all pursuant to notice of public hearing duly published
and posted as provided by law; and said matter having been duly considered by the
Planning Commission, and all parties having been heard appearing in support thereof
or in opposition thereto , NOW THEREFORE
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS
FOLLOWS:
SECTION I: The following described parcel of property in the CITY OF RENTON
is hereby rezoned to Business District (B-1) ; the City Engineer and the Planning
Director are hereby authorized and directed to change the maps of the Zoning Ordinance,
as amended , to evidence said rezoning:
Lots 1 , 2, 3, 4 & 5 Block 9 Car Works Addition to City of Renton
all situate in Renton, King County, Washington

4. That properties as described in Application No. R-224-65 (Cashway Lumber)be reclassified from R-2 to B-1, subject to approval of the Council of the proposed
amendment to the Comprehensive Land Use Map as heretofore recommended. Moved by

Schellert, seconded by Delaurenti, to concur in the recommendation of the Planning
Commission and that this matter be referred to the LAW AND ORDINANCE COMMITTEE to
be held in abeyance pending the results of the April 19th hearing. By way of clari-
fication it was noted that this is the property described in item (2) above. The
otion carried.
5. That properties described in Application No. R-227-65 (Dalpay, School
District, Hokenson) be reclassified from G-7200 to B-1. This recommendation, based
upon previous action of the City Council, will be in agreement with the Comprehensive
Land Use Map. Moved by Delaurenti,' seconded by Perry, to concur in the recommendation
of the Planning Commission and refer this matter to the LAW AND ORDINANCE COMMITTEE
for drafting of the proper ordinance. Carried.
6. That properties as described in Application No. R-228-65 (Arthur Webb) be
rezoned from B-1 and G-6000 to L-1. This property is located on Renton Junction Way
between 87th and 89th Avenues South. This proposed amendment to the zoning ordinance
is in agreement with the Comprehensive Land Use Plan. Moved by Schellert, seconded
by Dahlquist, to concur with the rezone request of the Planning Commission and to
refer this matter to the LAW AND ORDINANCE COMMITTEE for drafting of the proper
ordinance. Carried.
A letter from Mrs. Bertha Shane was read relative to water damage at premises located
at 528 "H" Street and requesting that the Council reconsider previous decisions and
advise what action she can take to recover these damages from the City. Moved by
Gianini, seconded by Perry, to refer this letter to the Fire and Water Con2n41ttea.
Councilman Delaurenti objected on the grounds that this represents a legal problem
and should be referred to the City Attorney. Considerable discussion followed
regarding what had transpired during the past several months and the City Attorney
again advised that inasmuch as a claim had not been filed in writing within the
specified time limitation, this did not represent a legal claim and the Council
could take no action at this time. In view of the failure to comply with the
statutory requirements for the filing of a claim against a second-class city, the
Insurance Company could not make a settlement, nor could City Funds be used for
this purpose without a court order. Mr. Shellan stated that Mrs. Shane had been
fully advised of these facts and the action she must take. A vote on the above
motion failed. Moved by Pedersen, seconded by Delaurenti, to refer this matter to
the CIffifITORNEY to answer Mrs. Shane's letter. Carried.
A letter from the Renton Knights of Columbus was read requesting permission to sell
tickets on 3rd Avenue between Wells and Williams Streets on Saturday, May 8th and
further requesting they be granted use of one parking stall for display purposes.
Moved by Delaurenti, seconded by Poli, that permission be granted with supervision
ef^t1e Police Department. Carried.
A letter from Pacific Coast Railroad Company, signed by Clark A. Eckart, was read
stating their position regarding the right-of-way across their property which will
be required for the new freeway access road. Mayor Custer stated that he was pre-
pared to make recommendations to the committee to which this matter is referred.
Moved by Delaurenti, seconded by Pedersen, to refer this matter to the STREET AND
ALLEY COMMITTEE and CITY ENGINEER to study and report back. Carried.
APPOINTMENTS:
A letter was read from Mayor Custer appointing Mr. Albert Reisberg to the position
of Building Director for the City of Renton, effective .April 6,.. 1965, and requesting
Council's concurrence. The Mayor suggested a starting salary for Mr. Reisberg at
Grade 26, Pay Range C, $682.00 a month, effective immediately upon employment. The
Mayor further requested that Mr. Jim Highton, acting Building Director, be designated
Building Inspector at Grade 21, Pay Range E at $590.00 base pay per month to become
effective on the Council's approval of Mr. Reisberg's appointment. Moved by Delaurenti,
seconded by Dahlquist, to concur in the appointment by the Mayor. Carried. At this
time the Mayor introduced Mr. Reisberg and he was accorded a welcome.

val of the site for the Civic Center.
After further discussion, the Chairman asked if there were any
comments from the audience. There being none , the hearing was de-
clared closed.
It was then moved by Cordell, seconded by Racanello9 to concur
in the Committee and Director' s report and recommend to the City
Council the proposed amendment to the Comprehensive Land Use Map.
Mr. Peretti voted no.

and R-4 , property on Lake Washington Blvd, S .E.

Director's report° Recommend that the proposed bezcne be consid-

North Renton Interchange as this , together with existing business zon-
ing ,will constitute adequate area to serve the needs of the future
multiple residential district expected to locate in this vicinity.
Chairman .Felker asked if anyone in the audience wished to speak
on this matter°
Mr. Joe Banasky, applicant , stated that when his property was
annexed to the City he was assured that he could retain the business
zoning.
Chairman Felker stated that the proposed rezone is reasonable ,
but the Comprehensive Land Use Map is not in agreement , so this would
have to be changed before the zoning is granted, unless the Commission
could justify this zone as immediately adjacent to an industrial area.
Councilman Schellert commented that this has been discussed by
the Council , and it has been suggested that the Comprehensive Plan
provide some means whereby certain retail-commercial uses might be
allowed in connection with high density residential uses.
Mr. Jensen stated that in looking at the map of this area where
the multiple residential area abuts industrial it would seem reason-
able for the Planning Commission to allow some commercial uses as a
buffer between.
It was then moved by Peretti , seconded by Cordell , that the east-
erly 100 ' of the subject property bordering on Lake Washington Boule-
vard be rezoned to B-1 and that the balance of the subject property
be rezoned to R=4, this being consistent with the Comprehensive Plan,
in that the property immediately adjoins industrial use. Motion carried,

Avenue and along the west side of Factory Street. This is an area
with many substantial residences whose economic life may be exten-ded for many years ;, provided that blighting influences are not intro-
duced which will overyhelm or seriously impair the existing desirable
living conditions . If the Land Use Map and zoning classification are
changed to allow businecr use it would be desirable tc provide screen-
ing for parking areas and general enclosure for any extension of the
existing or any other business qse not directly related to or compat-
ible with the residenti_aluses abutting on the common streets .
Mr. Jensen stated that he had talked with Mr. Dunn, the applicant,
who is willing to pre° i:Ic ecrcening and planting as a buffer between
the business and residential areas.
Mr. Dunn, showing a map of the area, pointed out the proposed
rezone and the Company's proposal to put up a sight obscuring hedge
in the area across from the R-2 area.
An otjection was voiced from a property owner who lives across
from the proposed 5r-ezone,, in that the business zoning would allow
the piling of lumber across from his residence,
Mr. Dunn stated that there would be a storage shed in the area in
question and any open areas would be adequately screened with plantings ,
which he felt would be less objectionable than deteriorating houses ,
if these were to remain.
Mr. Jensen advised that the ordinance requires that such business
uses provide an 8 ' sight obscuring fence .
It was then moved by Denzer, seconded by Peretti , to recommend to
the City Council that the Comprehensive Plan Land Use Map be changed
to reflect Retail-Commercial use Jn Lots 1 , 2 , 3 , 4 6 5 Block 9 ,
Car Works Addition to the City of Renton. Motion carried.
It was then moved by Denzer, seconded by Peretti, to recommend
to the City Council that Lots 1 , 2 , 3 , 4 E 5 , Block 9 , Car Works
Addition to City of Renton be rezoned from R-2 to B-l . Motion carried.
5 . DALPAY, SCHOOL DISTRICT, HOKENSON, APPLO NO. R-227-65 , request for re-
zone from G -7200 to B-1, nronerties on Sunset Boulevard E. and vicin-
ity of 132nd Avenue S.E.
Committee and Director' s report : Recommend these requests for
rezone ber nted upon-amendment by the Council of the Land Use Map
to Retail-Commercial uses.
Mr. Schellert stated that the Council has amended the Comprehen-
sive ',and Use Map to allow business uses in these areas to a aepth
of 500 ' along Sunset Highway.
Chairman Felker asked if there was anyone who wished to speak on
this matter. There being no protests , the hearing was declared closed.
It was then moved by Cordell , seconded by Denzer to recommend
to the City Council the rezone of the areas as requested to B-I .
Motion carried. Mr. Peretti abstained from voting..

1) In multiple residential districts other uses such as
are found in this area , namely, medical-dental offices and other
professional offices, , churches , parochial schools , etc. may be
allowed. .
2) The success of the program for rejuvenation and consol-
idation of the central business district will be dependent in
large part upon the location of multiple residential areas near
and complementary to the business district.
3) The opening up of extensive residential districts to
business and retail uses will , as stated earlier, tend to en-
courage scatteration of uses and tends to adversely affect real
estate values and causes the early deterioration of stable res-
idential areas and the development of blight conditions and
attendant problems .
4) The beginning effect on the community generated by the
freeway and the changing traffic circulation patterns may be
seen in the new shopping developments under construction or
proposed both within and adjacent to the City, It may reason-
ably be expected that the existing and proposed shopping dis-
tricts , when fully developed will serve the community .and the
adjacent areas for many. yearso

Chairman Felker stated that the public hearing on the proposed
change of land use in this area is set for ,March 24 . He suggested

Committee report: Recommend that this matter be held until

Mr. Jensen etated that the plot plan as originally submitted
showed the property divided into three parcels. The new plot plan
shows the property as one parcel fronting on Cemetery Road, and
also a revised description for only 85 ° was submitted. At the time
a building permit is requested the matter of access would have to be
resolved , but is not a part of this rezone.
Mr. Peretti , chairman of the rezone committee, stated that in
view of the revised plot plan and description he would recommend
granting the rezone.
Chairman Felker asked if there wore any objections to the rezone.
There being none the hearing was declared closed. It was then moved

VARIANCE:
5. RALPH SCHOMBERG: APPL. NO. V-225-65 , Variance request for addition
to non=conforming sign for the Rainbow Cafe on Main Street.
Committee report: Recommend that the request be denied and that
any addlitio snoralterationsonthesignberequiredtoconformto
the sign ordinance.
Director' s report: Concur with the Committee' s report.
Chairman Felker asked if there were comments from the audience
relative to this matter.
Mr. Bob Bower, contractor for the sign company, displayed a
drawing of the proposed sign, which would extend 6" out from the or-
iginal sign, but would be an attractive addition to the sign.
City Engineer Jack Wilson stated that he did not feel it is de-
sirable to have signs overhanging the curb in violation to the sign
ordinance.
It was then moved by Peretti, seconded by Teegarden, that the Var-
iance be denied.
During discussion on the question, Mr. Schomberg, the cafe owner,
stated that he felt that this sign is very necessary to help in up-
grading and brightening up this street.
Mr. Teegarden stated that he would withdraw his second and re-
consider the matter.
Mr. Garrison stated that if this sign is to be 16 ° above the side-
walk it would not interfere with ,visibilyty of traffic and would have

Members of the City Council
Gentlemen:
The Planning Commission at its public hearing
of March 24 , 1965, after due consideration and study
recommended that certain amendments be made in the
Comprehensive Land Use Plan and that certain amend-
ments be made to the Zoning Ordinance.
1. The Commission recommends that the Comprehen-
sive Land Use Map be amended to indicate a public use
rather than commercial for the proposed civic center
site, lying between Mill Street, Houser Way and the
Cedar River.
2. The Planning Commission recommends that the
Comprehensive Land Use Plan be amended to indicate
a change from Multiple Residential use to Retail-
Commercial use of Lots 1 through 5 , Block 9 , Car
Works Addition to the City of Renton.
3. JOE BANASKY: The Planning Commission recom-
mends that the property as described in APPLICATION
NO. R-223-65 be rezoned from G to B-1 and R-4 as re-
quested. This recommendation was made by the Com-
mission upon their determination that this proposed
zoning change is in agreement with the Comprehensive
Land Use Plan.

CASHWAY LUMBER: The Planning Commission recommends
that properties as described in APPLICATION NO. R-224-
65 be reclassified from R-2 to B-1, subject to appro-
val of the Council of the proposed amendment to the
Comprehensive Land Use Map as heretofore recommended.
