Moved by Gianini, seconded by Perry, to refer this letter to the Fire and Water Coahitree. Councilman Delaurenti objected on the grounds that this represents a legal problem and should be referred to the City Attorney. Considerable discussion followed ' regarding what had transpired during the past several months and the City Attorney again advised that inasmuch as a claim had not been filed in writing within the specified time limitation, this did not represent a legal, claim and the Council could take no action at this time. In view of the failure to comply with the , statutory requirements for the filing of a claim against a second-class city, the Insurance Company could not make a settlement, nor could City Funds be used for this purpose without a court order. Mr. Shellan stated that Mrs. Shane had been fully advised of these facts and the action she must take. A vote on the above motion failed. Moved by Pedersen, seconded by Delaurenti, to refer this matter to the CITY ti1TURNEY to answer Mrs. Shane's letter. Carried. Continued: Director ' s re ort : Recommend that serious consideration be giveninthzseuesttofSeffectuponthepropertiesqpproertie north of Brooks Avenue and along the west side of Factory Street. This is an area with many substantial residences whose economic life may be exten- ded for many years , provided that blighting influences are not intro- duced which will overwhelm or seriously impair the existing desirable living conditions . If the Land Use Map and zoning classification are changed to allow business use it would be desirable tc provide screen- ing for parking areas and general enclosure for any extension of the existing or any other business qse not directly related to or compat- ible with the residdentieluses abutting on the common streets . Mr. Jensen stated that he had talked with Mr. Dunn, the applicant , who is willing to pre-ide ccrcening and planting as a buffer between the business and residential areas. Mr. Dunn, showing a map of the area, pointed out the proposed rezone and the Company's proposal to put up a sight obscuring hedge in the area across from the R-2 area. An otjection was voiced from a property owner who lives across from the proposed rezone, in that the business zoning would allow the piling of lumber across from his residence . Mr, Dunn stated that there would be a storage shed in the area in question and any open areas would be adequately screened with plantings , which he felt would be less objectionable than deteriorating houses , if these were to remain. Mr. Jensen advised that the ordinance requires that such business uses provide an 8s sight obscuring fence . It was then moved by Denzer, seconded by Peretti , to recommend to the City Council that the Comprehensive Plan Land Use Map be changed to reflect Retail-Commercial use an Lots 1 , 2 , 3 , 4 6 5 Block 99 Car Works Addition to the City of Renton. Motion carried. It was then moved by Denzer, seconded by Peretti , to recommend to the City Council that Lots 1, 2s 3 , 4 6 5 , Block 9 , Car Works Addition to City of Renton be rezoned from R-2 to BGl . ADMINISTRATIVE MATTERS 7. Mr. Jensen informed the Commission that Councilman Bruce Hulse has been appointed to the Executive Board of the Planning Association of Washington. Letter, regarding this was read. Councilman Scheil.ert- stated that Mr. Hulse has requested some help on a committee to make arrangements for a possible meeting of the Association to be held in Renton. He stated that these plans would be dependent upon the completion of the new Renton Village Inn to provide adequate facilities for such a meeting. Chairman Felker appointed Mr. James Denzer and Mr. Dayle Garrison to work on Mr. Hulse' s committee. 1 8 . As information to the Commission Mr. Jensen stated that Mr. Felker had sent a telegram to Legislative Committee of the House advocating passage of House Bill 546 on Planning Enabling legislation. However, Mr. Jensen informed that this bill has failed to pass . 9 . Attention was called regarding the City Attorney's letter relative to the acquisition of parking .lots . Some discussion also followed re- lative to the operation of private parking lots, in particular, the possible violation of the permit agreement issued on the Northern Pacific Railroad property on Logan Street. Mr. Garrison was asked to check on this matter. J.O. Mr. Schel.lert -called the attention of the Commission to several matters under discussion by the Council of the Whole : a. Relative to the Land Use Map m what uses are allowed in the Commercial areas. b. In regard to zoning, what would be the Planning Commission' s feeling relative to rezoning property except for a buffer strip, Mr. Jensen stated that generally in rezoning you cannot do this , because it would deprive the property owner of the use of his property if you left a small strip which would be of no use to him. 11. The Commission discussed the proposed rezone of property in the County at the intersection of 138th and Cemetery Road, After discussion on the matter, it was moved by Denzer , seconded by Peretti , that a letter be sent to the County stating that the Commission has no objection to this rezone. Motion carried. Mr. Felker abstained from voting.
