AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CHANGING
THE ZONING CLASSIFICATION OF CERTAIN PROPERTY WITHIN THE
CITY OF RENTON FROM GENERAL CLASSIFICATION DISTRICT (G)
TO "APARTMENT HOUSES AND MULTIPLE DWELLINGS" (R-4)
WHEREAS under Chapter VII, Title IV (Business Regulations) of Ordinance No. 1628
known as the "Code of General Ordinances of the City of Renton", as amended, and the maps
adopted in conjunction therewith, the property hereinbelow described has heretofore been
zoned as General Classification District (G), and
WHEREAS a proper petition for change of zone classification of said property

has been filed with the City Clerk on or about September;.2' .;, which petition was then
referred to the Planning Commission for investigation, study and public hearing, and
a public hearing having been held thereon on or about September 22, 1965, all pursuant
to notice of hearing duly published and posted as provided by law; said matter having
been duly considered by the Planning Commission, and all parties having been heard
appearing in support thereof or in opposition thereto, NOW THEREFORE
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS FOLLWS:
SECTION I: The following described property in the CITY OF RENTON is hereby
rezoned to "Apartment House and Multiple Dwellings" (R-4); the City Engineer and the
Planning Director are hereby authorized and directed to change the maps of the Zoning
Ordinance, as amended, to evidence said rezoning, as follows:

Twp. 23 N. , R. 4 E.W.M., Described as follows: Beg. on the N line
of S 153rd St. at a point which is 727' W of the W line of C. D.
Hillman's Earl . Gar. Addn• to the City of Seattle, Div. #1, as per
plat recorded in Vol. 17 of Plats, P. 74, records of King Co. , thence
W along said street line 62' ; thence northerly at right angles to
said st. line 350' more or less, to the southerly line of Renton
Junction Wy (Sec. St. Hwy #1-L); thence NEly along said line 68'
more or less, to a line drawn at right angles from the point of
beg. thence southerly along said line to the point of beg. (beingknownasthatpor. of Tr. 6 of Sunset Home Gar. Tr. ) an unrecorded
plat, lying south of Renton Junction Wy; situate in the City ofRenton, County of King, St. of Wash. , as recorded in Vol. 3848 of
Deeds, P. 166, records of King County, EXCEPT that part lying
northerly of a line drawn parallel with and 100' distant southerly
when measured radially from the FAI-405 center line survey ofPrimarySt. Hwy. No. 1 Jct. SSH#'2-M' to Jct. PSH '#2 in Renton, as
condemned in King Co. Superior Court Cause No. 594806. Subject
to easements, rights and reservation of records.
Property being located on S. 153rd St. betw. 77th & 84th Avenues.
SECTION II: This Ordinance shall be in full force and effect from and after

Dear Helmie:
Enclosed you will find stencil for the proposed rezoning ordinanceforBrown1), Goodrich. We suggest that the Planning Director and
Engineer verify the legal description of subject property inasmuch
as your city file contains slight variations of said description.
Please also fill in the date of filing since the record does not
indicate when that was clone.
We naturally have made no reference to the requirement that the
applicant grant to the City certain.of his property for roadway
purposes since we believe, if that/ascondition to any rezoning,that it would be illegal and improper. Please refer to our previous
opinions on this subject matter; "conditional zonings" of this
type and nature have usually been condemned by the courts through—
out the country.

ing .of September -22 , 1965 recommends to the Council''. for
further action the following items
1. BEN :CABREROS, APPL. NO. R-250-65 ,. request: for
rezone from G to €I-1. The-:property ,is situated- on
South 180th Street between the . East and West Valley,
Action .Taken; ':
The Planning 1Cbnmission .:recommended that
the property be :rezoned. to. H-1 until the establishment.
of the Manufacturing Park Ordinance. At this time .the: :. .
property would be:,reclassified M-P. It was further .re-
commended that the applicant grant unto the City an
easement for roadway. and utility purposes over. ,the South
20' of the subject property in accordance with the 'pro-
posals of the Comprehensive 'Plan 'and the prior establish- - •- .
ment. of South 180th Street. as a 100' arterial by .the::
City.of -Renton.and the .,.City 'of Kent. : .
It was also recommended that the subject proper-
ty 'maintain -a 60' :'setback and::a 20'. .sideyard, which is
in agreement -with, the proposed M-P District.
The applicant.;was ,in agreement with the recommen-
datons and agreed to 'grant unto the City an easement

Action Taken
The Planning Commission recommended that, the.
property in question be rezoned to R-4.
It was further recommended that the Applicant grant
to the City an easement for roadway and utility purposes
over the South .15' -of the property adjacent to South
153rd Street. . This is in agreement with the Comprehen-
sive Plan.
The applicant, Mr.. Goodrich, present at the meeting,
stated that he was in agreement with the recommendations.
3. WILLIAM .GLOCKNER, APPL. NO. V-255-65 , request
for Variance of 3 ° from the required 25 ' rear yard set-
back, of proper•ty, located at 106.09 111th Place S.E.
Action Taken: .
The Planning Commission recommended approval
of the 3.' variance requested for the rear yard.
ADMINISTRATIVE MATTERS:
1) Mr. Dayle Garrison was elected to succeed 'Doug
Felker as Planning , Commission Chairman.
2) The Planning Commission's recommendations relative
to the M-P Manufacturing Park District will be presented
at the October 11 City Council meeting.

Chairman Felker questioned the legality of amending an applicant's
request without the consent of the applicant, and also of the change
to a classification which allows different uses than the one applied
for, without adequate notice.
It was then moved by Stredicke, seconded by Cordell , that we con-
tinue the hearing until the next regular meeting..and that the CityAttorneybecontacted .for a legal opinion. Motion carried.

Staff report: Recommend rezone providing applicant grant unto the
City an easement for roadway and utility purposes over the South :L51
of the property adjacent to South 153rd Street. This is in agreement
with the Comprehensive Plan,
Chairman Felker asked if there were any comments from the audience,
The applicant, Mr. Goodrich, preseut..,.at the meeting, stated that he.
was in agreement with the staff recommendation.
It was then moved by Stredicke, seconded by Denzer, that the hearingbeclosed. Motion carried.
It was moved by Stredicke, seconded by Denzer, that we recommend to
City Council the granting of the rezone in accordance .with the Commit-
tee report. Motion carried. Mr, Stredicke clarified the motion to
not include the staff report; whereupon Mr. Denzer withdrew his second.
Chairman Felker then ruleditheLmotion.' void.
It was then moved by Denzer, seconded by Racanello, that we recom-
mend to the City Council the granting of the rezone according to theStaffrecommendations . Motion carried.
Mr. Stredicke voted no because he did not believe that the provis-
ion for the easement should be a condition of granting the rezone.
