Dear Mr. Lindell,
We Piave reviewed the possibilities with regards to the location
of a gas pump at the proposed C.F.S. warehouse in Earlington
park. As I stated earlier, it was our first impression that it
be located inside the building. This, however, is apparently
in violation of.the present City building and fire codes.
Our second alternative was at the back of your southernmost
parking lot where it would less likely be seen. This was
unfeasable for you stating that the facility would bertoo
distant from its potential user.
Therefore, having reviewed these and other alternatives we .
felt that a location on the west side-of the building just
south of the loading docks would be suitable. It was felt
that, this would be a better location for all concerned. It
is proximate to its potential users but at the same time it is
adjacent to Seneca Street which is a side street as opposed to
a main arterial, SW 7th St. This location would also preclude the
elimination of additional parking spaces which,as I stated
in .our previous discussion, could become critical in your final
expansion phase.
To be formally approved this gas pump must be shown on your
building plans, and be approved by both the building and fire '
departments. The pump must be located on- a concrete foundation island.
It must be screened by a wood slatted cyclone fence of sufficient
height, and must also have the necessary guard posts to insure
that] it will not be hit by any vehicles.
The attached plan shows not only our gas pump location recommenda-
tion, but also the additional landscaping rbquirements as per
yourl,most 'recent site approval application.

THE ZONING COMMITTEE FOR STUDY AND REPORT BACK TO THE COM-
MISSION . MOTION SECONDED BY SEYMOUR .
Ross questioned if the committee would have. the opportunity
to receive further input at future committee meetings . and
was informed by the Chairman that he could ask for advice
from the staff , or the Engineering and Fire Departments , but
would not be entitled to question the applicant or hear tes-
1 timony .
On the question , MOTION FAILED .
SCHOLES THEN MOVED THAT THE HEARING ON THE RUSHMORE REZONE

Chairman Teegarden reviewed the application . The Planning
Director displayed the site plan and pointed out property
location . The development plan is for approximately 1 / 2
of the total site at this time . Mr . Ericksen indicated
there were questions regarding landscaping and ingress and
egress , and these matters have been reviewed with the ap-
plicant . The application complies with the requirements
of the M-P zone , and applicant has agreed to add additional
l/*// andscaping . , Staff recommends approval subject to posting
of a bond .for installation and maintenance of landscaping .
Mr . Frank . Lindell , Project Manager for Halvorson & Associ -
ates , made a brief presentation on their proposed plans and
indicated he was aware he would have to come before the Com-
mission again for any expansion of the building . He stated
he probably would be applying for the expansion within a
few weeks .
With regard to the landscaping , Mr . Lindell indicated he .
would like to put in landscaping similar to that across the
street (Washington Wholesalers ) to make it symmetrical .
Chairman Teegarden stated he would be willing to accede
to the staff working out the type of plants With the appli -
cant.
Following this , it was MOVED BY WIK , SECONDED BY SCHOLES ,
THAT THE HEARING BE CLOSED. MOTION CARRIED UNANIMOUSLY .

was dedicated by Puget Power , and west of Dayton Avenue the
right-of-way is wider. The main problem is at the intersec-
tion , and development of the property would require almost
immediate widening and improvement of the street adjoining
the Puget Power installation and the subject property . This
would bring obvious benefits to the adjacent property owners
by improving the intersection , the access problem and the
grade .. Puget Power has agreed to install improvements at
their cost at such time as the City requires it .
Discussion followed regarding the question of the right-of-
way dedication . Mr. Ericksen pointed out staff does not feel
the development of the property as presently zoned constitutes
a problem; however , if the density were increased , and both
the R-3 and B-1 properties were developed , then the problems
would be increased and N . E . 12th would definitely have to be
improved .
Chairman Teegarden called for comments from the audience .
Mr. Roland R. .Wylet , 1216 Dayton N . E . , acting as spokesman
for the petitioners , stated he felt all the objections were
covered in the petition and suggested it be reviewed . The
Chairman re-read the petition at this point .
Statements protesting the proposed rezone were also made by
Adrain Sheely , 1312 Dayton Ave . , N . E . , and W . D . Newton , 1212
Dayton Ave . N . E .
Mr . Schwab summarized by saying the remainder of Mr. Rushmore ' s
property is commercially zoned and the subject property is not
suitable for single family residential . He feels it is only
feasible to develop it a`s an apartment complex to act as a buf-
fer between the commercial property and the single family resi -
dential , and wanted it especially noted that the requested re-
zone is in accordance with the Comprehensive Plan . In regard
to the anticipated traffic use , Mr . Schwab stated Mr . Rushmore
is prepared to make a concession to not use N . E . 12th Street
for either ingress or egress .
Commissioner Ross , chairman of the Zoning Committee , stated
that due to the hazardous condition of N . E . 12th St . and the
intersection of 12th and Edmonds , the following proposal may
be feasible : That N . E . 12th St . from the west property line
of Puget Power ' s _ property be vacated and the City retain a_ 15-
foot utility easement which would accommodate future underground-
ing of wiring , etc. , and allow pedestrian and bicycle traffic
only . Mr. Schwab asked that the record show that Mr . Rushmore
would ,be agreeable to the suggestion made by Commissioner Ross .
The Planning Director reviewed the types of uses allowable in
an R-3 , zone -- ' including multiple dwellings , and other uses such
as professional.. offices , etc . , by special permit from the Plan-
ning Commission.. Mr . Ericksen stated the development of adja-
cent properties, should also be considered , as well as the timing
of a rezone .
After further discussion , Commissioner Humble MOVED THE HEARING
BE CLOSED .
Chairman Teegarden stated the Commission has three alternatives :
1 . Close the hearing and take action ; 2 . Close the hearing -and
refer to a committee for further study and report back ; or , 3 .
Continue the hearing to a definite future date .

On the subject of the minutes , Seymour requested that
they be made available to the Commissioners prior to
the following meeting . Discussion ensued on this sub-
ject , with the Planning Director explaining that the
workload has increased considerably in the Planning De-
partment and additional clerical help was needed . Mr .
Ericksen noted that the Planning Commission minutes
are written in detail to give complete information on
items discussed . Such detail has been at the request
of the Planning Commission and does take longer to
prepare . He suggested eliminating the detailed informa-
tion and condensing the minutes to reflect the basic
information and action taken on applications . The
Commissioners felt that the minutes should not be
condensed in order to provide a clear and complete
record of what has transpired at the meetings .
3. CONTINUED PUBLIC HEARING ITEMS FOR CONSIDERATION JUNE 27 :
A. REZONE:
RUSHMORE , JOHN C. ; Appl . No . R-728-73 ; request for
rezone from G-7200 to R-3 ; property located on S . W .
corner of N . E . 12th St . and Edmonds Ave . N . E .
Mr. Ericksen noted this item had been continued from the
May 23rd meeting to the meeting of June 27th , and had
been referred to the Zoning Committee for study and recom-
mendation . He noted that staff has met with applicant to
resolve any anticipated problems , and that Mr. Rushmore
has indicated reluctance to dedicate additional right-of-
way , particularly if the Commission were to deny access
to N . E . 12th St .
B. SITE PLAN APPROVAL:

tive of the applicant present at the May 23rd meeting .
There was a question with reference to the applicant ' s
landscaping plan , but staff expects to have this resolved
prior to the meeting June 27th .
4, NEW PUBLIC HEARING ITEMS FOR CONSIDERATION JUNE 27 :
Co REZONE:
GUY , CHARLES B . ; Appl . No . R-735-73 ; request for rezone
from G to L-1 ; property located at 1404 S .W. Grady Way .
The Planning Director described the application and pointed
out the property location , noting it is on Grady Way between
Totem Beverages and the Turf Motel . The proposed use is for
outdoor storage of travel trailers , motor coaches and boats .
The applicant is requesting L-1 zoning , which is in conform-
ance with the Comprehensive Plan .

meets , it would be difficult to restrict it to that use only
when the commercial property to the south is developed . The
Planning Director felt an effective way to prevent commercial
property traffic from using any access onto N . E . 12th would
be; by use of a barrier and landscape screening , etc .
Chairman Teegarden asked if anyone in the audience wished to
sp;eak in favor of the rezone . The applicant , Mr . John Rushmore ,
stated that the R-3 zoning would create a buffer between the
single family residential and the business zoning to the south .
He agreed the topography of the property is a problem , but any
development would be done in conjunction with the Traffic
Engineer to assure safe access , etc . He assured the Commission
he would be willing to cooperate and do whatever is requested
that is logical and good planning .
The Chairman then called for comments from ,those opposed to
the rezoning . Mr . Harry Watson , 1208 N . Dayton , Mr . and Mrs .
Fred Wendling and son , 2331 N . E . 12th , and Mr . W. D . Newton ,
owner of property at 1212 Dayton Ave . N . E . , spoke in opposition
to the rezone . Listed as reasons : the steep grade on 12th at
the intersection with Edmonds , the fact that apartments on the
higher elevation would overlook their back yards and invade
their privacy , the increased traffic and probability that cars
Would be parking on the streets . Mr . Wendling also asked about
notification requirements for rezones . Mr . Ericksen replied
the legal requirement is posting of 3 notices in the vicinity
of the property and legal advertisement in the Record-Chronicle , '
but that the Planning Department is investigating other methods
of notifying property owners of public hearings .
Mr . Rushmore responded to some of the questions raised by the
Opposition , and the Planning Director stated that the Parking
and Loading Ordinance requires 2 parking spaces per unit , with
a separate area set aside for parking of boats , trailers , etc .
in large complexes , which should eliminate on-street parking .
He further noted that if this property were developed , then
off-site improvements (curbs , gutters and sidewalks ) and
widening of the street would probably be required to accommo-
date existing and additional traffic .
ACTION :
Following this discussion , it was MOVED BY SCHOLES , SECONDED
BY SEYMOUR , THAT THE HEARING ON THE RUSHMORE REZONE BE CON-
TINuED TO THE MEETING OF JUNE 27TH AND REFERRED TO THE ZONING
COMMITTEE FOR STUDY AND RECOMMENDATION . MOTION CARRIED
UNANIMOUSLY .
Norman Ross , chairman of the Zoning Committee , then called
for a meeting of the committee at 7 : 30 p . m . , May 30th , and
noted that all committee meetings are open to the public . He
requested that the Engineering Department , prior to the Zoning
Committee meeting , furnish data and schedules for the improve-
ment of N . E . 12th Street and the intersection of Edmonds Ave . N . E .
and N . E . 12th St .

development plan , elevation drawing and the landscape plan
showing applicant ' s proposed landscaping and what staff
is recommending ) and showed slides of the property and
adjacent areas . He noted a site plan for the property
had previously been approved by the Commission , but that
applicant had submitted a revised plan . The development
plan is for approximately one-half of the total site and
is in accord with the M-P requirements with the exception
of the landscaping as proposed on the plan .
The Planning Director stated that staff recommends the
development plan be approved subject to finalization of
the landscaping and posting of the landscaping and main-
tenance bond , as previously required . He indicated , how-
ever , that the applicant didn ' t agree with staff ' s
recommendations regarding the landscaping .
Chairman Teegarden asked if a representative of the appli -
cant was present. No representative was in the audience ,
although Mr . Ericksen stated applicant was aware of the
date of the public hearing . Commissioner Seymour stated
she felt the Commission could not act on the application ,
in view of the confusion with regard to landscaping and
the absence of a representative from Halvorson .
ACTION :
MOVED BY SEYMOUR , SECONDED BY ROSS , TO CONTINUE THE
HALVORSON SITE PLAN APPROVAL APPLICATION UNTIL THE MEET-
ING OF JUNE 27TH. MOTION CARRIED UNANIMOUSLY .
Ross then requested that staff send a notice by registered
mail to Halvorson & Associates notifying them that their
application has been continued to the meeting of June •
27th . Staff agreed to do so .

The Chairman described the application , and the Plan-
ning Director explained the requirements of the platting
ordinance with reference to short subdivisions . He
noted there is a provision in the ordinance for the
waiver or delay of off-site improvements . He suggested
that the three applications for waiver of off-site im-
provements to be considered at this meeting be treated
somewhat in the manner that variances are , i . e . , that
the Commission state reasons for either granting or
denying the waiver.
The Planning Director pointed out the location of the
property on the Zoning Map and a blow-up of the area .
He noted the proposed development is for a single
family residence , with access by means of an easement
through the adjoining property . Mr. Ericksen showed
slides of the property .
Chairman Teegarden asked Lyman Houk about utilities .
He stated a sanitary sewer and water main are existing
on Park Avenue North . Mr. Houk then proceeded to give
the Public Works Department ' s position with regard to
waiving the requirement for off-site improvements . He

PUBLIC HEARING BE CLOSED. MOTION CARRIED UNANIMOUSLY .

COMMISSION GRANT THE REQUEST OF LEWIS H . PURCELL FOR A
WAIVER OF OFF-SITE IMPROVEMENTS SINCE THE ADJACENT AREA
IS NOT DEVELOPED TO CITY STANDARDS AT THIS TIME.
On the question , Seymour asked that the minutes show
this to be a particular exception in this case .

diagonally across Edmonds from McKnight Junior High School ,
with a Puget Power substation directly to the west . The
applicant is requesting a rezone of the property on the
corner presently zoned G-7200 . The property he owns south
Ito Sunset is zoned B-1 . Applicant is proposing a condo-
minium on the area to be rezoned . The Comprehensive Land
Use Map indicates medium density multi -family .
