The applicant indicated that a landscape plan had been pending on the issuance of the Planning Department report on the application. In response to the Examiner's inquiry about jutting building corners, Mr. Wells reported that an architectural review would be made of the matter. Regarding Item 6 of Exhibit #1, Mr. Smith directed Mr. Wells to coordinate the matterfwithrepresentativesoftheUtilitiesDivision, and reported that a comment regarding a 12-inch water main had been made. on Exhibit #3 by the Utilities Division at the time of application review. The Examiner labeled the duplicate site plan with Utilities Division comments as Exhibit #4. The Examiner asked for further comments in support or opposition of the application. There was no response. The Examiner asked Mr. Smith for additions, corrections or modifications to Exhibit #1. Mr. Smith added a comment relating to previous discussion regarding corners of buildings to be reviewed by an architect. The Examiner noted that a change of policy•by public utilities had occurred with purchase of the property easement from Puget Sound Power and Light Company. Mr. Smith indicated that policies of public utilities were currently more flexible, although the subject application represented the first construction project within the easement. Discussion ensued regarding future access problems on Grady Way and it was agreed that careful review would be made of future applications for proper access. Mr. Wells reported that a valid 180-day building permit had been issued for the current grading of the site in June, 1977 for the preload operation. Mr. Smith indicated that the current building permit would have been attached to the previous permit of September, 1976. The Examiner asked for further testimony. Since there was none, the hearing on Item #R-072-77 and SA-061-77 was closed by the Examiner at 4:15 p.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: 1. The request is for approval of a reclassification from G to M-P and site plan approval of an office/laboratory facility at the southwest corner of Lind Avenue S.W. and S.W. 10th Street. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this refort by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official: 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-730(M-P) and Chapter 22 (Parking and Loading) of Title IV and a Board of Adjustment variance of August 18, 1977. 8. A setback variance was approved by the Board of Adjustment on. August 18, 1977 to allow the building to be constructed 52 feet from the right-of-way of S.W. Grady Way. 9. The King County Hydraulics Division has not approved the Flood Zone Control Permit for the proposal. 10. Grading of the site has begun in connection with an existing building permit for another building previously intended for the site. 11. A landscape plan was not submitted to satisfy zoning requirements and Soil Conservation requirements per Resolution No. 1923 for 2% wildlife habitat mitigation. r J September 12, 1977 OFFICE OF THE LAND USE HEARING EXAMINER CITY OF RENTON REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL. APPLICANT: Duane A. Wells and Val Bain FILE NO. R-072-77 SA-061-77 LOCATIQp1: ••Property located at the, southwest corner of Lind Avenue S.W. and S.W. loth Street on the old Burlington Northern Right- of-Way and Puget Sound Power Line Right-of-Way located between Grady Way and S.W. 10th Street. SUMMARY OF REQUEST: Applicant requests approval of rezone from G to M-P and 1 Site Plan approval of a proposed office/laboratory facility to be located on a site consisting of the proposed rezone area together with the existing M-P (Manufacturing Park) zoning. One hundred twenty parking stalls are also proposed in conjunction with the facility as per the City's Parking and Loading Ordinance requirements together with various landscaping areas around the perimeter and interior of the site. SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: Hearing Examiner: Approval with conditions. PLANNING DEPARTMENT The Planning Department_ staff report was received by the REPORT: Examiner on August 30, 1977. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 6, 1977 at 3:45 p.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Assessor's Map Exhibit #3: Site Plan with Building Elevations In response to the Examiner's inquiry regarding grading accomplished on the site, Mr. Smith indicated that a building permit allowing grading may have been issued during a previous application request in September of 1976. The Examiner inquired about building corners jutting into parking areas designated on Exhibit #3. Discussion ensued regarding possible alternatives to protect corners including proposed landscaping or architectural revisions to the building plan. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Duane A. Wells 15 South Grady Way Renton, WA 98055 Mr. Wells reported that he did not concur with Page 5, Item 6 of Exhibit #1 relative to provision of suitable utilities and off-site improvements. He indicated that with provision of sewer and water along loth Avenue, an extension on Lind Avenue was unnecessary and not applicable to a rezone or site plan approval request. With the exception of this item the applicant concurred with Exhibit #1. R-072-77 Pago Four SA-061-77 5. Shellan, City Attorney Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed in writing on or before September 26, 1977. Any aggrieved person feeling'that the .,decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. Copies of this ordinance are available for inspection in the City Clerk's office, first floor of City Hall, or same may be purchased at cost in said office. R-072-77 Page ,Three SA-061-77 12. The proposed site plan, Exhibit #3, indicates that the northwest and southeast corner of the building protrude into the parking lot without protection ,via curbs and/or landscaping. 13. The site lies at the southern border of the Earlington Manufacturing Park. Along the southern border of the site is S.W. Grady Way. No access is provided to S.W. Grady Way. 14. This application represents the initial occurrence of development in this general area abutting the north side of S.W. Grady Way and utilizing the Puget Sound Power and Light Company right-of-way for parking. That portion of the utility right-of- way is included in the rezone; the applicant has purchased the right-of-way and granted the utility an easement. A precedent may be established in this application for similar future development in this area along the north side of S.W. Grady Way. 15. The majority of. the site is currently zoned M-P. 16. Final grading of the site must meet the requirements of Chapter 23, Mining, Excavation and Grading Ordinance. 17. Outside waste receptacles are not featured in the site plan, Exhibit #3. CONCLUSIONS: 1. The proposed rezone and site plan generally comply with, the goals and objectives of the Comprehensive Plan, and conditions are required for complete compliance Section 4-3014(B) ) . 2. This site clearly is physically oriented to the Earlington Industrial Park (M-P) to the north and across S.W. 10th Street. Access will be to S.W. 10th Street and not S.W. Grady Way. The building grade elevation will be several feet below S.W. Grady Way. These physical factors make this site somewhat unique from other similarly located properties along the north side of S.W. Grady Way. 3. Per Resolution No. 1923, 2% of the site must be devoted to wildlife habitat landscaping. Such landscaping must be located on site and should incorporate landscaping in the adjacent public right-of-way. The Planning Department files contain guidelines for implementing the landscaping requirements of the Soil Conservation Service which the applicant and Planning Department can satisfactorily use to develop a final landscape plan for that department's approval. 4. A Flood Zone Control Permit is essential from the King County Hydraulics Division which will utilize the Examiner's decision in its review of the permit. 5. Those portions of the building which protrude into paved parking and access areas should be protected by landscaping and/or curbing. A final site plan incorporating this revision can be satisfactorily reviewed and approved by the Planning Department. 6. This site lies within the Green River Valley Comprehensive Plan area, and consequently, the final drainage plan should adhere to the applicable goals and objectives. RECOMMENDATION: Based upon the record, testimony and evidence submitted in the public hearing, it is recommended by the Examiner to the City Council that the requested application be approved subject to: 1. Submittal by the applicant and approval by the Planning Department of a final landscape plan in compliance with Resolution No. 1923 and incorporating the adjacent public right-of-ways. 2. Submittal by the applicant and approval by the Public Works Department of a final storm water drainage plan and final. utilities and off-site improvements plan. 3. Submittal by the applicant and approval by the Planning Department and Public Works Department of the slope stabilization to be compatible with and complement the aforementioned final landscape plan. 4. The applicant indicated that a landscape plan had been pending on the issuance of the Planning Department report on the, application. In response to the Examiner's inquiry about jutting building corners, Mr. Wells reported that an architectural review would be made of the matter. Regarding Item 6 of Exhibit #1, Mr. Smith directed Mr. Wells to coordinate the matter with representatives of the Utilities Division, and reported that a:comment regarding a 12-inch water main had been made on Exhibit #3 •by the Utilities Division at the time of application review. The Examiner labeled the duplicate site plan with Utilities Division comments as Exhibit #4. The Examiner asked for further comments in support or opposition of the application. There was no response. The Examiner asked Mr. Smith for additions, corrections or modifications to Exhibit #1. Mr. Smith added a comment relating to previous discussion regarding corners of buildings to be reviewed by an architect. The Examiner noted that a change of policy by public utilities had occurred with. purchase of the property easement from Puget Sound Power and Light Company. Mr. Smith indicated that policies of public utilities were currently more flexible, although the subject application represented the first construction project within the easement. Discussion ensued regarding future access problems on Grady Way and it was agreed that careful review would be made of future applications for proper access. Mr. Wells reported that a. valid 180-day building permit had been issued for the current grading of the site in June, 1977 for the preload operation. Mr. Smith indicated that the current building permit would have been attached to the previous permit of September, 1976. The Examiner asked for further testimony. Since there was none, the hearing on Item #R-072-77 and SA-061-77 was closed by the Examiner at 4:15 p.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: 1. The request is for approval of a reclassification from G to M-P and site plan approval of an office/laboratory facility at the southwest corner of Lind Avenue S.W. and S.W. 10th Street. 2. The Planning Department report accurately sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this refort by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.Ca , a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development and no adverse comment was expressed. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-730(M-P) and Chapter 22 (Parking and Loading) of Title IV and a Board of Adjustment variance of August 18, 1977. 8. A setback variance was approved by the Board of Adjustment on August 18, 1977 to allow the building to be constructed 52 feet from the right-of-way of S.W. Grady Way. 9. The King County Hydraulics Division has not approved the Flood Zone Control Permit for the proposal. 10. Grading of the site has begun in connection with an existing building permit for another building previously intended for the site. 11. 'A landscape plan was not submitted to satisfy zoning requirements, and Soil Conservation requirements per Resolution No. 1923 for 2% wildlife habitat mitigation. September 12, 1977 OFFICE OF THE LAN•ID USE HEARING EXAMINER CITY OF RENTON REPORT AND RECOMMENDATION TO THE RENTON CITY COUNCIL. APPLICANT: Duane A. Wells and Val Bain FILE NO. R-072-77 SA-061-77 LOCATION: Property located at the southwest corner of Lind Avenue S.W. and•S.W. 10th Street on the old Burlington Northern Right- of-Way and Puget Sound Power Line Right-of-Way located between Grady Way and S.W. 10th Street. SUMMARY OF REQUEST: Applicant requests approval of rezone from G to M-P and Site Plan approval of a proposed office/laboratory facility to be located on a site consisting of the proposed rezone area together with the existing M-P (Manufacturing Park) zoning. One hundred twenty parking stalls are also proposed in conjunction with the facility as per the City's Parking and Loading Ordinance requirements together with various landscaping areas around the perimeter and interior of the site. SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: Hearing Examiner: Approval with conditions. PLANNING DEPARTMENT The Planning Department staff report was received by the REPORT: Examiner on August 30, 1977. PUBLIC HEARING: After reviewing the Planning Department report., examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 6, 1977 at 3:45 p.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1.. Michael Smith, Planning Department, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Assessor's Map Exhibit #3: Site Plan with Building Elevations In response to the Examiner's inquiry regarding grading accomplished on the site, Mr. Smith indicated that a building permit allowing grading may have been issued during a previous application request in September of 1976. The Examiner inquired about building corners jutting into parking areas designated on Exhibit #3. Discussion ensued regarding possible alternatives to protect corners including proposed landscaping or architectural revisions to the building plan. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was: Duane A. Wells 15 South Grady Way Renton, WA 98055 Mr. Wells reported that he did not concur with Page 5, Item 6 of Exhibit #1 relative to provision of suitable utilities and off-site improvements. He indicated that with provision of sewer and water along 10th Avenue, an extension on Lind Avenue was unnecessary and not applicable to a rezone or site plan approval request. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. Copies of this ordinance are available for inspection in the City Clerk's office, first floor of City Hall, or same may be purchased at cost in said office. R-072-77 page Three SA-061-77 12. The proposed site plan, Exhibit #3, indicates that the northwest and southeast corner of the building protrude into the parking lot without protection via curbs and/or landscaping. 13. The site lies at the southern border of the Earlington Manufacturing Park. Along the southern border of the site is S.W. Grady Way. No access is provided to S.W. Grady Way. 14. This application represents the initial occurrence of development in this general area abutting the north side of S.W. Grady Way and utilizing the Puget Sound Power and Light Company right-of-way for parking. That portion of the utility right-of- way is included in the rezone; the applicant has purchased the right-of-way and granted the utility an easement. A precedent may be established in this application for similar future development in this area along the north side of S.W. Grady Way. 15. The majority of the site is currently zoned M-P. 16. Final grading of the site must meet the requirements of Chapter 23, Mining, Excavation and Grading Ordinance. 17. Outside waste receptacles are not featured in the site plan, Exhibit #3. CONCLUSIONS: 1. The proposed rezone and site plan generally comply with the goals and objectives of the Comprehensive Plan, and conditions are required for complete compliance Section 4-3014(B) ) . 2. This site clearly is physically oriented to the Earlington Industrial Park (M-P) to the north and across S.W. 10th Street. Access will be to S.W. 10th Street and not S.W. Grady Way. The building grade elevation will be several feet below S.W. Grady Way. These physical factors make this site somewhat unique from other similarly located properties along the north side of S.W. Grady Way. 3. Per Resolution No. 1923, 2% of the site must •be devoted to wildlife habitat landscaping. Such landscaping must be located on site and should incorporate landscaping in the adjacent public right-of-way. The Planning Department files contain guidelines for implementing the landscaping requirements of the Soil Conservation Service which the applicant and Planning Department can satisfactorily use to develop a final landscape plan for that department's approval. 4. A Flood Zone Control Permit is essential from the King County Hydraulics Division which will utilize the Examiner's decision in its review of the permit. 5. Those portions of the building which protrude into paved parking and access areas should be protected by landscaping and/or curbing. A final site plan incorporating this revision, can be satisfactorily reviewed and approved by the Planning Department. 6. This site lies within the Green River Valley Comprehensive Plan area, and consequently, the final drainage plan should adhere to the applicable goals and objectives. RECOMMENDATION: Based upon the record, testimony and evidence submitted in the public hearing, it is recommended by the Examiner to the City Council that the requested application be approved subject to: 1. Submittal by the applicant and approval by the Planning Department of a final landscape plan in compliance with Resolution No. 1923 and incorporating the adjacent public right-of-ways. 2. Submittal by the applicant and approval by the Public Works Department of a final storm water drainage plan and final utilities and off-site improvements plan. 3. Submittal by the applicant and approval by the Planning Department and Public Works Department of the slope stabilization to be compatible with and complement the aforementioned final landscape plan. 4. PURPOSE OF REQUEST: To allow rezoning to Manufacturing Park District consistent with surrounding zoning and comprehensive planning , zoning , and uses to allow for development of a . proposed office/laboratory facility together with the necessary parking and landscaping . D, HISTORY/BACKGROUND: The subject site was annexed to the City on April 14 , 1959 , by Ordinance No. 1745 . The subject site was part of a former railroad right-of-way and also a portion of the site utilized for transmission line right-of-way. Mr . Mr. Wells has revised his proposed use for the subject site which resulted in the proposed rezone and site plan approval request . E. PHYSICAL BACKGORUND: 1 . Topography : The site has an elevation of approximately equal to that of S. W. 10th Street , however , both Lind Avenue S . W. and Grady Way S. W. are at a higher elevation than the subject site , a certain amount of cutting and grading in conjunction with the proposal will be required . 2 . Soils : Urban Land (Ur ) . 3 . Vegetation : A large portion of the subject site has been previously cleared as part of the previous proposed development project for the site . Typical vegetation in the old railroad right-of-way area extending west of the subject site is primarily scrub grasses w.it,h mixed , deciduous trees and 'bushes . It is difficult to tell at this time whether -or not the deciduous trees are located on the subject site ,., if so they should be retained as much as possible in the site development plan . 4. Wildlife : The existing vegetation that remains on the site provides suitable habitat for birds and small mammals . 5. Water : Surface water and streams are not apparent on the subject site , however , the elevation of the subject site is such that proper drainage will have to be provided as part of the site development. 6. Land Use : Subject site is presently undeveloped . There is an existing power line corridor located on the southerly portion of the subject site for approximately the southerly fifty feet thereof, however , the property is owned by the applicant and part of the subject development the power company retains easement for th& power line corridor . Just south of the power lines there exists an area of public , right-'of-way to the improved portion of Grady Way. The area within the old railroad right-of-way extending west of the subject site is presently undeveloped . The area south of the subject site is within the original Earlington Manufacturing Park District and is presently developed to manufacturing park standards . East of the subject site across Lind Avenue S . W. the old railroad right-of-way is also presently undeveloped . F. NEIGHBORHOOD CHARACTERISTICS : The general area is in a transitional nature from undeveloped and single family residence property to commercial and industrial uses . G. PUBLIC SERVICES: 1 . Water and Sewer : A 12 inch water main exists along S . W. 10th Street and an 8 inch sewer main exists along Lind Avenue S . W. A large Metro sewer interceptor line is located along S . PLANNING DEPARTMENT ANALYSIS: 1 . T•he subject rezone request is consistent with the Comprehensive. Land Use Plan , existing zoning , and existing uses , within the general area . The proposed use is , a permitted use within the M-P , (Manufacturing Park) zone . 2. Proper utilities are available to the site. Any development of the site must conform to City of Renton utilities and off-site improvement requirements . 3 . The subject site , parcels 1 and 2 surround an existing M-P , Manufacturing Park zone (rezoned December 17 , 1976 , Ordinance No. 3083 ) and are intended to be incorporated , into the overall development plan for the area . The proposed use is an office/ laboratory facility together with related parking ( 120 spaces required ; 120 spaces provided ) and landscaping . The use is permitted within the M-P District. 4. Parcel 2 ( the southerly parcel ) was purchased from Puget Power and contains an easement for existing overhead electrical trans- mission lines . According to the agreement with Puget Power this area cannot be utilized for permanent structures . Parking and landscaping are proposed for this area . Parcel 1 is also pro- posed for parking and landscaping as part of the total development. 5. A variance from the 60 foot setback requirement was granted. by the Board of Adjustment on August 18 , 1977 , subject to certain conditions including landscaping the City right-of-way between the subject' s southerly property line and the edge of the existing street improvements . A similar variance request for a 58 foot setback along the northerly portion of the site was denied by the Board of Adjustment. A copy of that decision is attached . 6. The applicant has indicated that he will provide additional land- scaping adjacent to the northerly facade of the proposed structure. The Planning Department encourages this proposal to assist in reducing the visual expanse of the proposed building . 7 . A detailed landscape plan must be provided at the time of building permit application submittal . Such plan should consist of a suitable combination of trees , shrubs , and groundcover to provide screening , buffering , aesthetic quality , and wildlife habitat as per the Green River Valley Comprehensive Plan , Objectives , pages 5 through 7 , and Resolution No . 1923 It appears that with the planting areas shown on the plans and the Board of Adjustment ' s conditions that the 2% site landscaping requirement of Resolution No . 1923 will be met. 8 . The proposed building meets the height and site coverage limits of the M-P zone. 9. The applicant has stated that he owns the additional property west of the subject site to Powell Avenue S . W. along the abandoned Burlington Northern Railroad Right-of-Way. Future similar development by the applicant is anticipated . Rezoning o.f this area will be necessary as well as subdivision if the property is separately sold . 10. Dumpster locations have created some visual and locational problems within the Earlington Manufacturing Park. Proper site screening and location should be required pursuant to the Green River Comprehensive Plan , Objectives , acid Section 4-3010(B ) 1 . P. PLANNING DEPARTMENT RECOMMENDATIONS: Recommend approval of the rezone request based on the above analysis and its compatibility with the Comprehensive Plan , existing zoning . together with the fact that proper utilities are available to serve the subject site and the proposed development. Approval of the site plan subject to the following : 1 . The conditions established by the Board of Adjustment ' s decision of August 18 , 1977 . 2 . Maintenance of a 60 foot setback along the northerly property. line as per the M-P standards . 3 . A detailed landscape plan including the areas designated for landscaping on the site plan and the area adjacent to the building , together with the right-of-way area along Grady Way must be submitted to and approved by the Renton Planning Department at the time of building permit application submittal . Such plans shall be consistent with the objectives of the Compre- hensive Plan , the Parking and Loading Ordinance , and Resolution No . 1923 . 4 . Location and screening methods for refuse dumpsters must be submitted to and approved by the Renton Planning Department . 5. Provisions of suitable . storm water retention and oil /water separation facilities subject to Public Works Department approval . 6. Provisions of suitable utilities and off-site improvements per Public Works Department , Uniform Building Code , Uniform Fire Code and Section , 4-102 requirements . This includes a sewer extension along Lind Avenue S . W . , a new 12 inch water main from S . Grady Way, property located in the vicinity of S.W. 10th Street and Lind Avenue S.W. The Chairman opened the public hearing. Mr. Hanson read applicant's answers to the questions on the variance application and advised the Board that the prop- erty involved is in an MP Zone, which requires a 60' setback.. He advised that applicant had submitted an additional list of eight reasons why they felt special circumstances applied. At the Board's request he read that list and then presented two plans, the first one submitted with the variance request, on which he pointed out the location of Grady Way, Lind and S.W. 10th Street, and the second, a City of Renton plan showing Lind Avenue improvements, noting there is a large distance which varies from 20 to 35 or 40 feet from appli- cant's property to the existing paved area. He pointed out that this street is included in the Six Year Street Program and that after improvements there would still be 22.5 feet from the sidewalk to applicant's property line. The Board questioned the applicant regarding reason for change in plans from a warehouse, for which variance had previously been granted, to an office/ laboratory building, the need for the size building proposed, and then ques- tioned Mr. Hanson regarding other properties and buildings in the area and street plans for the area, particularly regarding the streets on the three sides of applicant' s property. There were no others present to speak for or against the application and the public portion of the hearing was closed. Mr. ' Wells', 'has revised his proposed use for the subject site. which resulted in the proposed rezone and site plan approval request . E. PHYSICAL BACKGORUND: 1 . Topography : The site has an elevation of approximately equal to that of S. W. 10th Street , however , both Lind Avenue S . W. and Grady Way S. W. are at a higher elevation than the subject site , a certain amount of cutting and grading in conjunction with the proposal will be required . 2 . Soils : Urban Land (Ur) . 3. Vegetation : A large portion of the subject site has been previously cleared as part of the previous proposed development project for the site. Typical vegetation in the old railroad right-of-way area extending west of the subject site is primarily scrub grasses with mixed deciduous trees and bushes . It is difficult to tell at this time whether or not the deciduous trees are located on the subject site, if so they should be retained as much as possible in the site development plan . 4. Wildlife : The existing vegetation that remains on the site provides suitable habitat for birds and small mammals . 5. Water : Surface water and streams are not apparent on the subject site , however , the elevation of the subject site is such that proper drainage will have to be provided as part of the site development. 6. Land Use : Subject site is presently undeveloped . There is an existing power line corridor located on the southerly portion of the subject site for approximately the southerly fifty feet thereof, however , the property is owned by the applicant and part of the subject development the power company retains easement for the. power line corridor . Just south of the power lines there exists an area of public right-of-way to the improved portion of Grady Way. The area within the old railroad right-of-way extending west of the subject site is presently undeveloped . The area south of the subject site is within the original Earlington Manufacturing Park District and is presently developed to manufacturing park standards . East of the subject site across Lind Avenue S . W. the old railroad right-of-way is also presently undeveloped . F. NEIGHBORHOOD CHARACTERISTICS: The general area is in a transitional nature from undeveloped and single family residence property to commercial and industrial uses . G. PUBLIC SERVICES: 1 . Water and Sewer : A 12 inch water main exists along S . W. 10th Street an.d an 8 inch sewer main exists along Lind Avenue S . W. A large Metro sewer interceptor line is located along S . Land Use Plan , existing zoning , and existing uses , within the general area . The proposed use is a permitted use within the M-P , (Manufacturing Park) zone . 2 . Proper utilities are available to the site. Any development of the site must conform to City of Renton utilities and off-site improvement requirements . 3 . The subject site , parcels 1 and 2 surround an existing M-P , Manufacturing Park zone (rezoned December 17 , 1976 , Ordinance No. 3083 ) and are intended to be incorporated into the overall development plan for the area . The proposed use is an office/ laboratory facility together with related parking ( 120 spaces required ; 120 spaces provided ) and landscaping . The use is permitted within the M-P District. 4. Parcel 2 (the southerly parcel ) was purchased from Puget Power and contains an easement for existing overhead electrical trans- Mission lines . ' According to the agreement with Puget. Power this area cannot be utilized for permanent. structures . Parking and landscaping are proposed for this area . Parcel 1 is also pro- posed for parking and landscaping as part of the total development . 5 . A variance from the 60 foot setback requirement was granted by the Board of Adjustment on August ,18 , 1977 , subject to certain conditions including landscaping the City right-of-way between the subject' s southerly property line and the edge of the existing street improvements . A similar variance request fora 58 foot setback along the northerly portion of the site was denied by the Board of Adjustment. •A copy 'of that decision is attached . 6. The applicant has indicated that he will provide additional land- scaping adjacent to the northerly facade of the proposed structure. The Planning Department encourages this proposal to assist in reducing the visual expanse of the proposed building . 7.. A detailed landscape plan must be provided at the time of building permit application submittal . Such plan should consist of a suitable combination of trees , shrubs , and groundcover to provide screening , buffering , aesthetic quality , and wildlife habitat as per the Green River Valley Comprehensive Plan , Objectives , pages 5 through 7 , and Resolution No . 1923 It appears that with the planting areas shown on the plans and the Board of Adjustment ' s conditions that the 2% site landscaping requirement of Resolution No . 1923 will be met. 8 . The proposed building meets the height and site coverage limits of the M-P zone . 9. The applicant has stated that he owns the additional property west of the subject site to Powell Avenue S . W. along the abandoned Burlington Northern Railroad Right-of-Way. Future similar development by the applicant is anticipated . Rezoning of this area will be necessary as well as subdivision if the property is separately sold . 10. Dumpster locations have created some visual and locational problems within the Earlington Manufacturing Park. Proper site screening and location should be required pursuant to the Green River Comprehensive Plan , Objectives , and Section 4-3010(6) 1 . CALL TO ORDER The regular meeting of the Board of Adjustment was called to order by Chairman Qualls at 8:02 P.M. 2. PLEDGE OF ALLEGIANCE The•Chairman led those present in the flag salute. 3. ROLL CALL The secretary called the roll. All members responded present with the exception of. BAUER (out of town) , CAMPANELLA (conflicting meeting) and SMITH (out of town) . CORRESPONDENCE The Chairman advised that he 'had received a note from Mrs. Lally thanking the Board for their expression of sympathy at the time of her recent bereavement 5. PUBLIC HEARINGS SCHEDULED a) V-321-77 DUANE A. WELLS and VAL BAIN request variance to con- struct building within required 60' yard along street, '58' from S.W. 10th Street, 52' from S.W. Grady Way, property located in the vicinity of S.W. 10th Street and Lind Avenue S.W. The Chairman opened the public hearing. Mr. Hanson read applicant's answers to the questions on the variance application and advised the Board that the prop- erty involved is in an MP Zone, which requires a 60' setback. He advised that applicant had submitted an additional list of eight reasons why they felt special circumstances applied. At the Board's request he read that list and then presented two plans, the first one submitted with the variance request, on which he pointed out the location of Grady Way, Lind and S.W. 10th Street, and the second, a City of Renton plan showing Lind Avenue improvements, noting there is a large distance which varies from 20 to' 35 or 40 feet from appli- cant's property to the existing paved area. ' He pointed out that this street is included in the Six Year Street program and that after improvements there would still be 22:5. feet from the sidewalk to applicant's property line. Mr. Duane Wells, 15. Soutli Grady Way, Renton, was present to speak • in behalf of the. application. lie advised they. were ,asking for an eight foot encroach- ment into the front yard setback and two feet in the rear and would provide twenty feet of landscaping instead of the ten feet required to compensate. The Board questioned the applicant regarding reason for change in plans from a warehouse, for which variance had previously been granted, to an office/ laboratory building, the need for the size building proposed, and then ques- tioned Mr. Hanson regarding other properties and buildings in the area and . street plans for the area, particularly regarding the streets on the three sides of applicant's property. There were no others present to speak for or against the application and the public portion of the hearing was closed.
